The presence of the past is of prime importance in today's Mexican society. According to José Fuentes Mares, among the “peoples of the world the Mexican is the one who lives history the most”. With regard to the unsatisfactory relations between Mexico and North America, the journalist Alan Riding asks himself: “How can a people who relish the past to the point of intoxication understand another that looks constantly to the future?” In the Republic of Mexico, according to him, (...) “the entire past of the country throws a dense shadow over the present”. Conforming to a universal custom, every country divides its present past into four groups (survival, residues, memories and history), but in few nations are the four groups as copious as in this one. Although Mexico is rapidly shedding many old customs and is selling residual objects to foreign collectors on the sly, its historical treasure is still enormous, perhaps the largest in the world. In Alan Bennett’s play The History Boys, Irwin, a sixth-form history tutor destined for a media career (based, it is rumored, on that specialist in historical controversy Niall Ferguson) sets out his views on how a difficult change in the law that will affect individual rights should be dealt with. When agents insert technological systems into their decision-making processes, they can obscure moral responsibility for the results. This can give rise to a distinct moral wrong, which we call “agency laundering.” At root, agency laundering involves obfuscating one’s moral responsibility by enlisting a technology or process to take some action and letting it forestall others from demanding an account for bad outcomes that result. We argue that the concept of agency laundering helps in understanding important moral problems in a number (...) of recent cases involving automated, or algorithmic, decision-systems. We apply our conception of agency laundering to a series of examples, including Facebook’s automated advertising suggestions, Uber’s driver interfaces, algorithmic evaluation of K-12 teachers, and risk assessment in criminal sentencing. We distinguish agency laundering from several other critiques of information technology, including the so-called “responsibility gap,” “bias laundering,” and masking. (shrink)

In this paper, we argue that there are important ethical questions about healthcare improvement which are underexplored. We start by drawing on two existing literatures: first, the prevailing, primarily governance-oriented, application of ethics to healthcare ‘quality improvement’ (QI), and second, the application of QI to healthcare ethics. We show that these are insufficient for ethical analysis of healthcare improvement. In pursuit of a broader agenda for an ethics of healthcare improvement, we note that QI and ethics can, in some respects, (...) be treated as closely related concerns and not simply as externally related agendas. To support our argument, we explore the gap between ‘quality’ and ‘ethics’ discourses and ask about the possible differences between ‘good quality healthcare’ and ‘good healthcare’. We suggest that the word ‘quality’ both adds to and subtracts from the idea of ‘good healthcare’, and in particular that the technicist inflection of quality discourses needs to be set in the context of broader conceptualisations of healthcare improvement. We introduce the distinction between quality as a measurable property and quality as an evaluative judgement, suggesting that a core, but neglected, question for an ethics of healthcare improvement is striking the balance between these two conceptions of quality. For two thousand years the Mencius was revered as one of the foundational texts of the Confucian canon, which formed the basis of traditional Chinese education. Today it commands considerable attention in current debates on "Asian values" raging in classrooms and boardrooms in both East Asia and the West. This volume, which represents the work of fifteen respected scholars of early Chinese thought and culture, is an especially timely effort to bring the Mencius under fresh scrutiny. Making use of recently (...) excavated manuscripts, the contributors approach the Mencius from novel perspectives, challenge established interpretations, and confront anew issues that continue to attract and divide students of this classic text. The famous Mencian doctrine of the "goodness" of human nature forms one main focus. Questions of context and interpretation bring into sharp relief key hermeneutical issues that surround the text. The structural-systematic philosophy requires a moral theory. This essay seeks to determine whether either of two recent works, Joshua Greene’s Moral Tribes and Michael Tomasello’s A Natural History of Human Morality, should influence that theory. It first argues that Greene’s fails to make its case for utilitarianism over deontology. It then argues that Tomasello’s thesis that early humans developed moralities of sympathy and fairness, particularly when taken in conjunction with aspects of Alan Gewirth’s moral theory, fits well with the (...) moral theory envisaged by extant works on the structural-systematic philosophy. The concept of missed care refers to an irrefragable truth that required nursing care, which is left undone, occurs in the delivery of health care. As a technical concept, missed care offers nurses the opportunity to articulate a problematic experience. But what are we to make of missed care from an ethical perspective? Can nurses be held morally responsible for missed care? Ethically speaking, it is generally accepted that if a person has a moral obligation to do something, s/he needs (...) to have the capacity to do it. If a person does not have the capacity to fulfil a moral obligation, then s/he cannot be held responsible for failing to do so. This is captured by the “ought implies can” (OIC) principle. This paper brings the OIC principle to the forefront of the discussion on missed care. It is contended that nurses – qua moral agents – may be discharged from a moral obligation to carry out a required caring act because of some inability that is not of their making and therefore may not be morally responsible for missed care. However, the OIC principle may not be applied to all situations of missed care depending on their causes. In addition, following in the thought of Sapontzis (The Southern Journal of Philosophy, 1991, XXIX, 383–393) it is contended that when an original obligation to deliver a required act of care cannot be fulfilled, other obligations may be generated as summed up in the “Principle of Making Amends” and the “Principle of Appropriate Feeling.” It is the view of this paper that these further principles could prevent the OIC principle from being used to simply excuse omissions of care from a normative standard and could support the view that nurses continue to have alternative obligations to make amends and to respond with appropriate feelings to missed care. Although they were never to meet and corresponded only briefly, Catharine Macaulay and Mary Wollstonecraft shared a mutual admiration and a strong intellectual bond. Macaulay’s work had a profound and lasting effect on Wollstonecraft, and she developed and expanded on many of Macaulay’s ideas. While she often took these in a different direction, there remains a great synergy between their ideas to the extent that we can understand Wollstonecraft’s own feminist arguments by approaching them through the frameworks and ideas that (...) Macaulay provided. These included the principles of classical republicanism, particularly in its understanding of the values of freedom, equality and virtue, and an understanding of reason as grounded in immutable principles that apply equally to both sexes. On the question of women’s freedom and social equality with men, I argue that though Macaulay sets up the problem in far richer and more detailed philosophical terms, in the end it is Wollstonecraft that has the more compelling account of its far-reaching social implications and of how this might be addressed. Bertrand Russell’s conception of philosophy evolved dramatically in 1911 — the year he fell in love with Lady Ottoline Morrell. For many years Russell had been an ardent advocate of the view that philosophers ought to look for truths that are certain. The co-author of Principia Mathematica altered his commitment to certainty in philosophy in 1911. An analysis of his published views and correspondence from this time strongly suggests that the radical transformation was induced by an epiphany brought about by (...) his emotional entanglement with his lover. In the so-called reverse proportional reading :53, 1997), the truth conditions of statements of the form many/few \\ appear to make reference to the ratio of the individuals that are in the extensions of both \ and \ to the individuals that are in the extension of \. The analysis of such readings is controversial. One prominent approach assumes they are a symptom of many and few making reference to a context dependent standard of comparison. We observe that this initially (...) attractive approach systematically undergenerates, failing to capture pervasive reverse proportionality in environments that remove context dependency of the standard. Instead, we propose that reverse proportionality in such cases can arise from the underspecification of the measure function underlying the meanings of many and few. (shrink)

