We create a database of company codes of ethics from firms listed on the Standard & Poor's 500 Index and, separately, a sample of small firms. The SEC believes that "ethics codes do, and should, vary from company to company." Using textual analysis techniques, we measure the extent of commonality across the documents. We find substantial levels of common sentences used by the firms, including a few cases where the codes of ethics are essentially identical. We consider these results in (...) the context of legal statements versus value statements. While legal writing often mandates duplication, we argue that value-based statements should be held to a higher standard of originality. Our evidence is consistent with isomorphic pressures on smaller firms to conform. (shrink)

A limiting factor in ethics education in medical training has been difficulty in assessing competence in ethics. This study was conducted to test the concept that content analysis of pediatric residents’ personal reflections about ethics experiences can identify changes in ethical sensitivity and reasoning over time. Analysis of written narratives focused on two of our ethics curriculum’s goals: 1) To raise sensitivity to ethical issues in everyday clinical practice and 2) to enhance critical reflection on personal and professional values as (...) they affect patient care. Content analysis of written reflections was guided by a tool developed to identify and assess the level of ethical reasoning in eight domains determined to be important aspects of ethical competence. Based on the assessment of narratives written at two times (12 to 16 months/apart) during their training, residents showed significant progress in two specific domains: use of professional values, and use of personal values. Residents did not show decline in ethical reasoning in any domain. This study demonstrates that content analysis of personal narratives may provide a useful method for assessment of developing ethical sensitivity and reasoning. (shrink)

These notes of G. E. Moore's lectures for the three terms of 1934-1935 were compiled by Alice Ambrose, then Student of Newnham College, and Margaret Macdonald, then Fellow of Girton College. The lectures cover a wealth of interrelated topics, and provide instances of the analyses which made Moore «the father of the analytic school.» Since his analyses of such concepts as material objects, sense data, and truth rest on the ordinary use of expressions for these concepts, «ordinary language» philosophers (...) found in him their champion. In this paper I argue for a distinction between subjective and value laden aspects of judgements showing why equating the former with the latter has the potential to confuse matters when the goal is uncovering the influence of political influences on scientific practice. I will focus on three separate but interrelated issues. The first concerns the issue of ‘verification’ in computational modelling. This is a practice that involves a number of formal techniques but as I show, even these allegedly objective (...) methods ultimately rely on subjective estimation and evaluation of different types of parameters. This has implications for my second point which relates to uncertainty quantification—an assessment of the degree of uncertainty present in a particular modelling scenario. I argue that while this practice also involves subjective elements, in no way does that detract from its status as an epistemic exercise. Finally I discuss the relation between accuracy and uncertainty and how each relates to judgements that embody social/ethical/political concerns, in particular those associated with high consequence systems. Some very persuasive arguments have been put forward in recent years in support of the disunity of science. Despite this, one is forced to acknowledge that unification, especially the practice of unifying theories, remains a crucial aspect of scientific practice. I explore specific aspects of this tension by examining the nature of theory unification and how it is achieved in the case of the electroweak theory. I claim that because the process of unifying theories is largely dependent on particular kinds (...) of mathematical structures it is possible to have a theory that displays a degree of unity at the level of theoretical structure without an accompanying ontological unity or reduction. As a result, unity and disunity can coexist not only within science but within the same theory. (shrink)

By observing how fatalism expresses itself in one's daily life, in everything from table manners to shopping to sport, the book proposes ways to limit its influence.

