L'article examine les spécificités des forums de discussion proposés par les municipalités françaises au regard de quelques-unes des interrogations animant les réflexions sur la délibération. Le forum apparaît comme un lieu conflictuel où l'expression relève davantage du registre de l'émotionnel que de la seule argumentation rationnelle. Ce caractère polémique des échanges n'est pas cependant exempt du souci de l'intérêt général, les internautes tentent ainsi de monter en généralité à partir de leurs revendications personnelles. Les inégalités de compétence entre participants ne (...) disparaissent pas lors des échanges électroniques, notamment en raison d'une maîtrise différenciée de l'écriture, mais la prédominance discursive de l'institution municipale, qui accompagne habituellement les débats publics, est largement érodée. L'influence du forum dans l'espace public local se manifeste indirectement, à travers son instrumentalisation dans le cadre d'actions collectives. (shrink)

Clinicians have good moral and professional reasons to contribute to pragmatic clinical trials (PCTs). We argue that clinicians have a defeasible duty to participate in this research that takes place in usual care settings and does not involve substantive deviation from their ordinary care practices. However, a variety of countervailing reasons may excuse clinicians from this duty in particular cases. Yet because there is a moral default in favor of participating, clinicians who wish to opt out of this research must (...) justify their refusal. Reasons to refuse include that the trial is badly designed in some way, that the trial activities will violate the clinician’s conscience, or that the trial will impose excessive burdens on the clinician. Moral duties are regularly attributed to groups. Does this make conceptual sense or is this merely political rhetoric? And what are the implications for these individuals within groups? Collins outlines a Tripartite Model of group duties that can target political demands at the right entities, in the right way and for the right reasons.

Which kinds of responsibility can we attribute to which kinds of collective, and why? In contrast, which kinds of collective responsibility can we not attribute—which kinds are ‘gappy’? This study provides a framework for answering these questions. It begins by distinguishing between three kinds of collective and three kinds of responsibility. It then explains how gaps—i.e. cases where we cannot attribute the responsibility we might want to—appear to arise within each type of collective responsibility. Why, morally speaking, ought we do more for our family and friends than for strangers? In other words, what is the justification of special duties? According to partialists, the answer to this question cannot be reduced to impartial moral principles. According to impartialists, it can. This paper briefly argues in favour of impartialism, before drawing out an implication of the impartialist view: in addition to justifying some currently recognised special duties, impartialism also generates new special duties that are not yet (...) widely recognised. Specifically, in certain situations, impartial principles generate duties to take actions and adopt attitudes in our personal lives that increase the chance of new or different special relationships being formed—new or different friendships, family-like relationships, relationships akin to co-nationality, and so on. In fact, even if one thinks partialism is the best justification of the duties we have once in special relationships, impartialist justifications for taking steps to form such relationships should have some sway. Moreover, a little reflection shows that these duties are not as demanding or counterintuitive as one might expect. (shrink)

A collective duty gap arises when a group has caused harm that requires remedying but no member did harm that can justify the imposition of individual remedial duties. Examples range from airplane crashes to climate change. How might collective duty gaps be filled? This paper starts by examining two promising proposals for filling them. Both proposals are found inadequate. Thus, while gap-filling duties can be defended against objections from unfairness and demandingness, we need a substantive justification for their existence. I (...) argue that substantive justification can be found in the normative force of commitments individuals make to others with regard to ends. Along the way, I argue that gap-filling duties must be conceptualized differently in group agents, as compared to non-agent groups: in the former, gap-filling duties can be understood as duties to “take up the slack”; in the latter, this would be a category error. Climate change is more than a discrete issue demanding political attention and response. A changing climate permeates political life as material processes of planetary change reverberate in our bodies, affecting subterranean processes of attention and evoking bodily responses at and below the threshold of awareness. By way of example, I explore the register of bodily feeling to raise the possibility that proliferating anomalies in atmospheric, oceanic, and seismic activities are entering into subliminal experiences of time and confounding embodied expectations of (...) how the future is likely to flow from the past. The essay concludes with a preliminary discussion of how micropolitical strategies to amplify visceral experiences of climatic changes might valuably contribute to larger programs for climate action. This paper attempts a rational reconstruction of the Humean notion of an ideal critic. Claiming that the traits of practice and comparison can only arise through the gradual accumulation of experience, I argue that Humean critics are real, not ideal. After discussing the nature of perfection and the relation of delicacy to the other Human traits, I propose two supplements to Hume's list: imaginative fluency and emotional responsiveness. In recent years, a robust body of scholarship has emerged that examines ethical challenges facing the learning health organization model. In “Bystander Ethics and Good Samaritanism,” James Sabin and colleagues make a valuable addition to this scholarship, identifying and exploring the important question of what researchers' obligations are to patients receiving “usual care” if “that care is seen as suboptimal.” The central issue that Sabin et al. faced was whether it would be acceptable for researchers to identify patients with untreated (...) atrial fibrillation but then assign them to a control group that would not receive education about the importance of oral anticoagulation. The authors present this challenge as an issue of “bystander ethics.” To avoid being “bystanders” to identified instances of suboptimal care, the research team decided to instead identify a “delayed intervention” group for which they would not determine the members' anticoagulation status, thereby preventing them from knowing that specific patients met the criteria for oral anticoagulants but were not using them. This “workaround” approach strikes me as disingenuous. (shrink)

