The purpose of this research was to study the effect of administrative strategies on organizational sustainability of state enterprises in Bangkok Metropolitan Areas. The samples used in this study were 375 employees working in Thai state enterprises in Bangkok Metropolitan Areas. The research questionnaire was used as an instrument to collect data. Statistics used in this study consisted of percentage, mean, standard deviation, Correlation and Structural Equation Modeling (SEM). The research results showed that administrative strategies had an effect (...) on organizational sustainability of state enterprise in Bangkok Metropolitan Areas with Chi-square Probability equivalent to 0.073, which was less than 0.05; CMIN/DF equivalent to 1.207, which was less than 3; GFI equivalent to 0.961, which was more 0.90; and RMSEA equivalent to 0.024, which was less than 0.06. The results of statistical analysis indicated that the four statistical tests passed the evaluation criteria at good fit; it can be concluded that administrative strategies had an effect on organizational sustainability of state enterprises in Bangkok Metropolitan Areas, which can be presented as strategic management ((β = 0.89, p =.00), learning organization (β =.75, p =.00) and total quality management (β =.83, p =.00) respectively. When business organisations become involved in contributing to and resolving social issues, they enter areas traditionally seen as the purview of governments. In doing so, they begin to take on the expectations and responsibilities of government; they become politicised. This politicisation is a product of business’s success and power and appears largely unavoidable. Adopting Matten & Crane’s (2005a) extended view of corporate citizenship, business organisations’ responsibilities extend to the administration of citizens’ social, civil and political rights. Drawing upon the agenda of Margolis and Walsh (2003), we seek to enhance the understanding of how business navigates its responsibilities within the social governance gap, including its function as a significant actor influencing societal development and wellbeing. Having been supressed and denied their rights by successive Syrian governments over the years, Syrian Kurds are now asserting a de facto autonomy. Since the withdrawal of the Syrian President's forces from the ethnically Kurdish areas in the early months of the current civil war, the inhabitants have declared a self-rule government along the lines of the Kurdistan regional government in northern Iraq. All organizations have gray areas where the border between right and wrong behavior is blurred, but where a major part of organizational decision-making takes place. While gray areas can be sources of problems for organizations, they also have benefits. The author proposes that gray areas are functional in organizations. Gray areas become problematic when the process for dealing with them is flawed, when gatekeeper managers see themselves as more ethical than their peers, and when leaders, by their own inattention, inaction, (...) and poor modeling, minimize the importance of building a moral community by delegating gray area issues to second-tier administrators. There has been much debate regarding the 'double-effect' of sedatives and analgesics administered at the end-of-life, and the possibility that health professionals using these drugs are performing 'slow euthanasia.' On the one hand analgesics and sedatives can do much to relieve suffering in the terminally ill. On the other hand, they can hasten death. According to a standard view, the administration of analgesics and sedatives amounts to euthanasia when the drugs are given with an intention to hasten death. In this (...) paper we report a small qualitative study based on interviews with 8 Australian general physicians regarding their understanding of intention in the context of questions about voluntary euthanasia, assisted suicide and particularly the use of analgesic and sedative infusions (including the possibility of voluntary or non-voluntary 'slow euthanasia'). We found a striking ambiguity and uncertainty regarding intentions amongst doctors interviewed. Some were explicit in describing a 'grey' area between palliation and euthanasia, or a continuum between the two. Not one of the respondents was consistent in distinguishing between a foreseen death and an intended death. A major theme was that 'slow euthanasia' may be more psychologically acceptable to doctors than active voluntary euthanasia by bolus injection, partly because the former would usually only result in a small loss of 'time' for patients already very close to death, but also because of the desirable ambiguities surrounding causation and intention when an infusion of analgesics and sedatives is used. The empirical and philosophical implications of these findings are discussed. (shrink)

Service providers working for a service organization are asked to express such positive emotions as joy, pleasure, and politeness required at the organizational level rather than their natural emotions they are experiencing at the moment. They cannot express their emotion they are actually going through and accordingly, their level of emotional labor and emotional dissonance influence on their job commitment and trust toward their organization. This study thus set out to investigate the effects of leading variables of emotional labor on (...) the level of emotional labor and the impact of emotional labor on organizational trust and organizational commitment with a subject group of college administrative staffs. Three underlying factors such as job stress, intimacy, and professionalism were identified as the determinants of emotional labor. Conceptual background about job stress, intimacy, emotional labor, and organizational effectiveness as the core variables of the study was investigated. Based on the conceptual background and our research questions, 5 research hypotheses and the proposed research model regarding the effects of emotional labor on organizational commitment and trust were developed. We also tried to include the moderating effects of work environment and gender of service providers on the research model. Unlike many different studies on emotional labor from the traditional perspective of service, this study also offers a practical implication by expanding and applying it to the field of college administrative service, which is an area where service providers are in the different working environment from the traditional company work environment. The purpose of the study is to reveal the essence of digital technologies in the municipal government system, to identify the main problems of their transformation in