In this article, we present findings from a participatory action research program in France on the exercise of human rights and supported and substitute decision-making, inspired by the United Nations Convention on the Rights of Persons with Disabilities (“CRPD”). Bringing together persons with the lived experience of disability, academics, and health and social care and support professionals, the project used the method of “experience-based construction of public problem” to transform experience into collective expertise. This enabled the exploration of support that (...) persons in vulnerable situations, whose capacity to exercise their human rights has weakened, need to make decisions in their lives and participate meaningfully in public debate. The relationship between the awareness of rights and exercise of rights is discussed. We argue for the need to balance out the positions of different contributors in participatory action research, in a reasoned manner, by recognizing the scientific and citizen-based participation of all partners. Theorists seeking evidence of moral cognition – whether in human infants, nonhuman animals, or any other population – would benefit from a minimalistic description of what moral cognition is. However, such a definition has proven elusive. Some argue that debates over the existence (or not) of moral cognition in various populations turn on unresolvable semantic disagreement over how to characterize the moral domain. I acknowledge a semantic dimension to some disputes and identify another problem: Often, while sidestepping semantics, researchers rely (...) on logically circular operationalizations, defining moral cognition in terms of elements that are already implicitly understood to be features of moral cognition, while failing to answer the question of what makes these features, or their combination, uniquely moral. The present article proposes a single solution to both problems. The issue of semantics is addressed by the identification of a naturally emerging and distinctive cognitive modality that is necessary to all definitions of moral cognition. The problem of circularity is overcome by a reduction of moral cognition to elements that are, in themselves, nonmoral. I call this distinctive combination of nonmoral elements the “molecular” structure of moral cognition. (shrink)

This chapter outlines ways in which Wittgenstein’s opposition to scientism is manifest in his later conception of philosophy and the negative attitude he held toward his times. The chapter tries to make clear how these two areas of Wittgenstein’s thought are connected and reflect an anti-scientistic worldview he held, one intimated in Philosophical Investigations §122. -/- It is argued that the later Wittgenstein’s metaphilosophy is marked out against two scientistic claims in particular. First, the view that the scientific method is (...) superior to all other means of learning or gaining knowledge. Second, the view that scientific knowledge is superior to all other kinds of knowledge and understanding. Wittgenstein’s opposition to these claims is brought out through examining a fundamental aim of his later philosophy, producing the ‘kind of understanding which consists in “seeing connections”’ (PI §122), and his attempts to expose certain philosophical confusions. It is argued that these reflect his antiscientistic worldview. -/- Through discussion of Oswald Spengler’s influence on Wittgenstein, the chapter outlines how Wittgenstein’s opposition to scientism underwrites his negative cultural outlook and how this is connected with the anti-scientistic elements of his later philosophy discussed. According to the transparency thesis, some conscious states are transparent or “diaphanous”. This thesis is often believed to be incompatible with an inner‐awareness account of phenomenal consciousness. In this article, I reject this incompatibility. Instead, I defend a compatibilist approach to transparency. To date, most attempts to do so require a rejection of strong transparency in favor of weak transparency. In this view, transparent states can be attended to by attending (in the right way) to the presented world: that is, (...) they are merely translucent. Here, I first argue that this understanding of transparency is too weak to qualify as a compatibilist view. Drawing on insights from Franz Brentano, I then describe a middle road between strong and weak transparency. The crucial idea is that, although transparent states cannot be attended to, they can be noticed (under suitable conditions). This view, I submit, allows supporters of inner awareness to commit themselves to a more interesting understanding of transparency—moderate transparency—that preserves the initial intuition underlying the transparency metaphor. Cet article documente la pratique du plan dans les relations entre hommes, à savoir ces rencontres rapides, à but sexuel principalement et en général non répétées. Le matériel mobilisé résulte de trente entretiens semi-directifs. Le plan correspond souvent à une dissociation marquée entre le courant sensuel et le courant tendre, au sens freudien, et présente donc un intérêt pour approfondir la compréhension de cette dualité. L’article observe les prises de contact virtuelles, les lieux des plans et la possibilité de penser, (...) ou de ne pas penser, le plan, d’en refouler le