At the forefront of international concerns about global legislation and regulation, a host of noted environmentalists and business ethicists examine ethical issues in consumption from the points of view of environmental sustainability, economic development, and free enterprise.

At the UN, important projects laying down transnational corporations' (TNCs) human rights responsibilities have been launched without ever clarifying the relevant theoretical foundations. One of the consequences is that the human rights principles in projects like the 2000 UN Global Compact and the 2003 Norms on the Responsibilities of Transnational Corporations and Other Business Enterprises with Regard to Human Rights can be understood in different ways, which should not cause surprise given that their authors come from diverse backgrounds, including economics (...) and public policy. An examination of these projects and the views of their authors reveals that, although they are superficially linked to international human rights law, they go well beyond it and attempt to deal with corporate social responsibility issues in ways that elude neat classification as fitting neatly in either legal or non-legal categories. Too little attention has been paid to how in the course of developing these projects the legal and ethical dimensions have become entwined and how lines have gotten blurred. Meanwhile, there has been recognition that these UN projects have emerged simply as ad hoc responses to practical concerns about the sustainability of globalization. The lack of any foundational theory or normative framework should be addressed; it is time to bring together specialists from different fields concerned with the human rights responsibilities of corporations to see if it is possible to define a coherent overarching theory for these UN projects. Especially where a patient's ability to communicate is limited, the receptive use of art visually offers an entry point into contemplation and insight. Here, receptive work with visual art can help to dissolve limitations in verbal communication. In receptive art therapy, an independent therapeutic resource is attributed to the artistic work and its symbolic pictorial content, which can initiate a healing process. A form of indirect communication is stimulated, in which not only a change on the symbolic but also on (...) the emotional level takes place through the emotionally highly charged pictorial-symbolic expression in the confrontation. Different approaches and basic concepts of the method are presented. This conference volume is addressed to the patients, therapists and clinical as well as inclusive companions in these processes. In moral epistemology, the method of reflective equilibrium is often characterized in terms of intuitions or understood as a method for justifying intuitions. An analysis of reflective equilibrium and current theories of moral intuitions reveals that this picture is problematic. Reflective equilibrium cannot be adequately characterized in terms of intuitions. Although the method presupposes that we have initially credible commitments, it does not presuppose that they are intuitions. Nonetheless, intuitions can enter the process of developing a reflective equilibrium and, if (...) the process is successful, be justified. Since the method of reflective equilibrium does not essentially involve intuitions, it does not constitute a form of intuitionism in any substantial sense. It may be classified as intuitionist only in the minimal sense of not reducing justification to a matter of inference relations alone. (shrink)

Gemessen an Bedeutung, Rang und Wirkung steht die Rechtsphilosophie Hegels heute neben den Politiken von Platon und Aristoteles, dem Leviathan von Hobbes und dem Contrat social von Rousseau.Hegels "Grundlinien der Philosophie des Rechts" zählen zu den bedeutendsten Werken der neuzeitlichen Rechts- und Staatsphilosophie. In ihnen entwirft er teils unter Rückgriff auf das frühere ›Naturrecht‹, teils im Blick auf die politische und rechtliche Lage nach der Französischen Revolution und zu Beginn der Restaurationsepoche eine Philosophie des objektiven Geistes. In this paper, we approach the idea of group cognition from the perspective of the “extended mind” thesis, as a special case of the more general claim that systems larger than the individual human, but containing that human, are capable of cognition (Clark, 2008; Clark & Chalmers, 1998). Instead of deliberating about “the mark of the cognitive” (Adams & Aizawa, 2008), our discussion of group cognition is tied to particular cognitive capacities. We review recent studies of group problem-solving and group (...) memory which reveal that specific cognitive capacities that are commonly ascribed to individuals are also aptly ascribed at the level of groups. These case studies show how dense interactions among people within a group lead to both similarity-inducing and differentiating dynamics that affect the group's ability to solve problems. This supports our claim that groups have organization-dependent cognitive capacities that go beyond the simple aggregation of the cognitive capacities of individuals. Group cognition is thus an emergent phenomenon in the sense of Wimsatt (1986). We further argue that anybody who rejects our strategy for showing that cognitive properties can be instantiated at multiple levels in the organizational hierarchy on a priori grounds is a “demergentist,” and thus incurs the burden of proof for explaining why cognitive properties are “stuck” at a certain level of organizational structure. Finally, we show that our analysis of group cognition escapes the “coupling-constitution” charge that has been leveled against the extended mind thesis (Adams & Aizawa, 2008). (shrink)

