Restorative justice should have greater weight as a criterion in criminal justice sentencing practice. It permits a realistic recognition of the kinds of harm and damage caused by offences, and encourages individualized non-custodial sentencing options as ways of addressing these harms. Non-custodial sentences have proven more effective than incarceration in securing social reconciliation and preventing recidivism, and they avoid the serious social and personal costs of imprisonment. This paper argues in support of restorative justice as a guiding idea in sentencing. (...) Medical care of critically ill and injured infants and children globally should be based on best research evidence to ensure safe, efficacious treatment. In South Africa and other low and middle-income countries, research is needed to optimise care and ensure rational, equitable allocation of scare paediatric critical care resources.

Their own work in classrooms has shown them that, paradoxically, depth in pedagogy is most surely to be found when teachers follow the light in the eyes of children. The broader educational community is reminded that school experiences should balance the measurable and the immeasurable. The authors question some aspects of the, sharing their concern that it may focus teachers’ attention too tightly on ‘that which is formed from without’. The authors suggest that the weight of this legislation may result in the neglect of some very important aspects of learning. The broader educational community is invited to consider the implications of a pedagogy of depth, to become more aware of the skill of transcending known limitations through coming to shared understanding, and to find ways to reconcile the potential violence of legislated structures with the being‐in‐the‐world of children in schools. Employee performance plays a crucial role in the productivity of organizations, especially in the hospitality industry in Malaysia. This work performance is influenced by leadership style, and finding the type of leadership style that is suitable to apply to employees is crucial, especially in the midst of the COVID-19 pandemic. Transformational leadership theory is selected for this study in determining leadership styles. There are four dimensions under transformational leadership theory, namely idealized influence, individualized consideration, inspirational motivation and intellectual stimulation. Data (...) were collected online from 400 employees working in the hospitality industry in Malaysia and analyzed using partial least square structure equation modeling. The findings show that only two dimensions of transformational leadership, namely idealized influence and inspirational motivation, have a significant positive influence on employee performance. Despite a growing body of research by management scholars to understand and explain failures in ethical decision making (EDM), misconduct prevails. Scholars have identified character, founded in virtue ethics, as an important perspective that can help to address the gap in organizational misconduct. While character has been offered as a valid perspective in EDM, current theorizing on how it applies to EDM has not been well developed. We thus integrate character, founded in virtue ethics, into Rest’s (1986) EDM model to (...) reveal how shifting attention to the nature of the moral agent provides critical insights into decision making more broadly and EDM specifically. Virtue ethics provides a perspective on EDM that acknowledges and anticipates uncertainties, considers its contextual constraints, and contemplates the development of the moral agent. We thus answer the call by many scholars to integrate character in EDM in order to advance the understanding of the field and suggest propositions for how to move forward. Argument evaluation, the ability to separate prior belief from evaluation of the quality of an argument, is an essential element of critical thinking. The present study examined the ability of three personality traits (dogmatism, openness to experience, and open-mindedness) to predict argument evaluation quality and belief bias. One hundred and twelve undergraduate students completed the Argument Evaluation Test (Stanovich & West, 1997), measures of Dogmatism, Open-Mindedness, Openness to Experience, and a Vocabulary test. Argument Evaluation Quality was negatively related to Dogmatism, (...) and positively related to Openness to Experience and Vocabulary. Path analysis showed that, when controlling for Vocabulary, Dogmatism was the only personality variable that significantly (negatively) predicted Argument Evaluation Quality. None of the variables in our study were related to belief bias. Implications for future research and educational practice are discussed. (shrink)

