Historical injustice and global inequality are basic problems embedded in territorial rights. In Global Justice and Territory Cara Nine advances a general theory of territorial rights adapting a theoretical framework from natural law theory to ground all territorial claims.

The power of algorithms has become a familiar topic in society, media, and the social sciences. It is increasingly common to argue that, for instance, algorithms automate inequality, that they are biased black boxes that reproduce racism, or that they control our money and information. Implicit in many of these discussions is that algorithms are permeated with normativities, and that these normativities shape society. The aim of this editorial is double: First, it contributes to a more nuanced discussion about algorithms (...) by discussing how we, as social scientists, think about algorithms in relation to five theoretical ideal types. For instance, what does it mean to go under the hood of the algorithm and what does it mean to stay above it? Second, it introduces the contributions to this special theme by situating them in relation to these five ideal types. By doing this, the editorial aims to contribute to an increased analytical awareness of how algorithms are theorized in society and culture. The articles in the special theme deal with algorithms in different settings, ranging from farming, schools, and self-tracking to AIDS, nuclear power plants, and surveillance. The contributions thus explore, both theoretically and empirically, different settings where algorithms are intertwined with normativities. (shrink)

Criminal offenders may be offered to participate in voluntary rehabilitation programs aiming at correcting undesirable behaviour, as a condition of early release. Behavioural treatment may include direct intervention into the central nervous system (CNS). This article discusses under which circumstances voluntary rehabilitation by CNS intervention is justified. It is argued that although the context of voluntary rehabilitation is a coercive circumstance, consent may still be effective, in the sense that it can meet formal criteria for informed consent. Further, for a (...) consent to be normatively valid (“take the wronging out of the act”) under a coercive circumstance, the subject to be treated must (1) have the sovereign authority to consent, and (2) the offer-giver must be in the right normative position to make the offer. While I argue that subjects do have the sovereign authority to consent to treatment, I also argue that inappropriate offers yield invalid consents. Considerations on inappropriate offers should therefore inform which kinds of CNS intervention-based rehabilitation schemes the state may propose as part of the criminal justice system. Yet as I conclude in this paper, while there are some intrinsic constraints on voluntary rehabilitation programs, the main constraints on voluntary rehabilitation are likely to be contingent overriders. However, CNS intervention is not ruled out as such in the context of voluntary rehabilitation. (shrink)

This article represents conversations with the American composer Libby Larsen in which she described her beliefs about music, music education, and the dilemmas that our current system faces as we seek to provide relevant and meaningful music education to our students. Our conversation explores such topics as cognitive psychology, music theory, cultural practices and developments in American culture, and current music education practices. Larsen brought up many questions about music education in America, providing some suggestions for the future (...) and posing problems for which the solution may require a great deal of imagination by music education teachers. The article is structured as a Socratic dialogue, in which Larsen constructs an inductively strong argu- ment for making radical changes to current music education practice. (shrink)