This short article provides an overview of "care ethics" for students who are new to moral theory.

While the human papillomavirus vaccine is medically indicated to reduce the risk of genital warts and certain types of cancer, rates of HPV vaccination repeatedly fall short of public health goals. Individual-level factors contributing to low vaccination rates are well documented. However, system-level barriers, particularly the need for parental consent, have been less explored. To date, there is no legal or ethical consensus in the USA regarding whether adolescents might permissibly self-consent to the HPV vaccine. Consequently, there is considerable variability (...) in medical practice at the provider and state level. In this essay, we explore the ethical acceptability of vaccinating adolescents for HPV without parental consent. We argue that the same ethical considerations that justify permitting minors to consent to treatment for sexual and reproductive health care—namely, public health benefit and adolescents’ developing autonomy—similarly justify permitting minors to consent to HPV vaccination. Based on this analysis, we conclude that allowing adolescents to self-consent to the HPV vaccine is ethically justifiable and should be reflected in US state policies. (shrink)

The unpredictability of the development and results of a research program is often invoked in favor of a free, desinterested science that would be led mainly by scientific curiosity, in contrast with a use-inspired science led by definite practical expectations. This paper will challenge a crucial but underexamined assumption in this line of defense of scientific freedom, namely that a free science is the best system of science to generate unexpected results. We will propose conditions favoring the occurrence of unexpected (...) facts in the course of a scientific investigation and then establish that use-inspired science actually scores better in this area. The accelerated trend toward media cobranding, joint ventures, strategic alliances and mergers, and acquisitions with nonjournalistic companies raises new ethical concerns about the entanglements created in the name of synergy. As traditional media companies buy stakes in Internet companies in equity swaps, the cross-ownership of media creates vast potential for real or perceived conflicts of interest. Ethics scholarship routinely defines conflict of interest as an individual act, ignoring the rise of the media conglomerate. This article introduces the concept of institutional (...) conflict of interest. The problem with the traditional definition of conflict of interest, then, is that it assumes the interests of the institution are always good, and that only the journalist, acting individually can violate the norm. The article outlines how media consolidation creates new conflicts of interest by outlining the term's definitions in various professions and proposing a revised definition that encompasses institutional conflict of interest. This Element introduces the philosophical literature on models, with an emphasis on normative considerations relevant to models for decision-making. Chapter 1 gives an overview of core questions in the philosophy of modeling. Chapter 2 examines the concept of model adequacy for purpose, using three examples of models from the atmospheric sciences to describe how this sort of adequacy is determined in practice. Chapter 3 explores the significance of using models that are not adequate for purpose, including the purpose of informing (...) public decisions. Chapter 4 provides a basic framework for values in modelling, using a case study to highlight the ethical challenges in building models for decision making. It concludes by establishing the need for strategies to manage value judgments in modelling, including the potential for public participation in the process. (shrink)