Rudolf Carnap’s mature work on the logical reconstruction of scientific theories consists of two components. The first is the elimination of the theoretical vocabulary of a theory in terms of its Ramsification. The second is the reintroduction of the theoretical terms through explicit definitions in a language containing an epsilon operator. This paper investigates Carnap’s epsilon-reconstruction of theories in the context of pure mathematics. The main objective here is twofold: first, to specify the epsilon logic underlying his suggested definition of (...) theoretical terms and a suitable choice semantics for it. Second, to analyze whether Carnap’s approach is compatible with a structuralist conception of mathematics. (shrink)

This innovative study focuses on the Kantian theory of international relations, a subject which has frequently been either ignored or misunderstood. Kant was criticized by contemporaries who asserted that his political ideas were idealistic and impractical. He countered this accusation by evolving a political philosophy which formed a link between the theoretical doctrine of pure law and the actualities of the real world. The author argues that Kant’s theory of international relations can be read as an attempt to bring reason (...) and history together. Kant tries to apply the a priori principles of reason to history in general, and to the political conditions of the late eighteenth century in particular, and this volume examines the way in which he attempts to mediate between theory and practice. In Untersuchungen zur allgemeinen Axiomatik and Abriss der Logistik, Carnap attempted to formulate the metatheory of axiomatic theories within a single, fully interpreted type-theoretic framework and to investigate a number of meta-logical notions in it, such as those of model, consequence, consistency, completeness, and decidability. These attempts were largely unsuccessful, also in his own considered judgment. A detailed assessment of Carnap’s attempt shows, nevertheless, that his approach is much less confused and hopeless than it has often been made out to (...) be. By providing such a reassessment, the paper contributes to a reevaluation of Carnap’s contributions to the development of modern logic. (shrink)

Traditional logical reconstruction of arguments aims at assessing the validity of ordinary language arguments. It involves several tasks: extracting argumentations from texts, breaking up complex argumentations into individual arguments, framing arguments in standard form, as well as formalizing arguments and showing their validity with the help of a logical formalism. These tasks are guided by a multitude of partly antagonistic goals, they interact in various feedback loops, and they are intertwined with the development of theories of valid inference and adequate (...) formalization. This paper explores how the method of reflective equilibrium can be used for modelling the complexity of such reconstructions and for justifying the various steps involved. "If we are to understand not only the direct impact of Marx on the development of German thought but also his sometimes extremely indirect influence, an exact knowledge of Hegel, of both his greatness and his limitation, is absolutely indispensable."- from the preface. It is well known that Hegel exerted a major influence on the development of Marx's thought. This circumstance led Lukács, one of the chief Marxist theoreticians of this century, to embark on his exploration of Hegelian antecedents in (...) the German intellectual tradition, their concrete expression in the work of Hegel himself, and later syntheses of seemingly contradictory modes of though. Four phases of Hegel's intellectual development are examined: "Hegel's early republican phase," "the crisis in Hegel's views on society and the earliest beginnings of his dialectical method," "rationale and defense of objective idealism," and "the breach with Schelling and The Phenomenology of Mind." Lukács completed this study in 1938, but because of the imminent outbreak of war, it was not published until the late 1940s. A revised German edition appeared in 1954, and it is this text that is the basis of this first English translation of the work. (shrink)

This volume is the first collection focusing on the claim that we cannot but account for emotions if we are to understand the processes and evaluations related to empirical knowledge.

