BackgroundDespite consensus about the importance of implementing shared decision-making (SDM) in clinical practice, this ideal is inconsistently enacted today. Evidence shows that SDM practices differ in the degree of involvement of patients or family members, or in the amount of medical information disclosed to patients in order to “share” meaningfully in treatment decisions. Little is known on which representations and moral justifications physicians hold when realizing SDM. This study explored physicians’ experiences of SDM in the management of paediatric patients with (...) prolonged disorders of consciousness (PDOC). Specifically, we focused on physicians’ SDM approaches, representations, and ethical justifications for engaging in SDM.MethodsWe used a qualitative approach to explore the SDM experiences of 13 ICU physicians, paediatricians, and neurologists based in Switzerland who have been or were involved in the care of paediatric patients living with PDOC. A semi-structured interview format was used and interviews were audio-recorded and transcribed. Data were analysed through thematic analysis.ResultsWe found that participants followed three main decision-making approaches: the “brakes” approach, characterized by maximized family’s decisional freedom, though conditional to physician’s judgment regarding the medical appropriateness of a treatment; the “orchestra director” approach, characterized by a multi-step decision-making process led by the main physician aimed at eliciting the voices of the care team members and of the family; and the “sunbeams” approach, characterized by a process oriented to reach consensus with family members through dialogue, where the virtues of the physician are key to guide the process. We also found that participants differed in the moral justifications sustaining each approach, citing the duty to respect parental autonomy, to invest in an ethics of care, and to employ physicians’ virtues to guide the decision-making process.ConclusionOur results show that physicians come to perform SDM in different ways, with several representations, and distinct ethical justifications. SDM training among health care providers should clarify the ductility of SDM and the several ethical motivations underpinning it, rather than insisting on the principle of respect for patient’s autonomy as its only moral foundation. The anti-causal prophecies of last century have been disproved. Causality is neither a ‘relic of a bygone’ nor ‘another fetish of modern science’; it still occupies a large part of the current debate in philosophy and the sciences. This investigation into causal modelling presents the rationale of causality, i.e. the notion that guides causal reasoning in causal modelling. It is argued that causal models are regimented by a rationale of variation, nor of regularity neither invariance, thus breaking down the dominant (...) Human paradigm. The notion of variation is shown to be embedded in the scheme of reasoning behind various causal models: e.g. Rubin’s model, contingency tables, and multilevel analysis. It is also shown to be latent – yet fundamental – in many philosophical accounts. Moreover, it has significant consequences for methodological issues: the warranty of the causal interpretation of causal models, the levels of causation, the characterisation of mechanisms, and the interpretation of probability. This book offers a novel philosophical and methodological approach to causal reasoning in causal modelling and provides the reader with the tools to be up to date about various issues causality rises in social science. This paper argues that what is currently the most popular version of temporal Fragmentalism—‘unstructured’ temporal Fragmentalism, as I shall call it—faces a problem of Tensed Belief Explosion. Four possible solutions to this problem are reviewed and shown to be wanting; two more promising ones risk fostering scepticism about the existence of tensed facts—hence, about Fragmentalism itself. The tentative moral is that unstructured versions of Fragmentalism are at best unmotivated and at worst seriously flawed.

Causal claims in biomedical contexts are ubiquitous albeit they are not always made explicit. This paper addresses the question of what causal claims mean in the context of disease. It is argued that in medical contexts causality ought to be interpreted according to the epistemic theory. The epistemic theory offers an alternative to traditional accounts that cash out causation either in terms of “difference-making” relations or in terms of mechanisms. According to the epistemic approach, causal claims tell us about which (...) inferences (e.g., diagnoses and prognoses) are appropriate, rather than about the presence of some physical causal relation analogous to distance or gravitational attraction. It is shown that the epistemic theory has important consequences for medical practice, in particular with regard to evidence-based causal assessment. (shrink)

