Zusammenfassung Das Ziel dieses Beitrags ist es, den Anwendungsbereich und Nutzen der sozialen Netzwerkanalyse für die sportwissenschaftliche Forschung herauszuarbeiten sowie die Grundlage eines sportwissenschaftlichen Forschungsprogramms darzustellen. Dazu findet zunächst eine theoretische Einordung des Netzwerkbegriffs im Zusammenhang von sozialen Strukturen und sozialem Handeln statt. Im Anschluss werden die wichtigsten theoretischen und methodischen Konzepte der SNA vorgestellt. Schließlich werden zentrale Themen und Fragestellungen netzwerkanalytischer Forschung in der Sportwissenschaft diskutiert. Dies geschieht mittels einer sechsdimensionalen Typologie von sozialen Netzwerken im Sport, welche eine systematische (...) Betrachtung des Forschungsfeldes erlaubt. _Why originalism is a flawed, incoherent, and dangerously ideological method of constitutional interpretation__ “Chemerinsky... offers a concise, point-by-point refutation of the theory [of originalism]. He argues that it cannot deliver what it promises—and if it could, no one would want what it is selling.”—David Cole, _New York Review of Books__ Originalism, the view that the meaning of a constitutional provision is fixed when it is adopted, was once the fringe theory of a few extremely conservative legal scholars but is now (...) a well-accepted mode of constitutional interpretation. Three of the Supreme Court’s nine justices explicitly embrace the originalist approach, as do increasing numbers of judges in the lower courts. Noted legal scholar Erwin Chemerinsky gives a comprehensive analysis of the problems that make originalism unworkable as a method of constitutional interpretation. He argues that the framers themselves never intended constitutional interpretation to be inflexible and shows how it is often impossible to know what the “original intent” of any particular provision was. Perhaps worst of all, though its supporters tout it as a politically neutral and objective method, originalist interpretation tends to disappear when its results fail to conform to modern conservative ideology. ABSTRACT An ontological analysis of time and of serial order is offered within the framework of a comprehensive ontology wherein the category of facts plays a crucial role. It is applied to distinguish them while various ways and contexts in which both have been mixed up in past and in present philosophy are discussed. The good reasons for that mix-up and the astonishing difficulty of keeping them apart are considered. The focus is more on the ontology of order than on (...) the ontology of time. The latter is too wide a subject. It turns out that order has not really been grounded even in set theory. The ontology of serial order expounded is new. It is also needed for the adequate ontological analysis of relational facts. (shrink)

Clinical ethics consultation service remains undeveloped in developing countries. It is recognised that its introduction poses challenges. Malaysia, a multicultural society with diverse religions, values and perceptions further complicate the introduction of formal clinical ethics consultation service. Clinicians attending a national congress workshop completed a Strengths–Weaknesses–Opportunities–Threats analysis. The aim was to gain insight into clinician’s expectations and promote initiatives leading to the introduction of clinical ethics consultation service. Clinicians agree that clinical ethics consultation service can improve quality of care, reduce (...) healthcare costs and advocate for patients and providers. The analysis highlighted constraints in sufficient critical mass of relevant expertise and restricted opportunities for training. This book deals with more than political philosophy in medieval Islam. The Islamic community was a religio-political unity, and as a consequence Islamic thought drew no clearcut distinction between what was strictly religious and what was political or legal. This makes it impossible to study its political ideas without delving into its thought in general and the evolution of its institutions and legal systems. He then tries to show how the concept of meaninglessness, when interpreted in the manner he suggests, can be profitably used by philosophers, despite the many persuasive objections to its use that philosophers have raised in their disputes over it.