In the Republic, Plato’s Socrates argues that the wealthy feel contempt for the poor, and the poor feel hatred for the rich. But why is Socrates, leading a life of scandalous poverty without taking wages for philosophical work, an exception to this rule? Instead of hatred, envy, or no emotion at all, Socrates consistently treats wealth and the wealthy with ridicule and kataphronēsis – active looking-down or contempt – while meditating on the temptation of the poor to appropriate the excess (...) flesh of the wealthy (Resp. 556d). It is contempt that allows Socrates to remain free and wageless, away from the tempting distortion wealth has on the soul (Resp. 330c, 554a–b). Socrates therefore insists his philosopher-kings should be paid only in food, the same reward he proposes for himself in the Apology. In seeking for an understanding of ethical practices in health care situations, our challenge is always both to recognize and respond to the call of individuals in need. In attuning ourselves to the call of the vulnerable other an ethical moment arises. Asking ‘how are you?’ in health care practice is our very first possibility to learn how a particular person finds herself or himself in this particular situation. Here, ‘how are you?’ shows itself as an ethical question that opens (...) up a relational space that calls forth a response. It is a way to understand the situated moments in which we are already that enables us to act respectfully. Our ethical frameworks assist us in trying to decide what is the right thing to do given a set of circumstances. Yet there is a prior step that already calls us to ethical attention; this is when we ask ‘how are you?’, which transforms a seemingly small interaction into an ethical moment. ‘How are you?’ is a question that turns us back to who we are as health care professionals and calls us to be more deeply attentive to the moment. When we sincerely ask ‘how are you?’ we enact our ethical commitments to one another. (shrink)

The American states have demonstrated varying levels of support for animal rights legislation. The activities of interest groups, including pressures from competing groups, help to explain the presence or absence of ten pro-animal regulations and laws. This article analyzes and ranks each of the fifty states with regard to ten key areas of animal protection and welfare legislation. The analysis reveals that states with a more agricultural economic base are less likely to provide protection to animals. This essay evaluates Charles Taylor's defence of a politics of recognition in light of his broader account of modern identity and the self. I argue that his call for a politics of recognition betrays what is most ethically promising in his own account of modern subjectivity – namely, its emphasis on and affirmation of inner multiplicity. The first part of the paper identifies the ways in which his account of the self affirms inner multiplicity. The second part of the paper (...) outlines how a politics of recognition circumscribes this inner plurality by rendering core aspects of personal identity rigid and by promoting attitudes that inhibit attentiveness to multiplicity within the self. By outlining the ways in which it circumscribes inner multiplicity, I show that Taylor's preferred form of politics undermines two of his own central goals: that of securing the conditions in which authentic identity can be realized and that of promoting mutually receptive relations among diverse selves. A form of liberalism that strives for neutrality with respect to cultural symbols and practices more effectively facilitates the realization of these goals. (shrink)

This article focuses on the experiences of social care workers during the first wave of the Covid pandemic. The method involved analyzing diaries kept by 65 professionals in 8 French regions during the first lockdown in France in the spring of 2020. As a form of non-binding, narrative expression, keeping diaries breaks with traditional models of reporting common in social care structures and allowed professionals to reflect on the experience as it was lived. In the diaries, professionals explored how the (...) crisis disrupted and challenged their personal and professional values but also allowed innovation in care practices for vulnerable populations that will continue beyond the pandemic period. Five care values were put to forefront by professionals: (1) spontaneity/flexibility; (2) respect for persons; (3) team reflexivity; (4) innovation; (5) solidarity. Mobilizing philosopher Paul Ricoeur’s ideas on recognition, Payet and Laforgue’s analysis of weak actors, as well as research on moral distress, we discuss how these values were tested during the crisis and what effect they had on professionals’ and users’ vulnerabilities. We will also elaborate the interest of keeping account of social care work through narrative methods. (shrink)

