A growing body of literature critical of ethics review boards has drawn attention to the processes used to determine the ethical merit of research. Citing criticism on the bureaucratic nature of ethics review processes, this literature provides a useful provocation for (re)considering how the ethics review might be enacted. Much of this criticism focuses on how ethics review boards _deliberate,_ with particular attention given to the lack of transparency and opportunities for researcher recourse that characterise ethics review processes. Centered specifically (...) on the conduct of ethics review boards convened within university settings, this paper draws on these inherent criticisms to consider the ways that ethics review boards might enact more communicative and deliberative practices. Outlining a set of principles against which ethics review boards might establish strategies for engaging with researchers and research communities, this paper draws attention to how _Deliberative communication_, _Engagement with researchers_ and the _Distribution of responsibility_ for the ethics review might be enacted in the day-to-day practice of the university human ethics review board. This paper develops these themes via a conceptual lens derived from Habermas’ (The theory of communicative action. Volume 1: Reason and the rationalization of society, 1984 ) articulation of ‘communicative action’ and Fraser’s (Social Text, 25(26), 56–80, 1990 ) consideration of ‘strong publics’ to cast consideration of the role that human ethics review boards might play in supporting university research cultures. _Deliberative communication_, _Engagement with researchers_ and the _Distribution of responsibility_ provide useful conceptual prompts for considering how ethics review boards might undertake their work. States have implemented a variety of legal and policy approaches to address the overdose epidemic. Some approaches, like increasing access to naloxone and connecting overdose survivors with evidence-based treatment, have a strong public health foundation and a compelling evidence base. Others, like increasing reliance on punitive criminal justice approaches, have neither. This article examines law and policy changes that are likely to be effective in reducing overdose-related harm as well as those that are likely to increase it.

Despite shifts in rhetoric and some positive movement, Americans with the disease of addiction are still often stigmatized, criminalized, and denied access to evidencebased care. Dramatically reducing the number of lives unnecessarily lost to overdose requires an evidence-based, equity-focused, well-funded, and coordinated response. We present in this brief article evidence-based and promising practices for improving and refocusing the response to this simmering public health crisis. Topics covered include improving clinical decision-making, improving access to non-judgmental evidence-based treatment, investing in comprehensive public (...) health approaches to problematic drug use, and changing the way law enforcement actors interact with people who use drugs. Obtaining informed consent, an ethical obligation of nurses and other health care providers, occurs routinely when patients make health care decisions. The values underlying informed consent (promotion of patients’ well-being and respect for their self-determination) are embedded in the dominant American culture. Nurses who apply the USA’s cultural values of informed consent when caring for patients who come from other cultures encounter some ethical dilemmas. This descriptive study, conducted with Latino, Chinese and Anglo-American cancer patients in a large, public, west-coast (...) clinic, describes constraints on the informed consent process in a multicultural setting, including language barriers, the clinical environment, control in decision making, and conflicting desired health outcomes for health care providers and patients, and suggests some implications for nursing practice. One quality of remarriage comedies is that, for all their ingratiating manners, and for all the ways in which they are among the most beloved of Hollywood films, a moral cloud remains at the end of each of them. And that moral cloud has to do with what is best about them. What is best are the conversations that go on in them, where conversation means of course talk, but means also an entire life of intimate exchange between the principal (...) pair. We are bound to remember from these films, even years after viewing them, something of their sound: of conversation between Cary Grant and Irene Dunne in The Awful Truth, or between Grant and Rosalind Russell in His Girl Friday, or Grant and Katharine in Bringing up Baby, or those two together with James Stewart in The Philadelphia Story, or between Hepburn and Spencer Tracy in Adam’s Rib. We feel that these people know one another, and they know how to play together in a way to make one happy and hope for the best. But the moral cloud has to do with what that conversation is meant to do, and what I say about those films is that the conversation is in service of the woman’s sense of herself as in need of an education. Importantly for that reason, I call her a descendent of Nora in Henrik Ibsen’s A Doll’s House, who in one of the most celebrated moments in modern theater, ends a play by closing a door behind her. She leaves the dollhouse saying to her husband that she requires an education and that he is not the man who can provide it for her. The implication is that since he is not this man, he cannot be her husband. And implying the contrary as well: if he were, then he would be, and their relationship would accordingly—“miracle of miracles”—constitute a marriage. Stanley Cavell is the Walter M. Recently we have learned how experiment can have a life of its own. However, experiment remains epistemologically disadvantaged. Scientific knowledge must have a theoretical/propositional form. To begin to redress this situation, I discuss three ways in which instruments carry meaning: 1. Scientific instruments can carry tremendous loads of meaning through association, analogy and metaphor. 2. Instrumental models of complicated phenomena work representationally in much the same way as theories. 3. Instruments which create new phenomena establish a new field of material (...) possibilities. I suggest that scientists employ a "visual/physical/material logic," analogous to propositional logic, which establishes relations between different material forms. (shrink)

