The traditional distinction between retributive and distributive justice misconstrues the place of the criminal law in modern regulatory states. In the context of the regulatory state, the criminal law is a coercive rule-enforcing institution – regardless of whether it also serves the ends of retributive justice. As a rule-enforcing institution, the criminal law is deeply implicated in stabilizing the institutions and legal rules by means of which a state creates and allocates social advantage. As a coercive institution, the criminal law (...) requires justification as an instance of legitimate state authority. The operation of criminal justice institutions should therefore not be evaluated by reference to a distinct set of criteria, but should be evaluated by the same criteria that apply to coercive public institutions generally. It is often assumed that chemistry was a typical positivistic science as long as chemists used atomic and molecular models as mere fictions and denied any concern with their real existence. Even when they use notions such as molecular orbitals chemists do not reify them and often claim that they are mere models or instrumental artefacts. However a glimpse on the history of chemistry in the longue durée suggests that such denials of the ontological status of chemical entities do not (...) testify for any specific allegiance of chemists to positivism. Rather it suggests that the dilemma positivism vs realism is inappropriate for characterizing the ontology of chemistry. This alternative shaped at the turn of the twentieth century in the context of controversies about atomic physics does not take into account the major concern of chemists, i.e. making up things. Only by considering what matters for chemists, their matters of concern rather than their matter theories, can we expect to get an insight on their ontological assumptions. The argumentation based on historical data is twofold. It is wellknown that generating new substances out of initial ingredients which is the raison d'être of chemistry raised a vexing puzzle which has been alternatively solved with the Aristotelian notion of mixt and the Lavoisieran notion of compound. I argue that an essential tension remains intrinsic in chemistry between the two conceptual frameworks. The second section tries to make sense of the long tradition in chemistry of ontological noncommitment. I argue that what is usually considered as a denial of the existence of the basic units of matter would be better characterized as a focus on more important actors on the chemical stage. (shrink)

"Public engagement in science" is one of the buzzwords that, since 2000, has been used in nanotechnology programs. To what extent does public engagement disrupt the traditional relations between science and the public? This paper briefly contrasts the traditional model of science communication - the diffusionist model - that prevailed in the twentieth century and the new model - the participatory model - that tends to prevail nowadays. How should we update de dicto beliefs in the face of de se evidence? The Sleeping Beauty problem divides philosophers into two camps, halfers and thirders. But there is some disagreement among halfers about how their position should generalize to other examples. A full generalization is not always given; one notable exception is the Halfer Rule, under which the agent updates her uncentered beliefs based on only the uncentered part of her evidence. In this brief article, I provide a simple (...) example for which the Halfer Rule prescribes credences that, I argue, cannot be reasonably held by anyone. In particular, these credences constitute an egregious violation of the Reflection Principle. I then discuss the consequences for halfing in general. (shrink)

Résumé La défense du marché dans la tradition socialiste libérale est instrumentale : le marché est toléré lorsqu’il permet de produire des richesses en abondance que l’on peut redistribuer ex post. De son côté, la justification républicaine du marché, telle que présentée dans les travaux de Pettit, vise à réduire la domination dans l’échange. Cet article soutient qu’une telle justification nécessite d’être renforcée en l’adossant à un égalitarisme matériel, garant d’un échange entre égaux, établi ex ante.

The promises of nanotechnology have been framed by a variety of metaphors, that not only channel the attention of the public, orient the questions asked by researchers, and convey epistemic choices closely linked to ethical preferences. In particular, the image of the ‘therapeutic missile’ commonly used to present targeted drug delivery devices emphasizes precision, control, surveillance and efficiency. Such values are highly praised in the current context of crisis of pharmaceutical innovation where military metaphors foster a general mobilization of resources (...) from multiple fields of cutting-edge research. The missile metaphor, reminiscent of Paul Ehrlich’s ‘magic bullet’, has framed the problem in simple terms: how to deliver the right dose in the right place at the right moment? Chemists, physicists and engineers who design multi-functional devices operating in vitro can think in such terms, as long as the devices are not actually operating through the messy environment of the body. A close look at what has been done and what remains to be done suggests that the metaphor of the “therapeutic missile” is neither sufficient, nor even necessary. Recent developments in nanomedicine suggest that therapeutic efficacy cannot be obtained without negotiating with the biological milieu and taking advantage of what it affords. An ‘oikological’ approach seems more appropriate, more heuristic and more promising than the popular missile. It is based on the view of organism as an oikos that has to be carefully managed. The dispositions of nanocapsules have to be coupled with the affordances of the environment. As it requires dealing with nanoparticles as relational entities (defined by their potential for interactions) rather than as stable substances (defined by intrinsic properties) this metaphor eventually might well change research priorities in nanotechnology in general. The temporal logic KtT4 is the modal logic obtained from the minimal temporal logic Kt by requiring the accessibility relation to be reflexive and transitive. This article aims, firstly, at providing both a model-theoretic and a proof-theoretic characterisation of a four-valued extension of the temporal logic KtT4 and, secondly, at identifying some of the most useful properties of this extension in the context of partial and paraconsistent logics.

