Der protestantische Theologe Karl Girgensohn (1875–1925) ist 1903 mit seinem frühen Werk über das Wesen der Religion an die Öffentlichkeit getreten, welches einen starken religionsphilosophischen Standpunkt zum Ausdruck bringt. Kernüberlegung ist hierbei eine kognitive Theorie des Religiösen, in der die Gottesidee zentral ist. Unter Berücksichtigung der Biographie Girgensohns geht der vorliegende Beitrag auf diese frühe Studie zum Wesen der Religion ein und skizziert den Übergang des Autors von einem philosophischen zu einem experimentell-introspektiven Ansatz der Religiositätsforschung, welcher dann zum Fundament für (...) die Dorpater religionspsychologische Schule wurde. Basierend auf Girgensohns frühem Werk werden abschließend Implikationen für die heutige empirische Theologie vorgeschlagen.The Protestant theologian Karl Girgensohn (1875–1925) came to the public in 1903 with his early work on the nature of religion, which expresses a strong religious-philosophical standpoint. The core consideration here is a cognitive theory of the religious, in which the idea of God is central. Taking into account Girgensohn’s biography, the present contribution addresses this early study on the nature of religion and outlines the author’s transition from a philosophical to an experimental-introspective approach to religious research, which then became the foundation for the Dorpat School of the psychology of religion. Based on Girgensohn’s early work, implications for contemporary empirical theology are finally proposed. (shrink)

This book provides a thorough critical overview of the current debate on the ethics of war, as well as a modern just war theory that can give practical action-guidance by recognizing and explaining the moral force of widely accepted law. Traditionalist, Walzerian, and "revisionist" approaches have dominated contemporary debates about the classical jus ad bellum and jus in bello requirements in just war theory. In this book, Uwe Steinhoff corrects widely spread misinterpretations of these competing views and spells out the (...) implications for the ethics of war. His approach is unique in that it complements the usual analysis in terms of self-defense with an emphasis on the importance of other justifications that are often lumped together under the heading of "lesser evil." It also draws on criminal law and legal scholarship, which has been largely ignored by just war theorists. Ultimately, Steinhoff rejects arguments in favor of "moral fundamentalism"-- the view that the laws and customs of war must simply follow an immutable morality. In contrast, he argues that widely accepted laws and conventions of war are partly constitutive of the moral rules that apply in a conflict. The Ethics of War and the Force of Law will be of interest to scholars and advanced students working in just war theory, applied ethics, political philosophy, political theory, philosophy of law, and criminal and military law. ‘No-platforming’—the practice of denying someone the opportunity to express their opinion at certain venues because of the perceived abhorrent or misguided nature of their view—is a hot topic. Several philosophers have advanced epistemic reasons for using the policy in certain cases. Here we introduce epistemic considerations against no-platforming that are relevant for the reflection on the cases at issue. We then contend that three recent epistemic arguments in favor of no-platforming fail to factor these considerations in and, as a result, (...) offer neither a conclusive justification nor strong epistemic support for no-platforming in any of the relevant cases. Moreover, we argue that, taken together, our epistemic considerations against no-platforming and the three arguments for the policy suggest that no-platforming poses an epistemic dilemma. While advocates and opponents of no-platforming alike have so far overlooked this dilemma, it should be addressed not only to prevent that actual no-platforming decisions create more epistemic harm than good, but also to put us into a better position to justify the policy when it is indeed warranted. On the one hand, the absence of contraction is a safeguard against the logical (property theoretic) paradoxes; but on the other hand, it also disables inductive and recursive definitions, in its most basic form the definition of the series of natural numbers, for instance. The reason for this is simply that the effectiveness of a recursion clause depends on its being available after application, something that is usually assured by contraction. This paper presents a way of overcoming this problem within (...) the framework of a logic based on inclusion and unrestricted abstraction, without any form of extensionality. (shrink)