Building on Goldman 2008 and 2009, which argue that objective values would be strange in coming in degrees but in no determinate number of degrees, this paper argues that related properties having to do with degrees of value make a further case against objective values. The properties of giving rise to intransitive orderings and being essentially comparative are explained by Larry Temkin in Rethinking the Good. He shows that “better than” is intransitively ordered. Many subjective states are too. But similar (...) arguments for the intransitive orderings of intrinsic objective properties fail. Furthermore, subjective properties and states can change without these changes being explained by changes in their objects. This is similar to the essentially comparative nature of goodness. Given the analogies to subjective states and lack of analogies to objective properties that the present article points out, it argues that we should infer, as Temkin does not, that values are subjective. Although Joseph Priestley was notorious for rejecting much of orthodox Christianity and replacing it with a materialistic Unitarianism, in another respect he was an orthodox theist of his time in that he passionately upheld the Argument from Design. The Argument from Design was the heart of his “rational religion”. He contended that natural order, especially biological order, could only be successfully explained by intentional agency. At the time, however, the Argument was coming under attack, first from David Hume, then from (...) Matthew Turner, and lastly from Erasmus Darwin. Priestley replied to each of these critics. This article surveys his replies. The three critics of the Argument contended that intelligent agency could offer only a weak explanation of natural order or that natural order is self-explanatory or that natural mechanisms can explain biological order. Priestley in turn critiqued all three contentions, arguing that the Argument is a strong explanation; that natural order cannot be self-explanatory; and that the proposed natural explanations conflict with the empirical evidence. We propose that the ontic understanding of quantum mechanics can be extended to a fully realistic theory that describes the evolution of the wavefunction at all times, including during a measurement. In such an approach the wave equation should reduce to the standard wave equation when there is no measurement, and describe state reduction when the system is measured. The general wave equation must be nonlinear and nonlocal, and we require it to be time-symmetric; consequently, this approach is not a (...) new interpretation but a new theory. The wave equation is an integrodifferential equation (IDE). The time symmetry requirement leads to a retrocausal approach, in which the wave equation is solved subject to initial and final conditions to determine history at intermediate times. We propose that different outcomes from (apparently) identically prepared experiments may result from uncontrolled parameters; both the nonlocality and the retrocausality of the theory imply that Bell’s Theorem cannot rule out such “hidden variables.” Beginning with Hamilton’s principle, we demonstrate the construction of such a theory by replacing the action with a functional designed to give rise to a nonlinear, nonlocal IDE as the wave equation. This IDE reduces to the standard wave equation (a differential equation) in the absence of a measurement, but exhibits state reduction to a single eigenvalue when the system interacts with another system with the properties of a measurement apparatus. We demonstrate several desirable features of this theory; for other properties we indicate their plausibility and possible avenues to a proof. (shrink)

This is a “bottom-up” paper in the sense that it draws lessons in defining disciplinary categories under study from a series of empirical studies of interdisciplinarity. In particular, we are in the process of studying the interchange of research-based knowledge between Cognitive Science and Educational Research. This has posed a set of design decisions that we believe warrant consideration as others study cross-disciplinary research processes.

