Pour chaque volume de la collection Lectures de..., l'éditeur a fait appel aux universitaires les plus éminents dans le souci d'offrir au public francophone un ensemble d'études, hors de tout parti pris, sur les principaux philosophes de l'Antiquité à nos jours. Longtemps tenu pour un auteur ésotérique, Wittgenstein est aujourd'hui une référence centrale dans la vie intellectuelle, et il ne s'agit plus d'un simple effet de mode. Son oeuvre est présente dans le paysage international, non seulement en philosophie, mais (...) aussi en sciences humaines et sociales : la sociologie, l'anthropologie, la philosophie du droit et de l'économie s'en inspirent. Elle a largement débordé le monde anglophone, où elle façonne une partie de la réflexion depuis plus d'un demi-siècle. Pourtant, l'appréhension philosophique de cette oeuvre est loin d'être univoque, puisque l'on a assisté, depuis la mort de Wittgenstein en 1951, à une série de lectures divergentes de ses textes, dont les plus prégnantes méritent d'être ici expliquées. Les points de vue sur Wittgenstein se sont par ailleurs multipliés : d'abord lu dans les années 1950-1960 comme philosophe avant tout logicien, en fonction du Tractatus et dans le sillage de ses maîtres Frege et Russell, comme mystique ou comme philosophe du langage, au vu de sa "seconde" philosophie, il apparaît ensuite comme l'auteur d'une oeuvre complexe et multidimensionnelle touchant à des questions de philosophie générale (expérience, signification, réalité, etc.). Le présent ouvrage se donne pour tâche de cartographier ce réseau complexe qu'est la philosophie de Wittgenstein, d'abord en présentant les grands textes et les thèmes majeurs qui ont jalonné son parcours philosophique, puis en introduisant aux différentes lectures qui en ont été proposées dans la tradition interprétative. Capacity evaluation has become a widely used assessment device in clinical practice to determine whether patients have the cognitive ability to render their own medical decisions. Such evaluations, which might be better thought of as “capacity challenges,” are generally thought of as benign tools used to facilitate care. This paper proposes that such challenges should be reconceptualized as significant medical interventions with their own set of risks, side effects, and potentially deleterious consequences. As a result, a cost–benefit analysis should be (...) implemented prior to imposing such capacity challenges, and efforts should be made to minimize such challenges in situations where they are unlikely to alter the course of treatment. In their discussion paper of November 2020, Cooket alpresent a draft protocol for navigating circumstances in which emergency services are overwhelmed. Their paper suggests that COVID-related triage decisions should be based on clinical assessment, patient and family consultation, and a range of ethical considerations. In this response, we note that the protocol exhibits an ambiguity that is likely to result in irresolvable dilemmas when put into practice. This ambiguity is exemplified in the paper’s prime ethical imperative (to ‘save more lives (...) and more years of life’), which takes the form of an undefined conjunction whose practical implications are left unspecified. We see this ambiguity in the prime imperative as one manifestation of a broader set of tensions in the protocol. We show that the discipline of human rights provides an essential supplement to the ethical framework on which Cook and colleagues rely, providing a framework for understanding and working through triage dilemmas involving age, discrimination and equality. The concepts of disease, illness and sickness capture fundamentally different aspects of phenomena related to human ailments and healthcare. The philosophy and theory of medicine are making manifold efforts to capture the essence and normative implications of these concepts. In parallel, socio-empirical studies on patients’ understanding of their situation have yielded a comprehensive body of knowledge regarding subjective perspectives on health-related statuses. Although both scientific fields provide varied valuable insights, they have not been strongly linked to each other. Therefore, the (...) article aims to scrutinise the normative-ethical implications of patient perspectives in building a bridge to the empirical ethics debates. Three potential fields of tension between the illness and the disease perspective are presented. Consequently, findings from empirical research examining patient perspectives on illness are displayed and the practical implications and associated ethical issues which arise are discussed. This leads to the conclusion that an explicit and elaborate empirical-ethical methodology is needed to deal appropriately with the complex interaction between patients’ views and the medico-professional view of disease. Kon’s four-stage model of normative-empirical collaboration is then applied against the background of empirical data on patient perceptions. Starting from this exemplary approach, the article suggests employing empirical-ethical frameworks for further research on the conceptual and normative issues, as they help to integrate perspectives from the philosophy of medicine with socio-empirical research. The combination of theoretical and empirical perspectives suggested contributes to a more nuanced discussion of the normative impact of patients’ actual understanding of illness. Further empirical research in this area would profit from explicitly considering potential ethical issues to avoid naturalistic fallacies or crypto-normative conclusions that may compromise healthcare practice. Vice versa, medico-theoretical debates could be enriched by integrating subjective views of those people who are immediately affected. (shrink)

