Prior interpretations of the tattoos of nonhuman animals etched upon the preserved human bodies from the Pazyryk archaeological culture of Inner Asia have focused on solely human-generated meanings. This article utilizes an ethnoarchaeological approach to reassess these tattoos, by analogizing the nature and possibilities of human-ridden horse intersubjectivities in the present with those of the past. As enlightened by people who live with horses, including the author, the process of learning to ride can be seen as an interspecies apprenticeship process, (...) where both humans and horses pass along social knowledge as thoughtful actors with defined roles. From this perspective, the horse tattoos are presented as polysemic materializations of the bonds between particular Pazyryk horses and people, of blended identities, and of cosmological values related to time, memory, and belonging. The article concludes that exploring smaller-scale human-nonhuman animal interactions in the present allows for fresh interpretations of similar interactions in the past and provides a means for archaeology to move beyond the objectification of animals as sets of resources or symbols. This paper explores the proposals of Giorgio Agamben and Roberto Esposito, two of the top representatives of the Italian Thought, around the notion of community and commons. Starting from an analysis of the community based on the munus, the statute of the commons is examined as opposed to the right of property. Next, the discussion around the notion of use of the commons and its difficult reconciliation with the legal apparatus is presented. Finally, the notion of inappropriateness that underpins the (...) This article presents the relationship between the notions of equality and freedom assumed by Castoriadis as necessary conditions for social autonomy project. The chiasmatic figure that Castoriadis establishes between equality and freedom will be approached with the aim of clarifying whether both notions should be addressed jointly or, on the contrary, they can be considered separately for an autonomy project as well. Once exposed the difficulties that appear in the representation that establishes a correspondence between both terms, attention will be (...) directed to the need of the figure of law as a legal element to guarantee the privileges that are granted to the members of the community in the Autonomy project that is equal participation. To conclude, the article will be directed to a silence in the work of Castoriadis; who can be considered a subject in the autonomy project, that is, who should participate in the formation of the new institutions. El artículo se propone examinar las condiciones por las que los derechos humanos no son respetados en su totalidad para todos los seres humanos. En concreto, estudia la relación entre ser sujeto de justicia y la posesión del estatus de ciudadanía y, por otro lado, la relación entre privación de derechos y ausencia de ciudadanía. En este sentido, se exploran algunos de los discursos que han permitido la cesura entre el hombre como sujeto político y el hombre como sustrato biológico. (...) Se propone tomar la profunda intimidad entre el acceso a los derechos y el ser sujeto reconocido por el Estado como el vector explicativo de la vulneración de los derechos humanos. (shrink)

Celem artykułu jest próba rekonstrukcji rozwoju duchowego Zaratustry, głównego bohatera dzieła Nietzschego Tako rzecze Zaratustra. Ów rozwój polega na osiąganiu trzech stadiów świadomości: fazy konformistycznego wielbłąda, przepełnionego negacją lwa i finalnie dziecka afirmującego życie. Metodologia badań zastosowana w artykule opiera się na analizie, rekonstrukcji i syntezie tekstu Tako rzecze Zaratustra. Przeprowadzone badania osadzone są w kontekście tezy Heideggera o komplementarności głównych aspektów nietzscheanizmu: woli mocy i wiecznego powrotu. Zaratustra, aby przeistoczyć się w lwa, a następnie w dziecko, będzie musiał odkryć (...) i zaakceptować ową komplementarność. Głównym antagonistą proroka jest duch ciężkości, symbolizujący negację życia i destruktywną miłość bliźniego. (shrink)

