Background Dynamic consent has been proposed as a process through which participants and patients can gain more control over how their data and samples, donated for biomedical research, are used, resulting in greater trust in researchers. It is also a way to respond to evolving data protection frameworks and new legislation. Others argue that the broad consent currently used in biobank research is ethically robust. Little empirical research with cohort study participants has been published. This research investigated the participants’ opinions (...) of adding a dynamic consent interface to their existing study. Methods Adult participants in the Extended Cohort for E-health, Environment and DNA longitudinal cohort study who are members of the EXCEED Public and Participant Engagement Group were recruited. Four focus groups were conducted and analysed for thematic content. Discussion topics were derived from a review of the current literature on dynamic consent. Results Participants were in favour of many aspects of a dynamic consent interface, such as being able to update their information, add additional data to their records and choose withdrawal options. They were supportive provided it was simple to use and not intrusive. Participants expressed a markedly high level of trust in the study and its investigators and were unanimously happy with their current participation. No strong support was found for adding a dynamic consent interface to EXCEED. Conclusions Trust in the study researchers was the strongest theme found. Openness and good data security were needed to retain their trust. While happy to discuss dynamic consent, participants were satisfied with the current study arrangements. There were indications that changing the study might unnecessarily disturb their trust. This raised the question of whether there are contexts where dynamic consent is more appropriate than others. This study was limited by the small number of participants who were committed to the study and biased towards it. More research is needed to fully understand the potential impact of adding a dynamic consent interface to an existing cohort study. (shrink)

The term conceptual simulation refers to a type of everyday reasoning strategy commonly called “what if” reasoning. It has been suggested in a number of contexts that this type of reasoning plays an important role in scientific discovery; however, little direct evidence exists to support this claim. This article proposes that conceptual simulation is likely to be used in situations of informational uncertainty, and may be used to help scientists resolve that uncertainty. We conducted two studies to investigate the relationship (...) between conceptual simulation and informational uncertainty. Study 1 was an in vivo study of expert scientists; the results suggest that scientists do use conceptual simulation in situations of informational uncertainty, and that they use conceptual simulation to make inferences from their data using the analogical reasoning process of alignment by similarity detection. Study 2 experimentally manipulated experts' level of uncertainty and provides further support for the hypothesis that conceptual simulation is more likely to be used in situations of informational uncertainty. Finally, we discuss the relationship between conceptual simulation and other types of reasoning using qualitative mental models. (shrink)

I defend a form of preventive detention through the creation of an offence of ‘being a persistent violent dangerous offender’. This differs from alternative proposals and actual habitual offender laws that impose extra periods of incarceration on offenders after they have completed the sentence for their most recent crime or as a result of a certain number of prior convictions. I, instead, would make ‘being a persistent violent dangerous offender’ an offence itself. Persons to be preventively detained would be tried (...) and convicted of this offence. My approach would then have one significant advantage: provided the elements of being a PVDO could be rendered sufficiently determinate, punishing persons under such an offence would comport with central rule of law values, most importantly legality and fair notice, as well as principles of proportionality in sentencing. Political theorists have begun to re-examine claims by indigenous peoples to lands which were expropriated in the course of sixteenth-eighteenth century European expansionism. In Australia, these issues have captured public attention as they emerged in two central High Court cases: Mabo (1992) and Wik (1996), which recognize pre-existing common law rights of native title held by indigenous people prior to European contact and, in some cases, continue to be held to the present day. The theoretical significance of the two Australian (...) cases is examined and the links drawn out between the current debate about Aboriginal land rights in Australia and the wider philosophical debate about indigenous land rights, property rights, and indigenous justice as characterized by Jeremy Waldron and James Tully. Justice towards indigenous groups requires substantial acknowledgement and recognition of the values and institutions of the relevant indigenous group; yet, these values and institutions may not readily fall under the framework of existing state structures. Attempts to redress injustice towards indigenous groups which do not question the justice of existing state institutions will therefore prove to be inadequate responses to indigenous peoples' demands for substantive justice. Peirce’s True Gorgias is a brief dialogue from his essay “Grounds of Validity of the Laws of Logic”, published in 1869. The True Gorgias exposes the fallacy of existential import. It has received no sustained attention in the secondary literature, perhaps because the fallacy is now familiar. Peirce’s assessment of the fallacy involved in the reasoning, however, changes between 1865 and 1869, and he only arrives at the contemporary account of existential import in 1880. Moreover, a careful examination of the (...) context in which the True Gorgias appears reveals it provides an argument in support of Peirce’s early Aristotelian realism about universals in contradistinction to non-Aristotelian varieties of realism advocated by W.T. Harris, editor of the journal in which the True Gorgias was published. (shrink)

