There are two main messages in it that I find particularly important. First, Mark White derives from Kant (...) the idea of irreducible moral principles that govern the behavior of economic agents independently of welfarist and, more generally, consequentialist concerns. These principles of duty and the “incomparable worth” (21) of human dignity, as well as justice or rights, may not be economically traded off against some other motivations; hence, they simply evade economic reasoning altogether.Second, White endorses a version of libertarian Kantianism that treats people as individuals in essence (“autonomous”) and social in orientation (respecting the rights and the choices of the others). In discussing individualism, White attacks the conventional wisdom of economics and claims that preferences alone do not account for the identity of individuals [End Page 298] in space and time, although their unique characters do. Persons should be given free choice (absent in deterministic rational-choice models) and hence responsibility for their choices that incorporates the social factors in decision-making. However, White never mentions the almost insurmountable difficulties associated with fleshing out the truly individual features of a given person. Although he allows for a person’s identity and character changing over time, he does not recognize that character itself is in many respects a social construction.White criticizes paternalistic economic policies that suggest manipulating choice environments in order to follow the “true” preferences of the individuals. Instead, real consent, as satisfying both relevant preferences and principles (e.g. rights and human dignity), is, in his view, the sole criterion for justifying particular policy measures—not Pareto-efficiency or Kaldor-Hicks compensation. Economists’ obsession with efficiency leading to the misconceived notions such as “efficient level of crime” or “manageable level of terrorism” is also severely criticized.For White, the most popular formalistic version of the categorical imperative is less important than the other two—prohibiting treating other people simply as means and instituting the “Kingdom of Ends.” Formalism is reserved merely for the negative evaluation of actions and providing strict perfect duties that give clear guidance concerning what should not be done. White’s “Kantian-economic” model of decision-making incorporates perfect duties as constraints, and imperfect (positive) duties as preferences. He also stresses that for Kant, duties derived from the imperative depend on empirical knowledge, the context of decision-making, and judgment as a unique personal interpretation of the moral law. He further emphasizes the intersubjective role of Kantian morality: moral law should be universalizable to all rational persons (the “Kingdom of Ends” formula of the imperative), whereas rationality means not just following the patterns of behavior developed in the preference-oriented choice model, but rather acting on one’s beliefs and desires or choosing not to follow them, thus exhibiting genuine autonomy.The new and important contribution to the discussion is an explicit treatment of will as an inner faculty that, together with judgment, constitutes a person’s character or “self,” and helps to overcome the mere inclination to follow duty. Well [End Page 221] informed on ethics, criminal justice, and human rights, Marshall is a New Testament scholar at Victoria University in New Zealand.Marshall points out that the two best-known of Jesus’s parables—the Compassionate Samaritan, and the Prodigal Son—have been the most influential of Jesus’s parables in Western culture and legal theory. The Compassionate Samaritan is Jesus’s response to a lawyer’s question that answers a central legal question of the time: Who is my neighbor, whom I am obligated by Leviticus 19:7 to love as myself? In the Prodigal Son, the three main characters in legal offense are clearly portrayed as the offender, the victim, and the law-abiding community; in turn, as Marshall points out, “the older brother’s reaction centers directly on the justice of his father’s actions” (192–93). Marshall argues that present legal theory can learn from careful dialogue with these two parables. These parables are not only historically influential but also so insightfully and beautifully crafted that dialogue with them can bring incisive insights. In addition, dialogue with them presses Anglo-Saxon liberalism where it is weak and needs to grow.The parable of the Compassionate Samaritan opens up questions about the need for Good Samaritan laws that defend persons who come to the aid of a person in danger of death (e.g., from an accident, fire, or drowning) against liability for inadvertently and unintentionally causing damage. Under present Anglo-Saxon law, such good Samaritans can be sued for damages. This is not the case, however, in most European countries. Similarly, most European and Latin American countries have bad Samaritan laws: Where “victims are in mortal danger and unable to save themselves,” there is a legal duty for “those who are consciously aware of the victim’s predicament, who are close enough to intervene, and who have the effective means of intervention available to them” to come to the aid of the victims. “The most glaring exception to this pattern,” Marshall argues, “occurs in Anglo-American legal systems” because of liberalism’s maximization of individual liberty even against coercion to come to the aid of persons who would die if no help arrives (155). Samaritan laws “give formal expression to the supreme value of human life, to the bonds of solidarity and empathy that comprise human identity and that bind people together in social community, and to ongoing need human beings have to be committed to one another’s rescue and restoration when severe harm befalls them” (174).Responding to the parable of the Prodigal Son, Marshall argues that both compassion and repentance are crucial for understanding the humanity and the sufferings of persons being