En este trabajo se muestra la conveniencia y necesidad de aunar procedimientos filológicos tradicionales y metodologías propias del análisis del discurso que permiten relacionar las estrategias y recursos lingüísticos empleados en la elaboración de los textos, al examen y análisis de los textos escritos en nuestro pasado [1]. Para alcanzar dicho objetivo es necesario abordar una complicada y laboriosa tarea de recontextualización histórica, social, discursiva y comunicativa. El corpus empleado consta de 10 cartas escritas por Alonso de Medina a La (...) Gasca, desde Arequipa en 1549. Concretando más, se examinan los procedimientos lingüísticos empleados por el locutor de estas cartas para construir su identidad discursiva, así como el papel que desempeñan en la configuración de dicha identidad, el _ethos prediscursivo_ o _identidad social_, con atención especial a la ideología o _doxa_ (política/ley-religión). [1] Como señalaba Bustos Tovar (2016, etc.) la finalidad de todo análisis filológico debe explorar nuevas metodologías que, partiendo de que los textos son actos de comunicación que poseen un _sentido_ y que obedecen a una intención, ayuden a determinar cuestiones como los rasgos relevantes para determinar el sentido de los textos y los diferentes modos de construcción del discurso. The paper by Bergnar and Bunford in this edition of Philosophy, Psychiatry, & Psychology is a sophisticated examination of a central question that has lacked consensus in the philosophy of psychiatry, namely, what is “the key aspect of the meaning of this fundamental term, mental disorder”? To settle this question, the authors use an empirical approach by surveying graduate students in clinical psychology. In this way, they attempt to invoke the Wittgensteinian method of determining the meaning of a term by (...) seeing how it is used. This book takes readers on a philosophical discovery of a forgotten treasure, one born in the 14th century but which appears to belong to the 21st. It presents a critical, up-to-date analysis of Santob de Carrión, also known as Sem Tob, a writer and thinker whose philosophy arose in the Spain of the three great cultures: Jews, Christians, and Muslims, who then coexisted in peace. The author first presents a historical and cultural introduction that provides biographical detail as well as (...) context for a greater understand of Santob's philosophy. Next, the book offers a dialogue with the work itself, which looks at politics, sociology, anthropology, psychology, ethics, aesthetics, metaphysics, and theodicy. The aim is not to provide an exhaustive analysis, or to comment on each and every verse, but rather to deal only with the most relevant for today’s world. Readers will discover how Santob believed knowledge must be dynamic, and tolerance fundamental, fleeing from dogma, since one cannot avoid a significant dose of moral and aesthetic relativism. Subjectivity, within its own codes, must seek a profound ethics, not puritanical but which serves to escape from general ill will. Santob offers a criticism of wealth and power that does not serve the people which appears to be totally relevant today. In spite of the fame he achieved in his own time, Santob has largely remained a vestige of the past. By the end of this book, readers will come to see why this important figure deserves to be more widely studied. Indeed, not only has this medieval Spanish philosopher searched for truth in an unstable, confused world of contradictions, but he has done so in a way that can still help us today. (shrink)

The paper considers the notion of Science Policy from a postcolonial perspective. It examines the theoretical implications of the recent trend to include emerging and developing countries in international Science Policies by way of the case study of Switzerland. This country’s new international science policy instruments and measures have challenged the classical distinction between international scientific cooperation and development cooperation, with consequences on standards and evaluation criteria. The analysis reveals that the underlying assumptions of the concept of Science Policy perpetuate (...) traditional asymmetries in the global political economy of science. The paper suggests that the present legacy of Science Policy institutions and practices needs to be transformed to reflect an increasingly diverse spectrum of scientific purposes and traditions. It offers a revised set of foundational assumptions on Science Policy and, more broadly, proposes a fresh point of entry for the field of Science & Technology Studies to contribute to the Science Policy discourse. O artigo científico visa esclarecer acerca do judicial review com enfoque no originalismo e no interpretativismo. Neste trabalho pretendemos demonstrar ser o interpretativismo um construto da Suprema Corte dos Estados Unidos oriundo do precedente Brown. Em primeiro lugar, examinaremos os precedentes da Suprema Corte, cujos fundamentos foram obtidos a partir da corrente originalista, até chegarmos ao citado caso Brown e em seguida analisaremos filosoficamente o precedente. Em conclusão, antes se buscava a intenção original do constituinte, no entanto, modernamente, almeja-se controlar (...) a constitucionalidade com parâmetro nos princípios constitucionais. (shrink)

L’agence d’expertise indépendante INDEX, constituée d’architectes, d’artistes et de chercheurs, enquête sur les violences d’État en France et depuis la France. Dans cet entretien, iels expliquent comment iels réinvestissent politiquement la notion d’expertise dans les enquêtes policières, racontent leurs liens avec le collectif Forensic Architecture, explicitent ce qu’iels entendent par « vérité » dans les enquêtes en sources ouvertes et ce qu’iels mettent en place pour permettre une plus grande dissémination des outils de l’OSINT.