souvenir. Les affects éprouvés dans la rencontre de l’autre comme l’absence d’affect ( désaffectation ) sont alors analysés aux côtés de la question de la sociabilité et des impressions d’inquiétante étrangeté. The interventionist account of causation offers a criterion to distinguish causes from non-causes. It also aims at defining various desirable properties of causal relationships, such as specificity, proportionality and stability. Here we apply an information-theoretic approach to these properties. We show that the interventionist criterion of causation is formally equivalent to non-zero specificity, and that there are natural, information-theoretic ways to explicate the distinction between potential and actual causal influence. We explicate the idea that the description of causes should be (...) proportional to that of their effects. Then we draw a distinction between two ideas in the existing literature, the range of invariance of a causal relationship and its stability. The range of invariance is related to specificity and range of causal values. Stability concerns the effect of additional variables on the relationship between some focal pair of cause and effect variables. We show how to distinguish and measure the direct influence of background variables on the effect variable, and their influence on the relationship between the focal cause and the effect variable. Finally, we discuss the limitations of the information-theoretic approach, and offer prospects for complementary approaches. (shrink)

In this article I want to create a presumption in favor of a nonreductive analysis of emotional phenomenology. The presumption relies on the claim that none of the nonemotional elements which are usually regarded as constitutive of emotional phenomenology may reasonably be considered responsible for the evaluative character of the latter. In section 1 I suggest this is true of cognitive elements, arguing that so-called ‘evaluative’ judgments usually result from emotional, evaluative attitudes, and should not be conflated with them. Despite epistemological and ideological obstacles, the reasons of which are briefly recalled in this article, the relationship between law and religion in the medieval West has been extensively explored, notably through studies devoted to canon law, ecclesiastical procedures and legal qualifications. Yet the boundaries, contact zones and connections between these two “regimes of normativity” and “veridiction” have been left in the dark. This paper does not claim to encompass all the aspects of such a titanic investigation. Instead, it intends to (...) point out some of the problems that arise as soon as one approaches (as a historian) the relations that the Catholic Church – that established the Christian religion – has maintained with the law, and to indicate the paths currently explored in this direction. This article argues that Brentano’s classification of mental phenomena is best understood against the background of the theories of natural classification held by Auguste Comte and John Stuart Mill. Section 1 offers a reconstruction of Brentano’s two-premise argument for his tripartite classification. Section 2 gives a brief overview of the reception and historical background of the classification project. Section 3 addresses the question as to why a classification of mental phenomena is needed at all and traces the answer back to (...) Mill’s view that psychological laws are class-specific. Section 4 and 5 connect the second premise of Brentano’s argument to Comte’s principle of comparative likeness and Mill’s insistance that class membership is determined by the possession of common characteristics. Sont notamment visés le caractère coutumier qui lui est attribué, sa prétendue rationalité ainsi que l’interprétation qu’en font les juges. Moment décisif dans l’histoire des théories du droit, cette controverse tend à faire prévaloir l’idée d’un droit créé par un acte de volonté (...) sur un droit non écrit, tiré de la coutume, que les juges s’efforcent d’appliquer et de perpétuer. Mais, au-delà de leur portée critique, les textes de Hobbes et Bentham présentent des divergences qui font apparaître deux conceptions distinctes de la Common Law et de la décision judiciaire. Lex iniusta non est lex. Cette maxime a malheureusement été la source de nombreux malentendus. À travers cette formule, le positivisme attribue au droit naturel une thèse que personne ne défend réellement. Notre objectif est de comprendre la genèse de ce malentendu et d’exposer la manière dont les théories contemporaines du droit naturel tentent de démêler (...) les confusions véhiculées par cette maxime. Le droit naturel ne conteste pas nécessairement la validité des lois injustes mais il permet, à partir de la signification « focale » des concepts juridiques, de comprendre en quoi ces lois sont à la fois juridiquement et moralement défectueuses. BackgroundParanoia is associated with a multitude of social cognitive deficits, observed in both clinical and subclinical populations. Empathy is significantly and broadly impaired in schizophrenia, yet its relationship with subclinical paranoia is poorly understood. Furthermore, deficits in emotion recognition – a very early component of empathic processing – are present in both clinical and subclinical paranoia. Deficits in emotion recognition may therefore underlie