Objections arise to the concept of artistic intention based upon the psychology of a period. Here too we experience trends or volitions which can only be explained by precisely those artistic creations which in their own turn demand an explanation on the basis of these trends and volitions. Thus "Gothic" man or the "primitive" from whose alleged existence we wish to explain a particular artistic product is in truth the hypostatized impression which has been culled from the works of art (...) themselves. Or it is a question of intentions and evaluations which have become conscious as they find their formulation in the contemporary theory of art or in contemporary art criticism. Thus these formulations, just like the individual theoretical statements of the artists themselves, can once more only be phenomena parallel to the artistic products of the epoch; they cannot already contain their interpretation. Here again this parallel phenomenon would, in its entirety, represent an extraordinarily interesting object of humanistic investigation, but it would be incapable of defining in detail a methodologically comprehensible volition. So, too, the view of art which accompanies a period's artistic output can express the artistic volition of the period in itself but cannot put a name to it for us. This view can be of eminent significance when we are seeking a logical explanation for the perception of tendencies dominating at a given time and thus also for the judgment of artistic volition at that time, which must also be interpreted.Erwin Panofsky, the renowned art historian, was professor at the Institute for Advanced Study, Princeton University, until his death in 1968. Combinatory logic started as a programme in the foundation of mathematics and in an historical context at a time when such endeavours attracted the most gifted among the mathematicians. This small volume arose under quite differ ent circumstances, namely within the context of reworking the mathematical foundations of computer science. I have been very lucky in finding gifted students who agreed to work with me and chose, for their Ph. Addressing Problems Instead of Diagnoses: Reimagining Liberalism Regarding Disability and Public Health The public health systems of liberal states systematically fail to meet the goals and obligations of the Convention on the Rights of Persons with Disabilities, which aims to facilitate full societal participation and independent life choices by all impaired persons, as well as the unburdening of their private caretakers. This failure does not stem from a lack of money or effort by governments and other societal institutions, but flaws (...) in the anatomy of these systems. As these systems confine institutional assistance to the needs of persons with certain delineated disabilities, they neglect the needs of other persons, whose disabilities do not fit this mould. The responsibility for the latter group thus falls to their immediate social circle. These private caretakers are in turn seldom supported. To remedy this situation, I will present the alternative paradigm of vulnerability theory as the possible foundation for a more inclusive approach to public health. (shrink)

Bergmann advocated a universal realism different from that of Plato. His universals are different, and the fundamental tie connecting universals to particulars is also in many respects different from Plato's participation. Since Bergmann takes universals to be perceptible, it makes sense to argue empirically for the existence of the fundamental tie of exemplification. He holds that exemplification ties universals and particulars together into facts. However, finally he drops fundamental ties and attributes to diads of diversity the togetherness of universals and (...) particulars, though he is very reluctant to give up the principle that complexes need ties to give them unity. Analyzing the ontological tradition, Bergmann claims that it mostly mistook a function for a fundamental tie. (shrink)

Whether due to simplicity or hypocrisy, the question of access to patient data for biomedical research is widely seen in the public discourse only from the angle of patient privacy. At the same time, the desire to live and to live without disability is of much higher value to the patients. This goal can only be achieved by extracting research insight from patient data in addition to working on model organisms, something that is well understood by many patients. Yet, most (...) biomedical researchers working outside of clinics and hospitals are denied access to patient records when, at the same time, clinicians who guard the patient data are not optimally prepared for the data’s analysis. Medical data collection is a time- and cost-intensive process that is most of all tedious, with few elements of intellectual and emotional satisfaction on its own. In this process, clinicians and bioinformaticians, each group with their own interests, have to join forces with the goal to generate medical data sets both from clinical trials and from routinely collected electronic health records that are, as much as possible, free from errors and obvious inconsistencies. The data cleansing effort as we have learned during curation of Singaporean clinical trial data is not a trivial task. The introduction of omics and sophisticated imaging modalities into clinical practice that are only partially interpreted in terms of diagnosis and therapy with today’s level of knowledge warrant the creation of clinical databases with full patient history. This opens up opportunities for re-analyses and cross-trial studies at future time points with more sophisticated analyses of the same data, the collection of which is very expensive. (shrink)

The relation between universal and particular is considered to be the Achilles’ heel of universal realism. However, modern universal realism with facts does not have the difficulties which traditional Platonic universal realism had. Its exemplification relation connecting particulars and universals in atomic facts is very different from Platonic participation. Bradley’s regress argument against the exemplification relation can be refuted in two different ways. Nevertheless, there are good reasons to avoid the assumption of an exemplification relation and thus to go without (...) the Achilles’ heel altogether. (shrink)