defended or judged by law. Readers of this journal are well-versed in the myriad ways in which nonhuman animals are harmfully exploited at the hands of human beings—from battery hens and veal calves to mass-produced pigs; from Pennsylvania pigeon shoots to canned hunts on Texas ranches; from rodeos to roadside zoos; from LD-50 toxicity tests on rats and Draize eye tests on rabbits to head trauma and infectious disease experimentation on primates. This important book was the first serious work of philosophy to address the question: Do adults have a moral right to use drugs for recreational purposes? Many critics of the 'war on drugs' denounce law enforcement as counterproductive and ineffective. Douglas Husak argues that the 'war on drugs' violates the moral rights of adults who want to use drugs for pleasure, and that criminal laws against such use are incompatible with moral rights. This is not a polemical tract but (...) a scrupulously argued work of philosophy that takes full account of all available data concerning drug use in the United States today. The author is careful to describe the properties a recreational drug would have to possess before the state would be justified in prohibiting it. Since criminal laws against the use of recreational drugs are justified neither by the harm users cause to themselves nor by the harm users cause to each other, Professor Husak concludes that such laws are, in almost all cases, unjustified. Plea bargaining is a response to capacity overload in the criminal justice system. It both preserves and belies the right to trial, making possible its glorious display but only by denying it in most cases. While plea bargaining has been documented and analysed copiously in historical, sociological and legal terms, its ethical status as an institutional practice are hazy. Richard Lippke offers an account of plea bargaining that draws on the normative debates over responsibility, culpability and desert, in aid of (...) a holistic proposal for a morally defensible system of pre-trial adjudication. In proposing an ethical system of plea bargaining, and working through the normative challenges to this, two bigger questions become visible. These are: what are the implications of developing, in essence, an ethics of efficiency, and, how should the criminal justice system be held to account for the inequalities (and iniquities) that exist before and outside it? In this review essay, I show how these questions are constructed in the book and make some attempt at analysing them, thus engaging with the more urgent and general issue of the complicated relationship of the ideal to the real when it comes to penal practice. He first returns to Genesis and successfully argues that "God blesses sex and declares it good" (4). He closely examines the story of the first man and woman and proposes the concept of "cleave to" in Genesis 2:24–25 as the guiding definition for a healthy marriage in our modern society. By revisiting and creatively retelling the stories of women in the Bible—Lot's wife, Sarah, Dinah, Rebekah, and Tamar—he restores the humanity and dignity of women and calls for our responsibility to dismantle the patriarchal structures that foster sexual abuse. He also provides alternative interpretations of the troubling biblical texts for LGBTQ communities to consider. After thoroughly surveying the biblical justification of patriarchy and the subjugation of women in the Hebrew Bible, he proposes that "the entire Bible should be read through the lens of the Gospel message, specifically passages like John 10:10" (13). Though a creative attempt to liberate the sacred text from oppression, this approach requires caution, as there may be possible anti-Semitic ramifications for reading the Hebrew Bible through a New Testament lens.One of the major contributions of De La Torre to the field of sexual ethics is the proposal of "orthoeros" through a liberative method that seriously considers liberation theology and goes beyond the inadequate approaches of both conservatives' sexual legalism and liberals' permissiveness toward sexual ethics. "Orthoeros" promotes a "familial relationship based on mutual giving and vulnerability" (21) and is made up of five biblically based principles: safe, consensual, faithful, mutually pleasing, and intimate.As an ethicist who is invested in the public discourse, De La Torre actively and boldly engages with issues of various sexual practices. He critiques Fifty Shades of Grey and envisions an ethical, Christian-based sadomasochism by employing "orthoeros" principles. He also examines the historical reasons against masturbation and argues for its constructive role in the sexuality of Christians.Deeply disturbed by the prevailing injustice that corrupts our society, De La Torre focuses much of the volume on exposing the sources and the detrimental effects of sexism, heterosexism, and racism. In this work, Carol V.A. Quinn considers survivors’ arguments in the debate concerning the ethics of using Nazi medical data, showing what it would mean to take their claims seriously. Her approach is interdisciplinary, incorporating philosophy, psychology, trauma research, survivors’ testimony, Holocaust poetry, literature, and the Hebrew Bible.