We argue that the health sciences make causal claims on the basis of evidence both of physical mechanisms, and of probabilistic dependencies. Consequently, an analysis of causality solely in terms of physical mechanisms or solely in terms of probabilistic relationships, does not do justice to the causal claims of these sciences. Yet there seems to be a single relation of cause in these sciences - pluralism about causality will not do either. Instead, we maintain, the health sciences require a theory (...) of causality that unifies its mechanistic and probabilistic aspects. Background: The health professionals are involved in the paths of care for patients with different medical conditions. Their life is frequently characterized by psychopathological outcomes so that it is possible to identify consistent burdens. Besides the possibility to develop pathological outcomes, some protective factors such as resilience play a fundamental role in facilitating the adaptation process and the management of maladaptive patterns. Personal characteristics and specific indexes such as burdens and resilience are essential variables useful to study in-depth ongoing conditions (...) and possible interventions. The study was aimed at highlighting the presence and the relations among factors as personal variables, burdens, and resilience, to understand health professionals' specific structure and functions.Methods: The observation group was composed of 210 participants, 55 males, and 155 females, aged from 18 to 30 years old with a mean age of 25.92 years old. The study considered personal characteristics of the subjects, such as age, gender, years of study, days of work per week, hours of work per week, and years of work. Our study had been conducted with the use of measures related to burdens and resilience.Results: The performed analyses consisted of descriptive statistics, correlations, and regressions among the considered variables. Several significant correlations emerged among personal characteristics, CBI, and RSA variables. Specifically, age and work commitment indexes appeared to be significantly related to the development of burdens, differently from the years of study. Significant correlations emerged among personal and RSA variables, indicating precise directions for both domains. Age and gender were identified as predictors to perform multivariate regression analyses concerning CBI factors. Significant dependence relations emerged with reference to all CBI variables.Conclusion: Pathological outcomes and resilience factors represent two sides of the health professionals' experiences, also known as “invisible patients.” Greater knowledge about present conditions and future possibilities is a well-known need in literature so that the current analyses considered fundamental factors. In line with state of the art, future studies are needed in order to deepen elusive phenomena underlying maladjustment. (shrink)

Large part of contemporary science is in fact technoscience, in the sense that it crucially depends on several technologies for the generation, collection, and analysis of data. This prompts a re-examination of the relations between science and technologies. In this essay, I advance the view that we’d better move beyond the ‘subordination view’ and the ‘instrumental’ view. The first aims to establish the primacy of science over technology, and the second uses technology instrumentally to support a realist position about theoretical (...) entities. I suggest that we should instead concentrate on how science and technology interact. This will reveal that technology has a poietic character, namely it actively partakes in the production of knowledge. But this poietic character can only be understood within the cognitive activity of scientific communities. Current research in molecular epidemiology, notably the projects funded within the ‘European exposome initiative’, serves as a motivation for such discussion and as an illustration of the claims made. This book investigates the unresolved issue of democratic legitimacy in contexts of pervasive disagreement and contributes to this debate by defending a relational version of political liberalism that rests on the ideal of co-authorship. According to this proposal, democratic legitimacy depends upon establishing appropriate interactions among citizens who ought to ascribe to one another the status of putative practical and epistemic authorities. To support this relational reading of political liberalism, the book proposes a revised account of the civic virtue of (...) reasonableness along with an investigation of the epistemic-specific dimension of political equality. By engaging with political epistemology and social theory, this book explores ways to address inherent tensions within the liberal paradigm, using the following strategies of addressing these tensions: first, it defends a twofold model of legitimacy that distinguishes the goals, methodologies, and justificatory tasks of both ideal and nonideal phases of the two-level justificatory framework; second, it contends that democratic legitimacy requires an engaged and contextual critical appraisal of the injustices that characterize our daily social lives, illustrating how structural forms of injustice represent a profound betrayal of the liberal ideal of democratic legitimacy. BackgroundThe measures taken to contain the coronavirus disease 2019 pandemic, such as the lockdown in Italy, do impact psychological health; yet, less is known about their effect on cognitive functioning. The transactional theory of stress predicts reciprocal influences between perceived stress and cognitive performance. However, the effects of a period of stress due to social isolation on spatial cognition and exploration have been little examined. The aim of the present study was to investigate the possible effects and impact of the (...) COVID-19 pandemic on spatial cognition tasks, particularly those concerning spatial exploration, and the physiological leftward bias known as pseudoneglect. A right-hemisphere asymmetry for spatial attention processes crucially contributes to pseudoneglect. Other evidence indicates a predominantly right-hemisphere activity in stressful situations. We also analyzed the effects of lockdown on coping strategies, which typically show an opposite pattern of hemispheric asymmetry, favoring the left hemisphere. If so, then pseudoneglect should increase during the lockdown and be negatively correlated with the efficacy of coping strategies.MethodsOne week before the start of the lockdown due to COVID-19 in Italy, we had collected data from a battery of behavioral tests including tasks of peri-personal spatial cognition. During the quarantine period, from late April to early May 2020, we repeated the testing sessions with a subgroup of the same participants. At both testing sessions, participants performed digitized neuropsychological tests, including a Cancellation task, Radial Arm Maze task, and Raven’s Advanced Progressive Matrices. Participants also completed a newly developed COVID-19 Student Stress Scale, based on transactional models of stress, and the Coping Orientation to Problems Experienced—New Italian Version to assess coping orientation.ResultsThe tendency to start cancelation from a left-sided item, to explore first a left-sided arm of the maze, and to choose erroneous response items on the left side of the page on Raven’s matrices increased from T1 to T2. The degree of pseudoneglect increment positively correlated with perceived stress and negatively correlated with Positive Attitude and Problem-Solving COPE-NIV subscales.ConclusionLockdown-related stress may have contributed to increase leftward bias during quarantine through a greater activation of the right hemisphere. On the other hand, pseudoneglect was decreased for better coping participants, perhaps as a consequence of a more balanced hemispheric activity in these individuals. (shrink)