Wayne Davis presents a highly original approach to the foundations of semantics, showing how the so-called "expression" theory of meaning can handle names and other problematic cases of nondescriptive meaning. The fact that thoughts have parts ("ideas" or "concepts") is fundamental: Davis argues that like other unstructured words, names mean what they do because they are conventionally used to express atomic or basic ideas. The causal theory of reasons holds that acting for a reason entails that the agents action was caused by his or her beliefs and desires. While Donald Davidson (1963) and others effectively silenced the first objections to the theory, a new round has emerged. The most important recent attack is presented by Jonathan Dancy in Practical Reality (2000) and subsequent work. This paper will defend the causal theory against Dancy and others, including Schueler (1995), Stoutland (1999, 2001), and Ginet (2002).Dancy (...) observes that our reasons are neither psychological states nor causes, and that our reasons can be both motivating and normative. I argue that these observations are fully compatible with the causal theory. According to the reductive version I develop for both cognitive and optative reasons, what it is for an action to be done for a reason is for certain beliefs and desires to cause the action in a particular way. Our reasons for action are the objects of some of those beliefs and desires. The causal process has two stages. This theory explains not only Dancys observations, but also many other facts about reasons that alternative theories leave unexplained. I argue against Schueler and others that the non-appetitive desires entailed by acting for reasons are no less distinct and independent causal factors than the beliefs entailed. I go on to rebut arguments that the relation between psychological states and actions cannot be causal because it is non-empirical, rational, normative, or non-deterministic, and that explanations in terms of psychological causes are incompatible with explanations in terms of reasons. The starting point of this paper is Sellars’s rejection of foundationalist empiricism as found in his discussion of the Myth of the Given. Sellars attacks the Myth from two main angles, corresponding to the two elements of empiricism: the idea that our beliefs are justified by the world, and the idea that our concepts are derived from experience. In correctly attacking the second, Sellars is also, incorrectly, led to attack the first. Thus, Sellars rejects the commonsensical idea that at least (...) some of our ideas can be justified by appeal to the empirical world. My purpose is to examine why Sellars is led to this point, and how the same assumptions that lead him there also operate in his followers, such as Brandom, Rorty and McDowell. I then show how a rejection of these assumptions gives us a way around this problem that does not fall back into foundationalism. (shrink)

The first code of professional ethics must: (1)be a code of ethics; (2) apply to members of a profession; (3) apply to allmembers of that profession; and (4) apply only to members of that profession. The value of these criteria depends on how we define “code”, “ethics”, and “profession”, terms the literature on professions has defined in many ways. This paper applies one set of definitions of “code”, “ethics”, and “profession” to a part of what we now know of the (...) history of professions, there by illustrating how the choice of definition can alter substantially both our answer to the question of which came first and (more importantly) our understanding of professional codes (and the professions that adopt them). Because most who write on codes of professional ethics seem to take for granted that physicians produced the first professional code, whether the Hippocratic Oath, Percival’s Medical Ethics, the 1847 Code of Ethicsof the American Medical Association (AMA), or some other document, I focus my discussion on these codes. This book looks to establish worldwide technical and ethical standards of engineering as an occupation. The author is the most senior thinker in this field and has spent much of his career developing this thesis.

It has often been said that 'desire' is ambiguous. I do not believe the case for this has been made thoroughly enough, however. The claim typically occurs in the course of defending controversial philosophical theses, such as that intention entails desire, where it tends to look ad hoc. There is need, therefore, for a thorough and single-minded exploration of the ambiguity. I believe the results will be more profound than might be suspected.

Review of Naomi Oreskes’s why trust science?

I argue that the debate between proponents of substance causation and proponents of causation by powers, as to whether substances or their powers are causes, hinges on whether or not powers are self-exemplifying or non-self-exemplifying properties. Substance causation is committed to powers being non-self-exemplifying properties while causation by powers is committed to powers being self-exemplifying properties. I then argue that powers are non-self-exemplifying properties, in support of substance causation.

Feminist scholars have increasingly expressed their worries about the depoliticization of intersectionality since it has travelled from its point of origin in US Black feminist theory to the shores of Europe. They have argued that the subject for which the theory was intended has been displaced, that Black feminists have been excluded from the discussion, and that white European feminists have usurped all the credit for intersectionality as theory. Intersectionality has been transformed into a product of the neoliberal academy rather (...) than the helpmeet for social justice it was meant to be. This article explores three of the bones of contention in these debates about intersectionality and its travels. The author argues that they rest on notions of ownership that, while understandable, are untenable and, ultimately, counterproductive. A case will be made for taking a less proprietary stance toward critical theories and instead treating the travels of intersectionality as an occasion for dialogue rather than a contest over ownership. Philosopher Davis argues that Christian belief in the resurrection is rational on historical, philosophical, and theological grounds. Each of the book's ten chapters takes up a different aspect of the Christian concept of bodily resurrection and subsequently deals with such matters as perservation of personal identity and soul-body dualism, issues in biblical scholarship, and the reliability of New Testament accounts.