This volume is devoted to exploring a subject which, on the surface, might appear to be just a trending topic. In fact, it is much more than a trend. It relates to an ancient, permanent issue which directly connects with people's life and basic needs: the recognition and protection of individuals' dignity, in particular the inherent worthiness of the most vulnerable human beings. The content of this book is described well enough by its title: 'Human Dignity of the Vulnerable (...) in the Age of Rights'. Certainly, we do not claim that only the human dignity of vulnerable people should be recognized and protected. We rather argue that, since vulnerability is part of the human condition, human vulnerability is not at odds with human dignity. To put it simply, human dignity is compatible with vulnerability. A concept of human dignity which discards or denies the dignity of the vulnerable and weak is at odds with the real human condition. Even those individuals who might seem more skilled and talented are fragile, vulnerable and limited. We need to realize that human condition is not limitless. It is crucial to re-discover a sense of moderation regarding ourselves, a sense of reality concerning our own nature. Some lines of thought take the opposite view. It is sometimes argued that humankind is - or is called to be - powerful, and that the time will come when there will be no vulnerability, no fragility, no limits at all. Human beings will become like God (or what believers might think God to be). This perspective rejects human vulnerability as in intrinsic evil. Those who are frail or weak, who are not autonomous or not able to care for themselves, do not possess dignity. In this volume it is claimed that vulnerability is an inherent part of human condition, and because human dignity belongs to all individuals, laws are called to recognize and protect the rights of all of them, particularly of those who might appear to be more vulnerable and fragile. Plato not only perceived human dignity, but a recognition of dignity is also visible in his conception of justice, which forms (...) the core of his philosophy. Plato’s Republic is consistently interpreted here as a treatise on justice, relating to an individual and not to the state. The famous myth of the cave is a story about education taking place in the world here and now. The best activity is not contemplation, but acting for the benefit of others. Although the essays in this volume acknowledge that the primary locus for the love and care of children is the family, they also engage other contexts including religious communities, courts, and legislative bodies.In a section dealing with social-psychological perspectives on this theme, Peter Benson and Eugene Roehlkepartain make the case that doing the best for children requires shifting from a deficit model that focuses on what children lack to a model that emphasizes their developmental assets. While the story of Stanislav Petrov – the Soviet Lieutenant Colonel who likely saved the world from nuclear holocaust in 1983 – is often trotted out to advocate for the view that human beings ought to be kept “in the loop” of automated weapons’ responses, I argue that the episode in fact belies this reading. By attending more closely to the features of this event – to Petrov’s professional background, to his familiarity with the warning system, and to his decisions (...) to defy his protocol – it becomes clear that Petrov was not seamlessly working “in his loop,” but reassessing it entirely. I claim that this exhibits a paradox intrinsic to all automated loops: namely, that their optimum function in fact rests on unforeseen human interventions that cannot be reliably codified ex ante, that is, that good judgment cannot simply be “programmed into” their protocols. This dependence, moreover, reveals automation’s ineluctable need for virtue ethics – not in the usual sense (whereby ethics deliberates about, say, possible damages and loss of life), but in the sense that ethical judgment, rightly understood, entails the reassessment of all of the conditions surrounding a decision, including whether a protocol should be followed at all. In Justice, Care, and Value Thomas Randall advances the radical potential of care ethics as a distinct (and preferable) theory of distributive justice. Advancing the care ethical literature this book defends a vision of society that can best enable such relations to flourish. Specifically, Randall uses breakthrough arguments to propose a values-driven theory of care ethics that identifies good caring relations through classifying the values of care. He argues that such a theory gives us unique and meaningful solutions to (...) contemporary questions and encourages us to think about distributive justice across personal, political, global, and intergenerational domains. Through this the book makes significant strides to engage care ethics with the broader moral and political philosophy literature. Topical and interdisciplinary, Randall demonstrates that care ethics has the conceptual resources to ground distributive theories of socialism, territorial and natural resource rights, obligations to future generations, and historic redress. The book will be of great interest for academics, researchers, and students in feminist philosophy, but also in liberalism, global and intergenerational theories of justice, and political economy. By interpreting political possibilities with Christian commitments to justice, the book makes a distinctively practical contribution to the literature on Christianity and climate; it lifts an important theological voice in the growing subfield of climate ethics.The book begins by elaborating the general notion of ecological justice into workable criteria. Martin-Schramm describes four basic norms of ecojustice (sustainability, sufficiency, participation, and solidarity), from which he develops twelve energy policy guidelines (e.g., equity, adequacy). He then specifies those guidelines into fourteen criteria by which to assess the justice of climate action (e.g., historical responsibility, emissions verifiability).Subsequent chapters use those criteria to evaluate policy options. A chief difficulty in applying them lies in the tension between intergenerational and intragenerational claims. Global climate negotiations founder on disagreements about these undeveloped, plural dimensions of justice. Martin-Schramm therefore deploys criteria with a balancing objective: to develop obligations to the future while recognizing claims of the present poor and vulnerable, and while keeping the result within the bounds of North American political viability.For example, Martin-Schramm recognizes that the criterion of historical responsibility indicates that the United States should bear about one-third of the costs of climate transition. Since those emission reductions