Requests by patients for providers of specific demographic backgrounds pose an ongoing challenge for hospitals, policymakers, and ethicists. These requests may stem from a wide variety of motivations; some may be consistent with broader societal values, although many others may reflect prejudices inconsistent with justice, equity, and decency. This paper proposes a taxonomy designed to assist healthcare institutions in addressing such cases in a consistent and equitable manner. In this study we relate four different measures: the theodicy models proposed by van der Ven, the coping strategies proposed by Pargament, a measure of positive or negative self-image and the post critical belief scales we ourselves have developed. We analysed the data of 251 Dutch-speaking Belgians. In the analysis we focus on the relation of the different measures with the post critical belief scales. Different types of believers are using different theodicy models, somewhat different coping strategies and we observe (...) some differences in self-image, where believers have a more positive self-image than non-believers. We could suggest that there is a specific theodicy model used by symbolic believers and another theodicy model used by more literal believers. The former could be interpreted as more developed and perhaps more religiously mature. (shrink)

This case study investigates Gram Vikas' innovative social entrepreneurial approach to sustainable rural development through its 'Water and Sanitation Programme'. We explore its key innovation of 100 % inclusion and the process of creating democratic, self-governing management systems. This allows us to demonstrate how a social enterprise tries to realize its vision of "an equitable and sustainable society where people live in peace with dignity", and ultimately, how it contributes to the United Nations Millennium Goals of improving health, empowering women (...) and breaking the vicious circle of poverty. Im Zuge des „empirical turn“ der Medizin- und Bioethik ist von verschiedenen Autoren in den vergangenen Jahren die Idee einer „evidenzbasierten Ethik“ diskutiert worden. Die Analogie zwischen evidenzbasierter Medizin und „evidenzbasierter Ethik“ soll in diesem Beitrag kritisch diskutiert und dabei gezeigt werden, dass der Ausdruck „evidenzbasierte Ethik“ irreführend ist. Zentraler Ausgangspunkt der Kritik ist die unterschiedliche Bedeutung, die empirische Informationen für das medizinisch-klinische Urteil zum einen und das ethische Urteil in der Medizin zum anderen haben. Im medizinisch-klinischen Urteil können mit (...) Hilfe empirischer Informationen hypothetische Handlungsnormen generiert werden, welche auf den der Medizin inhärenten Zwecksetzungen basieren. Bei Fragen der Ethik in der Medizin hingegen sind die Handlungsziele selbst Gegenstand des Urteils; diese aber können allein aus empirischem Wissen heraus nicht zureichend bestimmt werden. Die Diskussion um die Möglichkeit einer „evidenzbasierten Ethik“ eröffnet weiterhin aufschlussreiche Perspektiven in Bezug auf empirische Forschung und den Umgang mit empirischen Informationen in der Angewandten Ethik und das Aufgabenfeld der Medizinethik. Definition of the problem Interprofessional learning of nursing trainees and medical students offers numerous opportunities for future cooperation aiming to provide high-quality care for patients. Arguments Expert panels, therefore, demand early integration of interprofessional teaching and learning structures in order to be able to achieve effective and sustainable improvements in practice. In Germany, interprofessional learning formats are increasingly used in undergraduate education of the two professions in selected—compulsory and optional—themes and courses. Conclusion So far, the field of health care ethics (...) has scarcely been taken into consideration. The study of Islamic philosophy has entered a new and exciting phase in the last few years. Both the received canon of Islamic philosophers and the narrative of the course of Islamic philosophy are in the process of being radically questioned and revised. Most twentieth-century Western scholarship on Arabic or Islamic philosophy has focused on the period from the ninth century to the twelfth. It is a measure of the transformation that is currently underway in the field that, unlike other (...) reference works, the Oxford Handbook has striven to give roughly equal weight to every century, from the ninth to the twentieth. The Handbook is also unique in that its 30 chapters are work-centered rather than person- or theme-centered, in particular taking advantage of recent new editions and translations that have renewed interest and debate around the Islamic philosophical canon. The Oxford Handbook of Islamic Philosophy gives both the advanced student and active scholar in Islamic philosophy, theology, and intellectual history, a strong sense of what a work in Islamic philosophy looks like and a deep view of the issues, concepts, and arguments that are at stake. Patient portals are poised to transform health