Recent research suggests that individuals from East Asian and Western cultures differ in the degree to which they hold a folk world view known as naïve dialecticism, which is characterized by tolerance for contradiction, expectation of change, and cognitive holism. The current research utilizes the Mouse Paradigm to investigate the dynamic nature of naïve dialecticism in real time by measuring individuals’ fluctuations in judgment during the process of contemplation. The results showed cultural differences in dynamic measures of evaluation process: Japanese (...) participants took more time to stabilize their thought and showed more fluctuations in their judgment than American participants. These cultural differences were fully mediated by individual differences in levels of naïve dialecticism as measured by the level of dialectical self-views. Implications for cultural psychology and the psychology of dialectical thinking are discussed. (shrink)

In his PhD proposal, now published as Seeing Sociological, Garfinkel [2006] formulated action in terms of a mutually constitutive structure—the Noesis-Noema Structures. This structure can be traced to Aaron Gurwitsch’s gestalt psychology and Law of Good Gestalt which theorises how participants prioritise functional Gestalts over other possible meanings of what is perceivable in their surroundings. While Gurwitsch illustrated his theory using images, in this paper we revisit Gurwitsch’s theory in light of the advances in recording real-time interaction to consider Gestalt (...) in spatio-temporality of real-time interaction. We consider the Law of Good Gestalt in terms of the dimensions of time and space, and postulate two analytical principles—the Principle of Good Momentary Gestalt and the Principle of Good Temporal Gestalt—for analysing a multi-angle video segment of a monologue taken from a training event. The analysis examines how the monologue was embedded in a multi-layer projection structure, so that during the time of the monologue, the trainer and trainees can be seen as achieving a transition between one activity to another while sustaining the frame of the training event. Through this, the analysis highlights the multi-layered structure of participants’ field of perception that constitutes their experience of the social activity, and explores a “method” to reconstruct such a structured field of perception through re-coupling meanings to the assemblages of multimodal resources recoverable on video. Using the exemplary case of 19th-century American state penitentiaries, the authors explore penitentiary control from the perspective of sensing agents who navigate a controlled sensory ecology – the prison, as structured by institutional rules, differential power relations, and architectural plans. Moving beyond Foucault’s Discipline and Punish and Goffman’s Asylums, they stress a pragmatist approach to understanding human sensing and explain inmates’ creativity under constraints. Employing wardens’ disciplinary journals and other secondary reports, the article emphasizes three theoretical issues that explain why (...) Panoptical prisons’ attempts to control sense experiences can sometimes fail: architectural designs that inadequately negotiate the contradictory demands of visual and acoustic control; inmates’ active mobilization of perceptible objects as means of resistance; and power differences between prison authorities and inmates that prevent actors from sharing a common sensory field. A meat restriction order seeks to limit citizens’ meat consumption at the level of meeting individuals’ basic nutrient needs. This article aims to loosen some potential psychological hooks that prevent a more expansive, rational deliberation of the proposal. Inspired by Michel Foucault’s analysis of “everyday experience” and the (...) Buddhist responses to global environmental issues, we investigate the social patterns that account for the formation of people’s meat commitment, using Hong Kong society as a major case study. With reference to scientific studies of meat-eaters’ psychology, we discuss how the meat commitment becomes a barrier for society to positively consider the justifiability of the proposal. This paper investigates the emotional import of literary devices deployed in fiction. Reflecting on the often-favored approach in the analytic tradition that locates fictional characters, events, and narratives as sources of readers’ emotions, I attempt to broaden the scope of analysis by accounting for how literary devices trigger non-cognitive emotions. I argue that giving more expansive consideration to literary devices by which authors present content facilitates a better understanding of how fiction engages emotion. In this paper I develop an aesthetic of horror film music based on the film sound theorist Kevin Donnelly's "direct access thesis". This states that horror film scores have the power to provide "direct accesses" to the bodies of an audience; they "produce bodily sensations, excite (mainly negative) emotions and insert in the audience "frames of mind and attitudes...much like a direct injection". I first argue that two dominant theories in the field, namely, the culturalist theory of film music and (...) Peter Kivy's cognitivist theory of music and emotion are inadequate. Then I will show that by aligning the direct access thesis with Jenefer Robinson's theory of music and emotion, Mark Johnson and Steve Larson's contention that musical meaning is primarily embodied, we will be able to reveal a deeper meaning of horror film scores than musical convention. I illustrate my proposal with the shark motif in Jaws and Dies Irae in The Shining. (shrink)

