Do motivational limitations due to human nature constrain the demands of justice? Among those who say no, David Estlund offers perhaps the most compelling argument. Taking Estlund’s analysis of “ability” as a starting point, I show that motivational deficiencies can constrain the demands of justice under at least one common circumstance — that the motivationally-deficient agent makes a good faith effort to overcome her deficiency. In fact, my argument implies something stronger; namely, that the demands of justice are constrained (...) by what people are sufficiently likely to be motivated to do. Thus, contrary to the prevailing wisdom, it is the business of ideal theory — not just nonideal theory — to work with the motivational capacities people are likely enough to have. Conceptual limitations restrict our epistemic options. One cannot believe, disbelieve, or doubt what one cannot grasp. I show how, even granting an epistemic ought-implies-can principle, such restrictions might lead to epistemic dilemmas: situations where each of one’s options violates some epistemic requirement. An alternative reaction would be to take epistemic norms to be sensitive to one’s options in ways that ensure dilemmas never arise. I propose, on behalf of the dilemmist, that we treat puzzlement as a kind of epistemic (...) residue, roughly analogous with guilt, appropriate only when one has violated an epistemic requirement. Sometimes, in bumping up against the limits of one’s concepts, it is appropriate to be puzzled no matter what one believes. Puzzlement can thus play the same role in an epistemic dilemmist’s theory that guilt plays in the theories of many moral dilemmists. (shrink)

What kinds of evidence reliably support predictions of effectiveness for health and social care interventions? There is increasing reliance, not only for health care policy and practice but also for more general social and economic policy deliberation, on evidence that comes from studies whose basic logic is that of JS Mill's method of difference. These include randomized controlled trials, case–control studies, cohort studies, and some uses of causal Bayes nets and counterfactual-licensing models like ones commonly developed in econometrics. The topic (...) of this paper is the 'external validity' of causal conclusions from these kinds of studies. We shall argue two claims. Claim, negative: external validity is the wrong idea; claim, positive: 'capacities' are almost always the right idea, if there is a right idea to be had. If we are right about these claims, it makes big problems for policy decisions. Many advice guides for grading policy predictions give top grades to a proposed policy if it has two good Mill's-method-of difference studies that support it. But if capacities are to serve as the conduit for support from a method-of-difference study to an effectiveness prediction, much more evidence, and much different in kind, is required. We will illustrate the complexities involved with the case of multisystemic therapy, an internationally adopted intervention to try to diminish antisocial behaviour in young people. (shrink)

Michael Bergmann argues directly from our ignorance about actual and merely possible goods and evils and the broadly logical relations that hold betweenthem to the conclusion that “noseeum” arguments from evil against theism like William L. Rowe’s are unsuccessful. I critically discuss Bergmann’s argument in the first part of this paper. Bergmann also suggests that our ignorance about value and modality undermines the Humean argument from evil against theism that I defended in a 1989 paper. The re-emergence of virtue ethics (henceforth VE) as both an academic theory and as an approach to applied ethics has contributed to the re-invigoration of ethical debate. It has encouraged reflective consideration of the nature of professionals' commitments to various values that constitute their personal and professional character, both collectively and individually. This paper argues that whilst there may be some value in the re-orientation of applied ethics towards questions of character, it has its limitations, including a tendency to (...) be reduced rather too easily to self-serving ends that ultimately favour dominant social groups. Neuroimaging showing brain abnormalities is increasingly being introduced in criminal court proceedings to argue that a defendant could not control his behavior and should not be held responsible for it. But imaging has questionable probative value because it does not directly capture brain function or a defendant’s mental states at the time of a criminal act. Advanced techniques could transform imaging from a coarse-grained measure of correlations between brain states and behavior to a fine-grained measure of causal connections between them. (...) Even if this occurs, bias and other attitudes may unduly influence jurors’ interpretation of the data. Moreover, judges’ decisions about whether neuroimaging data is legally relevant and admissible are normative decisions based on more than empirical evidence. Advanced neuroimaging will better inform assessments of criminal responsibility but will not supplant or explain away the psychological and normative foundation of the criminal law. (shrink)