communication by empowering patients with rapid access to their own health data. The 21st Century Cures Act is a US federal law that, among other provisions, prevents health entities from engaging in practices that disrupt the exchange of electronic health information—a measure that may increase the usage of patient health portals. Caregiver access to patient portals, however, may lead to breaches in patient privacy and confidentiality if not managed properly through proxy accounts. We (...) present an ethical framework that guides policy and clinical workflow development for healthcare institutions to support the best use of patient portals. Caregivers are vital members of the care team and should be supported through novel forms of health information technology (IT). Patients, however, may not want all information to be shared with their proxies so healthcare institutions must support the development and use of separate proxy accounts as opposed to using the patient’s own account as well provide controls for limiting the scope of information displayed in the proxy accounts. Lastly, as socioeconomic barriers to adoption of health IT persist, healthcare providers must work to ensure multiple streams of patient communication, to prevent further propagating health inequities. In this comment we take up two points made by Douglas Hollan in his article “Emerging Issues in the Cross-Cultural Study of Empathy,” and discuss their possible philosophical implications. Hollan‘s concept of complex empathy may give rise to the idea that we can learn about other people’s beliefs via empathy, which is something we do not believe is possible. Furthermore, Hollan’s description of possible negative effects of empathy, such as manipulations of a person on the basis of knowledge about their (...) emotions, might pose a problem for proponents of care ethics, who generally start from the assumption that empathy fosters altruistic behavior. Economic motivations are key drivers of human behavior. Unfortunately, they are largely overlooked in literature related to medical decisionmaking, particularly with regard to end-of-life care. It is widely understood that the directions of a proxy acting in bad faith can be overridden. But what of cases in which the proxy or surrogate appears to be acting in good faith to effectuate the patient’s values, yet doing so directly serves the decision-maker’s financial interests? Such situations are not uncommon. Many patients care (...) as deeply about economic wellbeing of their families as they do for their own lives and health. This brief work examines three scenarios that raise ethical issues regarding the role of pecuniary motives in making critical medical decisions. Each scenario presents a potential financial conflict of interest between an incapacitated patient and a third-party decision-maker and offers a framework for integrating ethical and legal concerns into clinical care. It is our hope that this work prepares physicians for unexpected ethical conflicts of interest and enables them to further the interests of his or her patients. (shrink)

The anonymous treatise De sex inconvenientibus is a good example of the calculatores’ approach when dealing with motion. It is organized around four main questions relating to the determination of rapidity in four kinds of changes, i.e. in the generation of substantial forms, in alteration, in increase, and in local motion. In some arguments the author points out the paradoxes to which the two ways of determining the rapidity of a motion can lead: rapidity is determined by the effect produced (...) (the degree of quality generated, the space covered, etc.) or it results from the ratio between the moving power and the resistance of the mobile or patient. While this twofold approach to determining rapidity appears in the majority of calculator texts, the two points of view – the analysis according to its effects and the analysis according to its causes – have rarely been confronted. Wilke et al. make significant headway in gaining a better understanding of the influence affect cues may have on action perception and judgement. In our view their account also brings up a row of important questions demanding further research. This concerns the role of conceptual and non-conceptual content and the different effects emotions of the same valence may play in the perception and judgement of action.

Este trabajo trata de ilustrar el paralelismo existente –no obstante ciertas diferencias de enfoque y de conceptualización– entre el pensamiento wittgensteineano de principios de los años 30 y la teoría del conocimiento de C.I. Lewis. El punto de comparación es la noción de experiencia en tanto que trato epistémico con los objetos. Según la lectura sugerida, nuestra vida epistémica se desarrolla –bajo el denominador común de nuestra conciencia de pertinencias conceptuales– como un dinámico juego entre certezas (vitales) y tentativas de (...) conocimiento (racional). On peut considérer que ce qui se produit dans le travail familial thérapeutique avec une famille dans une institution donnée est révélateur du fonctionnement de la famille tel que cette dernière le projette sur l’institution. Mais ce qui se passe dans cette thérapie peut aussi refléter le fonctionnement de l’institution à ce moment précis : ce qui se vit dans l’institution a souvent des répercussions sur les prises en charge thérapeutiques.