One less obvious impact of legal bilingualism in a postcolonial jurisdiction like Hong Kong is an increasing trend of unrepresented litigants. Since their lack of legal knowledge often places them at a disadvantage and poses numerous problems in court, the government has established the resource centre for unrepresented litigants to offer them information about legal procedure. This paper evaluates the usefulness of the Chinese official reference materials at the centre in equipping laymen for civil litigation. As a first point of (...) contact between unrepresented litigants and the law, these leaflets have a direct impact on the users’ understanding of litigation procedures and their courtroom performance. This paper argues that the leaflets suffer from two major problems: incomprehensibility of language and lack of structure. Problems involved in include inconsistency in terminology, problematic translation, and language complexity arising from the use of odd collocation, unusual words, difficult legal terminology and confusing parts of speech; whereas in , information is found to be scattered and disorganised. To improve readability, the paper suggests using plain language, and providing checklists of documents, and a legal glossary. Cross-jurisdiction practices will be examined to show how unrepresented litigants’ access to justice may be facilitated. (shrink)

There is a growing interest in the role of non-cognitive affective responses in the philosophical literature on fiction and emotion. This flurry of scholarly interest is partly a reaction to cognitivist accounts of fiction and emotion that have been found to be inadequate. The inadequacy is particularly salient when this approach is employed to account for narrative horror. Cognitivist conceptions of the emotion engendered by narrative horror prove to be too restrictive. Cognitivist accounts also fail to give the formal devices (...) and stylistic elements deployed in narrative horror a proper place within the spectator’s emotional engagement with it. In this paper I propose an alternative conception of the emotion “horror” that incorporates non-cognitive affective responses. I argue that this conception of “horror” is more fine-grained than the one characterized as a cognitivist approach. It captures more literary examples of the horror experience and it accommodates better the fear of the unknown. It also makes possible an aesthetics of horror in which formal devices and stylistic elements are given their proper place. (shrink)

Perceptual grouping is fundamental to many auditory processes. The Iambic–Trochaic Law (ITL) is a default grouping strategy, where rhythmic alternations of duration are perceived iambically (weak‐strong), while alternations of intensity are perceived trochaically (strong‐weak). Some argue that the ITL is experience dependent. For instance, French speakers follow the ITL, but not as consistently as German speakers. We hypothesized that learning about prosodic patterns, like word stress, modulates this rhythmic grouping. We tested this idea by training French adults on a German‐like (...) stress contrast. Individuals who showed better phonological learning had more ITL‐like grouping, particularly over duration cues. In a non‐phonological condition, French adults were trained using identical stimuli, but they learned to attend to acoustic variation that was not linguistic. Here, no learning effects were observed. Results thus suggest that phonological learning can modulate low‐level auditory grouping phenomena, but it is constrained by the ability of individuals to learn from short‐term training. (shrink)

Leading scholars, including Peter Singer and Gerald Dworkin, investigate diverse topics such as animal rights, vegetarianism, lethal injection, abortion and euthanasia.

Mark Coeckelbergh (Int J Soc Robot 1:217–221, 2009) argues that robot ethics should investigate what interaction with robots can do to humans rather than focusing on the robot’s moral status. We should ask what robots do to our sociality and whether human–robot interaction can contribute to the human good and human flourishing. This paper extends Coeckelbergh’s call and investigate what it means to live with disembodied AI-powered agents. We address the following question: Can the human–AI interaction contribute to our moral (...) development? We present an empirically informed philosophical analysis of how the AI personal assistant Siri changes its users’ way of life, based on the responses obtained from 20 semi-directive individual interviews with Siri users. We identify changes in the users’ social interaction associated with the adoption of Siri. These changes include: (1) the indirect effect of reducing opportunities of human interaction, (2) the second-order effect of diminished expectations toward each other in a community, and (3) the acquired preference to obtain hassle-free interaction with Siri over human interaction. We examine them in relation to concerns that are voiced in the current debates over the rise of AI, namely the suspicion that humans could become overly reliant on AI (Danaher 2019) and the worry that social AI could impede on moral development (Fröding and Peterson, Ethics Inf Technol 23:207–214, 2012; Li, Ethics Inf Technol 23:543–550, 2021). We analyze the ethical costs that come from these changes in light of virtue ethics and address potential objections along the way. We end by offering directions for thinking about how to live with AI personal assistant while preserving favorable conditions for moral development. (shrink)

