In this volume, Feinberg focuses on the meanings of "interest," the relationship between interests and wants, and the distinction between want-regarding and ideal-regarding analyses on interest and hard cases for the applications of the concept of harm. Examples of the "hard cases" are harm to character, vicarious harm, and prenatal and posthumous harm. Feinberg also discusses the relationship between harm and rights, the concept of a victim, and the distinctions of various quantitative dimensions of harm, consent, and offense, including the (...) magnitude, probability, risk, and "importance" of harm. He places special emphasis on the practical, local manifestations of their complex theoretical ideas, particularly the institutional milieu of Harvard University.

The second volume in Joel Feinberg's series The Moral Limits of the Criminal Law, Offense to Others focuses on the "offense principle," which maintains that preventing shock, disgust, or revulsion is always a morally relevant reason for legal prohibitions. Feinberg clarifies the concept of an "offended mental state" and further contrasts the concept of offense with harm. He also considers the law of nuisance as a model for statutes creating "morals offenses," showing its inadequacy as a model for understanding (...) "profound offenses," and discusses such issues as obscene words and social policy, pornography and the Constitution, and the differences between minor and profound offenses. (shrink)

My main concern will be to show that it makes sense to speak of the rights of unborn generations against us, and that given the moral judgment that we ought to conserve our environmental inheritance for them, and its grounds, we might well say that future generations /do/ have rights correlative to our present duties toward them. Protecting our environment now is also a matter of elementary prudence, and insofar as we do it for the next generation already here in (...) the persons of our children, it is a matter of love. But from the perspective of our remote descendants it is basically a matter of justice, of respect for their rights. My main concern here will be to examine the concept of a right to better understand how that can be. (shrink)

I consider applications of “AI extenders” (Vold & Hernández-Orallo 2021) to dementia care. AI extenders are AI-powered technologies that extend minds in ways interestingly different from old-school tech like notebooks, sketch pads, models, and microscopes. I focus on AI extenders as ambiance: so thoroughly embedded into things and spaces that they fade from view and become part of a subject’s taken-for-granted background. Using dementia care as a case study, I argue that ambient AI extenders are promising because they afford richer (...) and more durable forms of multidimensional integration than do old-school extenders like Otto’s notebook. They can be tailored, in fine-grained ways along multiple timescales, to a user’s particular needs, values, and preferences — and crucially, they can do much of this self-optimizing on their own. I discuss why this is so, why it matters, and its potential impact on affect and agency. I conclude with some worries in need of further discussion. (shrink)

I respond to the commentaries on 'Grace de Laguna's Analytic and Speculative Philosophy' offered by Peter Olen [2023], Trevor Pearce, Anthony Fisher, Marguerite La Caze and Frederique Janssen-Lauret. In doing so, I bring out some of the value of de Laguna’s perspectivism and of her treatment of modality. I also further clarify how she departs from pragmatism and from analytic philosophy, and how she relates to continental philosophy.

I examine the warrants we have in light of the empirical successes of a kind of model I call ‘ hybrid models ’, a kind that includes climate models among its members. I argue that these warrants ’ strengths depend on inferential virtues that are not just explanatory virtues, contrary to what would be the case if inference to the best explanation provided the warrants. I also argue that the warrants in question, unlike those IBE provides, guide inferences only to (...) model implications about which there is real uncertainty. My conclusion provides criteria of adequacy for epistemologies of climate and other hybrid models. (shrink)

We introduce the subject of modal model theory, where one studies a mathematical structure within a class of similar structures under an extension concept that gives rise to mathematically natural notions of possibility and necessity. A statement φ is possible in a structure (written φ) if φ is true in some extension of that structure, and φ is necessary (written φ) if it is true in all extensions of the structure. A principal case for us will be the class Mod(T) (...) of all models of a given theory T—all graphs, all groups, all fields, or what have you—considered under the substructure relation. In this article, we aim to develop the resulting modal model theory. The class of all graphs is a particularly insightful case illustrating the remarkable power of the modal vocabulary, for the modal language of graph theory can express connectedness, k-colorability, finiteness, countability, size continuum, size ℵ1, ℵ2, ℵω, ℶω, first ℶ-fixed point, first ℶ-hyper-fixed point, and much more. A graph obeys the maximality principle φ(a)→φ(a) with parameters if and only if it satisfies the theory of the countable random graph, and it satisfies the maximality principle for sentences if and only if it is universal for finite graphs. The informal fallacies can be conceived as enthymemes that are formally valid. But, then, what accounts for our sense of their fallaciousness? I explain this in terms of the notion of a warrant.

Many factors contribute to the inappropriate use of medicines, including not only a lack of information but also inaccurate and misleading promotional information. This review examines how the promotion of pharmaceuticals directly affects the prescribing and use of medicines. We define promotion broadly as all actions taken directly by pharmaceutical companies with the aim of enhancing product sales. We look in greater detail at promotion techniques aimed at prescribers, such as sales representatives, pharmaceutical advertisements in medical journals and use of (...) key opinion leaders, along with the quality of information provided and the effects thereof. We also discuss promotion to the public, through direct-to-consumer advertising, and its effects. Finally, we consider initiatives to regulate promotion that come from industry, government and nongovernmental organizations. (shrink)

On September 26th, 2023, the National Institute on Minority Health and Health Disparities (NIMHD) officially designated disabled people as a health disparity population, marking the most significant event for disabled people's health as it relates to the NIH. In this paper, I discuss the larger socio-political context as well as the clinical import of this historic decision.

