In this article, we present findings from a participatory action research program in France on the exercise of human rights and supported and substitute decision-making, inspired by the United Nations Convention on the Rights of Persons with Disabilities (“CRPD”). Bringing together persons with the lived experience of disability, academics, and health and social care and support professionals, the project used the method of “experience-based construction of public problem” to transform experience into collective expertise. This enabled the exploration of support that (...) persons in vulnerable situations, whose capacity to exercise their human rights has weakened, need to make decisions in their lives and participate meaningfully in public debate. The relationship between the awareness of rights and exercise of rights is discussed. We argue for the need to balance out the positions of different contributors in participatory action research, in a reasoned manner, by recognizing the scientific and citizen-based participation of all partners. Chemero's concept of sensorimotor empathy offers a relevant introduction to the study of human/non-human relationships. This article proposes an empirical characterization of this phenomenon occurring in human–horse interactions through the notion of 'contact', which is a core concept in the technical tradition of the equestrian world. According to the assumptions of 4E cognition, we approach the notion of contact with a broader meaning than how it is usually defined, i.e.as the connection of the rider's hand with the horse's mouth. We (...) state that contact involves the whole body and that it is not a passive touch but a dynamic one. Contact is intersubjective, meaning that its quality depends on the two agents of the interaction: the human and the horse. Within such an interaction, sensorimotor empathy allows the human and the horse to understand through the body and to fine-tune with each other to bring about 'good contact'. (shrink)

To control and think about death through cinema is perhaps one of the possibilities offered by Emmanuelle Bercot’s feature film starring Benoît Magimel and Catherine Deneuve. De son vivant tackles head-on the question of fate, through the life-and-death story of a young man in his forties suffering from a disease whose prognosis is grim. We follow Benjamin, in the last year of his life, as he faces the inevitability of his finitude announced in this clearly stated time frame: from six (...) months to one year. In so doing, he finds himself and his family plunged radically into the heart of his existential questions, faced with a series of choices that he must make, despite – or thanks to – the reality of his death. In Trois ans avec Derrida (Three Years with Derrida), his biographer, Benoît Peeters, notes that Jacques Derrida’s seminar was designed “like a theoretical serial which, aside from its slumps and convolutions, nonetheless maintained a kind of suspense and featured genuine cliff-hangers at the end of each session” (Peeters, 2010). Can one truly compare a seminar to a novelistic device like that of deferred narrative? Such is the question to which I devote my attention in this article, a question which (...) is discussed here in a dual — historical and formal — perspective. I thus ask “what is a seminar?” and how, in light of Derrida’s seminars in particular, it becomes a work. In closing, I meditate on the notion of “deferred thinking” in Derrida’s teaching, using the central concept of différance as my starting point. (shrink)

Résumé Le commentaire du pape cistercien d’Avignon, Benoît XII (Jacques Fournier), sur l’évangile de Matthieu a été partiellement édité au xvii e siècle par les dominicains qui l’attribuèrent à Benoît XI. Nous disposons ainsi d’une édition des traités 28 à 50 concernant le Discours sur la montagne (qui plus est, aujourd’hui disponible en ligne). À partir d’une lecture des deux premiers traités, cet article s’intéresse aux considérations exégétiques originales du pape cistercien, mais surtout à sa présentation de l’éthique du (...) Christ. Car c’est bien ainsi que sont abordées les béatitudes, et le moine donne, en particulier à propos de la première, un enseignement très original et approfondi sur l’humilité. Cette vertu clé du socratisme chrétien dont Bernard est le fleuron constitue le point de départ d’une philosophie pratique spécifiquement cistercienne. Le pape d’Avignon s’avère sur ce point un fidèle disciple de l’Abbé de Clairvaux. (shrink)