At present, the task of enforcing UK competition law lies almost exclusively with a public regulator. One of the aims of the Competition Bill which is currently before Parliament is to enable private litigants to seek redress through the courts for harm caused by unlawful anti-competitive conduct. This article considers the appropriate role of private actions in the enforcement of competition law. It is argued that private actions are of both instrumental and intrinsic value: not only can private actions act (...) as a deterrent against harmful behaviour, but they also enable those harmed by unlawful anti-competitive conduct to seek compensation for injury from the perpetrator. But private enforcement suffers from several shortcomings which are not shared by public enforcement. Accordingly, it is argued that although there is a strong case for ‘privatizing competition regulation’, private enforcement should be used to supplement, rather than supplant, public enforcement. This article also explores the problems within a regulatory scheme which combines both private and public enforcement, drawing on the experience of other jurisdictions to shed light on how such ‘aggregation problems’ might best be resolved. Finally, UK competition regulation is examined from an enforcement perspective. It is argued that the UK Competition Bill has the potential to provide a significantly more effective and efficient scheme of regulation. Whether or not this potential is realized will depend on a number of factors, particularly the ability of UK courts to interpret the legislative prohibitions in a coherent, predictable, and transparent manner which is consistent with the economic theory upon which competition regulation is based. The Black Mirror episode “Arkangel” tells a disturbing story of over-parenting driven by technology. The single mother Marie’s adoption of the Arkangel system has invited overwhelmingly negative moral evaluation from philosophers. But what accounts for the moral failure of a loving and concerned parent? Is it all about her flawed character, or are there situational factors at work? In the article, I first foreground the slipperiness of technology implicated in Albert Borgmann’s notion of the “device paradigm” and Hans Jonas’s analysis (...) of modern technology. Then I analyze the character of the Arkangel system in the light of the two philosophers’ works and show how the technology turns Marie into a failing parent. In the end, I offer tentative answers to the two questions; the answers shall also shed light on the problem of under-parenting driven by digital technology. (shrink)

Facing a recent surge in anti-natalist arguments saying that human procreation is immoral, some defend human procreation by saying that procreative parenting adds meaning to parents’ life. This article examines one such defence, and argues that it does not suffice to rescue human procreation from the challenges to procreation.