the territory of the subjects, and to develop directions for the mechanism of adaptation of the relationship between different management structures in the conditions of digitalization of processes. The article considers the author's vision of the development of digital technologies in the territorial aspect. In particular, the problems of technical equipment of remote territories (...) are considered, in particular, the problems of training personnel and territorial access to Internet resources are touched upon. When evaluating the legislative and regulatory acts of the Russian Federation, it is clear that digital technologies require a separate approach to solving problems of both legal and economic nature, while we focus on their relationship. It is obvious that when developing the strategic direction of digital technologies, the adapted elements require some adjustments and additions, which is currently being carried out. Such changes and additions are promoted not only through legislative and regulatory activities, but also on the basis of scientific research, which in turn develop new directions that contribute to solving problems in the development of digital technologies, not only in the management system, but also in the areas of business, professional education, training and retraining of personnel, etc. As a result, the identified problems in the resource provision of digital technologies allowed us to develop measures that specify the strategic direction. In response to the assumptions of new public management models and public or good governance, practical aspects of research in the area of public admin­istration and the development possibilities of qualitative research methods are presented in the article. Due to the fact that qualitative research has become increasingly popular in the above disciplines, data archiving and trans­parency is discussed, and guidelines and principles are established. However, there is a lot of controversy among scholars, and some examples are missing. This (...) paper presents the challenge of ‘openness’ in the empirical activities of researchers. Its purpose is to present the archiving data potential from in-depth interviews on the example of a small set of qualitative data from research in the field of public administration. Firstly, the basic assumptions of new models of functioning of public administration and related consequences for researchers are described. In the second part, the challenges related to openness in contemporary public administration models are briefly mentioned. Next, the method of creating an archive from existing data, individual stages, documents, and data is outlined; it is based on the au­thor’s best practice on Qualidata and DA-RT principles.1 The summary includes examples of probable opportunities and challenges related to usage of data archiving for the research in public administration and political science development. This article describes and analyzes the design and functioning of the Statistical Ethics System (SETE) in Colombia’s National Statistical Office. It presents the methodology and general process of planning and implementation of the System, supported by a conceptual analysis of the requirements for an ethical functioning of official statistics. The general objective of the article is to make a practical contribution to the understanding of conceptual and practical features that ought to be considered in the implementation of an ethical system (...) in the operation of the public sector, particularly in the area of the production of official statistics. The text is divided into five parts. In the first part, we make a general introduction to the ethical value of official statistics. In the second and third parts, we make a presentation and analysis of the principles and risks that were selected as the basic ethical framework for the production of official statistics at the National Administrative Department of Statistics (DANE). Immigration law is exceptional enough to deserve an administrative law focus of its own. The Administrative Procedure Act (APA) does not demand uniformity in adjudication. Therefore, it may be counterintuitive to argue that any one area of administrative adjudication is exceptional. Removal adjudication is indeed exceptional because it is an extremely dysfunctional system, it operates in a double void of fewer constitutional protections and without the protections of the APA, it relies on a vast network of (...) civil detention, and it is of a different genre than the type of regulation that drove the development of the APA. Given the profound public health and economic ramifications of decisions made by the U.S. Food and Drug Administration, the degree to which FDA activities should reflect an approach founded on complete transparency versus one focused on preserving confidentiality of information deserves public discussion. On one hand, reasonable requirements for transparency are critical to stimulating effective innovation, knowledge dissemination, and good business practice. On the other, ensuring the vitality of the medical products industry requires protecting legitimately proprietary information. With current standards (...) reflecting a lengthy accumulation of legal, regulatory, and practical precedent, recent significant changes in the environment in which the FDA operates should prompt a critical examination of current practices. In this article, I comment on Sharfstein and colleagues’ “Blueprint for Transparency,” which calls for multiple specific actions to increase transparency at the agency across five key areas, including interactions between FDA and industry, public disclosure of internal FDA analyses, deliberations concerning generics and biosimilars, expanded access to raw study data, and approaches to countering misleading information in the public sphere. I evaluate these recommendations in light of my experience as a clinician, researcher, and former FDA Commissioner, and reflect on possible outcomes that could result from enacting these practices. The “smart village” flourishes – at least in policy papers that envision the revitalization of rural areas through the civic deployment of networked media and telecommunications. Yet, while such aspirations are widespread, little is known about the views of those tasked with supervising and supporting digitally driven public participation for rural progress. To address the lack of insight into what these intermediary administrators conceive as catalysts and challenges for the realization of smart village conceptions, we surveyed representatives of regions in (...) Germany who oversee rural development schemes, most notably within the European LEADER framework. For these key actors, digital participation does not mainly hinge on broadband access and IT availability. Instead, they emphasize the importance of human and administrative resources as well as multi-actor collaboration, which we discuss in terms of digital readiness, digital willingness, and digital activity. Building the smart village, we conclude, seems not so much a matter of technological infrastructure, but rather of sociotechnical infrastructuring. (shrink)