This biography of Jacques Derrida tells the story of a Jewish boy from Algiers, excluded from school at the age of twelve, who went on to become the most widely translated French philosopher in the world – a vulnerable, tormented man who, throughout his life, continued to see himself as unwelcome in the French university system. We are plunged into the different worlds in which Derrida lived and worked: pre-independence Algeria, the microcosm of the École Normale Supérieure, the cluster (...) of structuralist thinkers, and the turbulent events of 1968 and after. In writing this compelling and authoritative biography, Benoît Peeters talked to over a hundred individuals who knew and worked with Derrida. He is also the first person to make use of the huge personal archive built up by Derrida throughout his life and of his extensive correspondence. Depuis Droit, mythe et raison (1980) écrit avec Jacques Lenoble jusqu’aux récents À quoi sert le droit? Usages, fonctions et finalités (2016) ou Le droit, objet de passions (2018), François Ost ne cesse de questionner les rapports de nos sociétés au droit et la place de celui-ci dans nos sociétés contemporaines. Avec Le droit malgré tout, il s’agit de rendre hommage à l’œuvre et à la carrière d’une figure centrale de la théorie du droit contemporaine et aussi au fondateur, (...) avec le regretté Michel van de Kerchove, de ce que l’on appelle parfois « l’école de Saint-Louis ». Abordant les deux pôles de la dialectique à laquelle François Ost est si attaché - la critique et la reconstruction -, l’ouvrage propose un regard interdisciplinaire sur le droit, à travers les principaux thèmes qui ont nourri la pensée de l’auteur. Un siècle avant la parution posthume du Cours de linguistique générale de Ferdinand de Saussure, la linguistique moderne a émergé en Allemagne avec les études de Wilhelm von Humboldt pour la linguistique générale et (entre autres) de Franz Bopp, Jacob Grimm, August Schleicher et Karl Brugmann pour la grammaire historico-comparative des langues indo-européennes. Dès les années 1830, les instituts allemands de philologie et de linguistique ont attiré nombre de jeunes chercheurs de Scandinavie, de France, de Suisse, de Pologne, des USA, (...) etc. Et avec la diffusion de la nouvelle "Science allemande" à l'étranger des échanges intenses se sont épanouis tout au long du XIXe siècle. Ce volume collectif, riche de neuf contributions d'historiens de la linguistique de France, d'Allemagne, de Suisse et des Pays-Bas, vise à retracer certains de ces échanges parmi les plus instructifs, notamment entre Franz Bopp et Michel Bréal, Max Müller et William Whitney, le psychologue Wilhelm Wundt et Albert Sechehaye ou Georg von der Gabelentz et Antoine Meillet. Des voies fécondes étaient ainsi ouvertes à la linguistique du XXe siècle en Europe et en Amérique. (shrink)

This collection of articles follows up on Jacques Le Bruns 2009 study of abdication, with analyses of abdications by Christine of Sweden, Celestine V, Charles de Gaulle, as well as abdication as treated in the films Habemus Papam and King Lear. Au debut de 2013, deux abdications souveraines se sont produites: celle de Beatrix, reine des Pays-Bas, annoncee le 28 janvier et celle du pape Benoit XVI, proclamee le 11 fevrier. L'actualite prenait en echarpe les huit siecles que nous parcourons ici. L'abdication, ce renoncement au pouvoir, constitue l'etat pur d'un acte de volonte dans la sphere politique ou religieuse. Une instance souveraine, qui ne depend de rien d'autre que de soi-meme, decide de s'abolir. L'abdication apparait alors non comme le simple abandon du pouvoir, mais comme un acte de pouvoir - celui de l'individu imposant son choix, se repliant sur son corps et abandonnant le corps politique - ou, du moins, comme une autre facon de le manipuler et de s'en saisir. Ce livre entend donner un echo et un prolongement au texte fondateur et magistral de Jacques Le Brun, Le Pouvoir d'abdiquer. Essai sur la decheance volontaire, paru en 2009. Notre entreprise a etendu ces variations aux cas mentionnes par Jacques Le Brun sans qu'il en traite, soit dans l'arc temporel premier, pour l'abdication de Christine de Suede, soit dans les temps anterieurs pour la renonciation du pape Celestin V, placee dans la perspective globale du XIIIe siecle, ou posterieurs, quant aux departs de De Gaulle. Pierre-Antoine Fabre, pour sa part, a ajoute au dossier le cas doctrinal de l'abdication du superieur jesuite en faveur de son collateral dans les Constitutions de l'ordre. Et Jacques Le Brun s'est attache a reperer les echos contemporains de l'abdication dans le film Habemus Papam de Nanni Moretti et dans Le Roi Lear. (shrink)

This paper provides a systematic exposition of what Wittgenstein took to be the fundamental error committed by James George Frazer, author of the classic anthropological work The Golden Bough, in his account of ritual practices. By construing those rituals in scientific or rationalistic terms, as aimed at the production of certain effects, Frazer ignores, according to Wittgenstein, their expressive and symbolic dimension. It is, moreover, an error to try to explain the powerful emotions evoked even today by traditions such as (...) fire festivals (which may once have involved human sacrifice) by searching for their causal origins in history or prehistory; the disquieting nature of such practices needs to be understood by attending to the inner meaning they already have in our human lives. Certain important general lessons are drawn about the necessarily limited power of scientific and causal explanations when it comes to alleviating many of our fundamental perplexities not just in the area of anthropology but in philosophy as well.1.