Decisional capacity evaluations (DCEs) occur in clinical settings where it is unclear whether a consumer of medical services has the capacity to make an informed decision about the relevant medical options. DCEs are localized interventions, not the global loss of competence, that assign a surrogate decision maker to make the decision on behalf of the medical consumer. We maintain that one important necessary condition for a DCE to be morally justified, in cases of medical necessity, is that the health care (...) consumer under evaluation is incapable of expressing a preference for a certain outcome. Psychiatric disorders usually do not have characteristic physical exam findings, imaging, or lab values. Psychiatrists therefore diagnose and treat patients largely based on reported or observed behavior, which makes collateral information from a patient’s close contacts especially pertinent to an accurate diagnosis. The American Psychiatric Association considers communication with patients’ supports a best practice when the patient provides informed consent or does not object to the communication. However, situations arise in which a patient’s objection to such communication is the product (...) of impaired decision-making and the benefits of obtaining collateral information represent best practice. In this article a framework for addressing these situations is proposed using a full decisional capacity evaluation, followed by an alternate decision-making process by concurrence from a second physician. It is recommended that a patient’s refusal to allow the gathering of collateral information should be addressed exactly like refusals for other diagnostic or treatment interventions. (shrink)

La restauración borbónica en España se extendió entre el 29 de diciembre de 1874 (pronunciamiento de Martínez Campos) y el 14 de abril de 1931 (proclamación de la Segunda República española). José Ortega y Gasset nació en 1883 y vivió casi medio siglo, 48 años, en este periodo. Durante el mismo desarrolló parte de su trabajo. Sin embargo, la fragilidad del sistema político, social y económico que desembocó en la II República y más tarde en la Guerra Civil española motivó (...) una obra de Ortega que fue recibida desde unas tensiones que en gran medida la hicieron incomprensible en unos casos, enemiga en otros, pero también, al mismo tiempo, atractiva, genuina, cercana, universal y necesaria para gran parte del público. Estas líneas receptivas se agudizaron a partir de la Guerra Civil española. El presente estudio las recorre por las distintas generaciones de autores desde los marcos filosóficos, las líneas políticas, las posiciones hacia la religión y, especialmente, un sinfronismo que el propio Ortega toma gracias a la vida que magníficamente refleja Azorín en su libro Un pueblecito: Riofrío de Ávila. Ortega, filósofo in partibus infidelium, se constituyó así en una especie de figura paterna de un cuerpo frágil que, sin embargo, logró, a pesar de los grandes contratiempos, asimilar y valorar su obra hasta consolidar e influir en las nuevas generaciones de pensadores llegando a nuestros días. Les arbres de mots constituent un des outils de la statistique textuelle pour visualiser les relations sémantiques entre mots d’un texte. Les méthodes de construction de ces arbres à partir d’une distance de co-occurrence dans le texte produisent des arbres dont les longueurs d’arêtes se prêtent mal à l’analyse. Pour faciliter l’interprétation visuelle de l’arbre, l’idéal serait que des longues arêtes séparent des classes sémantiques de mots. Ainsi, découper les arêtes les plus longues de l’arbre devrait conduire à une partition (...) de l’ensemble des mots qui fournit des classes pertinentes. A l’aide de deux corpus dont un sous-ensemble de mots a été partitionné en un ensemble de classes sémantiques, nous évaluons plusieurs formules permettant de recalculer les longueurs d’arêtes de l’arbre construit à partir des distances de co-occurrence, afin de rendre l’interprétation de l’arbre plus facile et plus fiable. The precarious rights of senior citizens, especially those who are highly educated and who are expected to counsel and guide the younger generations, has stimulated the creation internationally of advocacy associations and opinion leader groups. The strength of these groups, however, varies from country to country. In some countries, they are supported and are the focus of intense interest; in others, they are practically ignored. For this is reason we believe that the creation of a network of all these associations (...) is essential. The proposed network would act as a support for the already-existing policies of the United Nations’ High Commission for Human Rights, of independent experts, and of the Global Alliance for the Rights of Older People. All three have long ago recommended the creation of a recognized instrument for uniting presently scattered efforts. The proposed network, therefore, will seek to promote the international exchange of relevant expertise, and it will reinforce the commitments and actions that single countries are currently taking to meet these objectives. For example, informative public events can be organised to promote particular support initiatives and to provide an opportunity for new members of the network to be presented. The network will promote health for senior citizens, disease prevention, senior mobility, safe free time for seniors, alimentary education, protection against new risks and dangers, as well as equity in the services necessary for seniors to adopt new information and communication technologies. In the case of retired academic members, the network will promote equality with respect to continuing use of digital technologies (particularly email), continuing access to research libraries, and the guaranteed ability for seniors to fund their own research programs and to deliver free seminars. O ensaio visual pretende refletir sobre o processo de realização do documentário Do Outro Lado do Atlântico, com estudantes de Países Africanos de Língua Oficial Portuguesa (PALOP) no Brasil, a partir da ideia de um “encontro etnográfico” com os personagens do filme. Traz uma reflexão sobre a abordagem dos documentários de busca, e seus processos de subjetivação, ao mesmo tempo que busca reafirmar uma postura contra-colonial e antirracista, desconstruindo imaginários visuais de raça, subalternidade e estereótipos de África.