Some prominent contemporary ethicists, including Peter Singer and Jeff McMahan, do not consider human beings with profound intellectual disabilities to have the same moral status as “normal” people. They hold that individuals who lack sufficiently sophisticated cognitive abilities have the same moral value as nonhuman animals with similar cognitive capacities, such as pigs or dogs. Their goal—to elevate the moral standing of sentient nonhuman animals—is an admirable one which I share. I argue, however, that their strategy does not, in fact, (...) achieve this goal and that there are better ways to advance it than to attach lesser value to the lives of profoundly intellectually disabled persons. Some persons who believe provably false claims – such as that there were significant voter irregularities in the 2020 election – may nevertheless be evidentially rational for holding their false beliefs. I consider a person I call our average believer. In her daily life, she incidentally gathers evidence favoring the hypothesis that there were significant voter irregularities, but she does not investigate the matter. Her information environment, moreover, is such that it accidentally (through no fault of her own) excludes counterevidence (...) to the thesis that there were such irregularities and intensifies the flow of information that there were irregularities. As a consequence, she becomes convinced that there were significant voting irregularities in the 2020 U.S. election. I argue that while she is not zetetically rational, for she does not investigate the matter, she is evidentially rational in that she apportions her belief to the evidence. While she has no right to the Cliffordian, or assertoric, belief that there were such irregularities, she is not epistemically blameworthy for having the wagered belief it is true. (shrink)

The paper builds an argument about empathy, kinesthesia, choreography, and power as they were constituted in early eighteenth century France. It examines the conditions under which one body could claim to know what another body was feeling, using two sets of documents – philosophical examinations of perception and kinesthesia by Condillac and notations of dances published by Feuillet. Reading these documents intertextually, I postulate a kind of corporeal episteme that grounds how the body is constructed. Implicit in C. I. Lewis's conceptual pragmatism is an account of how our ideas undergo a process of social development. Lewis's account of that process resolves a problem with Josiah Royce's theory of ideas. Royce holds that there are both sensuous and symbolic ideas. It is, however, possible for someone to have only a sensuous idea of how middle C sounds and for another person to have only the symbolic idea that middle C is 261.63 Hz. In what sense, if (...) at all, can these two persons have the same idea, namely, the idea of middle C? On Lewis's account, while ideas in individual minds are typically constituted of both sensory correlates and pure concepts, ideas are also social products that individuals inherit through education and language acquisition. For two people to have the same idea is for them both to be heirs to the social development of the idea. (shrink)