The basic idea of logical expressivism in the Brandomian tradition is that logic makes inferential relations explicit and thereby accessible to critical discussion. But expressivists have not given a convincing explanation of what the point of logical theories is. Peregrin provides a starting point by observing a distinction between making explicit and explication in Carnap’s sense of replacing something unclear and vague by something clear and exact. Whereas logical locutions make inferential relations explicit within a language, logical theories use formal (...) languages to explicate inferential roles and meanings of ordinary-language expressions. But Peregrin also holds that the whole point of logical theories is to provide perspicuous models of inferential structures in ordinary language practice. This turns explication into a mere continuation of making explicit by other means, and it leads to a one-sided conception of logic which has no room for evaluating inferential practice in light of logical theories. As a more convincing alternative, I suggest that expressivists rely on the method of reflective equilibrium. This approach is closely related to Carnapian explication, but it has the potential of correcting informal inferential practice without dubious ambitions to replace ordinary languages by logical formalisms. Changing the information format from probabilities into frequencies as well as employing appropriate visualizations such as tree diagrams or 2 × 2 tables are important tools that can facilitate people’s statistical reasoning. Previous studies have shown that despite their widespread use in statistical textbooks, both of those visualization types are only of restricted help when they are provided with probabilities, but that they can foster insight when presented with frequencies instead. In the present study, we attempt to replicate this effect (...) and also examine, by the method of eye tracking, why probabilistic 2 × 2 tables and tree diagrams do not facilitate reasoning with regard to Bayesian inferences (i.e., determining what errors occur and whether they can be explained by scan paths), and why the same visualizations are of great help to an individual when they are combined with frequencies. All ten inferences of N = 24 participants were based solely on tree diagrams or 2 × 2 tables that presented either the famous “mammography context” or an “economics context” (without additional textual wording). We first asked participants for marginal, conjoint, and (non-inverted) conditional probabilities (or frequencies), followed by related Bayesian tasks. While solution rates were higher for natural frequency questions as compared to probability versions, eye-tracking analyses indeed yielded noticeable differences regarding eye movements between correct and incorrect solutions. For instance, heat maps (aggregated scan paths) of distinct results differed remarkably, thereby making correct and faulty strategies visible in the line of theoretical classifications. Moreover, the inherent structure of 2 × 2 tables seems to help participants avoid certain Bayesian mistakes (e.g., “Fisherian” error) while tree diagrams seem to help steer them away from others (e.g., “joint occurrence”). Based on Fichte's conception of international law from the Grundlage des Naturrechts the article examines to what extent a League of nations is compatible with the sovereignty of a nation state. Fichte's concept of sovereignty refers to a republican notion of a state which guaranties the congruence of power and right. This principle leads to an internal tension, for the League presupposes the existence of sovereign states and in the same time curtails their competences. It manifests an instance of power (...) without the legitimation of the singular nations. Fichte avoids the paradoxes of the Kantian vision of a perpetual peace, because he develops a more complex concept of political power, but it remains to be a contradictory construction. In the Rechtslehre of 1812 however, Fichte follows consistently the principle of popular sovereignty and therefore waives an explicit contract among states. He thus meets the ideal of congruence of power and right and also outlines the requirements for a realistic conception of the legalization of relations between states.Ausgehend von Fichtes Grundriss des Völkerrechts, dem Abschluss der Grundlage des Naturrechts nach Principien der Wissenschaftslehre wird untersucht, inwiefern ein Völkerbund mit der Idee staatlicher Souveränität vereinbar ist. Fichtes Konzeption der Souveränität basiert auf einem republikanischen Staatsverständnis, das im Idealfall die Koinzidenz von Macht und Recht garantiert. Dieses Prinzip führt zu internen Spannungen, denn ein Bund setzt einerseits die Existenz souveräner Staaten voraus, greift aber andererseits in die Kompetenzen der Einzelstaaten ein, bildet also selbst eine Machtinstanz, ohne wie die Einzelstaaten über eine entsprechende Legitimation zu verfügen. Zwar vermeidet Fichte die Aporien der Kantischen Vision eines ewigen Friedens, weil er über einen komplexeren Machtbegriff verfügt, doch bleibt seine Konstruktion widersprüchlich. In der Rechtslehre von 1812 hält Fichte dann jedoch konsequent am Prinzip der Volkssouveränität fest und verzichtet deshalb auf einen expliziten Vertrag der Staaten untereinander. Damit trägt er dem Ideal der Kongruenz von Macht und Recht Rechnung und skizziert zugleich die Voraussetzungen für eine realistische Konzeption der Verrechtlichung der Verhältnisse zwischen den Staaten. The article presents the conceptual groundwork for an understanding of the essentially improvisational dimension of human rationality. It aims to clarify how we should think about important concepts pertinent to central aspects of human practices, namely, the concepts of improvisation, normativity, habit, and freedom. In order to understand the sense in which human practices are essentially improvisational, it is first necessary to criticize misconceptions about improvisation as lack of preparation and creatio ex nihilo. Second, it is necessary to solve the (...) theoretical problems that derive from misunderstandings concerning the notions of normativity, habit, and freedom – misunderstandings that revolve around the idea that rationality is a form that is developed out of itself and thus works in a way similar to algorithms. One can only make sense of normativity, habit, and freedom if one understands that they all involve conflictual relationships with the world and with others, which in turn enables one to adequately take into account their constitutive connection to improvisation, properly understood. In outlining these conceptual connections, we want to prepare the foundations for an explanation of rational practices as improvisational practices. The article concludes by stating that human rational life is improvisatory because the conditions of human practice arise out of practice itself. (shrink)