relationships between paranoia and empathic processing. The current investigation aims to add to the literature on social cognition (...) and paranoia by: (1) characterizing the relationship between paranoia and empathy, and (2) testing whether there is an indirect effect of emotion recognition on the relationship between empathy and paranoia.MethodsParanoia, empathy, and emotion recognition were assessed in a non-clinical sample of adults (n= 226) from the Nathan Kline Institute-Rockland (NKI-Rockland) dataset. Paranoia was measured using the Peters Delusions Inventory-21 (PDI-21). Empathy was measured using the Interpersonal Reactivity Index (IRI), a self-report instrument designed to assess empathy using four subscales: Personal Distress, Empathic Concern, Perspective Taking, and Fantasy. Emotion recognition was assessed using the Penn Emotion Recognition Test (ER-40). Structural equation modeling (SEM) was used to estimate relationships between paranoia, the four measures of empathy and emotion recognition.ResultsParanoia was associated with the Fantasy subscale of the IRI, such that higher Fantasy was associated with more severe paranoia (p< 0.001). No other empathy subscales were associated with paranoia. Fantasy was also associated with the emotion recognition of fear, such that higher Fantasy was correlated with better recognition of fear (p= 0.008). Paranoia and emotion recognition were not significantly associated. The Empathic Concern subscale was negatively associated with emotion recognition, with higher empathic concern related to worse overall emotion recognition (p= 0.002). All indirect paths through emotion recognition were non-significant.DiscussionThese results suggest that imaginative perspective-taking contributes to paranoia in the general population. These data do not, however, point to robust global relationships between empathy and paranoia or to emotion recognition as an underlying mechanism. Deficits in empathy and emotion recognition observed in schizophrenia may be associated with the broader pathology of schizophrenia, and therefore not detectable with subclinical populations. This chapter argues that Gilbert Ryle’s account of misleading expressions, which is rightly considered a milestone in the history of analytic philosophy, is continuous with Brentano’s. Not only did they identify roughly the same classes of misleading expressions, but their analyses are driven by a form of ontological parsimony which sharply contrasts with rival views in the Brentano School, like those of Meinong and Husserl. Section 1 suggests that Ryle and Brentano share a similar notion of analysis. Section 2 spells (...) out the notion of misleading expression by means of the surface-grammar/truth-conditions distinction, which I argue is implicit in their accounts. Section 3 zooms in on a specific class of misleading expressions, namely expressions about ficta. Finally, Section 4 draws the consequences of what precedes for a correct understanding of the notion of meaning. (shrink)

The anti-psychiatry movement of the 20th century has notably denounced the role of values and social norms in the shaping of psychiatric categories. Recent activist movements also recognize that psychiatry is value-laden, however, they do not fight for a value-free psychiatry. On the contrary, some activist movements of the 21st century advocate for self-advocacy in sciences of mental health in order to reach a more accurate understanding of psychiatric categories/mental distress. By aiming at such epistemic gain, they depart from the (...) anti-psychiatry movement. Through the analysis of the epistemic and political influence of two of these movements – Neurodiversity and the Mad Studies, we show how this new activism has taken a scientific turn compatible with current philosophical scientific frameworks, while still developing a critical approach on psychiatry. A mysterious remark to Friedrich Waismann on 30 December 1929 marks the only occasion where Wittgenstein refers to both Heidegger and Kierkegaard. Yet although this has generated much controversy, little attention has been paid to the charge of nonsense that Wittgenstein here appears to bring against Heidegger; thus, the supporting argument that may be latent has not been unearthed. Through analysis of this remark, Wittgenstein's arguments in the Tractatus and 'A Lecture on Ethics', and Heidegger's account of anxiety (Angst) in (...) Being and Time, I argue that we can extract an argument against the central question of Heidegger's philosophy: the question of being. To understand this, I examine the Kierkegaardian ideas employed by Wittgenstein and Heidegger and attempt to show that this argument can be partly understood in Kierkegaardian terms. I further argue that examining what Heidegger means by 'being' (Sein) shows that Wittgenstein's argument does not meet its target. (shrink)

In this article, the authors, as researchers, are part of a clinical approach to psychoanalytic orientation in education sciences, questioning their research approach during an investigation on the expulsion from classrooms in secondary school in France. Trying to compare themselves to different types of collaborative research, they analyse the modalities of relationship they tried to implement during this research ‘with’ subjects, including teenagers students they have interviewed.