Therefore these evaluation criteria act as ‘switchmen’, determining the tracks along which scholarly work is pushed by the dynamic interplay of interests of both scholars and their institutions. Currently one of the most (...) important criteria is the impact of publications. In this research, the extent to which publish or perish, a long standing evaluation criterion, led to scientific misconduct is examined briefly. After this the strive for high impact publications will be examined, firstly by identifying the period in which this became an important evaluation criterion, secondly by looking at variables contributing to the impact of scholarly papers by means of a non-structured literature study, and lastly by combining these data into a quantitative analysis. In this book Uwe Steinhoff describes and explains the basic tenets of just war theory and gives a precise, succinct and highly critical account of its present status and of the most important and controversial current debates surrounding it. Rejecting certain in effect medieval assumptions of traditional just war theory and advancing a liberal outlook, Steinhoff argues that every single individual is a legitimate authority and has under certain circumstances the right to declare war on others or the state. He (...) also argues that the just cause cannot be established independently of the other criteria of jus ad bellum (the justification of entering a war), except for right intention, which he interprets more leniently than the tradition does. Turning to jus in bello (which governs the conduct of a war) he criticizes the Doctrine of Double Effect and concludes that insofar as wars kill innocents, and be it as "collateral damage", they cannot be just but at best justified as the lesser evil. Steinhoff gives particular attention to the question why soldiers, allegedly, are legitimate targets and civilians not. Discussing four approaches to the explanation of the difference he argues that the four principles underlying them all need to be taken into account and outlines how their weighing can proceed if applied to concrete cases. The resulting approach does not square the distinction between legitimate and illegitimate targets with the distinction between soldiers and civilians, which has extremely important consequences for the conduct of war. Finally, Steinhoff analyses the concept of terrorism and argues that some forms of "terrorism" are actually not terrorism at all and that even terrorism proper can under certain circumstances be justified. One of the optional topics of Corporate (Social) Responsibility (CSR) is animal welfare. This exploratory qualitative study reveals which communicative factors stimulate an attitude of responsibility towards animals in companies in the animal-based food industry. It shows that a manager who is made responsible for animal welfare can strengthen the company’s ethical position in two ways using communication. The first one is to connect with stakeholders within and outside the company. The second way is to facilitate, as a moderator, communicative (...) connections between these stakeholders in which the manager is not involved per se. In both cases, if these connections take the form of personal meetings, this is extra helpful for a responsible attitude, because in that way insight, trust and collaboration are gained and sustained. We present a model outlining all supportive communicative connections, a summary of communication channels that are used to effectuate them, and practical advice for managers. (shrink)

This book offers a philosophical analysis of the moral and legal justifications for the use of force. While the book focuses on the ethics self-defense, it also explores its relation to lesser evil justifications, public authority, the justification of punishment, and the ethics of war. Steinhoff’s account of the moral use of force covers a wide range of topics, including the nature of justification in general, the precise elements of different justifications, the logic of claim- and liberty-rights and of rights (...) forfeiture, the value of human life and its limits, and the principles of reciprocity and precaution. While the author’s analysis is primarily philosophical, it is informed by a metaethical stance that also places heavy emphasis on existing law and legal scholarship. In doing so, the book appeals to widely shared moral intuitions, precepts, and concepts grounded in criminal law. Self-Defense, Necessity, and Punishment offers the most comprehensive and systematic account of the ethics of self-defense. It will be of interest to scholars and graduate students working in applied ethics and moral philosophy, philosophy of law, and political philosophy. (shrink)

Arguing against the doctrine of double effect, Bennett claims that the terror bomber only intends to make his victims appear dead. An obvious reply is that he intends to make them appear dead by killing them. I argue that the alleged refutations of this reply rest on a mistaken test question to determine what an agent intends, as Bennett's own test question confirms, and that Bennett is misled by confusing metaphorical death and literal death. Moreover, Bennett's argument is half-hearted anyway, (...) and going the whole way would not only undermine the DDE but also Quinn's revision of it. (shrink)

New Publications on Nietzsche’s Musical Aesthetics and Philosophy of Music. The significance of music in Nietzsche’s aesthetic writings is undisputed. However, the question of the role that music played in Nietzsche’s thought and writing process still yields divergent answers which are not free of speculative interpretations. New publications on Nietzsche’s aesthetics of music cover a wide range of themes: from the significance that the syllabic rhythms of Greek antiquity held for Nietzsche to the relationship between sounds and language in poetic (...) texts, for example, and the processes to which Nietzsche applied himself as a composer of music. This makes it very clear that music is not simply a complementary element to express what cannot be said in language, nor is it a form of relief from the tragic perception of life. (shrink)

Arguments for mandatory or compulsory vaccination must justify the coercive infringement of bodily integrity via the injection of chemicals that permanently affect a body’s inner constitution. Four arguments are considered. The allegedly libertarian argument declares unvaccinated persons a threat; accordingly, vaccination could take the form of justifiable defence of self and others. This argument conflates material and statistical threats. The harsh coercive measures permissible in defence against the former are not permissible in prevention of the latter. The argument from tax (...) evasion claims that people can be permissibly coerced into bearing their fair financial burdens of community life and likens this to sharing burdens in the face of a viral threat. The argument fails to demonstrate that vaccination would be fair, permissible in spite of potential lethal side-effects, and sufficiently similar to taxation despite the categorical difference between temporary deprivation of money and permanent deprivation of one’s original inner bodily constitution. The argument from ‘social liberty’ claims that the loss of freedom due to mandatory vaccination is only apparent, namely outweighed by corresponding gains in freedom. This argument conflates freedom as the absence of coercion with freedom as the presence of options for action. It fails to give the former its due weight and to demonstrate that persons may be coerced into increasing the options of others. The argument from the priority of life elevates the protection of life to an absolute value. This is unwarranted and leads to counterintuitive implications. Without better arguments, mandatory vaccination must be rejected. (shrink)