This paper explores a grey area of psychiatric practice and, as with other challenging practices, the law is called upon to navigate conflicting legal issues. In particular, this paper explores the covert administration of medication: the concealment of medication in food or drink so that it will be consumed undetected. Rights-based approaches support nuanced understanding of the practices. Few policies, protocols or guidelines govern the practice in Ontario's psychiatric settings. While covert medication is understood to have “something to do” (...) with rights, there is confusion about how those rights play out on the ground. Institutional silences underlie and reinforce the practice. Most pressing, the covert administration of medication warrants an overt discussion, including of its impact on the rights-experience of persons in psychiatric settings. (shrink)

Tort claims have been studied for various reasons. Several studies have found that most tort claims are not related to negligent adverse events and most negligent adverse events do not result in tort claims. Several studies have examined the disposition of tort claims to understand the likelihood of payment once a claim has been made. Still others have proposed that tort-claims trend analysis may help administrators target their quality-improvement efforts and identify problems with quality that would not otherwise be captured.In (...) this article, we conduct a tort-claims analysis to explore areas for quality improvement, specifically for patient safety, in the Veterans Health Administration. Patient safety is an increasingly highlighted aspect of health-care delivery. Failure to assure patient safety can result in bad clinical outcomes, additional costs of care, and a negative organizational image. Filing a tort claim is one way for an individual to express concern about an organization. For our analysis, we draw from resolved tort claims in the Veterans Health Administration from fiscal years 1989 to 2000. (shrink)

This study came to complete the role that previous researchers began by focusing on strategic planning and linking it to an effective school administration in secondary public schools in Saudi Arabia to reach results and recommendations that may benefit principals, supervisors, and workers in the field of education. The study used the descriptive analytical approach and developed a questionnaire as an instrument, which was administered to 122 school principals from public schools in Saudi Arabia. The results concluded that the five (...) areas each received a very high relative weight, and this reinforces the importance of school principals using strategic planning in their schools because of its great benefit in increasing the effectiveness of school administration. The findings showed no statistically significant differences between the averages of the study sample’s estimates on the role of strategic planning in increasing the effectiveness of school administration due to years of experience, as all school principals need strategic planning because of its importance and because of its novelty, which limits the number of years of service. In seventeenth-century France, Colbert built a more effective state administration not by rationalizing state offices but by using public documents to increase the government’s intellectual capacity to exercise logistical power and engage in territorial governance. This pattern calls into question Weber’s model of the genesis of “modern officialdom,” suggesting that its source was not social rationalization, but rather the identification and management of expertise. Colbert recruited into government nascent technocrats with knowledge useful to territorial politics, using contracts and other documents (...) to limit their independence and subordinate them to patrimonial authorities. They exercised specific duties and impersonal powers in jurisdictional areas—much like modern technocrats. Their expertise enhanced the intellectual capacity of the administration to exercise territorial power and made the state less dependent on patrimonial clienteles without challenging the patrimonial culture of power/knowledge. During the resistance war against Japan in China, the national administrative authority penetrated the rural society in Enshi city in Hubei province. For one thing, the village officials as the national administrative power strengthened their functions controlling the rural area; for another, the clan organizations in the rural area in Enshi combated the control. The result of confrontation between the two forces was to further strengthen the legitimacy of the system, extend the national executive power down (...) to the grassroots level, instead of the legitimacy of cultural traditions, and control the rural communities in the Enshi area. This control shows that a modern local administrative system has been established in the Enshi area, and to a certain extent, it reflects that the national government was trying to combine the national strong power with the democratic system to explore patterns of modern political initiatives. Integrating the concept of place meanings into protected area management has been difficult. Across a diverse body of social science literature, challenges in the conceptualization and application of place meanings continue to exist. However, focusing on relationships in the context of participatory planning and management allows protected area managers to bring place meanings into professional judgment and practice. This paper builds on work that has outlined objectives and recommendations for bringing place meanings, relationships, and lived experiences to the (...) forefront of land-use planning and management. It proposes the next steps in accounting for people’s relationships with protected areas and their relationships with protected area managers. Our goals are to 1) conceptualize this relationship framework; 2) present a structure for application of the framework; and 3) demonstrate the application in a specific protected area context, using an example from Alaska. We identify three key target areas of information and knowledge that managers will need to sustain quality relationship outcomes at protected areas. These targets