In this article there is analysed an independent criminal punishment – public works, which was determined by the Criminal Code and the Punishment Enforcement Code of the Republic of Lithuania as alternative punishment to freedom deprivation punishment. Without looking into the process of historical development, it is made an attempt to overview the tendency of public works’ spreading, to analyse the problems of public works’ realisation and how to deal with them. There is compared Lithuanian legal regulations with international documents, (...) which are related with alternative punishment as alternative to freedom deprivation punishment. There is also looked over public works’ legal regulations in foreign countries, an experience of public works implementation in Lithuania and abroad and, the most important, there had been given landmarks of public works institution improvement. The article is based upon the documents of the United Nations and the Council of Europe, legal regulations and practice of public works in foreign countries, opinion and studies of foreign scientists and the other authors, the data of statistics and questioning of the officers of correctional inspections. The article deals with a study of a distinct criminal punishment established in the Criminal Code and the Code of Punishment Enforcement of the Republic of Lithuania—restriction of liberty, as an alternative to imprisonment. Without investigating extensively the course of development of this penalty, in the article it is sought to overview the development trends of restriction of liberty; analyse the problems of enforcing this penalty and suggest measures to eliminate them; investigate whether the legal regulation of Lithuania is in (...) line with the provisions of the main international instruments relating to non-custodial sanctions (1990 United Nations Standard Minimum Rules for Non-custodial Measures (the so-called Tokyo Rules), Recommendation R (92) 16 of the Committee of Ministers of the Council of Europe to Member States on the European rules on community sanctions and measures, Recommendation Rec (2000) 22 of the Committee of Ministers of the Council of Europe to Member States on improving the implementation of the European rules on community sanctions and measures); review the progressive legal regulation of restriction of liberty in place in individual states and provide a comparison between the national and foreign experience in relation to the penalty of restriction of liberty. Este trabajo discute qué razones tenemos para pensar que existe un espacio ontológico modal y por qué debemos pensar que este espacio está constituido por una pluralidad de mundos posibles. Después se presentan tres teorías metafísicas sobre la naturaleza de los mundos posibles: la concepción realista extrema de David Lewis, la concepción realista moderada de Alvin Plantinga y la concepción de los mundos posibles como universales estructurales máximos. Un breve examen comparativo tratará de mostrar por qué la tercea opción es (...) la más prometedora o, al menos, parece serlo. El trabajo finalmente considera el panorama que tiene por delante una defensa plenamente desarrollada de la teoría modal basada en universales. (shrink)

Mediation is a process in which two parties agree to resolve their dispute by negotiating over alternative solutions presented by a mediator. In order to construct such solutions, the mediator brings more information and knowledge, and, if possible, resources to the negotiation table. In order to do so, the mediator faces the challenge of determining which information is relevant to the current problem, given a vast database of knowledge. The contribution of this paper is the automated mediation machinery to resolve (...) this issue. We define the concept of a Mediation Problem and show how it can be described in Game Description Language. Furthermore, we present an algorithm that allows the mediator to efficiently determine which information is relevant to the problem and collect this information from the negotiating agents. We show with several experiments that this algorithm is much more efficient than the naive solution that simply takes all available knowledge into account. (shrink)

Este trabajo discute el argumento presentado por Carmichael (2010) para justificar la existencia de universales trascendentes, esto es, universales que no requieren instanciaciones para existir. Se sostiene en este trabajo que una proposición puede describir correctamente un mundo posible sin existir como una parte de ese mundo, esto es, que una proposición puede ser verdadera de un mundo posible, sin ser verdadera en un mundo posible. Se sostiene, además, que las mismas premisas usadas por Carmichael permiten justificar el necesitismo.

Superior responsibility has been a widely recognised form of responsibility for omission in both treaty and customary international law. Superiors are held responsible for the acts of their subordinates when they fail in fulfilling their duties to prevent or punish crimes of subordinates. Duties to prevent and punish arise only after the superior knows about the subordinate’s crimes or has a reason to know about it. ‘Has a reason to know’ is a form of constructive knowledge and could be defined (...) as absence of actual knowledge about subordinates’ crimes where that knowledge should exist because of information available to the superior from the content of which it could be easily concluded that there is a possibility that subordinates intend to commit, are committing or have already committed crimes and the lack of that knowledge is a cause of willful disregard of his duties or at least disregard based on gross negligence. Algunos textos parecen pertenecer de manera exclusiva ya sea al ámbito de la filosofía o de la literatura, como si no pudiera haber hibridación; como si lo que fuera de un campo no pudiera ser leído en la clave del de otro. En este sentido, cabe preguntarse si una obra considerada literaria podría leerse filosóficamente y cómo.