Relativists make room for the possibility of “faultless disagreement” by positing the existence of subjective propositions, i.e. propositions true from some points of view and not others. We discuss whether the adoption of this position with respect to a certain domain of discourse is compatible with a realist attitude towards the matters arising in that domain. At first glance, the combination of relativism and realism leads to an unattractive metaphysical picture on which reality comprises incoherent facts. We will sketch the (...) contours of a realist-relativist position called “subjectivism”, which avoids this result by giving up the assumption that the points of view of different subjects are all metaphysically “on a par”. There are two intuitions about time. The first is that there's something special about the present that objectively differentiates it from the past and the future. Call this intuition Specialness. The second is that the time at which we happen to live is just one among many other times, all of which are ‘on a par’ when it comes to their forming part of reality. Call this other intuition Egalitarianism. Tradition has it that the so-called ‘A-theories of time’ fare well (...) at addressing the first intuition, but rather badly when it comes to the second. This book systematically addresses the issue of assessing the normative nature of visions of emerging technologies in an epistemologically robust way. In the context of democratic governance of emerging technologies, not only it is important to reflect on technologies' moral significance, but also to address their emerging and future oriented character. The book proposes an original approach to deal with the issue of "plausible" ethical evaluation of new technologies. Taking its start from current debates about Technology Assessment, the proposed solution (...) emerges as a combination of theoretical and methodological insights from the fields of Philosophy of Technology, Science and Technology Studies and a normative justification based on pragmatist ethics. The book's main contribution is to engage a diverse and interdisciplinary audience (ethicists, philosophers, social scientists, technology assessment researchers and practitioners) in a reflection concerning the epistemological challenges that are associated to the endeavour of appraising the moral significance of emerging technologies in the attempt of democratically governing them. It brings together concepts and methodologies from different disciplines and shows their synergy in applying them to two specific case studies of emerging biomedical technologies. (shrink)

This paper presents a distinctively metaphysical version of the problem of other minds. The main source of this version of the problem lies in the principle that, when it comes to consciousness, no distinction can sensibly be drawn between appearance and reality. I will argue that, unless we want to call that principle into question, we should seriously consider the possibility of accepting the conclusion that other minds are not like our own. Children, because of age-related reasons, are a vulnerable population, and protecting their health is a social, scientific and emotional priority. The increased susceptibility of children and fetuses to environmental agents has been widely discussed by the scientific community. Children may experience different levels of chemical exposure than adults, and their sensitivity to chemical toxicities may be increased or decreased in comparison with adults. Such considerations also apply to unborn and newborn children. Therefore, research on children is necessary in both clinical (...) and environmental fields, to provide age-specific relevant data regarding the efficacy and safety of medical treatments, and regarding the assessment of risk from unintended environmental exposure. In this context, the stakeholders are many, including children and their parents, physicians and public health researchers, and the society as a whole, with its ethical, regulatory, administrative and political components. The important ethical issues are information of participants and consent to participate. Follow-up and protection of data should be discussed in the context of biobanks, where children obtain individual rights when they become adults. It is important to realise that there are highly variable practices within European countries, which may have, in the past, led to differences in practical aspects of research in children. A number of recommendations are provided for research with children and environmental health. Environmental research with children should be scientifically justified, with sound research questions and valid study protocols of sufficient statistical power, ensuring the autonomy of the child and his/her family at the time of the study and later in life, if data and samples are used for follow-up studies. When children are enrolled, we recommend a consent dyad, including parental informed consent and the child’s assent and/or informed consent from older minors. For evaluation of the studies including children, a paediatrician should always be involved in the research ethics committee. (shrink)

