Authentic objects are those that have a historical link to a person, event, time, or place of some significance. The current study examines everyday beliefs about authentic objects, with three primary goals: to determine the scope of adults' evaluation of authentic objects, to examine such evaluation in two distinct cultural settings, and to determine whether a person's attachment history predicts evaluation of authentic objects. We found that college students in the UK and the USA consistently evaluate a broad range of (...) authentic items as more valuable than matched control objects, more desirable to keep, and more desirable to touch, though only non-personal authentic items were judged to be more appropriate for display in a museum. These patterns were remarkably similar across the two cultural contexts. Additionally, those who had an attachment object as a child evaluated objects more favorably, and in particular judged authentic objects to be more valuable. Altogether, these results demonstrate broad endorsement of "positive contagion" among college-educated adults. (shrink)

Nicholas Makins makes a valuable contribution to the literature on medical decision-making, highlighting the role that risk attitudes play in deliberation and subsequently arguing that, in medical choices under uncertainty, if considerations of autonomy and beneficence support deference to patient values and outcome preferences then they also support deference to patients’ attitudes to risk.1 Crucially, however, Makins suggests that it is not simply first-order risk attitudes that are the appropriate target of deference but, rather, patients’ higher-order risk attitudes. In other (...) words, Makins argues that if considerations of autonomy and beneficence support deference in medical decision-making, this deference should include the risk attitudes that individuals desire to have or reflectively endorse. This commentary draws out a morally relevant and overlooked distinction between: (1) deferring to patients’ higher-order attitudes that endorse the first-order risk attitudes they currently hold. and (2) deferring to patients’ higher-order attitudes that endorse risk attitudes that are at odds with the first-order risk attitudes they currently hold (which equates to a higher-order desire to change one’s first-order risk-attitudes). I agree with Makins that if respect for autonomy and beneficence support deference to patient preferences, then these considerations may also support deference to at least some higher-order risk attitudes, namely, those of type (1). This essay investigates the way in which Wolff takes an interest in the hypothesis of an emendatio of the prima philosophia from Leibniz’s incitement in De primae philosophiae emendatione, et de notione substantiae (1694) to re-found metaphysics. This makes it possible, secondly, to examine the way in which Wolff takes Johannes Clauberg’s ontology as a model, even though it represents in his view only a failed attempt at that same emendatio. Through the analysis of the texts, this article considers the (...) possibility of a new reading of the ‘failure’ attributed by Wolff to Clauberg, which would consist in his having ‘emended’ first philosophy by expelling it from the domain of ontology and finally identifying it with Cartesian prima philosophia. The method chosen here draws on concepts borrowed from sociology and anthropology. This double conceptual approach is necessary for a society divided between values inherited from medieval Christianity and precapitalist practices. Seventeenth-century France did not think of itself as a class society but as a society of orders. Since sociology is a system of knowledge whose concepts are taken from an imaginary construct, it is thus more suited to analyzing bourgeois society than societies in transition.6 In trying to measure the (...) past with the aid of tools forged in and for contemporary societies, the sociologist runs the risk of only measuring an artifact, produced by his theories in the field of history. Hence the need for the anthropological concepts, including the notion of exchange, among others, whether material , symbolic , or sexual .This approach will bring to light the contradictions underlying the society of the ancient régime. Whereas an ordinary sociohistorical approach views the reign of Louis XIV as unified under a dogmatic classicism, the socioanthropological approach stresses the tensions and oppositions running through this society. Classicism appears then as a façade covering up the change that it cannot imagine. This “spectacle”7 makes it possible to unite contradictory social practices, both those produced by consumption and which originate in the medieval economy and those belonging to the early accumulation of capital which sketch future bourgeois economic practices. 6. These notes of G. E. Moore's lectures for the three terms of 1934-1935 were compiled by Alice Ambrose, then Student of Newnham College, and Margaret Macdonald, then Fellow of Girton College. The lectures cover a wealth of interrelated topics, and provide instances of the analyses which made Moore «the father of the analytic school.» Since his analyses of such concepts as material objects, sense data, and truth rest on the ordinary use of expressions for these concepts, «ordinary language» philosophers (...) found in him their champion. In this short essay, I suggest a few specific ways in which criminal law exceptionalism has shaped the theory and practice of criminal law. First, criminal law exceptionalism isolates criminal theory from legal theory more generally, with the result that criminal theorists often miss insights from other legal fields. Relatedly but more broadly, criminal law exceptionalism can make sociology, psychology, history, and political theory invisible or seemingly irrelevant to criminal theory. Together, these two forms of scholarly insularity put criminal theory (...) (or criminal theorists) into a silo in which the political, social, and historical contexts of actual criminal legal practices disappear from view. Ultimately, the siloed thinking of criminal law exceptionalism makes it difficult or impossible to contemplate a world without criminal law. Thus criminal law exceptionalism does its ideological work: it produces and reinforces the belief that criminal law is indispensable, a belief that in turn motivates policy choices and informs legal practices. One of two commentaries on “Normalizing Atypical Genitalia: How a Heated Debate Went Astray,” by Josephine Johnston, from the November‐December 2012 issue.