are recording stories or narratives, monitoring public trust in management, and identifying and prioritizing threats to relationships. The structure needed to apply this relationship-focused approach requires documenting and following individual relationships with protected areas in multiple ways. The goal of this application is not to predict relationships, but instead to gain a deeper understanding of how and why relationships develop and change over time. By documenting narratives of individuals, managers can understand how relationships evolve over time and the role they play in individual’s lives. By understanding public trust, the shared values and goals of individuals and managers can be observed. By identifying and prioritizing threats, managers can pursue efforts that steward relationships while allowing for the protection of experiences and meanings. The collection and interpretation of these three information targets can then be integrated and implemented within planning and management strategies to achieve outcomes that are beneficial for resource protection, visitor experiences, and stakeholder engagement. By investing in this approach, agencies will gain greater understanding and usable knowledge towards the achievement of quality relationships. It represents an investment in both place relationships and public relations. Discussion around the increasing use of AI in healthcare tends to focus on the technical aspects of the technology rather than the socio-technical issues associated with implementation. In this paper, we argue for the development of a sustained societal dialogue between stakeholders around the use of AI in healthcare. We contend that a more human-centred approach to AI implementation in healthcare is needed which is inclusive of the views of a range of stakeholders. We identify four key areas to support (...) stakeholder involvement that would enhance the development, implementation, and evaluation of AI in healthcare leading to greater levels of trust. Questions are raised about the relevance and appropriateness of rights-based adjudication in welfare needs contexts and about the reluctance of courts to intervene in the resolution of resource allocation disputes even where fundamental rights, particularly in areas such as health, community care, and education where notions of rights are inextricably bound up with use of financial resources. These key cases have arisen prior to the implementation of the Human Rights Act 1998. Where relevant, the likely impact of the Act on welfare needs disputes is considered. (shrink)

This article addressed historical aspects of the political economy involving sustained forest ecology in Sierra Leone as a whole, with emphasis on the Freetown Peninsula and its surrounding communities. Attention is paid to cultural, social and economic aspects involving forest livelihoods of residents on the Freetown Peninsula and far afield. The term 'Political Economy' is used in this situation to denote the relationship between the economics of people's livelihoods and public policy (in relation to the management of legislative procedures) in (...) ensuring that resources in the forest environment is sustainably managed to cater for the livelihood needs of people in Sierra Leone, while at the same time maintaining a balance in protecting the forest ecosystems. The paper has provided a critical review of the political economy of forest ecology in the country on the basis of scholarly discourses, and its applicability in adapting to the fragile political administrative management Sierra Leone have (and is continuing to) experienced. The Resolution of the Seimas of the Republic of Lithuania on the Approval of the State Sports Development Strategy for 2011-2020 states that it is important to create and develop a horizontal structure of public administration of sport, which includes many state administration areas and municipal institutions, which would allow to develop cooperation with non-governmental sports organizations and private sector of sports activities. To create legal and economic conditions for the fast development of active and healthy lifestyle and universal sports (...) clubs as primary subjects of the national sport system; to promote their contribution to non-formal sports education and employment of children and young people, development of various sports, interaction between amateur and professional sports. In this respect, the tasks have been set to create a multi-tier system of strategic cooperation with non-governmental sport organizations with public administration structures, to expand cooperation between municipal institutions in the field of sport, authorized by the Government of the Republic of Lithuania so that these resolutions include the National Sport for All Development Program implementation, enhancing the vitality of communities through sport, ensuring healthy lifestyle conditions and developing sports infrastructure through territorial planning documents and investment programs; to create and develop a system of partnerships in the field of sport between public and private sectors; to develop cooperation between institutions of all fields of management by developing and implementing physical activity, healthy lifestyles and work ability, social cohesion through sport, leisure employment and social prevention and other interinstitutional programs, accordingly reorganizing and expanding functions of the institution authorized by the Government, strengthening its administrative capacity. The implementation of the strategy is particularly relevant, as is the case at the level of municipal administrations and councils, to which functions are delegated to implement the priority functions of sport policy. Problems in the implementation of sport policy are analyzed by scientists as well as representatives of sports policy legislators. The aim of the research is to analyze how the sports policy of the Republic of Lithuania is formulated and implemented in the activities of municipal administrations and councils. Research methods -analysis of scientific literature, analysis of laws, analysis of sports management system. Research results and conclusions. The real role of municipalities and the priority to develop community sport, to promote the vitality of communities has not been realized yet. The role of private business for private investment in sports infrastructure for the development of sports movement and cooperation with socially responsible business representatives, the independent role of clubs and non-governmental organizations as a priority have also not been understood and finally not implemented. In the functional division of activities in the sport