How should probabilities be interpreted in causal models in the social and health sciences? In this paper we take a step towards answering this question by investigating the case of cancer in epidemiology and arguing that the objective Bayesian interpretation is most appropriate in this domain.

This paper defends the view that one's own mental states are metaphysically privileged vis-à-vis the mental states of others, even if only subjectively so. This is an instance of a more general view called Subjectivism, according to which reality is only subjectively the way it is. After characterizing Subjectivism in analogy to two relatively familiar views in the metaphysics of modality and time, I compare the Subjectivist View of the Mental with Egocentric Presentism, a version of Subjectivism recently advocated by (...) Caspar Hare. I argue that the Subjectivist View of the Mental goes a considerable way towards solving certain long-standing philosophical puzzles having to do with the unity of consciousness, the contents of self-awareness and the intransmissibility of experiential knowledge through testimony. Causal analysis in the social sciences takes advantage of a variety of methods and of a multi-fold source of information and evidence. This pluralistic methodology and source of information raises the question of whether we should accordingly have a pluralistic metaphysics and epistemology. This paper focuses on epistemology and argues that a pluralistic methodology and evidence don’t entail a pluralistic epistemology. It will be shown that causal models employ a single rationale of testing, based on the notion of variation. Further, (...) Many philosophers have been attracted to the idea of using the logical form of a true sentence as a guide to the metaphysical grounds of the fact stated by that sentence. This paper looks at a particular instance of that idea: the widely accepted principle that disjunctions are grounded in their true disjuncts. I will argue that an unrestricted version of this principle has several problematic consequences and that it’s not obvious how the principle might be restricted in order to (...) avoid them. My suggestion is that, instead of trying to restrict the principle, we should distinguish between metaphysical and conceptual grounds and take the principle to apply exclusively to the latter. This suggestion, if correct, carries over to other prominent attempts at using logical form as a guide to ground. (shrink)

To qualify as a fully rational agent, one must be able rationally to revise one’s beliefs in the light of new evidence. This requires, not only that one revise one’s beliefs in the right way, but also that one do so as a result of appreciating the evidence on the basis of which one is changing one’s mind. However, the very nature of belief seems to pose an obstacle to the possibility of satisfying this requirement – for, insofar as one (...) believes that p, any evidence that not-p will strike one as misleading and, on the face of it, believing that a certain piece of evidence is misleading is incompatible with appreciating the fact that such evidence should bear on the question at hand. Call this the ‘Paradox of Belief Revision’. This paper introduces the Paradox of Belief Revision, compares it with Kripke’s Dogmatism Paradox, and suggests that we may be able to see a way out of the former if we assume that rational agents are systematically aware of their own beliefs as beliefs they have. Resumen: El objetivo de este artículo es mostrar la relevancia de la máthesis para la concepción de la mimesis aristotélica. A partir de las observaciones de la Poética, delimitaré las características del aprendizaje tomando como eje su objeto, modalidad y consecuencias. Para ello analizaré, en primer lugar, el objeto sobre el que recae el aprendizaje mimético, esto es, los hombres que actúan. Luego examinaré la modalidad de presentación de sus acciones para que sea posible el aprendizaje, prestando especial atención al (...) papel que desempeña el error trágico o hamartía. Finalmente, resaltaré los aspectos por los que, a mi entender, la mímesis tiene consecuencias éticas y políticas relevantes en el marco del proyecto educativo de Aristóteles, y que permiten pasar de una consideración de la mímesis en el plano individual a una consideración sobre su función en el ámbito político.: The aim of this paper is to show the relevance of mathesis for the Aristotelian concept of mimesis. From the framework of Poetics, i try to demarcate the characteristics of learning, taking into account its object, modality, and consequences. In order to do this, I will analyze, first, the object of mimetic learning, that is, men who act. Then, I will examine the modality of presentation of their actions that make learning possible, paying special attention to the role played by tragic mistake or hamartía. Finally, I will highlight the aspects on account of which, in my opinion, mimesis has relevant ethical and political consequences in the framework of Aristotle's educational project, and which allow passing from a consideration of mimesis on an individual level to a political level. Mobile health is rapidly being implemented and changing our ways of doing, understanding and organising healthcare. mHealth includes wearable devices as well as apps that track fitness, offer wellness programmes or provide tools to manage chronic conditions. According to industry and policy makers, these systems offer efficient and cost-effective solutions for disease prevention and self-management. While this development raises many ethically relevant questions, so far mHealth has received only little attention in medical ethics. This paper provides an overview of bioethical (...) issues raised by mHealth and aims to draw scholarly attention to the ethical significance of its promises and challenges. We show that the overly positive promises of mHealth need to be nuanced and their desirability critically assessed. Finally, we offer suggestions to bioethicists to engage with this emerging trend in healthcare to develop mHealth to its best potential in a morally sound way. (shrink)