Doug Husak has argued, persuasively I think, that there is no literal ‘act requirement’ in Anglo-American law. I begin by reviewing Husak’s reasons for rejecting the act requirement, and provide additional reasons to think he is right to do so. But Husak’s alternative, the ‘control condition’, I argue, is inadequate. The control requirement is falsified by the widespread practice of holding extremely intoxicated offenders liable for criminal conduct they engage in even if they lack control over their conduct at the (...) time of the offense, and even if they are acting involuntarily. I provide examples from Canadian, US and German law to flesh out our legal practices with respect to intoxicated offenders. I then argue that, at least with respect to one class of intoxicated offenders–those known as ‘grand schemers’, who plan their criminal offending prior to rendering themselves incapable of voluntary control over their conduct–we are morally justified in imposing liability. I then propose an alternative to both the act and control requirements: what I call the ‘agency requirement’. I argue that our law does and should impose liability for conduct that is expressive of or constitutive of the defendant’s practically rational agency. Adopting an agency view allows us to expand our focus from just the moment of the offense to temporally extended instances of agency, such as is involved in planned offending by grand schemers. Curiously, Charles Sanders Peirce and Maurice Merleau-Ponty raise the same objection to British empiricism: its foundational tenet is nominalist. In his 1869 review of a new edition of James Mill's Analysis of the Phenomena of the Human Mind, Peirce traces the foundational tenet of Mill's work back to Hume's Copy Principle—that all of our ideas are fainter copies of our impressions—and then remarks, If I compare a red book and a red cushion, there is, according to them [the "English psychologists," (...) among whom Peirce includes Mill, Hume, and Berkeley], no general sensation red which enters into both these images, nor is there any idea of a general respect... Psychological hedonism is the theory that all of our actions are ultimately motivated by a desire for our own pleasure or an aversion to our own pain. Peirce offers a unique critique of PH based on a descriptive analysis of self-controlled action. This essay examines Peirce's critique and his accounts of self-controlled action and of desire.

In The Ethics of Ambiguity , Simone de Beauvoir makes reference to an “apprenticeship of freedom,” but she does not directly address why freedom requires an apprenticeship or what such an apprenticeship entails. Working from Beauvoir’s discussion of freedom in The Ethics of Ambiguity and her discussion of apprenticeships in The Second Sex , I explicate the idea of an apprenticeship of freedom, establishing why an apprenticeship is a necessary condition of freedom and describing how such an apprenticeship is administered. In doing so, I draw together two strands of thought within recent research on Beauvoir—first, that Beauvoir conceives of freedom as embodied and, second, that she conceives of freedom as interpersonal—to consider how adults’ interactions with a child either support or impede the realization of this child’s freedom. How can an art practice based upon lens imaging help us to question landscape as a pictorial category fixed in space and time? This article proposes that we practise landscape as an ongoing process that always surpasses human spatial and temporal framing while enfolding the activity of the human within it. Starting with reference to a specific geographic, geological and environmental site, the article tracks a process of situated making using the smartphone camera as the fulcrum of a performative activity.

The fundamental result of Lanczos is used in a new type of quadratic variational principle whose field equations are the Einstein field equations together with the Yang-Mills type equations for the Riemann curvature. Additionally, a spin-2 theory of gravity for the special case of the Einstein vacuum is discussed.

This paper explores Augustine’s use of the twin images of Christ the physician and sin as sickness, especially in his sermons and Confessions. It shows how distinctive features of this image enable Augustine to illuminate a scriptural moral theology that is egalitarian and developmental. It is founded upon repentance, humility and a powerful awareness of dependence upon God’s grace, and demands communal responsibility for morality. Augustine’s moral theory fully integrates his personal and pastoral experience; the relevant similarities between his own (...) society and ours suggest that his theory, in its broad outlines, has not lost its validity. Tiddy Smith, Philosophia, 42, 173–179 has recently argued that there is an enlightenment problem for Millianism. In this paper I show that Smith’s argument rests on a misunderstanding, and that the enlightenment problem can be solved according to standard versions of Millianism. In fact, the problem can be solved according to Nathan Salmon’s version of Millianism, which is one of Smith’s main targets.

Ever since his violent death in 1556, Archbishop Thomas Cranmer had been used by rival groups to justify their views about the Church of England. Thanks chiefly to John Foxe his burning, in particular, became central to Protestant narratives. In the nineteenth century, however, confessional stories became hotly contested, and amid the ‘rage of history’ erstwhile heroes and martyrs were placed under intense scrutiny. This article uses Cranmers fluctuating reputation as a lens through which to explore changing understandings of the (...) English past. As will become clear, uncertainties over how to place Cranmer bespoke a crisis of Anglican identity, one driven both by divisions within the Church of England and challenges to its political, cultural and intellectual authority from without. Despite and perhaps because of shifts in how he was seen, Cranmers liturgical writings - the Book of Common Prayer - came to be seen as his chief legacy. (shrink)