are unlikely apart from a price on carbon, Martin-Schramm argues that justice mandates a fossil fuel tax. Kant is probably one of the most misunderstood philosophers in the history of Western thought. Some of the most well-known and pervasive objections to Kant’s practical philosophy often rest on considerable misunderstandings of his central theses or a poor and superficial reading of his work. A common misconception is that in Kant’s practical philosophy there is no place or role for human happiness. In Happiness in Kant’s Practical Philosophy: Morality, Indirect Duties, and Welfare Rights, Alice Pinheiro Walla dispels this misunderstanding (...) by elucidating Kant’s conception of happiness (understood in broadly hedonist terms) and showing that, for Kant, the pursuit of happiness plays an important role in our personal and collective lives. This means that, far from endorsing an ascetic ideal of the moral agent, as it is commonly thought, Kant’s system embraces an ideal of the human life in which there is significant space, and even a duty, to pursue pleasurable endeavours. Somehow surprisingly, in Pinheiro Walla’s reading, Kant’s ethics is arguably less demanding than standard interpretations of Aristotelian and Utilitarian ethical theories. (shrink)

In this book the practical dimension of social justice is explained using the analysis and discussion of a variety of well-known topics. These include: the relation between theory and practice in normative political philosophy; the issue of justice under uncertainty; the question of whether we can and should unmask social injustices by means of conspiracy theories; the issues of privacy and the right to privacy; the issue of how certain psychological states may affect our moral obligations, in particular the (...) obligation to treat others fairly; and finally the concepts of morality, fairness, and self-deception. The primary goal of the book is to provide readers with an updated discussion of some important and practical social justice issues. These issues are presented from a new perspective, based on the author ́s research. It is hoped that bringing these topics together in a single book will promote the emergence of new insights and challenges for future research. This paper will analyse what it takes to conduct feminist and sensitive research in countries that have seen mass human rights violations. Transitional justice research involves critical examination of difficult topics which raises a number of ethical and methodological issues for both the participants and the researchers. Although empirical research has been a facet of the studies produced in the field, researchers’ accounts of undertaking research in often politically sensitive environments is largely missing from published books and research reports. This (...) paper is informed by personal experiences of doing research in wartime rape in the ethnically and politically divided country of Bosnia and Herzegovina. I argue that the researcher’s profile and positionality directly affects the fieldwork and that fieldwork is a dialogical process which is structured by the researcher and the wider political processes in the country. This review uses the excellent recent anthology, What Is Enough: Sufficiency, Justice, and Health, edited by Carina Fourie and Annette Rid, as a springboard for a discussion of a little-noticed problem for sufficientarian principles governing the distribution of health or health care. All sufficientarian principles must be assigned a scope: the set of individuals who are to be brought up to the level of sufficiency. When it comes to health and health care, sufficientarians will, rightly, want to reject broad scopes, (...) because they will entail that we are accountable for securing health care for, for example, wild animals. Unfortunately, any narrow scope will seem morally arbitrary, because it will imply that among all the individuals who could benefit from health care we are obligated to provide it only to some of them. But, I suggest here that such arbitrariness is no problem for narrow-scope sufficientarianism in health or health care as long as the principle is cast as a non-fundamental principle of public policy as opposed to a fundamental moral principle. There are many challenges to be met when writing an introductory treatise on an academic topic. The subject matter must be presented in a simple but not oversimplified manner. Enough theory must be included to ground the discussion of specific issues but not so much as to overwhelm or bore the readers. The text should be long enough to do justice to the subject matter but short enough to be readily accessible, especially for readers such as healthcare professionals, whose primary (...) concerns lie elsewhere.There are additional challenges in a relatively novel interdisciplinary field such as bioethics. The scope and methodology of bioethics are matters of great controversy, as are its relations with related subjects such as professionalism and human rights. The field is so broad that a single author cannot claim expertise on all topics. Rivalries between law and ethics and among medicine, other health professions, and disciplines such as philosophy complicate efforts to produce a broadly acceptable text. Finally, national and cultural differences pose major challenges to anyone trying to write for a truly international readership.The difficulty of meeting all these challenges in producing the WMA Medical Ethics Manual provides ample opportunity for criticism, especially from bioethics experts. The three expert reviewers of the manual in this issue of the journal are remarkably restrained in pointing out its shortcomings.1–3 I am grateful for both their positive evaluations and their constructive criticism. In what follows, I will respond to each of them in turn, focusing in particular on their suggestions as to how the Manual could have been improved.Before addressing these suggestions, I wish to clarify a matter raised by Søren Holm, namely, to what degree the manual …. In his