According to Leibniz’s infinite-analysis account of contingency, any derivative truth is contingent if and only if it does not admit of a finite proof. Following a tradition that goes back at least as far as Bertrand Russell, several interpreters have been tempted to explain this biconditional in terms of two other principles: first, that a derivative truth is contingent if and only if it contains infinitely complex concepts and, second, that a derivative truth contains infinitely complex concepts if and only (...) if it does not admit of a finite proof. A consequence of this interpretation is that Leibniz’s infinite-analysis account of contingency falls prey to Robert Adams’s Problem of Lucky Proof. I will argue that this interpretation is mistaken and that, once it is properly understood how the idea of an infinite proof fits into Leibniz’s circle of modal notions, the problem of lucky proof simply disappears. Mobile applications are increasingly regarded as important tools for an integrated strategy of infection containment in post-lockdown societies around the globe. This paper discusses a number of questions that should be addressed when assessing the ethical challenges of mobile applications for digital contact-tracing of COVID-19: Which safeguards should be designed in the technology? Who should access data? What is a legitimate role for “Big Tech” companies in the development and implementation of these systems? How should cultural and behavioural issues be (...) accounted for in the design of these apps? Should use of these apps be compulsory? What does transparency and ethical oversight mean in this context? We demonstrate that responses to these questions are complex and contingent and argue that if digital contract-tracing is used, then it should be clear that this is on a trial basis and its use should be subject to independent monitoring and evaluation. Williamson’s anti-luminosity argument has been thought to be in tension with the doctrine that we enjoy privileged epistemic access to our own mental states. In this paper, I will argue that the tension is only apparent. Friends of privileged access who accept the conclusion of the argument need not give up the claim that our beliefs about our own mental states are mostly or invariably right, nor the view that mental states are epistemically available to us in a way that (...) renders everything within our mind ‘open to view’ – arguably, two main pillars of their doctrine. What they need to reject is the idea that the mental is a realm whose ’determinacy’ or ’fineness of grain’ never escapes our appreciation. This idea – I will suggest – is not essential to privileged access and defenders of the doctrine should not be afraid to give it up. (shrink)

Solving the meta-problem of consciousness requires, among other things, explaining why we are so reluctant to endorse various forms of illusionism about the phenomenal. I will try to tackle this task in two steps. The first consists in clarifying how the concept of consciousness precludes the possibility of any distinction between 'appearance' and 'reality'. The second consists in spelling out our reasons for recognizing the existence of something that satisfies that concept.