A myriad of sensations inform and direct us when we engage with the environment. To understand their influence on the development of our habitus it is important to focus on unifying processes in sensing. This approach allows us to include phenomena that elude a rather narrow view that focuses on each of the five discrete senses in isolation. One of the central questions addressed in this volume is whether there is something like a sensual habitus, and if there is, how (...) it can be defined. This is especially done by exploring the formation and habituation of the senses in and by a culturally shaped habitat. Two key concepts, Synaesthesia and Kinaesthetics, are addressed as essential components for an understanding of the interface of habitat and the rich and multisensory experience of a perceiving subject. At a Berlin-based conference Synaesthesia and Kinaesthetics, scholars from various disciplines gathered to discuss these issues. In bringing together the outcome of these discussions, this book gives new insights into the key phenomena of sensory integration and synaesthetic experiences, it enriches the perspectives on sensually embedded interaction and its habituation, and it expands this interdisciplinary inquiry to questions about the cultures of sensory habitus. 2021 jährte sich zum zwanzigsten Mal die Einführung des Lebenspartnerschaftsgesetzes und damit der Eingetragenen Lebenspartnerschaft als das erste Rechtsinstitut für gleichgeschlechtliche Paare. 2017 löste die Ehe die Lebenspartnerschaft ab, allerdings nicht mit allen Rechten einer Ehe wie zwischen heterosexuellen Personen. Der Aushandlungsprozess zur sogenannten Ehe für alle ist insbesondere für religionswissenschaftliche Fragestellungen erkenntnisreich. Am Beispiel des Diskurses um die Einführung der gleichgeschlechtliche Ehe in Deutschland 2015 und dem Referendum in Irland als diskursivem Ereignis zeigt die Autorin, wie politische Akteur*innen in (...) einem zeitgenössischen Deutungskampf um die Bedeutung von Ehe wetteifern und dabei mit der Diskursprämisse einer angenommenen Moderne die Dichotomie von religiös vs. säkular sowie weitere Narrative von und über Religion(en) zur Selbst- und Fremdpositionierungen sowie für ihre Koalitions- und Oppositionsbildungen einsetzen. Die Analyse verwendet einen zeit-, akteurs- und arenaspezifischen Ansatz und verknüpft methodologisch die Wissenssoziologische Diskursanalyse (WDA) mit einem religionswissenschaftlichen Erkenntnisinteresse. This study aimed to advance our understanding of 5-year-olds’ behavioral difficulties by modeling and testing both mediational protective and risk pathways simultaneously. Drawing on two national samples from different Western European countries—the United Kingdom and Germany, the proposed model considered observed sensitive parental interactive behaviors and tested child vocabulary as protective pathways connecting parental education with children’s behavioral outcomes; the risk pathways focused on negative parental disciplinary practices linking parental education, parental distress, and children’s difficult temperament to children’s behavioral difficulties. (...) Further, the tested model controlled for families’ income as well as children’s sex and formal child care attendance. Children with comparatively higher educated parents experienced more sensitive interactive behavior, had more advanced vocabulary, and exhibited fewer behavioral difficulties. Children with a comparatively higher level of difficult temperament or with parents who suffered from distress tended to experience more negative disciplinary behavior and exhibited more behavioral difficulties. Additionally, children’s vocabulary skills served as a mechanism mediating the association between parental education and children’s behavioral difficulties. Overall, we found similar patterns of results across the United Kingdom and Germany with both protective and risk pathways contributing simultaneously to children’s behavioral development. The findings suggest that promoting parents’ sensitive interactive behaviors, favorable disciplinary practices, and child’s vocabulary skills have potential for preventing early behavioral difficulties. The first part of this book provides the best short overview of the German Enlightenment available in English. Although, as the author says, she “sheds no new light on the German Enlightenment but follows current views”, those views are largely unavailable in English. With admirable lucidity, Roehr covers topics such as the nature of enlightenment, theology, Freemasonry, responses to the French revolution, and moral philosophy.