This chapter presents a re-understanding of the contents of our analog magnitude representations (e.g., approximate duration, distance, number). The approximate number system (ANS) is considered, which supports numerical representations that are widely described as fuzzy, noisy, and limited in their representational power. The contention is made that these characterizations are largely based on misunderstandings—that what has been called “noise” and “fuzziness” is actually an important epistemic signal of confidence in one’s estimate of the value. Rather than the ANS having noisy (...) or fuzzy numerical content, it is suggested that the ANS has exquisitely precise numerical content that is subject to epistemic limitations. Similar considerations will arise for other analog representations. The chapter discusses how this new understanding of ANS representations recasts the learnability problem for number and the conceptual changes that children must accomplish in the number domain. Suicidality, a significant problem in New Zealand for the past decade or so, has invited a substantial body of research into causes and prevention. However, given the effort, the prevention results do not appear to be sufficiently convincing when coroners’ views are considered. This paper focuses on two mainstream therapeutic approaches towards persons with borderline personality disorder, in which suicidal behaviour is a prominent feature demanding understanding and active attention. It is argued that dialectical behaviour therapy and psychoanalytically informed therapies (...) are lacking on two accounts. Firstly, the philosophical and methodological underpinnings of both approaches perpetuate what Heidegger refers to as the compound misunderstanding of ourselves as human beings. Secondly, what this translates into is a practice which forgets the human order and misunderstands the experience of the singular human present in despair. As an alternative approach towards dealing with suicide in practice, the author presents concepts central to Heidegger’s phenomenology of human existence and discusses how these may inform and enhance the treatment of suicidal patients. Potential consequences of the cortical encoding of voiced stop-consonants on representational principles derived from orderly output constraints are discussed.

Philosophers have conjectured that human cognitive limitations might preclude our ever resolving the hard problem of consciousness. Few, however, have offered suggestions as to what it might be about our conceptual apparatus that poses the problem. I do so in this essay, arguing that our central difficulties lie with two conceptual categories that pervade philosophical discussion of the hard problem. They are compositional concepts -- part/whole, constituents/constitution, and the like – and instantiational concepts: properties/objects, universals/particulars, and the like. I (...) look at the uses of these two conceptual categories in four contexts in which the hard problem is considered: multiple realizability, zombies, mental causation, and panpsychism. I show that the two conceptual categories run into the same kinds of obstacles in each case, which suggests that they might be key to the cognitive limitations about which some have speculated. FIRST PARAGRAPH I have argued that dispositionalism is incompatible with the Principle of Least Action (PLA) (Katzav 2004). In ‘Katzav on the Limitations of Dispositionalism,’ Brian Ellis responds, arguing that while naïve dispositionalism is incompatible with the PLA, sophisticated dispositionalism is not. Naive dispositionalism, according to Ellis, is the view that the world is ultimately something like a conglomerate of objects and their dispositions, and that, therefore, dispositions are the ultimate ontological units that explain events. Sophisticated dispositionalism, according to (...) Ellis, supposes that, how things are disposed to behave depends also on what kinds of things they are, what kinds of property they have, and how these kinds of things and properties are placed in the natural kinds hierarchies to which they belong (Ellis 2005). Further, it supposes that at the top of each hierarchy of natural kinds there is a global kind. For example, ‘[t]he global natural kind in the category of substance is that of the physical system’ (Ellis 2005). Ellis continues, claiming that the PLA is of the essence of the global kind in the category of objects or substances. If this is so, then, of course, every continuing object must be Lagrangian, i.e. disposed to evolve in accordance with the principle of least action (Ellis 2005). Ellis concludes that, therefore, a sophisticated dispositionalist can accommodate the PLA and its metaphysical necessity. (shrink)