book, World Poverty and Human Rights, Pogge sets out to articulate an approach to basic justice that is inversal and cosmopolitan. This notion of justice is to be articulated through the language of human rights. Pogge’s arguments about justice, moral universalism and cosmopolitanism are impressive and reward serious study. It is to be hoped. indeed, that many aspects of his argument might be adopted by the elite ruling classes of world politics; they have much to offer in (...) the project of creating a world that is humane for all. The issues that I have raised in the foregoing argument however are central to the integrity of Pogge’s project. I have argued, in sum that it is not possible to advance a program for the expansion of justice and the implementation of human rights in world politics without making an appeal to a specific account of the nature of justice and of human rights. The account that informs Pogge’s argument is that of political liberalism, and this is an account that has much in its favor as a preferred vehicle for justice in world politics. However, this account makes itself vulnerable when it argues for universal principles without acknowledging their partisan and normative base. My argument has been that this issue is at the center of Pogge’s attempt to isolate the conception of human rights he explicates, which he wants to serve as the language for his global ethical universalism, from the ontological affirmations which make that conception of human rights possible, and which of necessity tie human rights to a specific conception of the nature of the good for human persons and groups. The attempt to establish a single, universal criterion of justice, and to express it in the language of human rights, is undermined from within for as long as it fails to engage with ontological concerns. ISBN: 0-19-515203-4.At the very last page of her book Kristin Shrader-Frechette writes: "We fail to recognize that unless we are the agents of democracy and social reform, there will be neither democracy nor social reform." This is such a (...) short sentence, and yet it is so important. Shrader-Frechette writes this book in order for us the readers to be moved both philosophically and politically speaking. It is a Socratic way of shocking the student, and causing her to reflect upon the way she has conceived things, the way she has interpreted the world. This is not an easy book to read—it is more like watching a violent film: it tells us about greediness, cruelty, misery, cynicism, and the like. But just like watching a good film, after reading the book one cannot remain indifferent.This book, then, is not a typical neutral piece of philosophy or social science. Shrader-Frechette has an agenda on her mind, and she claims that not only is it wrong not to do something to stop environmental injustice, but in fact people have a duty to be active, politically speaking (see especially [End Page 140] pp. 195-7). Indeed, it is about time environmental philosophers realize that they have a social obligation not to remain unconcerned. Their first weapon is their philosophical tools, which they should employ to reveal and criticize what is going on. In this case, for example, Shrader-Frechette not only describes many cases of environmental injustice, but she also eloquently analyzes the arguments that are used by those opposing policies that are meant to rectify environmental disadvantages. Her position is unequivocal: environmental injustice is wrong because it is immoral, and because it discriminates against people, often the more vulnerable. Environmental injustice is defended by arguments which are philosophically flawed and morally repugnant. However, there are growing cases of environmental injustice because there are strong interests behind them, and because the more powerful can exploit the vulnerability of those marginalized by society. The reader can hear the echo of the French novelist Emile Zola's famous article, apropos of the Dreyfus affair: "J'accuse."What is 'environmental justice'? Often goods (e.g., cheaper electricity or faster cars) are manufactured with an environmental cost (pollution). Obviously, one relevant question is whether we need these goods. Let us assume that society decides we do. Sometimes this production ends up in severe injustice. Sometimes only the rich enjoy the benefits (e.g., faster cars) while the entire population pays the cost (more air pollution, more noise). Sometimes it is the case that society in general enjoys the benefits (e.g., cheaper electricity). Nevertheless, only a small group bears the cost.Why is the cost so unevenly distributed? First, pollution and hazardous waste must be treated by professionals so it is transferred to, and concentrated in several locations to be treated. This exposes the populations that live there to very high levels of pollution. These people, then, face risks to their health and well-being, which other people do not have to face.Furthermore, when this happens house prices in the area usually fall, and these people are trapped there: so sharp is the fall in house pricing in their area that they cannot move to another, cleaner, or safer place, because whatever price they will get for their houses won't allow them to buy a decent house in cleaner areas. Once the process has started, even more pollution is attracted to this place. This is partly due to market forces: buying burial space for hazardous waste becomes very cheap in these locations, and therefore more and more firms use these locations for the burial [End Page 141] of hazardous waste. However, there is a second reason for this: it seems that the authorities and committees that decide where to send the waste to, are formed by middle class people who are less likely to live in those locations. Previously in the West, dignity has been seen in two ways: as something inherent in one’s station (...) in life, whether acquired or conferred by birth; or more recently as an essential condition and right common to all of humanity. In what might be called a work