Ecological refugees are expected to make up an increasing percentage of overall refugees in the coming decades as predicted climate change related disasters will displace millions of people. In this essay, I focus on those rights ecological refugees may claim on the basis of collective self-determination. To this end, I will focus on a few specific cases that I call cases of ‘ecological refugee states’. Tuvalu, the Maldives, and to a certain extent, Bangladesh are predicted to be ecological refugee states (...) in the near future. These are states whose entire (or close to it) geographical territory is predicted to be lost to rising sea levels; the collective body of the people will itself become an ecological refugee.The question is: what may the people of an ecological refugee state legitimately claim on the basis of their right to self-determination? Should we redraw state borders to accommodate a New Tuvalu? I argue that a plausible position regarding territorial rights is that when (1) a people clearly is (or recently was) self-determining and has a legitimate claim to continue to be self-determining, and (2) the self-determination of a people is existentially threatened because the people lacks territorial rights, that (3) the people becomes a candidate for sovereign over a new territory. The result is that existing state borders may need to change to accommodate something like a New Tuvalu. To generate these results on behalf of ecological refugee states, I examine the principles of the system of territorial states. Because the system of territorial states is a system of exclusive rights over goods, especially land, it is possible that it is subject to the conditions of a Lockean proviso mechanism. Therefore we can either discard it as generally irrelevant for the understanding of the cultural functions of texts, or use it as a point of departure for the formulation of both general and basic aspects of such functions. The position taken in this essay will opt for the (...) last possibility, although I know full well that already the term "metafiction" itself inevitably triggers a variety of skeptical reactions. Does it not just refer to some author's self-centered ruminations in the ivory tower? Or a topic for the nerds of literary studies with a taste for theoretical acrobatics? If so, in both cases following metafictional inclinations results in complete isolation from both the context of literature and its readers.However, one may also adopt the opposite position. The metafictional features of literature constitute one of the means by which literature reaches out to its context and also engages its readers. And critical endeavors are not necessarily devoid of anything but their own concepts. They may instead pave the way for methodological and didactic considerations that ultimately make difficult literature more accessible as a cultural phenomenon. Rather than dwelling upon subtle theoretical differences in the definition of what metafiction is, I will therefore engage in a methodological approach: what kind of questions can we put to the texts, and what kind of answers can we reasonably come up with when using metafiction in a methodological and didactic framework?I shall begin by proposing a set of definitions broader than metafiction that will allow me to zoom in on it as a relevant methodological concept that opens for didactic reflections. The notion of metalevel will constitute my starting point. In its broadest sense, a metalevel indicates a position outside a given field of objects or meanings and in relation to it. But rather than relating [End Page 13] to the content of the field in question, the metalevel is supposed to serve as a platform enabling us to observe and evaluate basic principles and function of the field. This is the role of, for example, the theory of science or of epistemology in relation to the particular knowledge of various sciences. We may call it an epistemological metalevel.In a more restricted sense, a metalevel comprises a level in relation to a given sign system — rather than to a given field of objects — from which we can observe and evaluate the basic principles defining the function, range and validity of the sign system. This is the role of, for example, musicology in relationto the acoustic arts, art criticism in relation to the visual arts, medicine in relation to bodily symptoms. We may call it an inter-semiotic metalevel.Finally, in its most restricted sense, a metalevel points toward a level inside a given sign system from which we can refer to this sign system itself,but not in relation to a given field of objects or in relation to another sign system. Advances in emotion and affective science have yet to translate routinely into psychiatric research and practice. This is unfortunate since emotion and affect are fundamental components of many psychiatric conditions. Rectifying this lack of interdisciplinary integration could thus be a potential avenue for improving psychiatric diagnosis and treatment. In this contribution, we propose and discuss an ontological framework for explicitly capturing the complex interrelations between affective entities and psychiatric disorders, in order to facilitate mapping and integration between affective science and (...) psychiatric diagnostics. We build on and enhance the categorisation of emotion, affect and mood within the previously developed Emotion Ontology, and that of psychiatric disorders in the Mental Disease Ontology. This effort further draws on developments in formal ontology regarding the distinction between normal and abnormal in order to formalize the interconnections. This operational semantic framework is relevant for applications including clarifying psychiatric diagnostic categories, clinical information systems, and the integration and translation of research results across disciplines. In Sharing Territories, Cara Nine defends a river model of territorial rights. On a river model, groups are assumed to be interdependent and overlapping. Drawing on natural law philosophy, Nine's theory argues for the establishment of foundational territories around geographical areas like rivers.