The aim of this paper has been to contribute to the ongoing discourse on skill, know-how, and expertise in the sporting world by posting an alternative view, one that explores the meaningfulness of difference from the outlook of difference. Hence, my ambition was to put focus on how we look at difference in the sporting world and, subsequently, to set the stage for expanding the analytical framework we use in exploring sports today. Essentially, my argument is based on an assumption (...) that the prevailing paradigm of sports is constructed and continuously redeveloped on the grand narrative of modernity emphasizing sameness over difference, and consequently, leaving sportification as its evolutionary footprint. Accordingly, in pursuit of an alternative, I have utilized a postmodern outlook with emphasis on emancipation, deconstruction, vocabulary, dialog, diversity, and aesthetics as the analytical framework in constructing a narrative of difference, rather than sameness. This paper presents empirical data which allow us to examine how ethical aspects influence ethical consumers’ brand choices on technology-based products,such as washing machines, fridge freezers, and cars. Predicted by the literature review, the majority of our interviewees did make their brand choice based onreliability. However, we found that ethical consumers’ concept of reliability includes not only functionality but also ethical values. The results suggest that we have to reconsider whether considerations of companies’ ethical standards are the only indicators of (...) brand choice as a shortcut of the assessment of business ethics or whether various forms of ethical considerations including ethically reconstructed reliability can also a contribute to this. John Ziman-- the much-missed-- reminds us that 'no man is an island', and takes us to task for working from an individualistic theoretical base. That 'us' includes nearly all social scientists, and most Anglo-American philosophers too. For sure, it includes cognitive scientists, who theorize people in terms of concepts drawn from cybernetics and/or artificial intelligence. (I'll use the term 'computational concepts' broadly, to cover both types.) Indeed, it's a common complaint that cognitive science is overly individualistic.

Seventeenth century philosophers were pre-occupied with the justification for the use of coercion; the nature and scope of the citizen's duty to obey the law was a central concern. The typical philosophical accounts which attempt to articulate the conditions under which a citizen has an obligation to obey the law tend to fall into two camps: those that ground the obligation to obey the law in consent, and those that ground it in benefits received, or possibly a combination of both. (...) More recently, however, some have argued that questions about the obligation to obey the law have been eclipsed by questions about distributive justice. Many leading figures in modern analytic jurisprudence remain concerned with the nature of political obligation. Joseph Raz is a current-day theorist who has recognized the importance of this issue and the need for an answer that is not over-simplistic. Recently Raz has re-examined his account in ?The Problem of Authority: Revisiting the Service Conception, - making an exploration of his theory particularly timely. Raz argues that all governments claim morally legitimate authority, but not all of them actually possess it. His theory seeks to give us the tools by which to distinguish the legitimate claims from imposters. The complexity and flexibility of Raz's understanding of the nature and scope of the individual's obligation to obey the law accounts for its appeal. Upon closer inspection, however, difficulties emerge. I argue that Raz's theory is plagued by a deep-seated tension between his two central theses: the pre-emption thesis and the normal justification thesis. While I explore both theses in further depth, the gist of the pre-emption thesis is that it requires a pre-commitment to authority in order for the law?s mediating role to be performed. Conversely, the normal justification thesis invites a case by case assessment of the bindingness of norms. I argue that instead of offering us a unified conception of authority, Raz vacillates unstably between two models - a consent-based model and a benefits received model. I demonstrate that this tension is ineradicable because the theses are connected to divergent models of law and incompatible methodologies. (shrink)

Much of the recent psychological literature on boredom aims to define, categorize, and measure boredom in order to assess it, to identify correlated mental pathologies, to find the psychophysiological bases of boredom, or to apply the findings to specific settings or social groups. This literature uses both quantitative and qualitative methods to seek an objective, scientific understanding of boredom. It presupposes that boredom is an aversive, individual experience, which psychology can help ameliorate, prevent, or divert. By contrast, Kierkegaard uses his (...) methods of ‘experimenting psychology’ and ‘indirect communication’ to deploy boredom in awakening his reader to the task of becoming a self. He uses literary devices and exemplary characters to this end. Heidegger pursues a similar aim: to awaken the reader/listener to the possibility of attuning herself to profound boredom in a way that will enable her to become an authentic self. Heidegger uses a method of historical, hermeneutic phenomenology to enable his reader to hear the call of being through an attunement to profound boredom. He starts with the familiar experience of boredom, then defamiliarizes his listener to enable an original grasp of the meaning of being. (shrink)

In Stoic theory, the principal affective response of the wise person is joy, the virtuous counterpart to the problematic pleasure or delight of ordinary agents. Close attention to Seneca’s usage in the Moral Epistles reveals that while he often speaks of joy as a central element of the normative life, he employs more than one philosophical conception of gaudium, and not from casualness, because each conception coheres in its own way with Stoic orthodoxy. These inconsistencies in his handling of an (...) idea he cares about can provide clues to his working methods and, ultimately, to differences of approach he had found in treatises of Hellenistic and Roman philosophy on such subjects as ethics and friendship.
