How do diverse groups of women in Canada define sexual harassment? To answer this question requires incorporating race and citizenship into the analysis of sexual harassment. The authors use data from seven focus groups of Canadian women. The white women with full citizenship rights most easily identify with existing legal understandings of sexual harassment and believe they have the right to report their harassment. For women of color and women without full citizenship rights, issues of racialized sexual harassment emerge as (...) central factors in their harassment experience. Black women with full citizenship rights call into question whether the term sexual harassment captures their experiences. Filipinas working as live-in caregivers on limited visas demonstrate how racism and lack of citizenship changes definitions of sexual harassment. Their experiences of harassment combine elements of isolation due to their lack of citizenship, racialized sexual harassment, and abuse. The authors argue that intersectional analyses are needed to understand women’s harassment experiences and their ability to complain and seek legal recourse. (shrink)

ABSTRACTThis article examines accounts of the moral basis of compensatory duties that explain such duties as the continuation, in some way, of the pre-wrong normative situation. I identify, contrast, and assess three versions of this view—duty continuity, right continuity, and reasons continuity. I argue that each version is defensible, once properly articulated. The article responds to a range of objections to these views that have not received much critical attention by their proponents.

In the context of the mandated phaseout of methyl bromide, California’s strawberry industry has increased its use of chloropicrin, another soil fumigant that has long been on the market. However, due to its 2010 designation as a toxic air contaminant, the US Environmental Protection Agency and California’s Department of Pesticide Regulation have developed enhanced application protocols to mitigate exposures of the chemical to bystanders, nearby residents, and farmworkers. The central feature of these mitigation technologies are enhanced buffer zones between treated (...) fields and nearby buildings. Not only do buffer zones inherently privilege neighbors over farmworkers, but the determinations of the size of these buffer zones are also based on acceptable threshold levels and probabilities that allow significant exposures to those they are designed to protect. Moreover, these protocols require human monitors to detect sensory irritation. While the science and technology studies literature is highly useful for understanding the inextricability of science and politics in developing protective measures and is attentive to what counts as data in setting acceptable thresholds, it tends to overlook that social sorting is intrinsic to such regulation. We thus turn to Foucault’s biopolitics to make sense of regulations that are designed to protect but inherently allow some to become ill. Doing so illuminates how determinations of the bright line are at once technical–political as well as implicit decisions about whose bodies count. (shrink)

I examine the implications of stereotyping and its intersections with the political realities facing American Indian communities. Specifically, I examine the typification of Indian as ecologically noble savage, as both employed and refuted by environmentalists, through the lenses of cognitive and social psychological perspectives and then bring it within the context of a broader cultural critique. I argue that the noble savage stereotype, often used to promote the environmentalist agenda is nonetheless immersed in the political and ideological parameters of the (...) modern project. Finally, I reassert the right and, more importantly, the authority of Native American peoples to ultimately define for themselves their respective identities and destinies. (shrink)

The aim of this paper is to describe five speech practices employed by Jish Arabic speakers: greeting a passerby, forms of address, necessary expressions when talking about death, necessary expressions when praising someone, and necessary expressions when mentioning entities of “low” value. These five speech practices are described using the Cultural Scripts Approach, which employs simple, universal language, thus enhancing descriptive accuracy and reducing ethnocentrism.

ArgumentThis article focuses on the specific ways in which Zionist scientists studying malaria in Mandatory Palestine presented their work to international scientific circles, moving between the transnational aspects and the local aspects of their work on malaria while suffusing that work with nationalist meanings. This slippery yet seemingly unproblematic movement between the general and the specific, between the colonial world and Palestine, was a necessary mechanism of scientific exchange. In the Zionist case the work on malaria for these scientists was (...) both a marker of their belief in progress and also a sign of their devotion to a specific political and social project. The knowledge imparted by Zionist malariologists and the international reception it received lent scientific legitimacy to the Zionist project while it advanced the goals of settling the land and defining the communal borders within Palestine between the Arab population and the Jewish one. In this way, the Zionist anti-malaria project in Palestine holds a unique place in malaria research of the time. (shrink)

This article derives from a doctoral thesis in which a particular discourse was used as a ‘paradigm case’. From this discourse an ethic set within a South African culture arose. Using many cultural ‘voices’ to aid the understanding of this narrative, the ethic shows that one can build on both a ‘justice’ and a ‘care’ ethic. With further development based on African culture one can take the ethic of care deeper and reveal ‘layers of understanding’. Care, together with compassion, forms (...) the foundation of morality. Nursing ethics has followed particular western moral philosophers. Often nursing ethics has been taught along the lines of Kohlberg’s theory of morality, with its emphasis on rules, rights, duties and general obligations. These principles were universalistic, masculine and noncontextual. However, there is a new ethical movement among Thomist philosophers along the lines to be expounded in this article. Nurses such as Benner, Bevis, Dunlop, Fry and Gadow - to name but a few - have welcomed the concept of an ‘ethic of care’. Gilligan’s work gave a feminist view and situated ethics in the everyday aspects of responsiveness, responsibility, context and concern. Shutte’s search for a ‘philosophy for Africa’ has resulted in finding similarities in Setiloane and in Senghor with those of Thomist philosophers. Using this African philosophy and a research participant’s narrative, an African ethic evolves out of the African proverb: ‘A person is a person through other persons’, or its alternative rendering: ‘I am because we are: we are because I am.’ This hermeneutic narrative reveals ‘the way affect imbues activity with ethical meaning’ within the context of a black nursing sister in a rural South African hospital. It expands upon the above proverb and incorporates the South African constitutional idea of ‘Ubuntu’ (compassion and justice or humanness). (shrink)