Answer-set programming (ASP) has emerged as a declarative programming paradigm where problems are encoded as logic programs, such that the so-called answer sets of theses programs represent the solutions of the encoded problem. The efficiency of the latest ASP solvers reached a state that makes them applicable for problems of practical importance. Consequently, problems from many different areas, including diagnosis, data integration, and graph theory, have been successfully tackled via ASP. In this work, we present such ASP-encodings for problems associated (...) to abstract argumentation frameworks (AFs) and generalisations thereof. Our encodings are formulated as fixed queries, such that the input is the only part depending on the actual AF to process. We illustrate the functioning of this approach, which is underlying a new argumentation system called ASPARTIX in detail and show its adequacy in terms of computational complexity. (shrink)

Since the late eighties, a sequel of annual workshops on logic and analytic philosophy has been held on the Island of Poel near Wismar, close to both Gottlob Frege’s grave and to his house in Bad Kleinen. The meeting last year, however, was held in Graal-Müritz and was devoted to Ontologic. It was organised by Jerzy Perzanowski, Uwe Scheffler and Max Urchs. The present number of Logic and Logical Philosophy is not exactly the proceedings of the 94’ conference. On one (...) hand, not all the papers presented at the workshop (see next page for the programme) are included in this volume, while others were changed considerably. Studies have shown that in the mammalian neuromuscular system stretch reflexes are localized within individual muscles. Neuromuscular compartmentalization, the partitioning of sensory output from muscles, and the partitioning of segmental pathways to motor nuclei have also been demonstrated. This evidence indicates that individual motor nuclei and the muscles they innervate are not homogeneous functional units. An analysis of the functional significance of reflex localization and partitioning suggests that segmental control mechanisms are based on subdivisions of motor nuclei–muscle complexes. A partitioned (...) organization of segmental control mechanisms could utilize (1) the potential functional diversity of muscle fiber types, (2) the variety of mechanical actions of individual muscles arising from their distributed origins and insertions, and (3) diverse architectural features such as intramuscular variations in pinnation and complex in-series and in-parallel arrangements of muscle fibers. The differentiated activity observed in some muscles during natural movements also calls for localized segmental control mechanisms. Partitioning may also play a role in mechanical interactions between contracting motor units and in increasing the stability of neuromuscular systems. The functional advantages of reflex localization and partitioning suggest they are probably common features of segmental systems, whose organization reflects the structure and function of their associated neuromuscular systems. I argue in this paper that traditional just war theory did allow private, indeed even individual war, and that arguments in support of a legitimate authority criterion, let alone in support of the “priority” of this criterion, fail. I further argue that what motivates the insistence on “legitimate authority” is the assumption that doing away with this criterion will lead to chaos and anarchy. I demonstrate that the reasoning, if any, underlying this assumption is philosophically profoundly confused. The fact of (...) the matter is that wars need not necessarily be authorized by some higher authority (such as a king, president, or parliament) in order to be justified, and this moral fact does not need to chaos and anarchy. Accordingly, the criterion of legitimate authority cannot be relied on to delegitimate individual war, private war, guerrilla war, or even terrorism. Finally, I consider some other defenses of authorization and demonstrate that the “authorization” these accounts defend is either not needed for justification or already provided by other just war criteria or, indeed, entirely fictitious. McGowan argues “that ordinary utterances routinely enact norms without the speaker having or exercising any special authority” and thereby not “merely cause” but “constitute” harm if harm results from adherence to the enacted norms. The discovery of this “previously overlooked mechanism,” she claims, provides a potential justification for “further speech regulation.” Her argument is unsuccessful. She merely redefines concepts like “harm constitution” and “norm enactment” and fails to explain why speech that “constitutes” harm is legally or morally problematic and thus (...) an initially more plausible target for speech regulation than speech that “merely causes” harm. Even if she could explain that, however, her account would still be incapable of identifying cases where utterances “constitute harm.” This is so for two reasons. First, she provides neither analytical nor empirical criteria for deciding which so-called “s-norms” have been enacted by an “ordinary utterance.” Second, even if such criteria could be provided, there is no epistemically available means to distinguish whether harm has ensued due to adherence to the enacted s-norms or through other mechanisms. Given this lack of criteria and practical applicability, there is no way that this account could serve as a principled basis for speech regulation – it could only serve as a pretext for arbitrary censorship. Following the studies of Araujo et al. (AI Soc 35:611–623, 2020) and Lee (Big Data Soc 5:1–16, 2018), this empirical study uses two scenario-based online experiments. The sample consists of 221 subjects from Germany, differing in both age and gender. The original studies are not replicated one-to-one. New scenarios are constructed as realistically as possible and focused on everyday work situations. They are based on the AI acceptance model of Scheuer (Grundlagen intelligenter KI-Assistenten und deren vertrauensvolle Nutzung. Springer, Wiesbaden, 2020) (...) and are extended by individual descriptive elements of AI systems in comparison to the original studies. The first online experiment examines decisions made by artificial intelligence with varying degrees of impact. In the high-impact scenario, applicants are automatically selected for a job and immediately received an employment contract. In the low-impact scenario, three applicants are automatically invited for another interview. In addition, the relationship between age and risk perception is investigated. The second online experiment tests subjects’ perceived trust in decisions made by artificial intelligence, either semi-automatically through the assistance of human experts or fully automatically in comparison. Two task types are distinguished. The task type that requires “human skills”—represented as a performance evaluation situation—and the task type that requires “mechanical skills”—represented as a work distribution situation. In addition, the extent of negative emotions in automated decisions is investigated. The results are related to the findings of Araujo et al. (AI Soc 35:611–623, 2020) and Lee (Big Data Soc 5:1–16, 2018). Implications for further research activities and practical relevance are discussed. (shrink)