policy process, all chains of interaction between organizations, acting within the competence, must strive to implement laws and strategic goals of sports policy. In order to achieve these objectives, the activities of the institutions depend on the political decisions adopted jointly by the central government, public programs and projects. It is important that the executive structures are delegated the same kind of functions, so that the implementation of the policy is carried out consistently in all areas of the republic.Improvement of the process of implementing sports policy and the search for the improvement, trying to achieve the efficiency of activities of municipal administrations and councils must be the main goal of all institutions involved in it. The whole system of institutions involved in the development and implementation of sport policy is too centralized. Institutional differences in the management of interdependence and in the resolution of structural problems between national organizations and municipal organizations are very pronounced. This has a negative impact on the status of municipal territorial sports divisions, when grants are distributed from the state budget, selecting sportsmen, performing medical technological examination of promising sportsmen, setting up sports bases, and so on. Compared with traditional technological innovation modes, green technology innovation is more targeted for low carbon development and critical support for countries worldwide to combat climate change. The impact of green technology innovation on carbon emissions is considered in terms of fixed effect and mediating effect models through industrial structure upgrading. For this purpose, the sample dataset of 30 provincial administrative areas in China from 2008 to 2020 is employed. The results demonstrate that green technology innovation exerts significantly inhibitory effects (...) on carbon emissions, whose conclusion still holds after removing municipalities and replacing the dependent variable. Industrial structure upgrading is vital for green technology innovation to diminish carbon emissions. There is significant regional heterogeneity in the effects of green technology innovation on carbon emissions, i.e., the direct and indirect impact of green technology innovation on carbon emission reduction is significant in the eastern-central area, but its effect is insignificant in the western region. Therefore, it is essential to realize carbon emission reduction by further bolstering green technology innovation and accelerating industrial structure upgrading to fulfill the synergy of technology and structure. Whilst the benefits expected are ubiquitously stated, probable negative impacts are seldom admitted by the dominant actors in the field. ObjectiveThe study aims to discuss the longitudinal impact of the parent-teacher relationship on students’ academic achievements in China.MethodBased on the China Education Panel Survey, covering the data from 438 classes of 112 schools in 28 county-level administrative areas in China, we used the hierarchical linear model to analyze the data.ResultsWe found that the parents’ active communication with teachers, parents’ participation in parent meetings, teachers’ active contact, whether parents are afraid to communicate with teachers, and parents’ willingness to participate in (...) parent meetings have significant relationships with students’ academic achievements. At the class level, the extent of teachers’ stress from parents’ requests and teachers’ perception of respect from parents also affected students’ academic achievements significantly in the Chinese context.ConclusionThere was a longitudinal association between the parent-teacher relationship and students’ academic achievements. The use of Genetic Modification in food is the subject of deep political disagreement. Much of the disagreement involves different perceptions of the kinds of risks posed by pursuing GM food, and how these are to be tolerated and regulated. As a result, a primary institutional site of GM food politics is regulatory agencies tasked with risk assessment and regulation. Locating GM food politics in administrative areas of governance regimes produces unique challenges of democratic legitimacy, conventionally secured through legislative (...) channels. In particular, debate over the ends of a society’s policy on GM food inevitably continues in these institutional locations, despite conventional instrumental understandings of administrative legitimacy resting on effective application of ‘ends-means’ norms. This paper assesses the two major regulatory frameworks currently applied to GM food—the ‘precautious’ and ‘proof of harm’ approaches—and presents their respective limits in securing the procedural and substantive dimensions of the legitimacy of administrative deference in democratic societies. On the basis of these criticisms, a synthesized and emergent approach—‘experiential precaution’—is presented as having the resources to deepen the legitimacy of risk governance institutions in the case of GM food. It is characterized by deepened participatory practices of negotiated rulemaking and inclusion of further substantive requirements in approval criteria. (shrink)

Educational provision and activity takes place within spaces ranging from a room at home or in a school to a campus to an administrative area which could be a state within a country, a whole country or a group of countries. Such spaces are known as geographical surfaces. Relying on the systematic, logical, and analytical methods, national legislation and some internationally accepted guidelines, as well as on the research conducted by the Lithuanian scientists and law practitioners, this article consistently and comprehensively deals with the problems arising in the areas of interpretation and application of tax law. The article examines the relevant tax concepts, studies the tax law system, deals with the relevant issues arising in the field of application of legal regulations on taxation, and provides a particularly (...) detailed analysis of court jurisprudence within the context of the relationship between tax and law. On the basis of the analysis conducted, it was established that the basis for the Lithuanian tax law system consists of the Constitution of the Republic of Lithuania; the Law on Tax Administration; tax laws that lay down specific taxes and of by-laws adopted on their basis; national legal regulations that contain a consideration attribute and set mandatory payments to the State budget; the Law on Customs; ratified international agreements; the European Union legal regulations to the extent they are related to the duties, import