The concept of hierarchical organization is commonplace in science. Subatomic particles compose atoms, which compose molecules; cells compose tissues, which compose organs, which compose organisms; etc. Hierarchical organization is particularly prominent in ecology, a field of research explicitly arranged around levels of ecological organization. The concept of levels of organization is also central to a variety of debates in philosophy of science. Yet many difficulties plague the concept of discrete hierarchical levels. In this paper, we show how these difficulties undermine (...) various implications ascribed to hierarchical organization, and we suggest the concept of scale as a promising alternative to levels. Investigating causal processes at different scales offers a way to retain a notion of quasi-levels that avoids the difficulties inherent in the classic concept of hierarchical levels of organization. Throughout, our focus is on ecology, but the results generalize to other invocations of hierarchy in science and philosophy of science. (shrink)

Intellectual humility is a hot topic. One of the key questions the literature is exploring is definitional: What is intellectual humility? In their recent paper, “Intellectual Humility: Owning our Limitations,” Dennis Whitcomb, Heather Battaly, Jason Baehr, and Daniel Howard-Snyder have proposed an answer: Intellectual humility is “proper attentiveness to, and owning of, one’s intellectual limitations”. I highlight some limitations of the limitations-owning account of intellectual humility. SAMBURSKY I THE NEOPLATONICREVlV~of Plato's views on the physical world offers some highly interesting aspects to the historian of scientific ideas. There is first of all the interaction between a 600-year-old tradition and other philosophical systems that grew up during this long period and that exerted such a decisive influence on later antiquity. And there is further the magnificent development (...) of science--mathematics and astronomy in particular--in the period following Plato, reaching its climax in the Hellenistic era. This development introduced profound changes in the scientific world picture by adding a wealth of new facts to astronomy, mechanics, optics, and biology, and thus facing the later disciples of Plato with a difficult alternative : They could either assume an orthodox attitude by doubting the facts or at least belittling their significance for the Platonic doctrine; or else they could compromise by attempting to interpret the facts in the Platonic spirit--doing so by availing themselves of the well-known expedient of reading between the lines of the master's writings. It can, of course, not be denied that everything Plato has written on the physical world and on scientific cognition will always be, as it has been in antiquity, subject to interpretations. The task of a Platonic commentator is made even more difficult by his poetic style, his predilection for allegory, and his frequent use of allusions at the very moment when one expects systematic analysis. The increasing anti-metaphysical bias of modern science combined with the fact that Plato himself was neither a practicing scientist nor a creative mathematician led to the disparagement of his contribution to scientific thought in the last centuries. This applies in particular to the Timaeus,where the main tenets of PIato's scientific doctrine are expounded. However, on the whole, this negative attitude is not justified. The consistency and significance of Plato's epistemology of science is borne out by his statements in the Timaeusif they are taken together with his assertions concerning the role of mathematics in the cognition of nature and his appeal to the astronomers to "save the phenomena" of the planetary motions. Careful consideration of all these passages, regarded as a coherent whole, will show in the first place that Plato's philosophy of science does not fall short of his other great contributions to philosophy and human thought. It will further serve as a background against which the significant shift of emphasis that is found in Proclus's evaluation of the capacity of the human mind for the progressive understanding of nature will be seen. We all know of Plato's fundamental belief that the sensible world, i.e., the obiect of physical