This paper examines the relation between the various forces which underlie human action and verbal reports about our reasons for acting as we did. I maintain that much of the psychological literature on confabulations rests on a dangerous conflation of the reasons for which people act with a variety of distinct motivational factors. In particular, I argue that subjects frequently give correct answers to questions about the considerations they acted upon while remaining largely unaware of why they take themselves to (...) have such reasons to act. Pari passu, experimental psychologists are wrong to maintain that they have shown our everyday reason talk to be systematically confused. This is significant because our everyday reason-ascriptions affect characterizations of action that are morally and legally relevant. I conclude, more positively, that far from rendering empirical research on confabulations invalid, my account helps to reveal its true insights into human nature. (shrink)

Where most discussions of trust focus on the rationality of trust, in this paper I explore the doxastic justification of beliefs formed through trust. I examine two forms of trust: the self-trust that is involved when one trusts one’s own basic cognitive faculties, and the interpersonal trust that is involved when one trusts another speaker. Both cases involve regarding a source of information as dependable for the truth. In thinking about the epistemic significance regarding a source in this way, I (...) call upon Process Reliabilism (PR). With its core idea that the epistemic goodness of a belief tracks the reliability of the process through which the belief was formed, PR suggests one way to think about the (potential) epistemic benefits and risks of trust: in cases of trust the process through which belief is formed includes reliance on an information source, where the reliability with which the source produced its information is the main determinant of the epistemic status of the beliefs formed through trusting that source. While it is much more common to find something like this picture endorsed in connection with cases of self-trust, I argue that it ought to be endorsed for cases of interpersonal trust as well. The failure to do so, I submit, reflects a commitment to an individualistic orientation that proponents of PR need not, and should not, endorse. (shrink)

The concept of cultural safety offers a unique approach to nursing practice, based on recognition of the power differentials inherent in any interaction. It is from within the context of nursing in Aoteaoroa/New Zealand (A/NZ) that the concept developed and was subsequently integrated into nursing education. Cultural safety is based within a framework of biculturalism, and is congruent with the tenets of the nation's founding document, the Treaty of Waitangi. Clarification of the concept is offered, together with a review of (...) the historical shift in nursing attitudes that has led to the emergence of ‘cultural safety’ as a viable and valued component of nursing practice.The argument is made that cultural safety has allowed for a more reflective, critical understanding of the actions of nursing to develop. This includes recognition that nurses’ attitudes and values have inevitably been influenced by social and political forces, and as such are in part reflective of those within the wider community. Comparison between the support given by nurses in the early 1900s to the theory of eugenics and the current acceptance of cultural safety is used to highlight this point. An examination of the literature identifies that ideological and conceptual changes have occurred in the approach of A/NZ nurses to issues with cultural implications for practice. A review of background factors relating to Maori health status and the Treaty of Waitangi is presented as a necessary context to the overall discussion.The discussion concludes with an acknowledgement that while the rhetoric of cultural safety is now part of nursing culture in New Zealand, there is no firm evidence to evaluate its impact in practice. Issues identified as impacting on the ability to assess/research a concept, such as cultural safety, are discussed. For cultural safety to become recognised as a credible (and indispensable) tool, it is necessary to further examine the ‘end-point’ or ‘outcomes’ of the process. (shrink)

This volume brings together a collection of essays on the history and philosophy of probability and statistics by one of the eminent scholars in these subjects. Written over the last fifteen years, they fall into three broad categories. The first deals with the use of symmetry arguments in inductive probability, in particular, their use in deriving rules of succession. The second group deals with four outstanding individuals who made lasting contributions to probability and statistics in very different ways: Frank Ramsey, (...) R. A. Fisher, Alan Turing, and Abraham de Moivre. The last group of essays deals with the problem of 'predicting the unpredictable' - making predictions when the range of possible outcomes is unknown in advance. Until the 1970s, models of early infancy tended to depict the young child as internally preoccupied and incapable of processing visual-tactile data from the external world. Meltzoff and Moore's groundbreaking studies of neonatal imitation disprove this characterization of early life: They suggest that the infant is cognizant of its external environment and is able to control its own body. Taking up these experiments, theorists argue that neonatal imitation provides an empirical justification for the existence of an innate ability to engage (...) in social communication. Since later imitation is taken as a benchmark for self- and other-awareness, theorists claim that a proto- or primitive self must exist in the infant. This paper takes up the issue of whether or not neonatal imitation does provide us with a ground to argue against developmental accounts that consider self-awareness to be a later acquisition. I argue that the enthusiasm over neonatal imitation is premature. Psychological studies that claim to prove neonatal imitation do not provide sufficient grounds for dismissing alternate philosophical and psychological theories about the self as being a post-birth "event" rather than an intrinsic condition. Therefore, I argue that there is no compelling reason to suppose that we come to the world with a primitive sense of self- or other-awareness. (shrink)