The paper explains the reasons why the goal of personalization is so deeply rooted in the digital transformation. It also describes the five meanings attributable to the concept and details their philosophical underpinnings. This article critically analyses the notion of intentionality from several philosophical cognitive points of view. The authors argue that the notion of mental representation in the wider sense and intentionality in the narrower sense remains elusive despite accommodated paradoxes, improved semantic precision and more sophisticated strategies in dealing with intentionality. We will argue that different approaches to intentionality appear to be coherent in their inferences. However, most of them become contradictory and mutually exclusive when juxtaposed and applied to borderline questions. (...) While the explanatory value of both philosophy of mind as well as cognitive psychology should not be underestimated, we must note that not even hard-core neuroscience has been able to pin point what is going on in our minds, let alone come up with a clear cut explanation how it works or a definition of what thought really is. To date, however, intentionality is the best of all explanatory models regarding mental representations. (shrink)

This article introduces an agent-based and a system-dynamics model investigating the cultural transmission of frequent collective rituals. It focuses on social function and cognitive attraction as independently affecting transmission. The models focus on the historical context of early Christian meals, where various theoretically inspiring trends in cultural transmission of rituals can be observed. The primary purpose of the article is to contribute to theorizing about cultural transmission of rituals by suggesting a clear operationalization of their social function and cognitive attraction. Furthermore, the article challenges recent trends in the field by providing a theoretically feasible model for how, under certain conditions, cognitive attraction can influence the transmission to a relatively greater extent than social function. In the system dynamics model we reproduce the results of our agent-based model while putting some of our basic operational assumptions under scrutiny. We consider approaching social function and cognitive attraction in isolation as a preliminary but necessary step in the process of creating more complex models of the cultural selection of rituals, where the two aspects will be combined to produce ritual forms with greater correspondence to real-world religious rituals. The literature on listening and daily discourse often describes an overly romanticized conception of listening, meaning what it should be in its ideal form. However, at most, this ideal is realized through the ‘masks’ that listeners ‘carry’ during their performance of listening. The ideal version that is being projected through the performance of listening is not cognruent with what actually happens behind the mask and performance. Individuals do not have the cognitive capacities to realize this unrealistic and unattainable ideal, but (...) they have the capacity to act as if they do. Using Goffman’s (1959) dramaturgical account this paper reveals the psychological and social world that hides behind the mask and performance of listening in order to ground the theorizing of listening in a more realistic perspective. This account gives rise to novel and indispensable listening concepts: the definition of the situation, the sincere and cynical listener, undercurrent listening, and misrepresentations of listening. These concepts demonstrate that the study of interpersonal listening cannot be isolated from the dramaturgy of listening as (expressed) manners of listening are intricately and inherently embedded in social structure. This account also strongly contests the psychocentric and simplistic definition of listening as proposed by Kluger, A. N., & Mizrahi, M. (2023). Defining Listening: Can We Get Rid of the Adjectives? The article analyzes one of the fundamental rights – the right to maintenance, which proper implementation ensures normal development of the child. This right matches with the duty of parents to maintain their minor children. Paragraph 6 of Article 38 of the Constitution of the Republic of Lithuania states that parents have a duty to educate their children to be honest people and loyal citizens, supporting them until adulthood. The obligation to maintain children is established in the first 3.192 Article (...) paragraph of the Civil Code of the Republic of Lithuania, and the responsibility for avoiding to maintain a child is provided in Article 164 of the Criminal Code. The article discusses the fact that the analysis of criminal law rate is not precise enough. Article 164 of the Criminal Code does not match with the child maintenance methods specified in the CC Article 3.196 paragraph 1. Since criminal liability is only for judgment in default in civil cases, a person shall only be liable for breaking the right to maintain a child, provided in the CC 3.196 paragraph 1. This article deeply analyzes the problematic qualification aspects of the avoidance to maintain a child. Some alternative ways of child maintenance are mentioned, as can be chosen from other law instruments (bailiffs, Guarantee child support fund) and it leads to the ultima ratio principle. On the other hand, it is not required to seek alternative remedies for affected interests, and it is possible to initiate a pre-trial investigation. Therefore, this article seeks to identify specific civil and criminal law rules delimitation. Avoidance of child maintenance is an ongoing crime. The main problem in legal practice is to determine an end of this ongoing criminal conduct. The practice of the Supreme Court of Lithuania is not unanimous. In some cases, the end of this ongoing conduct is considered to be a moment when the past judgment has entered into force, in other cases – the moment of indictment. These positions are criticized by many authors and it is suggested to follow the Supreme Court’s practice, according to which the moment when a judgment of conviction for the criminal act is passed should be considered as an end of an ongoing criminal conduct. This article examines the dominant agricultural model in Colombia of which the emergence of biofuels is an inevitable and major consequence. Some uncertainties and complexities of the introduction of biofuels and the use of genetically modified crops are analyzed, including a general reflection on the possibilities of producing biofuels on the basis of a model of ecological agriculture.

La discusión acerca de la capacidad de nuestra inteligencia de acceder al conocimiento de la realidad en sí es y sigue siendo una de las más antiguas y apasionantes de la filosofía. Piaget revolucionó la historia de la psicología y la pedagogía a partir de sus descubrimientos científicos relativos al modo en que el ser humano conoce. Sin embargo, por su misma inclinación filosófica, su constructivismo pedagógico quedó fuertemente arraigado en tradiciones filosóficas inmanentistas, a punto tal que la asociación entre (...) constructivismo pedagógico y antirrealismo constituye una suerte de lugar común y un cierto presupuesto dogmático. Lo cierto es que esta asociación no constituye la única alternativa posible y, hasta cierto punto, ni siquiera parece responder cabalmente a los principios o consecuencias últimas de los hallazgos del constructivismo de Piaget. Es posible justificar el constructivismo pedagógico desde posiciones realistas, siempre y cuando se revisen algunos supuestos que la modernidad ha instalado de manera no muy crítica en los círculos educativos y filosóficos. La revisión de la noción de representación, concebida según la tradición aristotélica y aggiornada por los aportes del constructivismo, permite abrir un camino de conciliación entre el constructivismo pedagógico y un tipo de realismo que sea, a la vez, robusto y plural.