Confirmation bias is one of the most widely discussed epistemically problematic cognitions, challenging reliable belief formation and the correction of inaccurate views. Given its problematic nature, it remains unclear why the bias evolved and is still with us today. To offer an explanation, several philosophers and scientists have argued that the bias is in fact adaptive. I critically discuss three recent proposals of this kind before developing a novel alternative, what I call the ‘reality-matching account’. According to the account, confirmation (...) bias evolved because it helps us influence people and social structures so that they come to match our beliefs about them. This can result in significant developmental and epistemic benefits for us and other people, ensuring that over time we don’t become epistemically disconnected from social reality but can navigate it more easily. While that might not be the only evolved function of confirmation bias, it is an important one that has so far been neglected in the theorizing on the bias. (shrink)

abstract Can torture be morally justified? I shall criticise arguments that have been adduced against torture and demonstrate that torture can be justified more easily than most philosophers dealing with the question are prepared to admit. It can be justified not only in ticking nuclear bomb cases but also in less spectacular ticking bomb cases and even in the so‐called Dirty Harry cases. There is no morally relevant difference between self‐defensive killing of a culpable aggressor and torturing someone who is (...) culpable of a deadly threat that can be averted only by torturing him. Nevertheless, I shall argue that torture should not be institutionalised, for example by torture warrants. (shrink)

This chapter offers a version of Cartesian dualism that draws on the resources of a Husserlian account of intentionality. For example, it argues that 'I can locate myself at the point in space from which I am looking at the world (my 'center of perspective')'. It relies on empirical phenomenology to show that this location that does not correspond to my body or any part of it. Phantom sensations provide confirming evidence. Next, the chapter uses the example of blurred (versus (...) sharp) vision to provide evidence of qualitative properties that cannot be instantiated within the physical world. Finally, it argues that the self's endurance through calls for explanation in terms of patterns of psychophysical causation or interaction. (shrink)

For synergistic interactions between humans and artificial intelligence (AI) systems, AI outputs often need to be explainable to people. Explainable AI (XAI) systems are commonly tested in human user studies. However, whether XAI researchers consider potential cultural differences in human explanatory needs remains unexplored. We highlight psychological research that found significant differences in human explanations between many people from Western, commonly individualist countries and people from non-Western, often collectivist countries. We argue that XAI research currently overlooks these variations and that (...) many popular XAI designs implicitly and problematically assume that Western explanatory needs are shared cross-culturally. Additionally, we systematically reviewed over 200 XAI user studies and found that most studies did not consider relevant cultural variations, sampled only Western populations, but drew conclusions about human-XAI interactions more generally. We also analyzed over 30 literature reviews of XAI studies. Most reviews did not mention cultural differences in explanatory needs or flag overly broad cross-cultural extrapolations of XAI user study results. Combined, our analyses provide evidence of a cultural bias toward Western populations in XAI research, highlighting an important knowledge gap regarding how culturally diverse users may respond to widely used XAI systems that future work can and should address. This commentary points to the lack of sound data supporting Corballis's thesis that there is a general left-hemisphere dominance for nonverbal vocal production in mammals. I also point out that area F5 in the rhesus monkey, which Corballis considers as homologous to Broca's area, contains not only visual “mirror” neurons but also auditory “mirror” neurons. This weakens Corballis's thesis that language developed exclusively at the gestural level.