excise duty, and value added tax; and the European Union directives in respect of direct and indirect taxes and the extent to which they are related to tax administration. When relationships in public law are directly regulated by the relevant public law regulations, it is not private law regulations, but the corresponding public law regulations that must be applied. In order to determine the need for tax authorities to rely on the regulations of the Civil Code, it is necessary to state the necessity to assess legal relationships from the point of view of private law or to identify a gap in legal regulation of public law due to which the norms of the Civil Code are subsidiary. Prior to establishing the tax base, the tax authority does not have to rebut transactions in civil procedure. The taxpayer’s obligation to fulfil tax liabilities that are properly prescribed by tax laws is not called into question by unlawful acts of other persons which constitute grounds for their civil (non-contractual) liability for the damages caused. The factual circumstances of tax relations established in the court cases heard in criminal and/or administrative procedures, do not need to be proved again – they are relied on in the course of tax inspections or when hearing tax disputes. The principle of equality of taxpayers requires tax administrators to give equal treatment to the facts with respect to all participants regarding the same tax relationship and obliges taxpayers to pay taxes honestly, because non-payment of taxes is a breach of public interest and therefore of this principle. In accordance with the principle of general applicability and equality, each taxpayer has an obligation to pay taxes as prescribed in tax legislation observing the calculation and payment procedures stipulated in the tax legal regulations, whereas the amount payable as established by the tax administrator shall be regarded as well-founded to the extent that it does not exceed the criterion of equality and reasonableness. The principle of clarity of taxation requires the tax administrator to adopt clear and comprehensive decisions with respect to the taxpayer and therefore to ensure their rights and legitimate interests. In the calculation of tax by applying the principle of primacy of content over form, it is necessary to establish that a transaction, an economic deal or indeed any group thereof has been concluded for the purpose of obtaining tax benefits. The border is an area where the rule of law has often found difficulty taking root, existing as law-free zones characterized by largely unbounded legal and administrative discretion. In his important new book, The Rule of Law in the Real World, Paul Gowder deftly combines historical examples, formal models, legal analysis, and philosophical theory to provide a novel and compelling account of the rule of law. In this paper I consider whether the account Gowder offers can provide the (...) tools needed to bring the border under the rule of law. I argue that on Gowder’s account, there are two ways in which we might try to extend the rule of law to the border.The first is to look at concrete connections that current citizens or members of the political community have with non-citizens. Just as the interests of current citizens give them strong reasons to coordinate to establish the rule of law in their own community, so may the interests of current members in connections with nonmembers give them reason to work to extend the rule of law to the border. These interests can include family ties, other forms of personal relationships, offers of employment, intellectual connections, and others. Some of these connections already serve to give greater legal protections, including protections from arbitrary decision-making, to some non-citizens, and the general trend, I argue, can and should be further strengthened The second method for extending the rule of law to the border involves appealing to certain universal norms so as to build a sense of community that stretches beyond borders. While these norms are not as robust or well established as domestic law, and therefore are unlikely to extend all of the protections of the rule of law to all people at the border, they can, I argues, be a basis for working against the worst arbitrary actions by border officials. I conclude by considering the vexed dispute about providing “amnesty” for unauthorized immigrants in the United States and other countries. I argues that Gowder’s account of the amnesty provided to supporters of the oligarchic coups in ancient Athens provides a model for thinking about when and how amnesties for unauthorized migrants can be done without offending the rule of law, thereby making them more palatable to current citizens. This chapter first outlines the general evolution of the European Union's (EU) decision‐making regime. The pattern of EU decision making has traditionally varied across policy fields to a degree that is unknown in the national constitutional law of its member states, where laws and administrative rules are usually made according to fairly standard procedures covering all policy areas. Such policy‐related variation has been a constant feature throughout the history of European integration. The chapter then examines EU legislative decision making, (...) and reviews administrative rule making by the EU institutions. The chapter then describes other relevant forms of decision making in the European Union. Finally, it shows how successive revisions of the European treaties such as Single European Act, Treaty of Maastricht, Treaty of Amsterdam, Treaty of Nice, and Treaty of Lisbon have incrementally modified the decision‐making regime of the European Union. This book demonstrates that art is implicit in the process of administration of international justice. The diverse nature of recent global threats as well as an overwhelming pull towards isolationism and nationalism challenge the dominant deterrence paradigm of international governance created in the aftermath of World War II. An alternative model is to focus on cooperation, and not deterrence, as a guiding operational principle. This study focuses on the theoretical component linking justice with aesthetics as well as on the practical (...) manifestation of this connection evident, inter alia, in the rhetoric of international courts, their architectural design, and their commemorative practices expressed by the practice of symbolic reparations adopted by some of the courts. The underlying premise of the book is that international justice requires new vocabulary and new approaches, which can be derived from the study of aesthetics. It is held that exploring the aesthetical dimension of international