A recent study by P.R. Blum suggests the hypothesis of an ideal line from Scotus to Mastri, passing through Perera, which would tend towards a new concept of metaphysics attainable through the use of abstraction by indifference. This essay intends to test this hypothesis starting from the way in which Perera questions the unity of metaphysical abstraction through a series of innovative interpretations that are widely received in both Catholic and Reformed and Protestant domains. A first interpretation, less radical, advances (...) a model of metaphysical abstraction, taken up by Mastri and Micraelius, which maintains the unity of metaphysics; a second interpretation, more radical, breaks the methodological unity of metaphysics through a clear distinction between ‘real’ abstraction from matter (secundum rem et rationem) and ‘mental’ abstraction by indifference (secundum rationem tantum) and, consequently, between metaphysics and ontology. Political theorists imagine a world without government in order to assess the legitimacy of existing states. Some thinkers, such as philosophical anarchists, conclude that in fact no state can be justified. Should theorists of criminal law similarly imagine away the very thing they seek to theorize? Doug Husak has claimed that “the object of criminal theory is to offer suggestions to improve the content of the criminal law … not to abolish it.” But this Essay argues that abolitionist-leaning scholarship reflects (...) several welcome developments in criminal theory: a concern with the state; attention to empirical data and the distinction between normative claims and descriptive ones; recognition of enforcement as an essential element of criminal law; and above all, a demand that criminal law prove itself—a refusal to grant to criminal law a presumption of legitimacy. These theoretical orientations did not appear for the first time in abolitionist scholarship. In fact, all are calling cards of Husak’s own work, and cause to celebrate it. (shrink)

L’anthropologie philosophique est l’un des fronts sur lesquels s’est développée, ces dernières années, la critique du libéralisme politique : à la figure d’un sujet rationnel et souverain, déjà autonome, certains courants de la théorie politique ont tenté d’opposer une conception alternative du sujet et c’est dans ce contexte qu’a émergé la thématique de la vulnérabilité dont le développement est apparu comme le fondement éventuel d’un dépassement de la problématique libérale. On ne s’étonnera pas de voir la référence à la vulnérabilité (...) figurer en bonne place dans la réflexion néorépublicaine et en particulier dans la théorie de liberté comme non-domination élaborée par Philip Pettit. Comment les néorépublicains définissent-ils la vulnérabilité et quel statut lui accordent-ils ? Quel rôle la vulnérabilité joue-t-elle dans la définition d’une perspective républicaine originale et dans l’élaboration d’une conception non libérale de l’autonomie ? Que nous apprend-elle enfin sur les limites éventuelles du projet néorépublicain ? C’est à ces questions que tentent de répondre les deux articles rassemblés ici. Ces deux textes correspondent aux deux volets d’une étude sur le statut de la catégorie de la vulnérabilité dans la théorie néorépublicaine. Le premier article (« Vulnérabilité, non-domination et autonomie : l’apport du républicanisme ») correspond au volet proprement analytique de notre étude : il propose un état des lieux du statut de la vulnérabilité dans le cadre des théories néorépublicaines, de Pettit à Iseult Honohan, en passant par John Maynor... L’examen de l’articulation entre vulnérabilité et non-domination met en lumière les ressources du néorépublicanisme et son potentiel d’élargissement (via l’intégration des problématiques socialistes, multiculturalistes, écologistes et féministes). Le second article (« Vulnérabilité, non-domination et autonomie : vers une critique du néorépublicanisme ») part de la manière dont les néorépublicains ont souligné la convergence entre l’autonomie telle qu’elle est pensée à l’aune de la non-domination et les approches relationnelles de l’autonomie. Il s’agit pour nous d’interroger ce rapprochement et par là de dégager certaines limites de l’approche néorépublicaine de la vulnérabilité en la confrontant de façon systématique à d’autres conceptions mises en avant dans la théorie des capabilités, dans les théories de la reconnaissance et dans les éthiques du care. The aim of the paper is the comparison of the conceptions of Emmanuel Levinas and Maurice Blanchot, which should serve as a basis of the further contemplation of the relationship between the thinking and experience. The shared critical view of the phenomenological interpretation of experience leads both philosophers to an alter- native conception, in which experience transcends thinking and in face of such an experience the reality is an alterity. However, the experience of alterity, which under- lines the wholeness and (...) temporal unity of all human thinking, is conceived differently, resulting in different conceptions of subjectivity: With Levinas the domi- nating role is played by humankind as the opposite of the nonhuman, while with Blanchot the dichotomy is dissolved. His conception is thus a challenge to conceive the experience, thinking and reality beyond the human/nonhuman dichotomy. (shrink)

. Gender is a social construct. Technically, it is a grammatical structuring category that may refer to sex, as is typical of Indo‐European languages, or to another set of features such as animate versus inanimate, as is typical of Algonkian languages. Gender in language forces speakers of the language to be continually conscious of application of the category, and they tend to project the categorization into their experience of the world and collocate observations under these broad categories. Western science has (...) been developed by speakers of Indo‐European languages employing male/female genders, and in a cultural tradition that at least since the time of Classical Greece has collocated male with active, creative, rational, and public /dominant , and female with passive, irrational/emotional, and private /subordinate. Religion and science‐organons for rendering existential experience intelligible‐have always been used by the dominant class as instruments of power, and therefore in Western cultures have been entangled with legitimization of a congeries of concepts collocated with male gender. This paper illustrates the social construction of this congeries by contrasting it with non‐Western usages and valuations. (shrink)

Philosophers commonly say that beliefs come in degrees. Drawing from the literature, I make precise three arguments for this claim: an argument from degrees of confidence, an argument from degrees of firmness, and an argument from natural language. I show that they all fail. I also advance three arguments that beliefs do not come in degrees: an argument from natural language, an argument from intuition, and an argument from the metaphysics of degrees. In this paper, I present and defend a novel account of doubt. In Part 1, I make some preliminary observations about the nature of doubt. In Part 2, I introduce a new puzzle about the relationship between three psychological states: doubt, belief, and confidence. I present this puzzle because my account of doubt emerges as a possible solution to it. Lastly, in Part 3, I elaborate on and defend my account of doubt. Roughly, one has doubt if and only if (...) one believes one might be wrong; I argue that this is superior to the account that says that one has doubt if and only if one has less than the highest degree of confidence.