En este trabajo se expone y comenta esquemáticamente la biofilosofía de Hans Jonas, poniéndola en relación con su visión del ser humano. Para Jonas la vida se distingue de la materia inerte por la libertad ganada desde la aparición del metabolismo. Percepción y emoción generan un hiato o mediatez entre el interés animal y su satisfacción; la conducta animal sería, entonces, el segundo grado de libertad. Con el ser humano surge un nuevo grado de libertad, que implica un salto ontológico (...) caracterizado por el autor como transanimalidad. Lo transanimal remite a un modo propio de apropiarse del mundo, que se distancia de la satisfacción de las necesidades meramente biológicas, que no reviste utilidad para él, y que lo lleva a encontrarse consigo mismo y reflexionar sobre su propia existencia. En este plano Jonas examina tres signos de lo humano: la herramienta, la imagen y la tumba. La antropología de Jonas entronca con su comprensión de la realidad natural como fenómeno vivo y con su fenomenología de la vida animal. Este planteamiento de Jonas nos parece original y fecundo. Sus aportes iluminan la paleontología contemporánea, aportan criterio para juzgar el nivel de desarrollo humano en toda época y aportan una base sólida donde poder anclar una metafísica. (shrink)

Is ChatGPT a good teacher? Or could it be? As understanding is widely acknowledged as one of the fundamental aims of education, the answer to these questions depends on whether ChatGPT fosters or could foster the acquisition of understanding in its users. In this paper, I tackle this issue in two steps. In the first part of the paper, I explore and analyze the set of skills and social-epistemic virtues that a teacher must exemplify to perform her job well – (...) in those contexts in which epistemic aims are at play and in which understanding plays a pivotal role. In the second part of the paper, I put my conception of good teacher to test and deal with the question whether, and to which extent, the software ChatGPT is (or could serve as, if suitably modified or fine-tuned) a good teacher for its users. The paper examines definitions of ‘cause’ in the epidemiological literature. Those definitions all describe causes as factors that make a difference to the distribution of disease or to individual health status. In the philosophical jargon, causes in epidemiology are difference-makers. Two claims are defended. First, it is argued that those definitions underpin an epistemology and a methodology that hinge upon the notion of variation, contra the dominant Humean paradigm according to which we infer causality from regularity. Second, despite the fact (...) that causes be defined in terms of ‘difference-making’, this cannot fixes the causal metaphysics. Causality in epidemiology ought to be interpreted according to the epistemic theory. In this approach relations are deemed causal depending on the evidence and on the available methods. Indeed, evidence to establish causal claims requires difference-making considerations; furthermore, those definitions of cause reflect the ‘variational’ epistemology and methodology of epidemiology. ABSTRACT The article critically discusses Rahel Jaeggi’s recent philosophical contribution to a critical theory of capitalism. The first part reconstructs Jaeggi’s account of Lebensform, life-form, that builds up the main ontological framework for addressing and problematizing capitalism intended not as an economic system but as a social whole. The second part focuses on the three different theoretical strategies that Jaeggi puts forward to detect and deal with capitalism’s immanent flaws. The third and last part problematizes the metaphysical assumptions and implications (...) of Jaeggi’s understanding of life-form and outlines a more dialectical, or “transactional” notion of form of life, which is inspired by Dewey’s non-reductionist naturalist method of inquiry. It has been observed that, unlike other kinds of singular judgments, mental self-ascriptions are immune to error through misidentification: they may go wrong, but not as a result of mistaking someone else’s mental states for one’s own. Although recent years have witnessed increasing interest in this phenomenon, three basic questions about it remain without a satisfactory answer: what is exactly an error through misidentification? What does immunity to such errors consist in? And what does it take to explain the fact (...) that mental self-ascriptions exhibit this sort of immunity? The aim of this paper is to bring these questions into focus, propose some tentative answers and use them to show that one prominent attempt to explain the immunity to error through misidentification of mental self-ascriptions is unsuccessful. Kilimanjaro is an example of what some philosophers would call a ‘vague object’: it is only roughly 5895 m tall, its weight is not precise and its boundaries are fuzzy because some particles are neither determinately part of it nor determinately not part of it. It has been suggested that this vagueness arises as a result of semantic indecision: it is because we didn’t make up our mind what the expression “Kilimanjaro” applies to that we can truthfully say such things (...) as “It is indeterminate whether this particle is part of Kilimanjaro”. After reviewing some of the limitations of this approach, I will propose an alternative account, based on a new semantic relation—multiple reference—capable of holding in a one-many pattern between a term and several objects in the domain. I will explain how multiple reference works, what differentiates it from plural reference and how it might be used to accommodate at least some aspects of our ordinary discourse about vague objects. In Responsible Brains, Hirstein, Sifferd and Fagan apply the language of cognitive neuroscience to dominant understandings of criminal responsibility in criminal law theory. The Authors make a compelling case that, under such dominant understandings, criminal responsibility eventually ‘translates’ into a minimal working set of executive functions that are primarily mediated by the frontal lobes of the brain. In so arguing, the Authors seem to unquestioningly accept the law’s view of the “responsible person” as a mixture of cognitive capacities and mechanisms—thereby (...) leaving aside other fundamental aspects of individuals’ human agency. This commentary article offers a critique of the Authors’ rationalist and individualist approach. The critique can be summarized through the following claim: We humans, as responsible beings, are more than our executive functions. This claim articulates through four main points of discussion: role of emotions in moral judgments and behavior; executive functions and normative criteria for legal insanity; impact of adverse situational factors on executive functions; Authors’ account of punishment and, especially, rehabilitation. The current disruption of ecosystems and climate systems can be likened to an increase in entropy within our planet. This concept is often linked to the second law of thermodynamics, which predicts a necessary rise in entropy resulting from all material and energy-related processes, including the intricate organisation of living systems. Consequently, discussions surrounding the ongoing crisis commonly carry an underlying sense of fatalism when referencing thermodynamic principles. In this study, we explore how the understanding of life has been harmonized (...) with thermodynamics to show that entropy production is a consequence of heightened complexity in life rather than its breakdown. Furthermore, it is crucial to perform a thermodynamic analysis of the Earth system as a whole to dispel fatalistic assumptions. The extremum principles linked to thermodynamics do not foretell the precise evolution of complex organisations but rather set the thermodynamic boundaries associated with their development. Ultimately, treating the Earth system as an integrated autonomous entity in which life and human societies play pivotal roles is essential for charting a sustainable path forward for humanity. Understanding how to contribute to thermodynamic states that are more conducive to life, rather than hastening the journey towards chaotic states, is paramount for human survival and well-being in the Anthropocene era. Economies - and the government institutions that support them - reflect a moral and political choice, a choice we can make and remake. Since the dawn of industrialization and democratization in the late eighteenth century, there has been a succession of political economic frameworks, reflecting changes in technology, knowledge, trade, global connections, political power, and the expansion of citizenship. The challenges of today reveal the need for a new moral political economy that recognizes the politics in political economy. It also (...) requires the redesign of our social, economic, and governing institutions based on assumptions about humans as social beings rather than narrow self-serving individualists. This Element makes some progress toward building a new moral political economy by offering both a theory of change and some principles for institutional design. (shrink)