The aim of this paper is to contribute to the discussion of expertise and skilled movement in sport by analysing the bodily practice of learning a new movement at a high level of skill in parkour. Based on Sennett’s theory of craftsmanship and an ethnographic field study with experienced practitioners, the analysis offers insight into the skilful, contextual and unique practice of parkour, and contributes to the renewed discussion of consciousness in sport at a high level of skill. With Sennett’s (...) concept of craftsmanship, it is possible to describe and grasp important aspects of obstacles put up, repetitions and material consciousness in developing perceptual and physical skills in parkour. The parkour craftsmen conduct a constant dialogue between concrete, material practices and thinking. It is argued in the article that Sennett’s ideas about craftsmanship are, in many ways, similar to Dreyfus and Dreyfus’ concept of mastery, but are less elitist and exclusive than the theory of skill acquisition... Predictive genetic testing is now routinely offered to asymptomatic adults at risk for genetic disease. However, testing of minors at risk for adult-onset conditions, where no treatment or preventive intervention exists, has evoked greater controversy and inspired a debate spanning two decades. This review aims to provide a detailed longitudinal analysis and concludes by examining the debate's current status and prospects for the future. Fifty-three relevant theoretical papers published between 1990 and December 2010 were identified, and interpretative content analysis was (...) employed to catalogue discrete arguments within these papers. Novel conclusions were drawn from this review. While the debate's first voices were raised in opposition of testing and their arguments have retained currency over many years, arguments in favour of testing, which appeared sporadically at first, have gained momentum more recently. Most arguments on both sides are testable empirical claims, so far untested, rather than abstract ethical or philosophical positions. The dispute, therein, lies not so much in whether minors should be permitted to access predictive genetic testing but whether these empirical claims on the relative benefits or harms of testing should be assessed. The notion of quality features prominently in contemporary discourse. Numerous ratings, rankings, metrics, auditing, accreditation, benchmarking, smileys, reviews, and international comparisons are all used regularly to capture quality. This book paves the way in exploring the socio-political implications of evaluative statements, with a specific focus on the contribution of the concept of quality to these processes. We may correctly say that Søren Kierkegaard is one of the most influential Christian-religious thinkers of the modern era, but are we equally justified in categorizing his writings as foundationally religious? This paper challenges a prevailing exclusive-theological interpretation that contends that Kierkegaard principally writes from a Christian dogmatic viewpoint. I argue that Kierkegaard’s religion is better understood as an outcome of his philosophical analysis of human nature. Conclusively, we should appreciate Kierkegaard first as a philosopher, whose aim is the explication (...) of human subjectivity, and not primarily as an orator of Christian orthodoxy. (shrink)

Recent debates in psychopathy studies have articulated concerns about false-positives in assessment and research sampling. These are pressing concerns for research progress, since scientific quality depends on sample quality, that is, if we wish to study psychopathy we must be certain that the individuals we study are, in fact, psychopaths. Thus, if conventional assessment tools yield substantial false-positives, this would explain why central research is laden with discrepancies and nonreplicable findings. This paper draws on moral psychology in order to develop (...) tentative theory-driven exclusion criteria applicable in research sampling. Implementing standardized procedures to discriminate between research participants has the potential to yield more homogenous and discrete samples, a vital prerequisite for research progress in etiology, epidemiology, and treatment strategies. In this paper, I critically examine an important premise in theories of global distributive justice that, despite its widespread influence, has remained largely unexamined. This is the claim that state borders are morally arbitrary with respect to a just distribution of goods. I examine two common arguments for this claim, the argument that state borders are historically unjust and therefore morally arbitrary; and the argument first made by Charles Beitz that the conditions of a fair, hypothetical social contract would not (...) include knowledge of one's location with respect to the distribution of natural resources between state borders. I argue that there are good reasons to reject both arguments. Beitz's immense contribution to international justice can be gauged by the fact that it is difficult to find a contemporary work on global justice that does not reference his arguments in Political Theory and International Relations . Although some authors find Beitz's cosmopolitan theory objectionable, no author has, to my knowledge, criticized Beitz's pivotal arguments that our placement in the distribution of natural resources is morally arbitrary. We use hyperbolic towers to answer some model-theoretic questions around the generic type in the theory of free groups. We show that all the finitely generated models of this theory realize the generic type $p_{0}$ but that there is a finitely generated model which omits $p^{}_{0}$. We exhibit a finitely generated model in which there are two maximal independent sets of realizations of the generic type which have different cardinalities. This essay defends a strong right against displacement as part of a basic individual right to secure access to one’s home. The analysis is purposefully situated within the difficult context of climate change adaptation policies. Under increasing environmental pressures, especially regarding water security, there are weighty reasons motivating the forced displacement of persons—to safeguard water resources or prevent water-related disasters. Even in these pressing circumstances, I argue, individuals have weighty rights to secure access to their homes. I explain how the (...) home provides a functional context for conditions of autonomous agency. Being coerced from the home disrupts and subverts the conditions necessary for autonomous processes. I conclude by suggesting that the right to the home could be a foundational element of territorial rights. (shrink)