Enquiry teaching approaches are widely considered as more useful than didactic approaches for the development of environmentally responsible behaviour. This paper is a report of an empirical study on the validity of this belief with reference to higher-ability and lower- to medium-ability groups drawn from geography classes at the Advanced Level in Hong Kong. The hypotheses were that, taken together, enquiry approaches are more effective than didactic approaches for the development of environmentally responsible behaviour in both the short and long (...) terms for students as a whole, and for students within the same range of academic ability. A quasi-experimental control group design was used for selecting students and classes from schools in the territory. A questionnaire survey and a series of interviews were conducted to collect data about students' behaviour before and after they were taught a people-environment topic with a didactic approach or an enquiry approach. The results suggest that the students on the whole were not behaving as positively for the environment as their peers in other countries. For both the higher- and the lower- to medium-ability classes, those who were taught with an enquiry approach were behaving positively in more areas than those who were taught with a didactic approach in both the short and long terms. This trend could be attributed to their greater attention to critical thinking, positive behavioural changes, and the development of internal locus of control, while society as a whole was still largely apathetic to personal efforts for improving environmental quality. To further enhance the effectiveness of enquiry for the development of environmentally responsible behaviour, it is suggested that teachers should give more attention to the elements of concern and empathy in the classroom. Improvements in teacher education and training and in the guidelines for teachers, restructuring and revision of environmental education in schools, providing adequate funding and resources, and revision of the style and content of questions in public examinations are also recommended. With the increasing degrees A.I.s and machines are applied across different social contexts, the need for implementing ethics in A.I.s is pressing. In this paper, we argue for a pluralist hybrid model for the implementation of moral A.I.s. We first survey current approaches to moral A.I.s and their inherent limitations. Then we propose the pluralist hybrid approach and show how these limitations of moral A.I.s can be partly alleviated by the pluralist hybrid approach. The core ethical decision-making capacity of an (...) A.I. based on the pluralist hybrid approach consists of two systems. The first is a deterministic algorithm system that incorporates different moral rules for making explicit moral decisions. The second is a machine learning system that calculates the value of the variables required by the application of moral principles. The pluralist hybrid system is better than the existing proposals as (i) it better addresses the moral disagreement problem of the top-down approach by including different moral principles, while (ii) it reduces the opacity of ethical decision-making compared with a bottom-up system by implementing explicit moral principles for moral decision making. This article advances an account of the nonhedonic values of horror fiction (including film). It is motivated by cases in which consuming horror fosters what theorists of education call "transformative learning" in adult students, which is a more shocking and disturbing experience than pleasurable. I first present two cases in which Polanski's Repulsion (1968) and Browning's Freaks (1932) disrupted and modified two students' experience of madness and abnormality respectively. Then I draw on Dewey's "aesthetic experience", Foucault's "experience book" and O'Leary's (...) approach to the value of fiction to give the transformative experience in question a philosophical underpinning. In the second half of the paper, I offer a close reading of Bloch's Psycho (1959), with the aim of demonstrating that it has the potential to transform the everyday experience of madness in readers. Ethical behavior among businesses has gained significant prominence in recent years. Survey evidence shows that Asian consumers demand for greater social responsibility among businesses. Thus, a deeper understanding of the factors that contribute to such a demand is useful. This study examines the influence of religiosity and values on corporate social responsibility (CSR) support among consumers in Hong Kong and Singapore. Primary data collected among consumers in these cities point to a significant direct relationship between religiosity and CSR support. In (...) Hong Kong, this attitude is due both to altruistic as well as for egotistical (or face saving) reasons. In Singapore, this is mainly due to the latter. The results imply that different motivations should guide CSR strategies in these two cities. (shrink)

The paper uses questionnaire responses provided by a sample of ethical investors to investigate willingness to sacrifice ethical considerations for financial reward. The paper examines the amount of financial reward necessary to cause an ethical investor to accept a switch from good ethical performance to poor ethical performance. Conjoint analysis is used to allow quantification of the utilities derived from different combinations of ethical and financial performance. Ethical investors are shown to vary in their willingness to sacrifice ethical for financial (...) performance, and hence to display more heterogeneity than the all-encompassing ‘ethical’ label implies. Because of the existence of sub-groups of ethical investors with different attitudes towards financial reward, an attempt has been made to associate observable investors’ characteristics with their level of willingness to trade-off morality for cash. One sub-group of investors in particular appears highly resistant to the idea of accepting higher financial return as compensation for poor ethical performance. This unwillingness casts doubt on Jensen and Meckling’s widely reported claim that trade-off behaviour is ubiquitous in all areas of life. (shrink)

Previous research on moral dilemmas has mainly focused on decisions made under conditions of probabilistic certainty. We investigated the impact of uncertainty on the preference for action (killing one individual to save five people) and inaction (saving one but allowing five people to die) in moral dilemmas. We reported two experimental studies that varied the framing (gain vs loss), levels of risk (probability of gain and loss) and levels of ambiguity (imprecise probability information) in the choice to save five individuals (...) by sacrificing one. We found that participants preferred actions with uncertainty (risk/ambiguity) over inaction. Specifically, we found that participants preferred actions with precise probability information (risk) over inaction, and they preferred actions with modest or high levels of ambiguity over actions with precise probabilities, especially when moral dilemmas had a loss frame. We also observed commission bias in Study 2. We discussed the implications for research in moral decision-making. (shrink)