inquiry, is only an image of the inaccessible world of ideas. The intelligible world, the ultimate reality, is permanent and unchangeable, whereas [11 2 HISTORY OF PHILOSOPHY the material world is a world of transience and change. Every possible description of the physical world is therefore by necessity only a plausible story, not rising above the level of probability. The use of predictive systems has become wider with the development of related computational methods, and the evolution of the sciences in which these methods are applied Solon and Selbst and Pedreschi et al.. The referred methods include machine learning techniques, face and/or voice recognition, temperature mapping, and other, within the artificial intelligence domain. These techniques are being applied to solve problems in socially and politically sensitive areas such as crime prevention and justice management, crowd management, and emotion analysis, just (...) to mention a few. However, dissimilar predictions can be found nowadays as the result of the application of these methods resulting in misclassification, for example for the case of conviction risk assessment Office of Probation and Pretrial Services or decision-making process when designing public policies Lange. The goal of this paper is to identify current gaps on fairness achievement within the context of predictive systems in artificial intelligence by analyzing available academic and scientific literature up to 2020. To achieve this goal, we have gathered available materials at the Web of Science and Scopus from last 5 years and analyzed the different proposed methods and their results in relation to the bias as an emergent issue in the Artificial Intelligence field of study. Our tentative conclusions indicate that machine learning has some intrinsic limitations which are leading to automate the bias when designing predictive algorithms. Consequently, other methods should be explored; or we should redefine the way current machine learning approaches are being used when building decision making/decision support systems for crucial institutions of our political systems such as the judicial system, just to mention one. When should you engage with difficult arguments against your cherished controversial beliefs? The primary conclusion of this book is that your obligations to engage with counterarguments are more limited than is often thought. In some standard situations, you shouldn't engage with difficult counterarguments and, if you do, you shouldn't engage with them open-mindedly. This conclusion runs counter to aspects of the Millian political tradition and political liberalism, as well as what people working in informal logic tend to say about argumentation. (...) -/- Not all misleading arguments wear their flaws on their sleeve. Each step of a misleading argument might seem compelling and you might not be able to figure out what's wrong with it. Still, even if you can't figure out what's wrong with an argument, you can know that it's misleading. One way to know that an argument is misleading is, counterintuitively, to lack expertise in the methods and evidence-types employed by the argument. When you know that a counterargument is misleading, you shouldn't engage with it open-mindedly and sometimes shouldn't engage with it at all. You shouldn't engage open-mindedly because you shouldn't be willing to reduce your confidence in response to arguments you know are misleading. And you sometimes shouldn't engage closed-mindedly, because to do so can be manipulative or ineffective. -/- In making this case, Jeremy Fantl discusses echo chambers and group polarization, the importance in academic writing of a sympathetic case for the opposition, the epistemology of disagreement, the account of open-mindedness, and invitations to problematic academic speakers. Professor Frankena's Carus Lectures exhibit the analytical acumen and probing intelligence we have long come to expect from his writings. The distinctions he draws, the questions he raises, and the answers he suggests all serve powerfully to advance philosophical thought. While I shall have criticisms to make of some of his central doctrines, this must not be allowed to obscure the real indebtedness one feels for the enlightening and stimulating effect of his work as a whole.