This paper addresses a problem that has so far been neglected by scholars investigating the ethics of Big Data and policy makers: that is the ethical implications of Big Data initiatives’ environmental impact. Building on literature in environmental studies, cultural studies and Science and Technology Studies, the article draws attention to the physical presence of data, the material configuration of digital service, and the space occupied by data. It then explains how this material and situated character of data raises questions (...) concerning the ethics of the increasingly fashionable Big Data discourses. It argues that attention should be paid to the vocabulary currently used when discussing the governance of data initiatives; the internal tension between current data initiatives and environmental policies; issues of fair distribution. The article explains how taking into account these aspects would allow for a more responsible behaviour in the context of data storage and production. (shrink)

This article defends a specific account of reasonableness as a virtue of liberal citizenship. I specify an account of reasonableness that I argue is more consistent with the phenomenology of intersubjective exchanges among citizens over political matters in contexts of deep disagreement. My reading requires reasonable citizens to undertake an attitude of epistemic modesty while deliberating public matters with agents who hold views different from theirs. In contrast with my view, I debate Martha Nussbaum’s and Steven Wall’s accounts of reasonableness (...) and specify why I believe that these proposals, although interesting, both require revisions. Distinguishing my account from theirs, I specify the normative relation between reasonableness and a general framework of political legitimacy that identifies citizens as ‘co-authors of democratic decisions’. Here, I argue that the liberal ideal of ascribing to each member of the constituency the status of putative epistemic authority can be properly fulfilled if coupled with a correct specification of the political ideal of mutual respect. I conclude claiming that opacity respect, a notion of respect according to which the recognition respect that is owed to individuals is expressed by the idea that we have to treat them as ‘opaque’, is the most adequate concept of political respect when dealing with interpersonal deliberations at political level in contexts of deep disagreement.