Next SectionObjectives To evaluate the adequacy of paediatric informed consent and its augmentation by a supplemental computer-based module in paediatric endoscopy. Methods The Consent-20 instrument was developed and piloted on 47 subjects. Subsequently, parents of 101 children undergoing first-time, diagnostic upper endoscopy performed under moderate IV sedation were prospectively and consecutively, blinded, randomised and enrolled into two groups that received either standard form-based informed consent or standard form-based informed consent plus a commercial (Emmi Solutions, Inc, Chicago, Il), sixth grade level, (...) interactive learning module (electronic assisted consent). Anonymously and electronically, the subjects' anxiety (State Trait Anxiety Inventory), satisfaction (Modified Group Health Association of America), number of questions asked, and attainment of informed consent were assessed (Consent-20). Statistics were calculated using t test, paired t test, and Mann Whitney tests. Results The ability to achieve informed consent, as measured by the new instrument, was 10% in the control form-based consent group and 33% in the electronic assisted consent group (p<0.0001). Electronically assisting form-based informed consent did not alter secondary outcome measures of subject satisfaction, anxiety or number of questions asked in a paediatric endoscopy unit. Conclusions This study demonstrates the limitations of form-based informed consent methods for paediatric endoscopy. It also shows that even when necessary information was repeated electronically in a comprehensive and standardised video, informed consent as measured by our instrument was incompletely achieved. The supplemental information did, however, significantly improve understanding in a manner that did not negatively impact workflow, subject anxiety or subject satisfaction. There are conceptual riddles concerning the scope of the term 'harm', three of which provide the excuse for this essay, namely, whether there can be such things as purely moral harms (harm to character), vicarious harms (as I shall call them), and posthumous harms. My discussion of these questions will assume without argument the orthodox jurisprudential analysis of harm as invaded interest, not because I think that account is self-evidently correct or luminously perspicuous, but rather because I wish to explore (...) its implications for the borderline cases of harm, the better to test its adequacy, and to determine the respects in which the concept of self-interest still need s clarification. In the essay “Cézanne’s Doubt,” Merleau-Ponty explores the relationship between Paul Cézanne’s art and his embodiment. The doubt in question is ultimately about the meaning of his disabilities. Should Cézanne’s disabilities or impairments shape how we interpret his art or should they instead be treated as incidental, as mere biographical data? Although Merleau-Ponty's essay isn’t intended to be phenomenological, its line of questioning is as much about lived experience as it is about art criticism, art history, and aesthetics. I here (...) offer a reading of “Cézanne’s Doubt” as an exploration of one of the more fundamental issues for phenomenological methodology: the relationship between normality and the normate. I first defend this phenomenological and disability-centric or crip reading of the essay. I then argue that insofar as one takes oneself to be “normal” and insofar as doing so underwrites phenomenological inquiry, the problematic of the normate, not just that of normality, is central to phenomenology. Most epistemologists of testimony assume that testifying requires that the beliefs to which speakers attest are identical to the beliefs that hearers accept. I argue that this characterization of testimony is misleading. Characterizing testimony in terms of duplicating speaker/hearer belief unduly resticts the variety of beliefs that might be accepted from speaker testimony.

How can a perfectly good God justifiably damn anyone to hell? This is one version of the problem of hell. The problem of hell has become one of the most widely discussed topics in contemporary philosophy of religion. This anthology brings together contributions by contemporary philosophers whose work shapes the current debate.

Whether defended or criticized, Darwinism is generally considered a scientific theory. However, Popper contests this point. According to him, Darwinism (defined as the explanation of evolution by natural selection) is less a scientific theory than a metaphysical research program: a theoretical framework that has a heuristic function for science, but that does not fulfill the necessary condition for any science, namely testability. In terms of deconstructing Darwinism, Popper’s position is therefore interesting. It raises the question of the scientificity of Darwinism. (...) More generally, it raises the question of the scientificity of the debate on the mechanisms of evolution: what type(s) of argument(s) does this debate bring into play? Can this debate be reduced to an opposition between a scientifically founded theory (Darwinism) and other theories of evolution that are purely philosophical, or even ideological? First, I analyze Popper’s position. According to him, Darwinism is rationally defensible, but difficult to test because it is not capable of making precise and sufficiently specific predictions. Darwinism is therefore more metaphysical than scientific, even if it has a heuristic function for science. Moreover, Popper proposes an improvement of Darwinism by asserting that it must give a more important place to the activity of organisms in evolution. In a second step, I discuss Popper’s position, taking into account the criticisms that this position has generated. As regards the non-testability of Darwinism, it appears that the tests proposed in the literature do not meet the defects pointed out by Popper. On the metaphysical character of Darwinism, I discuss Popper’s assertion on two levels: on the possibility of a clear demarcation between science and non-science, and on the value of the demarcation criterion proposed by Popper. Finally, on the improvement of Darwinism, I attempt to underline the originality of the Popperian proposal. (shrink)

In the second part, I define the Natural God as the Force of Nature—evolving, unifying, maximizing—and consider Its relation to last things. Finally, I discuss our knowledge of the Natural God and Its relevance to our personal lives. I argue that we can know the Natural God through scientific reason combined with global intuition, and that this knowledge, (...) from the perspective of last things, may help us achieve universal love, ethical action, and personal salvation.