of observational philosophy—an effort to describe the philosophy underlying the Black Lives Matter movement—Vincent W. Lloyd defines dignity as something performative, not an essential quality but an action: struggle against domination. Without struggle, there is no dignity. He defines anti-Blackness as an inescapable condition of American life, and the slave’s struggle against the master as the “primal scene” of domination and resistance. In addition, he turns to the early church fathers to contend that, prior to Constantine, “without exception, the church strongly condemned the taking of human life in any form whatsoever”—thus rejecting abortion and infanticide, the blood sport of the Roman games, suicide, and killing in war (120). This was because the New Testament witness to Jesus and his death on the cross required early Christians to view “the means as just as important, if not more important, than the ends” (xiii).Arner supplements this deontological argument for Christian pacifism, which he learned from John Howard Yoder, with a brief consideration of the virtue of patience cultivated in the early churches, reflecting the influence of Stanley Hauerwas on his thought. This “cardinal virtue” connoting “longsuffering, forbearance, patient endurance”—as found in Jesus’s teaching in the Sermon on the Mount (Mt 5:38–48)—enabled early Christians to practice non-violent resistance “deferring personal revenge in favor of God’s vindicating justice” (98). If Christians were to adopt this same consistently pro-life ethic today, argues Arner, it would “lead to greater healing and peace in our blood-soaked world” (121). The book closes with three appendices—one of which is a chart of terminology that dehumanizes vulnerable victims, including unborn human beings. Unfortunately, the book does not have an index.Christ at the Checkpoint, edited by Paul Alexander (professor of Christian ethics and public policy at the Palmer Theological Seminary of Eastern University), includes thirteen plenary addresses delivered at a conference on the Arab-Israeli conflict organized by Palestinian Evangelical Christians at Bethlehem Bible College in March 2010. Almost all of the contributors to this volume—including biblical scholars, theologians, ethicists, pastors, activists, and others—criticize the ideology of Christian Zionism and its support of a theology of dispensationalism that, in their view, distorts the scriptures and fosters violence rather than reconciliation between the Israelis and the Palestinians. In his own presentation titled “What Can Pentecostals and Charismatics Do for Peace with Justice in Israel and Palestine?,” Alexander—who describes himself as a former “one-sided” Christian Zionist who later discovered the writings of Yoder and Hauerwas—appeals to Jesus’s teaching in the Sermon on the Mount and urges Pentecostals to create church communities “that cultivate persons of character and conviction, who through habits, practices, and action live out the core of our faith” (69). On the argumentative journey from private property and punishment, via the "emptiness" of Kant's moral law to Hegel's vision of a (...) rational social order, it is easy to lose sight of the overall arch of Hegel's argument. Indeed, this kind of problem is confounded by an ever-growing literature on individual ideas and sections of the text (from Hegel's conception of agency to his argument for the market economy), which, while interesting and rewarding on their own, direct our attention to parts of his argument, rather than to the Philosophy of Right as a whole.Dean Moyar's new book is devoted to making us see the forest again—albeit while never leaving the trees out of sight. Indeed, to stretch the metaphor of forest and trees a little bit further, Moyar builds his ambitious endeavor on two new interpretative theses, which enable him to show us completely new paths through and clearings in the forest, bringing to light previously underappreciated aspects of the argument and adding refreshing new takes on the parts of Hegel's view that are already well known.The first of Moyar's two central theses concerns Hegel's methodology in his Philosophy of Right. But while this Hegelian process is dynamic, relying on conflicts and their resolution, the process is—in contrast to some pragmatist forms of inferentialism—not open-ended: instead, or so Moyar convincingly argues, it leads to a point of inferential equilibrium as telos of the text (Hegel's vision of Ethical Life), in which some dynamism persists but further development of right is no longer necessary.This kind of interpretation, Moyar argues, has several advantages: it renders the methodology of the Philosophy of Right consistent with the method of Hegel's Logic, but it also provides us with a general template (which Moyar calls the "basic argument" [30 and passim]) on which to understand all the different transitions in the Philosophy of Right as structurally analogous, thereby showing Hegel to be both intertextually and intratextually consistent. Flynn; ix & 212 pp. Lincoln: University of Nebraska Press, 2000, $40.00. James Flynn's search for non-objective grounds for humane ideals opens with an admission that the author spent decades searching for an "ethical truth-test" by which (...) to measure ideals. This truth-test would constitute a "higher court of appeals," a nonpartisan judgment of right and wrong that would grant objectivity to the winning belief. This is the stance of Socrates and Kant. What Flynn came to realize was that the truth-tests he sampled proved to be contradictory, easily exploited, and ineffectual in convincing people of the tests' warrant. For many this collapse of ethical truth leads to relativism, and a concomitant tolerance of the values of others, however repellant one finds them. This is the stance of the postmodernists, those dedicated to "building bonfires to celebrate the demise of the Enlightenment" (p. 181). But Flynn deems the anti-truth position just as contradictory and exploitable as the truth-test position. Instead, he