Proponents of the “literacy” thesis share with proponents of the “extended mind” thesis the viewpoint that communication systems such as language or writing have cognitive implications that go beyond their purely social and communicative purposes. Conceiving of media as extensions of the mind thus has the potential to bring together and cross-fertilize research programs that are currently placed in distant corners of the study of mind, language, and society. In this issue, we bring together authors with a diverse set of (...) interests to identify promising areas of overlap, blaze new trails for us to explore, but also to highlight dissonances and challenges that will have to be addressed in future work. Background: Nursing home residents are a vulnerable population. Most of them suffer from multi-morbidity, while many have cognitive impairment or dementia and need care around the clock. Several ethical challenges in nursing homes have been described in the scientific literature. Most studies have used staff members as informants, some have focused on the relatives’ view, but substantial knowledge about the residents’ perspective is lacking. Objective: To study what nursing home residents and their relatives perceive as ethical challenges in Norwegian nursing (...) homes. Research design: A qualitative design with in-depth interviews with nursing home residents, and focus-group interviews with relatives of nursing home residents. The digitally recorded interviews were transcribed verbatim. Analysis was based on Interpretive Description. Participants and research context: A total of 25 nursing home residents from nine nursing homes in Norway, and 18 relatives of nursing home residents from three of these nursing homes. Ethical considerations: This study was reported to and approved by the Regional Ethics Committee in Oslo, Norway. Findings and discussion: The main ethical challenges in Norwegian nursing homes from the residents’ and relatives’ perspective were as follows: (a) acceptance and adaptation, (b) well-being and a good life, (c) autonomy and self-determination, and (d) lack of resources. The relationship with the staff was of outmost importance and was experienced as both rewarding and problematic. None of the residents in our study mentioned ethical challenges connected to end-of-life care. Conclusion: Residents and relatives experience ethical challenges in Norwegian nursing homes, mostly connected to “everyday ethical issues.”. (shrink)