There is a morally questionable laxity in our practices of apologising. A genuine apology involves substantially more than regret about offence caused by one’s behaviour. I argue that it is in fact possible to unpack a normative paradigm (or essence) underlying the practice of apologising. This essence involves doxastic, affective, and dispositional elements, related at the moral phenomenological level. The Consummate apologiser believes that he has transgressed because of identifiable moral saliences of his conduct, feels reproachful towards himself as a (...) result, and as a result resolves to avoid repetition of the same conduct. The latter might require the cultivation of new dispostions or the sharpening of existing ones. It is rational to accept an apology insofar as the preceding doxastic, affective, and dispositional elements are believed to be present and rational in the apologiser. In accepting an apology, the recipient agrees to the attempt at normalisation of relations with the transgressor. (shrink)

While there is considerable disagreement on the precise nature of material objecthood, it is standardly assumed that material objects must be spatial. In this paper, I provide two arguments against this assumption. The first argument is made from largely a priori considerations about modal plenitude. The possibility of non-spatial material objects follows from commitment to certain plausible principles governing material objecthood and plausible principles regarding modal plenitude. The second argument draws from current philosophical discussions regarding theories of quantum gravity and (...) the emergence of spacetime. When it is appreciated what possible worlds these current theories commit us to, the possibility of non-spatial material objects will follow. Thus, either route will lead us to the possibility of non-spatial material objects. The significance of this result is that we need to revise our accounts of material objecthood to both accommodate these possibilities and the theories that lead to them. (shrink)

This paper is primarily a response to John Simmons’s critique of Locke’s consent theory of political obligation (Two Treatises). It seeks to apply ordinary legal reasoning to what Locke actually says about “express consent” and “tacit consent.” The result is a theory both different from the theory commonly attributed to Locke and more plausible. Among the differences is that express consent (“entering political society”) is understood to arise chiefly from seeking to vote (rather than by oath or voting) and tacit (...) consent is understood as a reasonable (but rebuttable) presumption of actual consent. In the course of presenting Simmons’s critique, the paper identifies four commonly accepted criteria of adequacy for theories of moral obligation to obey law or government, noting that Locke’s theory, under its lawyerly interpretation, fails to satisfy any of the four criteria but seems reasonably plausible (for example, in its ability to deal with Simmons’s critique). This is taken to be reason to weaken all four criteria. (shrink)

Horn (1989) identified a number of irregular or marked negations that are not used in accordance with the standard rule of propositional logic. He concluded that negation was pragmatically ambiguous. Van der Sandt (1991) disputed Horn’s ambiguity claim, and proposed a uniform semantics for all negations. I will provide an informal explanation of van der Sandt’s theory, and develop a number of objections. I show that irregular negations are not anaphoric, as Van der Sandt believes, but compositional. I argue for (...) Geurts’s (1998) view that there are several different rules for irregular negations. I reject the implicature theory in favor of the semantic ambiguity thesis. (shrink)

This paper argues that research for engineering ethics should routinely involve philosophers, social scientists, and engineers, and should focus for now on certain basic questions such as: Who is an engineer? What is engineering? What do engineers do? How do they make decisions? And how much control do they actually have over what they do?

In April, 2007, 15 Royal Navy sailors and marines were taken prisoner and held hostage for nearly two weeks by Iran’s Revolutionary Guard. Their crime? Allegedly crossing over into Iranian waters. Within 48 hours a British sailor was plastered all over Iranian TV publicly confessing that the Britons were entirely at fault in the matter. Another sailor wrote a letter—no doubt under some duress— calling for the UK to withdraw all of its troops from Iraq. Then to cap things off, (...) the British soldiers were paraded in front of the Iranian President, where they gave him a big “thumbs up” before being allowed to go home. If you were one of the captives, what would you have done? Would you have cooperated with your captors? Or would you have resisted them, possibly putting your own life at risk? Not surprisingly, the British people recoiled in shame. As one commentator put it, “The honorable thing would have been to renounce their coerced behavior, denounce the Iranians’ use of them for propaganda, and acknowledge that anything they endured was nothing.. During spring of 2020, environmental ethics students at a medium sized metropolitan university in the Southeastern United States were asked to read and comment on classic essays from Robert Heilbroner and Garrett Hardin, essays regarding our responsibilities towards future generations. In general, students seemed to hold more with Heilbroner’s stance, which left room for compassion, while condemning Hardin’s harshness. Students were then asked to provide written responses stating whether they would personally sacrifice their eventual retirement in order to stop COVID-19 (...) and the reasons for their views. Responses were analyzed and categorized to detect inconsistencies between students’ described views and their willingness to personally sacrifice for the sake of others. Almost 72% of respondents asserted that they would be willing to intervene to stop the novel coronavirus by sacrificing their retirement. A fair number of respondents that stated they would sacrifice said that they would do so because they would benefit personally from the avoidance of guilt and/or from the opportunity to feel good about themselves, suggesting that even seemingly selfless behaviors are sometimes driven by egoistic motivations. Forty percent of all respondents held inconsistent views. Most notably, a number of students condemned Hardin for his lack of compassion, yet were not willing to act compassionately themselves.