Este artículo es un estudio acerca de la elaboración de la teoría de la empatía de Edmund Husserl. Procura reconstruir dos de los hitos principales de las reflexiones sobre la empatía en cuanto que vivencia intencional aprehensora de una subjetividad ajena, a partir de una interpretación de textos póstumos sobre la intersubjetividad editados por Iso Kern en 1973 en los volúmenes XIII, XIV y XV de _Husserliana_. El primer hito es la discusión que a comienzos del 1900 Husserl entabla con, (...) por un lado, la teoría de la inferencia por analogía de Benno Erdmann –formulada originalmente por John Stuart Mill– y, por el otro, la teoría de la empatía como instinto de imitación y expresión de Theodor Lipps. El segundo es la reelaboración del concepto de empatía a partir de la fenomenología genética y el descubrimiento de síntesis pasivas a la base de los actos cogitativos del ego. Sostengo en este trabajo que estos dos jalones del pensamiento husserliano sobre la intersubjetividad no están completamente desvinculados: las nociones de analogía y de operaciones no-yoicias, tan importantes en el segundo período, estaban ya presentes a su manera en la interpretación crítica de las teorías de Erdmann/Mill y Lipps. Private law theory must confront the plurality of values that inform the problems that private law addresses in practice. We consider Hanoch Dagan’s and Michael Heller’s The Choice Theory of Contracts as a case-study in the promise and perils that embracing plural values poses for private law theory. We begin by arguing that private law theory cannot ignore value pluralism and identify three approaches that theory might take to pluralism. We call these approaches capitulating to, leveraging, and embracing value pluralism. (...) We illustrate each approach and assess its strengths and weaknesses. Theories that capitulate to pluralism simultaneously limit their scope and hamper their persuasiveness even within their restricted domains. Theories that leverage pluralism limit their domains more dramatically still. And theories that embrace pluralism are difficult to operationalize in practice without abandoning their pluralist roots. We briefly illustrate the drawbacks of capitulating to and leveraging pluralism with examples from recent contract theory. We then take up theories that embrace pluralism in greater detail, by studying Dagan and Heller’s approach. We argue that Dagan and Heller do not solve the deep problems that operationalizing their embrace of pluralism inevitably engenders. (shrink)

Despite the many differing perspectives possible regarding the concept of a property right, one central aspect is, arguably, the primal exclusionary impulse and its special connection to a particular form of subjectivity, especially in terms of how people feel about space, enclosed space and any subsequent property rules applicable. Such aspects limit speculative thought concerning the enactment of challenging housing reforms. This essay therefore asks: Why is exclusion so relevant to spatial ethics, and is it only a particular form of (...) subjectivity that is involved in the phenomena of exclusionary impulses? As a response, new speculative thoughts are proposed that aim at challenging such specialised subjectivity, exclusionary impulses and spatial engagement: re-sanctification of enclosed space, de-objectification of being and a call to develop new or alternative subjectivities and modes of somatic thought. “Is it heretical to conclude that a noble rather than a base motive lay at the core of the Jewish unwillingness to join the apostolic church?”.

Decision confidence is a prototypical metacognitive representation that is thought to approximate the probability that a decision is correct. The perception of being correct has also been associated with affective valence such that being correct feels more positive and being mistaken more negative. This suggests that, similarly to confidence, affective valence reflects the probability that a decision is correct. However, both fields of research have seen very little interaction. Here, we test if affect, similarly to confidence reflects probability that a (...) decision is correct in two perceptual decision-making experiments where we compare the relationships of theoretically relevant variables (e.g. evidence, accuracy, and expectancy) with both confidence and affect ratings. The findings indicate that confidence and affect ratings are similarly sensitive to changes in accuracy, evidence, and expectancy, indicating that both track the subjective probability that a decision is correct. We identify various mechanisms that can explain these results. We also envision future research for clarifying the role of cognitive and affective aspects of metacognition relying on deeper integration of the respective research fields. (shrink)

Mammalian cells frequently depend on homologous recombination (HR) to repair DNA damage accurately and to help rescue stalled or collapsed replication forks. The essence of HR is an exchange of nucleotides between identical or nearly identical sequences. Although HR fulfills important biological roles, recombination between inappropriate sequence partners can lead to translocations or other deleterious rearrangements and such events must be avoided. For example, the recombination machinery must follow stringent rules to preclude recombination between the many repetitive elements in a (...) mammalian genome that share significant but imperfect homology. This paper takes a conceptual approach in addressing the homology requirements for recombination in mammalian genomes as well as the general strategy used by cells to reject recombination between similar but imperfectly matched sequences. A mechanism of heteroduplex rejection that involves the unwinding of recombination intermediates that may form between mismatched sequences is discussed.