proposes an intermediate stance, short of objective truth but more than relativist assertion, an outlook that takes the best of truth, beauty, diversity, perfectibility, utilitarianism, and justice and casts them in a relation of trade-off and compromise.To reach this negotiation model of humaneness, Flynn must dispense with [End Page 177] three faulty beliefs. The first mistake is the objective one, that is, the reliance on ethical truth-tests (chapters 2-4). The problem lies in their grounding in "a theory of being that posits something beyond the physical universe... or that asserts that the physical universe contains something not revealed by science, such as the purposes of nature" (pp. 47-48). Plato has his Forms, Rousseau his nature, Moore his "moral goodness." The difficulty with these criteria is that, granted their existence, we know not how to apply them to human affairs. We may appeal to God to justify our actions, but in doing so "we tend to assume that God's overriding criterion of moral rectitude is similar to our own. The humane posit a benevolent God, the not so humane a stern God" (p. 72). In other words, such criteria beg the question of their use. Their transcendence of the world renders them eminently adaptable to various worldly designs, for example, when Kant reads into nature "whatever content he needs to get decisions in favor of his own principles" (p. 77).When ethical truth-tests fail in their implementation, the temptation is to reject ethical grounds altogether. Flynn terms this the "nihilist fallacy," the notion that if there is no extra-human ground for ethics, no ethical truth-test, then no ethic is justified. Flynn counters that "Even in the absence of a truth-test, people may internalize ideals and be deeply committed to them" (p. 9). They believe in those ideals not because they think they are true, but because they think they are right. Only those who believe that ethical beliefs are an epistemological matter assume that ideals must be shored up by evidence and proven to be correct. It is ironic, Flynn notes, that it is anti-epistemologists like Nietzsche who make this argument, claiming that ethical believers fail a truth-test when in fact those believers are not interested in truth-testing at all.The flip side of this nihilism is postmodernism, another ethical outlook Flynn rejects. Nihilists and postmodernists share an epistemological skepticism, treating putatively objective ideals as disguised power plays concocted to promote certain interests. Over the past twenty years, numerous philosophers have produced important works on the ethical perspectives and social and political philosophy of the classic thinkers of the pragmatist tradition, including several volumes on John Dewey and William James, and a volume on Charles S. Peirce that James Liszka also published in 2021. However, there exist few general statements of the potential of the pragmatist approach to the topic of ethics in general. For this reason, Liszka's new book outlining pragmatist ethics is welcome. Despite its concise presentation of only about 170 pages, Liszka manages to discuss a number of pragmatist notions and views both in their historical context and in contrast and comparison with contemporary arguments, particularly ones developed in the fields of metaethics and normative ethics of the analytic tradition.As both a scholar and a philosopher, Liszka offers his own perspective on the pragmatist approach and what is unique and distinctive about it. In the introduction, the pragmatist perspective is described as beginning with an examination of actual problems to develop solutions that may reveal what would be good or better than the present, rather than aiming at the development of a concept of the good that could then be applied in particular cases. The remainder of the book can be characterised as developing this notion of ethics through the lenses of philosophical debates, both historical and contemporary, on practical reasoning, community, inquiry, and moral progress. Following the introduction, Liszka presents in the second chapter his pragmatist, problem-based ethics as a response to the "tragedy of life", in the sense of an inevitable conflict of goods and values, with the melioristic slogan "solve problems, and good will follow". In the third chapter, Liszka delves deeper into the roots of his problem-based ethics by looking at the writings of the classical pragmatists, including Peirce's maxim of pragmatism, James's account of truth as that which brings us into a satisfactory relation with other parts of our experience, Peirce's notion of the community of inquiry, and Dewey's account of democracy as the setting for solving the problems of the community. James Wallace's account of practices as potential solutions for problems provides Liszka with an important stepping stone to his conclusion, drawn at the end of this chapter, that in order to solve problems, practices must aim to attain a good end in the right way.However, this formal conclusion does not provide specific guidance on how problems should be solved. Providing such guidance is the task of practical reason, the subject of chapter four. David Hollenbach’s introduction explains how the book brings together Christian (mostly Catholic) theologians, human rights activists, humanitarian practitioners, and legal scholars to help us focus on a class of persons referred to as “forced migrants” or “persons needing protection.” These individuals are neither classical “convention refugees” (according to international law definitions) nor are they simply “migrant workers” (in the classical sense) since their basic human rights to security and subsistence cannot [End Page 230] be adequately guaranteed in their home country or region. They do not emigrate merely in search of a higher standard of living; rather, forced migrants enter and settle in foreign lands seeking some sort of “protection” similar to that afforded to “conventional” refugees. More concretely, the book focuses on persons on the move—individuals