Robert Alexy develops his influential theory of legal reasoning exploring the nature of legal argumentation and its relation to practical reasoning. In doing so he sheds light on fundamental questions of law and rationality, which are as crucial to practising lawyers and law students as they are to scholars of legal theory.

Prior to statistical mechanics and especially before the advent of the new quantum mechanics, it was traditionally held, following in the main the Kantian philosophy, that the task of science is to attain a unique quantitative representation of reality. It was thought—and with justifiable zeal—that a scientific discipline is exact to the extent to which a mathematical pattern yielding quantitative relations can be applied to its subject matter. This view was based on the implicit assumptions that functional relatedness conducive to (...) quantitative evaluation is bound to reveal the most generic, and hence, the most essential traits of events. Empathy is often split into an affective facet for embodied simulation or sometimes sensorial processing, and a cognitive facet for mentalizing and perspective-taking. However, a recent neurophenomenological framework proposes a graded view on empathy (i.e., “Graded Empathy”) that extends this dichotomy and considers multiple levels while integrating complex neural patterns and representations of subjective experience. In the current magnetoencephalography study, we conducted a multidimensional investigation of neural oscillatory modulations and their cortical sources in 44 subjects while observing stimuli that convey (...) vicarious pain (vs no-pain) in a broad time window and frequency range to explore rich neural representations of pain empathy. Furthermore, we collected participants’ subjective-experience of sensitivity to vicarious pain, as well as their self-reported trait levels of affective and cognitive empathy to examine the possible associations between neural mechanisms and subjective experiences and reports. While extending previous electrophysiological studies that mainly focused on alpha suppression, we found here four significant power modulation patterns corresponding to multiple facets of empathy: an early central (peaking in the paracentral sulcus) alpha (6–11 Hz) suppression pattern plausibly reflecting sensory processing, two early beta (15–23 Hz) suppression patterns in the mid-cingulate cortex (plausibly reflecting the affective component) and in the precuneus (plausibly reflecting the cognitive component), and a late anterior (peaking in the orbitofrontal cortex) alpha-beta (11–19 Hz) enhancement pattern (plausibly reflecting cognitive-control inhibitory response). Interestingly, the latter measure was negatively correlated with the subjective sensitivity to vicarious pain, thereby possibly revealing a novel inhibitory neural mechanism determining the subjective sensitivity to vicarious pain. Altogether, these multilevel findings cannot be accommodated by the dichotomous model of empathy (i.e., affective-cognitive), and provide empirical support to theGraded Empathyneurophenomenological framework. Furthermore, this work emphasizes the importance of examining multiple neural rhythms, their cortical generators, and reports of subjective-experience in the aim of elucidating the complex nature of empathy. A narrowly person-affecting (NPA) axiology is an account of the moral ranking of outcomes such that the comparison of any two outcomes depends on the magnitude and weight of individuals’ well-being gains and losses between the two. This article systematically explores NPA axiology. It argues that NPA axiology yields an outcome ranking that satisfies three fundamental axioms: Pareto, Anonymity and, plausibly, Pigou-Dalton. The axiology is neutral to non-well-being considerations (desert); and (assuming well-being measurability) leads to the Repugnant Conclusion (RC). In (...) short, NPA axiology provides a grounding for Paretian, equity-regarding welfarism, albeit one that includes the RC. (shrink)