justice contributes to the discussion on the foundations of its authority and the grounds for compliance with it. The work engages deeply with the theory of aesthetics developed by Immanuel Kant and Abinavagupta, a Kashmiri critic, philosopher and scholar writing in the early 11th century. This chapter considers four areas in the differences between Vygotsky's concept of reason and ‘Enlightenment rationality’ in its familiar characterisation. These areas cover: (1) foundationalism and anti‐foundationalism, (2) the conception of science, (3) the conception of development and (4) idealism and materialism. The last is developed more by Ilyenkov, although, given its Hegelian and Spinozist provenance, it can be reasonably interpreted as part of the general direction of Vygotsky's work. Two indications of the importance of Hegel for understanding Vygotsky are: (...) first, the absence of an unbridgeable epistemological chasm between thought and world, and second, the conception of development as a non‐linear process embedded in historical resources. Marx's and Hegel's ideas of history and development influenced every aspect of Vygotsky's thinking on concepts. Vygotsky's work provides no blueprint for teachers and educational administrators, but it does provide a frame of ideas within which questions concerning education can fruitfully be pursued. In few other areas of bioethical inquiry exists as close a connection between bioethical professional advice and policy development as is the case with HIV and AIDS. Historically, the reasons for this have much to do with one of the groups initially affected most severely by HIV and AIDS, namely well-educated middle-class gay men in developed countries. This particular group of people, highly sophisticated and used to political activism in its pursuit of civil rights-related objectives, engaged the medical profession as (...) well as regulatory agencies such as the US Food and Drug Administration, and legislators (more so in the USA than in other countries) in a number of bioethically interesting policy areas. Many of the controversies of the times were framed as civil rights and/or ethical disputes. The initial areas of concern and inquiry focused on: informed consent to HIV testing and trial participation, the confidentiality of HIV test results, access to trials as a means of access to experimental drugs, the length of time it took to get an experimental drug to the market approval stage, and end-of-life decision-making. This line-up of issues explains why AIDS has become such an interesting topic for bioethicists. Bioethicists concerned about the traditional breadand- butter themes of medical ethics themes of the doctor - patient relationship (e.g., Daniels, 1991; Boyd, 1992), as well as bioethicists more concerned about policy and regulatory issues in the drug research and approval process (e.g., Edgar & Rothman, 1990; Salisbury & Schechter, 1990), found research topics worthy of vigorous pursuit. No surprise, then, that HIV/AIDS led to a probably unprecedented number of books and articles in professional journals (Manuel et al., 1990). HIV/AIDS has become a permanent fixture in all major mainstream bioethics textbooks (e.g., Kuhse & Singer, 1998; Arras & Steinbock, 1999). Reference series in medicine, ethics and law provide for dedicated volumes on AIDS.1 Even specialist bioethics textbooks, for instance those directed at dentistry students, carry chapters on HIV/AIDS (Ozar & Sokol, 2002). 128 Udo Schuklenk AIDS, designated by the medical profession a pandemic lives up to its classification. It did not stop at the borders of developed countries. As one would expect of a primarily sexually transmitted illness in the age of globalisation, it spread rapidly across the globe. Indeed, in many countries it has become one of the main causes of death, as in sub- Saharan Africa (Shisana & Simbayi, 2002). Dramatic increases in the number of AIDS cases are predicted for many Eastern European countries as well as for the two most populous nations on earth, India and China. Some of the HIV/AIDS-related bioethical and policy issues of concern to developed countries remain the same for developing countries. However, in ethically important ways they are dwarfed by concerns over drug prices, intellectual property rights, and affordable access to essential AIDS drugs for the impoverished masses of infected people in such countries. Of increasing importance have become ethical issues pertaining to the ever-growing research industry associated with clinical trials undertaken in developing countries. Indeed, major funding initiatives both in the USA and UK have brought clinical research in developing countries into focus. Some have questioned whether this attention is appropriate, considering other bioethical problems of arguably greater importance to developing countries (Chadwick & Schuklenk, 2003). Standards of clinical care in a study, and after a trial has concluded, as well as community benefits and access to the trial regime after the trial’s conclusion remain contentious issues. It is worth noting that more often than not it was an AIDS-related trial or policy decision that led to a great deal of bioethical analysis, yet the issues discussed almost always have ramifications far beyond AIDS. For instance, decisions about the question of what (if any) standards of care failures in preventive trials (of HIV vaccines or microbicides) ought to receive have important implications for non-AIDS prevention trials. This study was administrated to undergraduate students living in the various hostels of Universiti Sains Malaysia. The primary purpose of this study was to identify the most important factors that predict undergraduate students’ level of satisfaction with the student hostels they are living in. This paper also explored the difference in the satisfaction levels of students living in hostels within the campus and those living in hostels outside the campus. Based on literature review, it was hypothesized that there would be (...) a difference in the satisfaction level between these two groups of hostel residents due to the different characteristics that these hostels have. Additionally, this study investigated the most preferred hostels among students and identified the reasons for the preference. A sample population of 288 students (220 females; and 68 males) was involved in this study with 48.3% living in hostels inside the campus and 51.7% living in hostels located outside the main campus area. The result of the study suggests that satisfaction with fees, distance from university facilities, room safety, room size, hostel security, and hostel facilities are the most important factors which predict