Cet article propose d'interroger la notion de contextualisation à partir d'une perspective d'analyse textuelle des discours. La contextualisation est ici définie comme le processus par lequel le chercheur tente d’établir la pertinence d’une mise en relation entre un texte et un autre (ou plusieurs autres) et de leur regroupement au sein d’un corpus. Trois critères (générique, auctorial et thématique) sont identifiés, autorisant les passages de texte à texte(s) et dessinant ce que nous suggérons d'appeler des sphères de contextualisation. I analyze the complex relations between Pascal and the three figures of Montaigne, Descartes, and St. Augustine, and the relations the first two figures bear to St. Augustine. For Pascal's philosophy, one is in effect a resource , another a way of thinking that he makes his own , and yet another serves as a model . I further investigate Pascal's anti-Augustinism, that is, some of the points of resistance in Pascal against the thought of St. Augustine. Central to this (...) investigation is the famous rapprochement between the cogitos of Augustine and Descartes, which requires a consideration of what, for Pascal, it means "to say the same thing." This analysis leads us to two conclusions: first, Augustine's The City of God should be placed among the number of works that Pascal did not read; second, there are fundamental philosophical reasons for Pascal to reject certain theses central to that work. Above all, there should no longer be any need to assume a merely abstract conception of an unproblematic Augustinianism in Pascal. (shrink)

The Natural Contract (1990) marks the emergence of the environmental question in Serres’s work that became central in his later publications. Over the twenty years when the Anthropocene emerged as a distinct narrative entangling geological time with the history of human technology, Serres developed a rather similar “Grand Récit” embracing deep geological time, biological evolution, the process of hominization, and the future of humankind, although he did not enter into conversation with the leading figures of the interdisciplinary field of Anthropocene (...) studies. This paper seeks to characterize Serres’s position in the field of environmental philosophy as it has been reconfigured by the introduction of the concept of the Anthropocene. It first briefly surveys the personal pathway that led Serres to his diagnosis of a global climate crisis. It then compares the concepts that guided his analysis with the concepts debated in Anthropocene studies. Finally, I will suggest that the ethical measures proposed by Serres to face the crisis did not help to bring him into dialogue with the Anthropocene scholars. (shrink)

ABSTRACT Medical AID organisations such as Médecins Sans Frontières receive several requests from individuals and international academic institutions to conduct research at their implementation sites in Africa. Do AID agencies have an ethical duty to comply with research requests? In this paper we respond to the views and constructed theories (albeit unfounded) of one such researcher, whose request to conduct research at one of our sites in the Democratic Republic of Congo was turned down.

L'intérêt considérable de la théorie de la culture défendue par Dan Sperber, dans son livre La contagion des idées, est d'expliciter plus fermement que de coutume les présupposés ontologiques d'une approche atomiste dans ce domaine. L'ethnographe présuppose qu'il y a dans le monde, non seulement des personnes, mais des idées. Comment les idées sont-elles dans le monde ? Le 'monisme ontologique' de Sperber consiste à refuser de multiplier les genres d'entités. Les idées sont donc, selon lui, des entités matérielles au (...) même titre que les personnes. Pourtant, le véritable problème ontologique qui se pose au sujet des idées n'est pas de décider si elles sont des objets matériels ou plutôt des objets immatériels, mais de savoir si leur mode d'être est celui des objets ou s'il est d'une autre catégorie que celle des objets.