This paper proposes a dynamic theory of embodiment that aims to get beyond the absent moving body in embodied social theory. The first somatic revolution, inspired by Merleau Ponty, provided theories based on the feeling and experience of the body. The theory of dynamic embodiment focuses instead on the doing itself as embodied social action, in which the embodied person is fore-grounded as a complex resource for meaning making. This represents a theoretical enrichment of the earlier turn to the body (...) in social theory, which tended to separate the semiotic, as necessarily representational and/or linguistic, from the somatic as a wide range of corporeal processes and practices assumed to be separated from mind, language and/or conscious thought. We argue that overcoming this persistent Cartesianism requires a New Realist approach to the proper location of human agency as a causal power, one that promotes a bio-psycho-social concept of personhood. Part one of the paper presents a general framework for this perspective, while part two applies this paradigm ethnographically to illustrate how bringing semiosis and somatics together requires a robust conception of multi-sensory modalities. Ironically, while it is an ingredient in almost every encounter between analyst and patient, the analyst's personal feelings about money are rarely discussed openly or in any great depth. So what is it about money that relegates it to the background, both on the couch and off? In _Money Talks_, Brenda Berger, Stephanie Newman, and their excellent cast of contributors address this and other (...) questions surrounding the tender topic of money, how we talk about it, and how it talks to us. Its multiple meanings are explored in the contexts of patients and analysts and the ways in which they relate, in the training and practice of the analysts themselves, as well as the psychological and cultural consequences of having too much or too little in both flush and tight economic times. The earliest was published in 1986, the last in 2004, and three appear here for the first time. They are grouped topically by period—"I. Mostly (...) before Kant; II. Mostly Kant; III. Mostly After Kant"—rather than chronologically. While this order is useful, it introduces some dislocation if one approaches the book as a whole since the last essay in the book is the first chronologically, and part of the interest of the book lies in the changes in Paul Guyer's positions over time that are reflected in his careful reconsideration of topics that he has dealt with more extensively in his volumes on Kant's [End Page 422] philosophy. As one of the most important contemporary interpreters of Kant's aesthetics, those reconsiderations are well worth attending to.The focus of all of the essays is clearly on Kant's aesthetics. That perspective is clear even when Guyer is discussing the history of aesthetics prior to Kant. As he notes, "this history of the first decades of modern aesthetics has obviously been written with an eye to Kant" ("Origins of Modern Aesthetics: 1711–1735," pp. 32–33). It continues in the discussions of recent aesthetics. For example, Guyer concludes that "the effect that is intended on the revised Beardsleyan definition [of art] is in the tradition of the Kantian concept of the free play of imagination and understanding" ("From Jupiter's Eagle to Warhol's Boxes," p. 313). Danto and Mothersill are also, it is argued, in the Kantian tradition.There are, of course, some problems with this perspective, especially with regard to the pre-Kantian history of aesthetics. For example, Guyer finds Kant's distinction between pure beauty and apprehended beauty reflected in an earlier distinction between beauty of form and beauty of interest or utility. He writes: "The foundation of this theory [Hume's theory of beauty in the Treatise and An Enquiry Concerning the Principles of Morals] is the division of beauty into two classes, the first that of pleasurable sentiment caused by an immediate response—that is, a response not mediated by the intervention of imagination or judgment—to the form or other perceptual qualities of an object, and the second that of pleasurable sentiment, which arises only when the perception of the form of an object is supplemented by a concept or concepts brought to bear on it by imagination or judgment." ("The Standard of Taste and the 'Most ardent Desire of Society,'" p. 46). What Guyer identifies as a distinction between kinds of beauty is for Hume a distinction between sources of ideas, however. The second kind of beauty requires reflection and the combination of other ideas. For Hume, there are not two kinds of beauty but two ways that the ideas of beauty, which is just a form of pleasure, are sorted. Reservations about Guyer's perspective on the earlier history of aesthetics do not detract from the interest of his analysis, however, which is always careful and detailed.The central eight essays labeled "Mostly Kant" trace themes that Guyer has treated in much greater detail in his earlier books. Two central themes are especially prominent throughout these essays. This comparative case analysis contrasts two nations – Viet Nam and The United States of America (U.S.) – in terms of processes each employed and results each achieved in respective response to the COVID-19 pandemic. We use a general theory of teaching to contrast the countries in terms of their approaches to COVID public health education. Viet Nam followed the recommendations of the theory. The U.S. did not. While our analysis does not and cannot prove educational theory acted as the (...) sole causal factor in realization of the disparate results in the countries, our case study does illustrate that the different approaches to public health education used by the countries may be counted among factors contributing to wide differences in the contrasting cases. The argument proceeds by 1) describing differences in relevant statistics between Viet Nam and the U.S., 2) outlining the theory of teaching we use to analyze differences in public health education in the two contexts, and 3) discussing successful implementation of the theory in Viet Nam and failure to implement in the U.S. Finally, we 4) dismiss competing explanations of differences between the countries and 5) offer considerations about how the U.S. may educate citizens away from turning the pandemic into a pan(en)demic.