The Russellian approach to the semantics of attitude ascriptions faces a problem in explaining the robust speaker intuitions that it does not predict. A familiar response to the problem is to claim that utterances of attitude ascriptions may differ in their Gricean conversational implicatures. I argue that the appeal to Grice is ad hoc. First, we find that speakers do not typically judge an utterance false merely because it implicates something false. The apparent cancellability of the putative implicatures is irrelevant, (...) since cancellability does not indicate conversational implicature. Finally, the appeal assumes, implausibly, that ordinary speakers generally subscribe to a particular philosophical theory about belief. (shrink)

Inside and outside of a Christian worldview, bioethicists have discussed ectopic pregnancy at some length as a maternal-fetal vital conflict. Most bioethicists agree that methotrexate and salpingostomy are low-risk, successful interventions for this life-threatening pathology, and are thus beneficent, just, and wholly acceptable. A small cohort of Christian, largely Catholic, bioethicists have reservations about methotrexate and salpingostomy, but cannot resolve their internal disputes about these because of flawed casuistry. This paper aims to settle the issue about whether methotrexate and salpingostomy (...) are acceptable within a Catholic worldview: despite the best arguments in favor of methotrexate as a moral option, it is morally unacceptable, and despite hesitation about salpingostomy related to analogies with previable delivery, it is the optimal procedure for ectopic pregnancy. In ‘What’s Wrong with Colonialism,’ Lea Ypi argues that the wrong of colonialism can be expressed as procedural wrongs, not as wronging territorial rights. On her view, colonial practices went wrong in two ways: they forced residents into political associations, and the terms of the political association were not established through equal and reciprocal negotiations. I argue that because Ypi’s account successfully side-lines all but essential claims to territory, her theory ends up being vulnerable to an objection it means to (...) avoid. Historical residents may be subject to unequal treatment under newly formed political associations because their historical patterns of land use are not considered to have any independent moral weight. My analysis does not rely on any appeal to property or territorial rights. Instead, I appeal to pre-existing obligations holding between residents. (shrink)

Revisionists claim that the retributive intuitions informing our responsibility-attributing practices are unwarranted under determinism, not only because they are false, but because if we are all victims of causal luck, it is unfair to treat one another as if we are deserving of moral and legal sanctions. One revisionist strategy recommends a deflationary concept of moral responsibility, and that we justify punishment in consequentialist rather than retributive terms. Another revisionist strategy recommends that we eliminate all concepts of guilt, blame and (...) punishment, and treat dangerous criminals as we treat people with contagious diseases. I argue against both strong and moderate revisionism that it is not unfair to hold persons desert -entailingly responsible insofar as they take an interest in being treated as appraisable, and that it is unfair to persons not to treat them as desert -entailingly responsible contrary to their interests in being treated as such. The interest-based argument, I conclude, give us a justification for communicating retributive attitudes, but may still require a weak revision of our retributive practices, in the direction of a communicative theory of punishment. Competition is pervasive in modern society, affecting work, education, and recreation. The question arises whether competition is consistent with scriptural teaching. The context for this enquiry is that Christians today disagree among themselves about whether Scripture has any normative content relating to competition. Some view competition as incompatible with Scripture, while for others it is compatible. On the basis of a given definition of competition, Christian contributions to the debate in the last decade are reviewed. Only six inputs were discovered, (...) with five arguing that Scripture takes no normative position toward competition. Most of this article is taken up with evaluating their cases that are found to be unpersuasive. A sixth paper claims that Scripture is incompatible with competition, examined in the penultimate section. From reviewing the six contributions to the debate, the conclusion is that that Scripture does not have a favorable attitude toward competition. (shrink)