People who suffer brain damage to their ventromedial prefrontal cortex have a puzzling psychological profile: they seem to retain high intellect and practical reasoning skills after their brain injuries, but continually make poor decisions in many aspects of their lives. Adina Roskies argues that their behavior is explained by the fact that, although VM patients make correct judgments about what they ought to do, they are entirely unmotivated by those judgments. Roskies thus takes VM patients to be real-world counterexamples to (...) motivational internalism: the thesis that, necessarily, if S judges that she ought to φ in circumstances C, then S is somewhat motivated to φ in C. In this paper, however, I argue that the neuropsychological evidence that Roskies appeals to does not actually show that VM patients are entirely unmotivated by their normative judgments. Rather, I argue, the evidence suggests that VM patients form weaker normative judgments than normals during practical deliberation. And this affords the internalist with a plausible explanation for VM patients’ behavior: because VM patients form weaker normative judgments than normals, they are less motivated by their normative judgments than normals, which allows their decision-making to be overruled by their standing desires for greater and more immediate rewards. This paper explores the gendered discourses of the – seemingly favourable – media coverage that certain Heads of State received for their handling of the COVID-19 pandemic. Looking at media reports published in different English-speaking outlets in the US, the UK, India, Bangladesh, Singapore, New Zealand, Australia, and Ireland, and using multimodal feminist critical discourse analysis, we identify and describe strategies that on the surface appear to challenge hegemonic – and largely masculine – discourses of leadership. Upon closer scrutiny, these (...) superficially complimentary reports rather reinforce and naturalise discriminatory gender ideologies, and, as we demonstrate, they do so to different degrees along a continuum of essentialising, contextualising, and problematising. We critically discuss the discursive and visual processes involved and show that complimenting these leaders on their performance compares them against a masculine norm to construct their leadership as ‘alternative’, exceptional, and hence marked. This gendered portrayal of political leadership in times of crisis illustrates how the discursive construction of identities, responsibilities, and relationships during COVID-19 largely hinges on power relations and political ideologies that systematically disadvantage and undermine women. The purportedly positive form in which this occurs makes it particularly difficult to challenge and subvert these discriminatory discourses and their underlying gendered ideologies. (shrink)

Taking care of a hyperactive child at school gives 2 meanings to the word ‘care’: worrying about a vulnerable person and health care with the recognition of his behaviour disorder, the unruly pupil becomes a disabled pupil. But how does an undisciplined pupil become a psychiatric case? How do you recognise a hyperactive child at school, that is, from a medical point of view, a child with ADD/ADHD (Attention Deficient Disorder with or without Hyperactivity)? Teachers contribute to the medical diagnosis (...) by filling in behavioural tests. Then, in order to be taken care of, the child will need to have his hyperactivity recognised as a disability. To help the teacher, the doctor will give them advice on how to teach the child. Nevertheless, this desirable partnership raises difficulties. Between a paramedical support teacher and an educationalist doctor isn’t there a risk of witnessing a dilution of roles? The lifting of doctor-patient confidentiality called for by some teachers is emblematic of this confusion. Canguilhem’s distinction between normal and pathological will guide our reflection on the medical care of the hyperactive child at school. This case arouses an ethical issue about the medicalisation of our society. (shrink)

The legitimacy of multi-stakeholder initiatives (MSIs) as institutions for social and environmental governance in the global economy has received much scholarly attention over the past years. To date, however, research has yet to focus on assessing the legitimacy of MSIs in their interactions with other actors within larger systems of deliberation. Drawing on the deliberative systems perspective developed within deliberative democracy theory, we theorise a normative framework to evaluate the roles of MSIs within the broader systems of governance they co-construct (...) through their interactions with other initiatives, governments, non-governmental organisations, and other external actors. As we demonstrate in our evaluation of the illustrative case of the Bangladesh Accord on Fire and Building Safety as a MSI in the context of the Bangladeshi garment industry, this framework can help researchers assess whether a MSI ultimately serves to enhance or undermine the deliberative legitimacy of the overall system of which it forms a part. Theory in Africa, Africa in Theory explores the place of Africa in archaeological theory, and the place of theory in African archaeology. The centrality of African models in reconstructions is explored, focusing on materiality and agency in the past. The differences between how African models are used in western theoretical discourse and the use of that theory within Africa are also highlighted, as a means to explore the nature of theory itself. Thus, this dual purposed volume is a timely intervention (...) into archaeological theory, deconstructing the taken-for-granted foundations of the ways we approach the past. (shrink)

There are some cases where it appears permissible to perform a rescue at someone’s expense, and other cases where it appears impermissible to do so. Existing explanations for our asymmetric moral judgments about such cases either fail to provide intuitive moral verdicts or lack a satisfying rationale. In this article, I propose a new explanation of what is morally problematic about certain rescues that is subject to neither issue. My proposal is a version of the means principle which adds the (...) essential caveat that there is no moral presumption against using someone as a means to benefit herself. By attributing moral significance to the victim’s relationship to the beneficiary rather than the agent alone, my solution points to a new underlying rationale for the means principle as well as extensional and explanatory inadequacies in competing theories. Studies of corporate social performance (CSP) research indicate the critical importance of research design and methodology in developing and testing CSP theories. In this paper we analyze data from a study of environmental performance in the U.S. wine industry to demonstrate how the research methodologies can cause researchers to reach different theoretical conclusions from the same data. We conclude that structural equation modeling (SEM) offers CSP researchers valuable tools that can accommodate critical theory development needs.