The HIT framework accepts a number of assumptions that are widely held as plausible or even well established in the literature on category-specific agnosia. We point out that a number of these elementary conjectures, now almost taken for granted, have received little in the way of convincing empirical support.

Two notable limitations exist on the use of personhood arguments in establishing moral status. Firstly, although the attribution of personhood may give us sufficient reason to grant something moral status, it is not a necessary condition. Secondly, even if a person is that which has the ‘highest’ moral status, this does not mean that any interests of a person are justifiable grounds to kill something that has a ‘lower’ moral status. Additional justification is needed to overcome a basic wrongness (...) associated with killing something possessing moral status. There are clear arguments already available in this regard in the case of a foetus that are not available in the case of a newborn infant. Hence, there is scope to consistently hold that abortion may be permissible but that after-birth abortion may not be permissible. (shrink)

In reply to Ballantyne, I clarify my reasons for thinking that open-mindedness is a matter of being willing to change your mind and that amateurs can in some (...) ways and in some situations be more immune to misleading arguments than experts can. The freedom of expression is vital to our ability to convey opinions, convictions, and beliefs, and to meaningfully participate in democracy. The state may, however, ‘limit’ the freedom of expression on certain grounds, such as national security, public order, public health, and public morals. Examples from around the world show that the freedom of individuals to express their opinions, convictions, and beliefs is often imperilled when states are not required to meet a substantial justificatory burden when limiting such freedom. This (...) article critiques one of the common justificatory approaches employed in a number of jurisdictions to frame the state’s burden to justify limitations on the freedom of expression—the proportionality test. It presents a case for an alternative approach that builds on the merits and addresses some of the weaknesses of a typical proportionality test. This alternative may be called a ‘duty-based’ justificatory approach because it requires the state to demonstrate—through the presentation of publicly justifiable reasons—that the individual concerned owes others a duty of justice to refrain from the expressive conduct in question. The article explains how this approach is more normatively compelling than a typical proportionality test. It also illustrates how such an approach can better constrain the state’s ability to advance majoritarian interests or offload its positive obligations by limiting the freedom of expression of minorities and dissenting voices. Branigan & Pickering (B&P) present a case that linguistic theory should pay heed to the results of structural priming studies. I can agree with this wholeheartedly. Since the pioneering work of Bock (Reference Bock1986), structural priming has provided interesting evidence for the construction of linguistic representations as part of the process of sentence generation and understanding. B&P are somewhat ambivalent on the question of whether linguistic theory should pay heed only to structural priming (as seems implied in the abstract) or (...) simply add it to the repertoire of methodologies for testing the predictions of theories. If simply an addition to the repertoire, again, I am in thorough agreement. (shrink)

This paper examines the origin and the development of the mechanistic model of the human body and health in terms of Max Weber's theory of rationalization. It is argued that the development of Western scientific medicine is a part of the broad process of rationalization that began in sixteenth century Europe as a result of the Reformation. The development of the mechanistic view of the human body in Western medicine is consistent with the ideas of calculability, predictability, and control — (...) the major tenets of the process of rationalization as described by Weber. In recent years, however, the limitations of the mechanistic model have been the topic of many discussions. George Engel, a leading advocate of general systems theory, is one of the leading proponents of a new medical model which includes the general quality of life, clean environment, and psychological, or spiritual stability of life. The paper concludes with consideration of the potential of Engel's proposed new model in the context of the current state of rationalization in modern industrialized society. (shrink)

Jaegwon Kim’s exclusion argument is a general ontological argument, applicable to any properties deemed supervenient on a microproperty basis, including biological properties. It implies that the causal power of any higher-level property must be reducible to the subset of the causal powers of its lower-level properties. Moreover, as Kim’s recent version of the argument indicates, a higher-level property can be causally efficient only to the extent of the efficiency of its micro-basis. In response, I argue that the ontology that aims (...) to capture experimentally based explanations of metabolic control systems and morphogenetic systems must involve causally relevant contextual properties. Such an ontology challenges the exclusiveness of micro-based causal efficiency that grounds Kim’s reductionism, since configurations themselves are inherently causally efficient constituents. I anticipate and respond to the reductionist’s objection that the nonreductionist ontology’s account of causes and inter-level causal relations is incoherent. I also argue that such an ontology is not open to Kim’s overdetermination objection. (shrink)

After several decades during which formalization has flourished it now becomes possible to detect its shortcomings. A definition of formalization is given at the outset. It is next shown that the main justification of formalization as making explicit the form of a proof has serious difficulties. An important shortcoming is found in the fact that many validation procedures in logic and mathematics are not adequately represented deductively. Several such procedures relating to the validation of logical and mathematical sentences are examined. (...) It is concluded that formalization is materially inadequate. (shrink)

This article offers an alternative approach to paradigms that cast culture solely as a nurturing influence on children's language development. It proposes a dimensional model of Child-Directed Communication to delineate ways in which a community's habitus may impede the communicative potential of children with neuro-developmental conditions such as severe autism. It argues that certain features of Euro-American CDC are illadapted for autistic children. Due to inertia, caregivers often find themselves unable to transcend the limitations of CDC habitus. Yet, occasionally, (...) a transformation in CDC emerges that more effectively engages children with impairments. The article analyzes one such transformation forged in the niche of a unique mother–son relationship in India and then introduced in the USA. (shrink)