undergraduate students’ satisfaction with their hostel. There was also a significant difference in the satisfaction level between inside-campus and outside-campus hostels students. The most important factors that influenced that students satisfaction levels were distance from the university facilities, the exterior condition of the hostel, hostel population, satisfaction with transport, hostel security, room size, and room safety. The study also found that the most preferred hostel among the students was Cahaya Gemilang due to its strategic location, close distance to lecture halls and other main facilities in the campus and, good internet network connection. In this chapter I focus on two problems facing immigration systems around the world, and Australia in particular. The topics addressed are chosen because each one involves important fundamental rights and because significant improvement in these areas is possible even if each state acts alone, without significant coordination with others. First, I examine refugee programmes, focussing specifically on the ‘two- tier’ refugee programmes pioneered by Australia with the introduction of Temporary Protection Visas by the Howard Government in 1999. Next, I (...) look at recent declines in refugee resettlement schemes from already stingy levels and, in relation to Australia in particular, I show how the tying of resettlement numbers to the number of affirmative asylum claims granted is both wrong- headed and counterproductive. The second area of immigration policy explored is family migration, another area where immigration systems around the world have been moving in the wrong direction, often via less than transparent administrative processes. Australia is no exception. While Australia’s family migration system is reasonably good on its face, in practice there are several factors which make the programme significantly less than satisfactory from the perspective of protecting the basic rights of migrants and, arguably more importantly, citizens. These problems can and should be fixed in straightforward ways, and since doing so would be more just, would have few— if any— significant negative consequences, and in fact would have a number of clear benefits, those changes should be made. Public administration curricula typically offer only very limited exposure to computers, despite the growing importance of computers in public management. This paper examines an approach to teaching computer management in a masters of public administration program, and relates that approach to the broader question of what public administrators need to know about computers. The approach involves instruction in computer literacy, computer applications, and management of computer resources. Instruction in these three areas appears to increase the importance students place on managing (...) computer resources and on understanding computer concepts, and to decrease the relative importance students place on managers' knowledge about specific computer applications. This shift in viewpoint appears appropriate based on interviews which suggest that practicing administrators place greater emphasis on understanding the broad issues of computer resource management, rather that on more specific computer knowledge or skill. The administration of electroconvulsive therapy (ECT) to children and adolescents remains an unresolved area of clinical debate for nurses. Thus, some nurses have refused to participate in the treatment of minors with ECT, invoking codes of conduct to justify their actions. Other nurses have supported the use of ECT with children and adolescents, via provision of technical assistance to medical colleagues. A cross-national comparison of ethical codes of conduct has confirmed that nurses should take decisive action in the clinical (...) arena when the needs or rights of vulnerable minors are compromised. The provision of clinical guidelines is suggested as one method to enshrine the rights of at-risk children and adolescents. (shrink)

Despite the fundamental and administrative difficulties associated with cross-cultural research the rewards are significant and, given an increasing trend toward globalisation, the move away from singular location studies to more comparative research is to be encouraged. In order to facilitate this research process it is imperative, however, that considerable attention is given to the methodological issues that can beset cross-cultural research, specifically as these issues relate to the primary domain or discipline of investigation, which in this instance is research (...) on business ethics. Utilising the experience of a four country comparative study of both Asian and Western cultures in the field of business ethics, the following presents a discussion of methodological concerns under the three broad areas of operationalising culture, operationalising business ethics, and data interpretation. The Reshaping of Phytogeographical Knowledge as the “Transition zone” Wallacea: An American Expansion Project in the Philippines, 1902–1928. This paper examines the development of a concept that to this day plays an important role in biogeography: the region Wallacea. Focussing on the work of the American tropical botanist Elmer D. Merrill in the Philippines, I argue that his research on the geographical movement and settlement of Philippine plants reflects a shift in the United States’ scientific and cultural understanding of the (...) Pacific area towards a notion of “American tropics”. While inventorying plants for the American administration from 1901 to 1923, the composition of Philippine flora prompted Merrill to question biogeographical regionalization in Wallace's Malay Archipelago. Not being able to situate the Philippine flora within “Asian” or “Australasian” biota, Merrill described the islands as an area of trans‐regional plant migration. Together with the paleontologist Roy E. Dickerson, he later conceptualized the region Wallacea as biogeographical “transition zone” between the Philippines and Australia. In addition to the scientific conceptualization, Wallacea constitutes a space between two biogeographical subregions, whose flora was considered as being part of both, but could not be unambiguously attributed to either of these regions. In this respect, the plants resembled the inhabitants of the United States’ insular overseas territories, who were legally defined neither as aliens nor as citizens. In this sense, Wallacea embodies epistemic as well as geopolitical boundaries, while its case also illustrates some of the ways in which colonial interests in the usability of plants found expression in botanical research during the early period of American overseas expansion.