The cuticular surface of Drosophila is decorated by parallel arrays of polarized structures such as hairs and sensory bristles; for example, on the wing each cell produces a distally pointing hair. These patterns are termed [tissue polarity]. Several genes are known whose activity is essential for the development of normal tissue polarity. Mutations in these genes alter the orientation of the hair or bristle with respect to neighboring cells and the body as a whole. The phenotypes of mutations in these (...) genes allows them to be placed in three phenotypic groups. Based on their behavior in genetic mosaics, it has proved possible to determine that individual genes are required either for the generation of an intercellular polarity signal and/or the transduction of that signal to the cytoskeleton. Decision theory seems to offer a very attractive normative framework for individual and social choice under uncertainty. The decisionmaker should think of her choice situation, at any given moment, in terms of a set of possible outcomes, that is, specifications of the possible consequences of choice, described in light of the decisionmaker's goals; a set of possible actions; and a "state set" consisting of possible prior "states of the world." It is this framework for choice which provides the foundation for (...) expected utility theory, as demonstrated in the work of Leonard Savage. Problems arise, however, when the decisionmaker is boundedly rational: when the mental process of thinking about outcomes, actions, and states is itself expensive and time consuming. In the case of the unboundedly rational decisionmaker, decision theory enjoins her to employ maximally specific outcomes; to consider all possible actions; and to use a set of mutually exclusive and collective exhaustive states, each of which is sufficiently finely specified so that each action, together with each state, yields one and only one maximally specific outcome. In the case of the boundedly rational decisionmaker, this procedure is either infeasible or, if feasible, irrational. This paper presents the problem of bounded rationality. It surveys possible solutions, none of which are found to be attractive. And it concludes by discussing the difficulties that the problem of bounded rationality poses for the welfarist program for legal scholarship presented by Louis Kaplow and Steven Shavell in their book, Fairness versus Welfare. A teoria das virtudes epistêmicas (VE) sustenta que as virtudes dos agentes, tais como a imparcialidade ou a permeabilidade intelectual, ao invés de crenças específicas, devem estar no centro da avaliação epistêmica, e que os indivíduos que possuem essas virtudes estão mais bem-posicionados epistemicamente do que se não as tivessem, ou, pior ainda, do que se tivessem os vícios correspondentes: o preconceito, o dogmatismo, ou a impermeabilidade intelectual. Eu argumento que a teoria VE padece de um grave defeito, porque fracassa (...) ao se ajustar à natureza social dos questionamentos (epistêmicos) típicos. Esse e outros defeitos relacionados a esse infectam o paralelo que os teóricos VE traçam entre virtudes epistêmicas e morais. Ao prometer o incremento na proporção de crenças verdadeiras sobre crenças falsas, ou ignorância, as virtudes epistêmicas não podem desempenhar um papel paralelo àquele que Aristóteles reserva às virtudes morais ao prometer o incremento em nossa felicidade e no bem-estar da comunidade. A minha rota para essas críticas é feita das razões sobre por que os agentes (sociais) devem buscar a obtenção de seus objetivos morais e epistêmicos diferentemente nos papéis que atribuem às virtudes. ABSTRACT Epistemic Virtue (EV) theory holds that virtues of agents, like impartiality or openmindedness, rather than specific beliefs, should be at the center of epistemological evaluation, and that individuals with those virtues are better positioned epistemically than if they lacked them or, worse, if they instead had the corresponding vices: prejudice, dogmatism, or close-mindedness. I argue that EV theory suffers from a serious flaw because it fails to accommodate to the social nature of typical (epistemic) inquiries. This and related flaws infect the parallel that EV theorists allege between epistemic and moral virtues. In promising to improve our ratio of true beliefs to either false beliefs or ignorance, the epistemic virtues cannot play a roll parallel to that which Aristotle claims for the moral virtues in promising to increase our happiness and the well-being of the community. The path to these criticisms I introduce by offering reasons for why (social) agents should seek to realize their epistemic and moral goals very differently in the respective roles they accord to the virtues. After joining the staff of the Burgholzli Mental Hospital in 1900, Jung developed and applied the word-association tests for studying normal and abnormal psychology. The studies have remained a significant phase in the development of Jung's conceptions and an important contribution to diagnostic psychology and psychiatry. Between 1904 and 1907 he published nine studies on the tests. These studies, together with two lectures on the association method given in 1909 at Clark University and three articles on psychophysical researches from American (...) and English journals in 1907-1908, compose this volume. Jung's association studies showed the definite influence of Bleuler and also of Freud, with whom he worked closely for several years. With this volume, the Collected Works are complete except for the Miscellany, Bibliography and Index volumes. (shrink)

At the turn of the last century C.G. Jung began his career as a psychiatrist. During the next decade, three men whose names are famous in the annals of medical psychology influenced his professional development: Pierre Janet, under whom he studied at the Sappetriere Hospital in Paris; Eugen Bleuler, his chief at the Burgholzli Mental Hospital in Zurick; and Sigmund Frued, whom Jung met in 1907. It is Bleuler, and to a lesser extent Janet, whose influence is to be found (...) in the descriptive experimental psychiatry composing Volume I of the _Collected Works_. These papers appeared between 1902 and 1905l most of them are now being published in English for the first time. The volume opens with Jung's dissertation for the medical degree: 'On the Psychology and Pathology of So-Called Occult Phenomena', a study that foreshadows much of his later work, and as such is indispensable to all serious students of his work. It is the detailed analysis of the case of an hysterical adolescent girl who professed to be a medium. The volume also includes papers on cryptomnesia, hysterical parapraxes in reading, manic mood disorder, simulated insanity, and other subjects. (shrink)

The numerous difficulties facing the traditional Humean regularity approach to the problem of causation have been discussed in the literature at great length. In view of the current interest in possible worlds semantics, it is not surprising that the only serious alternative treatment of causation presently available, the counterfactual approach, has been explored recently as a means of circumventing the apparently unresolvable difficulties facing regularity causal theories. It is the purpose of this paper to suggest that such a strategy holds (...) little promise. Specifically, I will argue that, in addition to giving rise to problems directly analogous to those facing regularity accounts, the counterfactual approach fails in principle to reflect important properties of causal relations as we understand them intuitively. David Lewis's possible worlds account, the most comprehensive counterfactual theory to date, is further criticized for implicit problems with natural lawhood even more serious than those typically raised for regularity accounts, for additional inadequacies in its analysis of causal relations, and for its failure to satisfy basic empiricist epistemological standards. This paper attempts a philosophically rigorous interpretation of H.C. Andersen’s tales. Through a radically conceived sentimentality – the unmediated juxtaposition of the abjection of things, conceived as a paradoxical “desire for desire” having no place in the world, with a cruel, apathetic gaze – Andersen challenges the existence of the soul or subjectivity as what, by combining the theoretical gaze with contemplative pleasure, grants coherence to experience. Thus undermining not only Romantic self-reflection, and its suturing of philosophy to criticism, but (...) Plato’s erotic psychology, Andersen inaugurates a new philosophical literature: a writing for children cultivating an openness. (shrink)