What can nurse scientists learn from Rorty in the development of a philosophical foundation? Indeed, Rorty in his 1989 text entitled Contingency, Irony, and Solidarity tantalizes the reader with debates of reason 'against' philosophizing. Forget truth seeking; move on to what matters. Rorty would rather the 'high brow' thinking go to those that do the work in order to make the effort useful. Nursing as an applied science, has something real that is worth looking at, and that nurse researchers need (...) to think about. And as a profession built upon relationships, we should be thinking of the exchanges we have with those around us, of the contrasts in vocabularies used and of the contingencies involved, letting this launch us into our imaginings and areas of enquiry. The business of nurse researchers is to study what nurses do – how we care; Rorty would have us care. But, not to dismiss the reflective thinker as Rorty advocates for the self-doubting ironist to continue to seek the final vocabulary, the ideal of what 'this' means, accepting this as the best to be offered at the time. As a science struggling to find foundation, we need only to look at what we do and value – as antifoundational as Rorty portrays himself, Rorty 'ironically' may have revealed a foundation for nursing science that is consistent with its path. Maybe we have things the wrong way round, and in our understandable preoccupation with the future we fail to appreciate how prospective ends often lie in the past. While the expression might refer to practices, experiences, and real social relations, capitalism is a (...) conceptualization and as such is a synthetic product of the understanding. Between abstraction and the concrete, could the end of capitalism lurk somewhere in this activity? Might it be something we can experience but never know? Is our expectation of paradigmatic transformation counterproductive? Is there a role for utopias and utopianism in this, and if so what might that be? (shrink)

In this paper I formulate the thesis of the Division of Epistemic Labor as a thesis of epistemic dependence, illustrate several ways in which individual subjects are epistemically dependent on one or more of the members of their community in the process of knowledge acquisition, and draw conclusions about the cognitively distributed nature of some knowledge acquisition.

In his book, Democratic Autonomy: Public Reasoning about the Ends of Policy, Henry Richardson suggests a process-based objection to bureaucracy – that is, an objection to bureaucracy that does not refer primarily to results, but rather to an ethical flaw that is inherent to bureaucratic procedures. Richardson’s worry is that, while large and complex societies rely on bureaucratic agencies to implement policies, there is a threat of those within bureaucratic institutions having more power than the average citizen when it comes (...) to making specific decisions about how to enact policy, and that this inequality in decision making power may be unjustified because undemocratic. If such inequality in decision making power is indeed a real threat, it will turn out that bureaucratic organisations, while being largely motivated by considerations of procedural fairness, may in fact constitute quite unfair procedures. Richardson proposes some institutional reforms that he thinks will enable us to avoid being dominated by bureaucracies, while retaining bureaucratic agencies, which he believes are necessary in modern societies. In what follows, I illustrate Richardson’s worry about bureaucratic domination and his proposed solution to the problem with a simplified, concrete example. If we compare Richardson’s proposed institutional reforms with Max Weber’s analysis of the concept of bureaucracy, however, I argue that it becomes apparent that bureaucracy is in fact incompatible with the sort of democracy that Richardson favours. If I am correct, this means that to the extent that we adopt Richardson’s proposed reforms, we will be replacing bureaucracies with something else. (shrink)

This article offers a critical theoretical exploration of the transformation of academic life that is currently taking place under the sign of ‘neoliberalization’. The main aim is to differentiate appropriation from exploitation as strategies of surplus labour dispossession, to identify the growth of appropriative techniques in academic life, and to situate the proliferation of such techniques in the broader transformations of global political economy. Alloyed with poststructuralist social theory, the historical materialist thrust of the article demonstrates how, in the technologically (...) articulate ‘social factory’ of advanced capitalism, the spatial operations of these techniques of dispossession have a particularly ‘aesthetic’ character that is immanent to their appropriative operation, and which renders their workings both more discreet and effective. The article aims: (1) to problematize the neoliberal concepts of efficiency, transparency, and autonomy, in terms of practical outcomes; (2) to stimulate reflexive consideration of the ‘positioning’ of academics themselves in the reproduction of these techniques; and (3) to ask how these techniques might generate new ‘historical subjects’ of struggle and organization in academic life. This paper considers phenomenological descriptions of health in Gadamer, Heidegger, Merleau-Ponty, and Svenaeus. In these phenomenologies of health, health is understood as a tacit, background state that permits not only normal functioning but also philosophical reflection. Nietzsche’s model of health as a state of intensity that is intimately connected to illness and suffering is then offered as a rejoinder. Nietzsche’s model includes a more complex view of suffering and pain as integrally tied to health, and its language opens up the (...) possibility of many ‘healths,’ providing important theoretical support to phenomenological accounts of the diversity and complexity of health and illness.