fleeing violence and the extreme poverty rampant in regions devastated by ecological degradation and natural disasters.Extending the logic of the 1952 Refugee Convention and adapting it to the realities of today, one can argue convincingly that the international community has a duty to protect such persons when their states of origin are structurally unable or unwilling to afford protection (as argued in Susan Martin’s essay). However, paternalistic approaches that diminish rather than augment the agency of local governments and migrants are to be avoided (as maintained in M. Brinton Lykes’ essay). The book helps us reflect on what can be done to guarantee the basic rights of forced migrants not only at the level of international law and institutions but also through domestic and regional policymaking spurred and inspired by both Christian and secular global-humanitarian values. Such values are eminently compatible when applied to this particular issue (see Silvano Tomasi’s contribution). Agbonkhianmeghe Orobator’s essay—which offers insightful reflections (albeit rather general ones) from Christian ethics, ecclesiology, and biblical theology—likewise points to the need for a truly interdisciplinary approach to the issue. The other authors help the book achieve precisely this. Theological ethics finds its own distinctive place and voice in dialogue with a range of perspectives: legal and political sciences and case studies (Frank Brennan, Daniel Kanstroom); philosophical approaches (Arash Abizadeh); and sociological research on particular migrant populations (M. Brinton Lykes, Maryanne Loughry). The book includes essays that integrate case studies, technical reflections, useful summaries of theological principles and doctrines (J. Bryan Hehir, Mary M. DeLorey, and Tomasi), and philosophical stances (Abizadeh, Thomas G. Weiss), and present practical and legal proposals (see Martin’s essay). A stimulating read for scholars and for the general public, the volume provides good training material for faith-based activists and practitioners.The argumentation strategy in many of the essays in Driven from Home is to appeal to the reader’s sense of solidarity with the needy or suffering neighbor. It promotes the virtues of hospitable citizenship and hospitable disciple-ship while carefully trying to convince national and international policymakers to reinforce and expand the international protection regime. Emboldened by the 2005 “Responsibility to Protect” breakthrough at the United Nations, the authors seek to remain acceptable to a wide audience in an atmosphere of resurgent nationalism, nativism, and protectionism. Background Many indigenous people have died or been harmed because of inadequately monitored research. Strong regulations in Human Research Ethics (HRE) are required to address these injustices and to ensure that peoples’ participation in health research is safe. Indigenous peoples advocate that research that respects indigenous principles can contribute to addressing their health inequities. This scoping literature review aims to analyze existing peer reviewed and grey literature to explore how indigenous values and principles from countries of Oceania are incorporated into (...) HRE and the governance of research involving human participants. Methods A scoping literature review framework was used for this study. A search for peer reviewed and grey literature from Google, bibliographies, and electronic databases such as SCOPUS, SPRINGER, Medline (Ovid) and JBI Database of Systematic Reviews was conducted, limited to the years 2002–2020. Sixty (60) documents that focused on indigenous knowledge from Oceania region and HRE were included, from which key findings and themes were synthesized. Results Charting the data showed that more than half the eligible documents were peer-reviewed journal articles (54%). Other sources included: International Declarations on Human Research (8%); book chapters (8%); government documents (8%); HRE Guidelines or protocols (13%); news articles (7%) and PhD thesis (2%). The literature was from Australia, Cook Islands, Guam, New Zealand, Fiji, Samoa, Tonga and Vanuatu, some of which focused specifically on HREs in the Pacific Region. Issues emerging from the literature were grouped into five themes (i) indigenous and cultural principles of HRE; (ii) informed consent in indigenous settings in Oceania; (iii) vulnerability and minority status of indigenous populations exploited for research; (iv) research ethics governance for Oceania indigenous peoples; and (v) research ethics committees in Oceania. Respect, relationship building, and trust were priority indigenous HRE principles that encompass the principles of partnership, capacity building, reciprocity, and equality. Relationship building and trust imply the equal distribution of benefits for indigenous population and researchers. Conclusion Indigenous principles of HRE identified were interconnected and interdependent. Recommendations were to incorporate indigenous principles of research in HRE regulations and processes of all countries with indigenous populations. This is especially pertinent for emerging national research committees in LMIC countries, including Fiji and Tonga. Relationship building among researchers and indigenous populations is key to successful research with indigenous populations. HRE principles important for relationship building include respect that is reciprocal among researchers and indigenous people. Elements of the principle of respect highlighted are empathy, collaboration, sharing of benefits, reciprocity, appreciation, empowerment, protection, safety and awareness of culture and languages. Indigenous ontology from the Oceania region involves spirituality, connectedness to land, religious beliefs and a participatory approach to HRE and should be respected in research. An ethical governance mechanism of HRE is one that incorporates indigenous principles and applications for the purpose of maximizing the protection of the dignity and rights of indigenous peoples of Oceania.