Hilbert's plan for understanding the concept of infinity required the elimination of non‐finitist machinery from proofs of finitist assertions. The failure of the original plan leads to a hierarchy of progressively less elementary, but still constructive methods instead of finitist ones . A mathematical proof of this failure requires a definition of « finitist ».—The paper sketches the three principal methods for the syntactic analysis of non‐constructive mathematics, the resulting consistency proofs and constructive interpretations, modelled on Herbrand's theorem, and their (...) mathematical and logical consequences. A characterization of finitist proofs is sketched. A remark on the completeness of the predicate calculus concludes the paper. Throughout open problems and alternative approaches are emphasized.ZusammenfassungHilbert sah das Verstehen des Begriffs des Unendlichen in der Eliminierung nichtfiniter Methoden aus Beweisen finiter Sätze. Interpretations of Kant usually focus on his legal or political cosmopolitanism, a cluster of ideas revolving around perpetual peace, an international organisation, the reform of international law, and what Kant has termed cosmopolitan law or the law of world citizens. In this essay, I argue that there are different cosmopolitanisms in Kant, and focus on the relationship among political, legal or juridical, moral and ethico-theological cosmopolitanisms. I claim that these form part of a comprehensive system and are fully compatible with (...) each other, given Kant’s framework. I conclude that it is not self-evident that one can pick out some elements of this greater system as if they were independent of it.Keywords: cosmopolitanism; morality; the highest good; philosophy of history; theology. "The actuality of the revolution: this is the core fo Lenin's thought and his decisive link with Marx."This essay on Lenin, which appeared in 1924, was intended to head off the massive criticism leveled at Lukacs History and Class Consciousness by Communist Party leadership. It was a period in which Lukacs was decisively influenced by Lenin and by Rosa Luxemburg, and his intellectual development proceeded concretely toward a political interpretation of history and of literature.In a postscript Lukacs remains essentially unchanged (...) in his view of Lenin as a practitioner whose theoretical superiority lay in his ability to assess the sociohistorical uniqueness of any given situation that required action. Looking back, Lukacs regards the book as a document of the mid-twenties--of how a number of Marxists of the period saw Lenin's personality and mission and his place in world events. Ideas in the book were determined by the concepts of the period, its prejudices, illusions, and extravagances. Nevertheless, the book established certain spiritual verities in perceiving Lenin as the active-practical sage who had a skillfull tactical grasp of realpolitik which was neither empirical nor dogmatic but the culmination of a theoretical attitude. "His life was one of permanent action, of continuous struggle in a world in which he was profoundly convinced that there was no situation without a solution, for himself or his opponents. The leitmotiv of his life was accordingly: always be armed ready for action--for correct action." Lukacs further notes that an essential dimension of Lenin's activism was unceasingly self-education and constant openness to the lessons of experience.Lukacs also emphasizes a number of points in the book that remain methodologically valid, including criticisms of Lenin's behavior which were implicit and accurate critiques of Stalin's later development and the increasing bureaucratization and mechanization of the party. The “extended mind” thesis (Clark, 2008) has focused primarily on the interactions between single individuals and cognitive artifacts, resulting in a relative neglect of interactions between people. At the same time, the idea that groups can have cognitive properties of their own has gained new ascendancy in various fields concerned with collective behavior. My main goal in this paper is to propose an understanding of group cognition as an emergent form of socially distributed cognition. To that end, I first clarify (...) the relevant notions of cognition and emergence that are at play in the contemporary debate. I then apply our conceptual framework to recent developments in the theory of transactive memory systems (Wegner, 1986), arguing that the idea of group cognition is neither trivial nor shrouded in metaphysical mystery. Benjamin Franklin famously wrote that “the good [that] men do separately is small compared with what they may do collectively” (Isaacson 2004). The ability to join with others in groups to accomplish goals collectively that would hopelessly overwhelm the time, energy, and resources of individuals is indeed one of the greatest assets of our species. In the history of humankind, groups have been among the greatest workers, builders, producers, protectors, entertainers, explorers, discoverers, planners, problem-solvers, and decision-makers. During the late 19th (...) and early 20th century, many social scientists employed the notorious “group mind” idiom to express the sensible idea that groups can function as the seats of cognition, intelligence, and agency in their own right (Allport 1968; Wilson 2004). In their quest to stress (rightly) that group phenomena are something “over and above” the sum of individual contributions, a fondness for vitalist metaphors led them to believe (wrongly) that genuine group cognition must be the result of tapping into individualistically inaccessible, “holistic” forces. Today, inspired in part by historically unparalleled forms of mass collaboration enabled by the internet, it has once again become popular to speak of collective intelligence, group agency, or even the emergence of a “global brain” (cf. the wiki-edited MIT Handbook of Collective Intelligence). -/- In this chapter, I review some contemporary developments of the idea of group cognition, defined broadly as the collaborative performance of cognitive tasks such as remembering, problem-solving, decision-making, or verbal creativity for the purpose of producing a group-level outcome. My discussion serves a two-fold purpose. First, by discussing how the idea of group cognition can be operationalized, I seek to show that we can retain some central theoretical insights of the “group mind” thesis without succumbing to its eccentric metaphysical overtones. Second, by providing a useful array of generalizable taxonomic resources, I hope to foster greater degrees of mutual awareness among insufficiently integrated areas of research on group performance. National electronic identity (e-ID) card schemes and electronic identity management systems (e-IDMS) in Europe are characterised by considerable diversity. This contribution analyses the creation of a national e-IDMS in Austria with the aim of improving our understanding of the reasons behind the genesis of particular designs of national e-IDMS. It seeks to explain how the system’s specific design evolved and which factors shaped its appearance. Being part of a comparative four country study, a common theoretical framework is employed to allow (...) for a comparison of national e-IDMS in Austria, Belgium, Germany and Spain. It combines the approach of actor-centred institutionalism and the concept of path dependence in order to analyse the innovation process and to explain resulting key characteristics of the e-IDMS in Austria: a technology-neutral system with multiple tokens; an ID model based on the Central Register of Residents; a privacy concept using sector-specific personal identifiers. It is shown that innovation process and outcome are not only shaped by specific actor constellations dominated by strategic e-government bodies, but also by path dependence at three levels: technological, institutional and organisational.