En retournant contre lui-même son propre dard, le sens historique procède à la réévaluation de l'histoire.

Le " troisième homme " de la primaire socialiste compte bien peser dans le sprint final à l'élection présidentielle. Il n'a pas fini de faire parler de lui... Mais à quoi peut bien encore servir la politique? Jamais la démocratie n'a été aussi solidement installée et, en même temps, jamais elle n'a été autant menacée par le vide, l'impuissance ou l'abus de pouvoir. Le politique a-t-il encore la main? Le rouleau-compresseur des marchés a-t-il eu raison de sa superbe? L'archaïsme des (...) institutions n'a-t-il pas réduit la démocratie française à un théâtre d'ombres? Les multiples filtres qui s'intercalent entre la sphère politique et le peuple ont-ils vidé le fait politique de son sens, laissant derrière lui des résignés et une société en forme de cocotte-minute? Et pourtant, si notre démocratie ne cesse de se dévorer elle-même, elle se régénère toujours. En effet, le politique est là, comme une braise sous les cendres, prêt à renaître, prêt à écrire encore quelques belles pages de l'histoire de France. C'est comme une étincelle à côté d'un baril de poudre, car il suffit de peu. Quand le voisin de classe de votre enfant est arrêté sans ménagement à la sortie de l'école, avec ses parents parce qu'ils sont sans-papier, voilà que vous vous mobilisez dans des comités de soutien, que vous faites le tour des élus, que vous interpellez le préfet et que vous organisez des manifs! Vous, parent d'élève tranquille qui n'avez jamais eu le moindre intérêt pour la cause des sans-papier! Là est le paradoxe du politique, à la fois décevant, incontournable et enthousiasmant quand la cause s'y prête. Alors, dans ce contexte, comment faire pour changer la vie? Comment débusquer le prêt-à penser politique? A qui s'adresse aujourd'hui la politique? Comment réenchanter ceux qui ne le sont plus? Où mener le combat politique qui est aussi un combat culturel? Quelles vieilles certitudes faut-il déboulonner? Qu'est-ce que l'on a encore à se dire dans notre société et comment la faire tenir ensemble? Toutes ces questions sont au coeur de cet antimanuel politique qui entend prendre à contrepied les stratèges cyniques, les barons inamovibles, les communicants qui pensent le politique comme une publicité, les ambitieux qui veulent la place à tous prix, les résignés qui méprisent tout... Et pourtant, la stratégie, la communication ou l'ambition sont nécessaires à tout projet politique. Arnaud Montebourg ne décerne ni les bons ni les mauvais points comme le maître d'école, mais prend une distance critique sur la politique, sublime et misérable, et sur le politique, omniprésent et invisible. Le présent article tente de se demander pourquoi Schopenhauer demeure un philosophe important pour nous aujourd’hui, c’est-à-dire qu’il vise à déterminer quel fut le geste propre de cet auteur en philosophie. Pour cela, nous cherchons à situer son point de rupture avec Kant, et nous pensons le trouver dans la question des rapports entre temps et causalité, à l’occasion de laquelle Schopenhauer institue une critique de Kant. Nous présentons quatre observations au sujet de cette critique, qui concernent respectivement les notions (...) de corps et de volonté, de rêve, de connaissance, enfin d’objet, de perception et d’expérience. À l’issue de cette analyse, l’innovation de Schopenhauer apparaît dans un certain retournement qu’il fait subir à la question critique elle-même. (shrink)
