In their discussion paper of November 2020, Cooket alpresent a draft protocol for navigating circumstances in which emergency services are overwhelmed. Their paper suggests that COVID-related triage decisions should be based on clinical assessment, patient and family consultation, and a range of ethical considerations. In this response, we note that the protocol exhibits an ambiguity that is likely to result in irresolvable dilemmas when put into practice. This ambiguity is exemplified in the paper’s prime ethical imperative (to ‘save more lives (...) and more years of life’), which takes the form of an undefined conjunction whose practical implications are left unspecified. We see this ambiguity in the prime imperative as one manifestation of a broader set of tensions in the protocol. We show that the discipline of human rights provides an essential supplement to the ethical framework on which Cook and colleagues rely, providing a framework for understanding and working through triage dilemmas involving age, discrimination and equality. This article focuses on how aesthetic values permeate Nietzsche’s philosophy. Artistry is not confined to the creation of conventional works of art but occurs in the form-giving that is essential to all human forms of life. Since Nietzsche was committed to the view that the world is in some basic sense chaotic and meaningless, he held that only by imposing forms can we create a cognizable world. This close association between the conditions of life itself and the aesthetic activity of (...) giving form belies that Kantian conception that any appreciation of aesthetic phenomena is essentially disinterested. The affective sciences are essential to research regarding sustainable transition towards renewable energy. We focus on important questions that should be addressed by affective science in relation to the siting of large-scale renewable energy projects like wind and solar. Considering the recent acceleration of the transition, a more holistic understanding of negative and positive emotional responses to energy development will be essential. This is particularly important as the least controversial sites begin to dwindle in number. We break this commentary down (...) into four primary question categories for future research. These are the causal relationships between emotional elicitations and their sources, dual processing through cognitive and affective response, affect and its relationship with place, and how all of these elements change over time. This paper argues that Kant presents two different accounts of beauty, one that applies properly to art and one that applies properly to nature. The judgment of beauty that applies properly to nature can be free and thus judged without concepts. The work of art, however, is judged beautiful when it expresses aesthetic ideas. This distinction then enables me to explain several problematic passages in Kant's text: those that serve to distinguish these two conceptions of beauty from one another as (...) well as those passages in which Kant views them as overlapping. With respect to the latter, I argue that Kant lays especial significance on cases where we apply the conception of artistic beauty to natural objects, as in doing so we view nature as expressing ideas that step beyond nature. Democratic theorists, especially since the advent of the deliberative democracy paradigm in the 1980s, have focused primarily on relationships involving citizens and their political representatives, and have thus paid scant attention to the bureaucratic agencies within the modern state that are presumed merely to “flesh out,” implement, and enforce the decisions made by elected officials. This undertheorized space between markets and democratic decision making, in brief, is where corporations and other interested parties inter- act with regulatory agencies, their bureaucrats, and (...) the elected officials who are accountable for what governments do on their watch. How and why ought democratic governments to facilitate, regulate, or get out of the way of, markets and corporations in a so-called market democracy? We cannot possibly provide or defend a detailed answer to this question here. What we will attempt to do, however, is to make the case for why the question is too normatively and conceptually rich for political philosophers to continue to outsource it almost entirely to scholars in law and the social sciences. Although the tensions between lawmaking by bureaucrats and the ideals of representative democracy rarely merit more than a few sentences of abstract reflection by democratic theorists, we have tried to reconstruct the implicit assumptions that might explain this neglect. Directed duties are those duties whose violation would wrong someone in particular. Under what conditions, and in virtue of what, is a duty directed to someone? This is the Question of Direction. In this article, I explore the possibility of providing a Contractualist answer to the Question of Direction—one where the directedness of a directed duty is explained by the way in which that duty is derived in Contractualist moral reasoning. After presenting and rejecting three attempts at such an answer, (...) I arrive at a satisfactory one: An agent has a duty to an individual to perform some action just in case and because, were the agent not to perform that action, the agent would make the individual occupy the standpoint relative to which any principle that permits the agent not to perform that action is unacceptable. Classic inductive skepticism–the epistemological claim that we have no good reason to believe that the unobserved resembles the observed–is plausibly everyone’s lot, whether or not they embrace Hume’s metaphysical claim that distinct existents are “entirely loose and separate”. But contemporary advocates of a Humean metaphysic accept a metaphysical claim stronger than Hume’s own. I argue that their view plausibly gives rise to a radical inductive skepticism–according to which we are downright irrational in believing as we do about the unobserved–that we (...) don’t otherwise have reason to accept. This essay takes the position, consistent with Ayer’s own retrospective judgments, that the philosophical significance of Language, Truth and Logic (LTL) was minimal at best, and that its real significance was socio-historical. LTL stands as one of the most influential expressions of an overzealous and simplistic scientism that swept through Western culture in the first half of the twentieth century. This scientism played a crucial role in problematizing the West’s relationship to truth in ways that contributed to the eventual emergence (...) of “post-truth” culture, with its “post-truth politics.” This in turn made possible the disastrous results of recent votes and elections in Britain and, above all, in the United States. In short, LTL’s real significance resides in the role it played as a sophisticated and successful bit of propaganda for an ideology that played a crucial role in loosing Western culture from its moral and epistemic moorings. In this paper I argue for the incompatibility of three claims, each of them quite attractive to a theist. First, the doctrine of deep dependence: the universe depends for its existence, in a non-causal way, on God. Second, the doctrine of true transcendence: the universe is wholly distinct from God; God is separate and apart from the universe in respect of mereology, modes, and mentality. Third, the doctrine of robust creaturely freedom: some creature performs some act such that he could (...) have done other than he in fact did. After laying out the claims, I show that their conjunction has its adherents—most clearly, the medieval Jewish philosopher, Maimonides. I then argue in detail that the claims are in fact incompatible. I conclude with a discussion of which of the claims is best jettisoned, drawing in part on the work of the Absolute Idealist, Mary Calkins. (shrink)

We identify a species of experiment—Kon-Tiki experiments—used to demonstrate the competence of a cause to produce a certain effect, and we examine their role in the historical sciences. We argue that Kon-Tiki experiments are used to test middle-range theory, to test assumptions within historical narratives, and to open new avenues of inquiry. We show how the results of Kon-Tiki experiments are involved in projective inferences, and we argue that reliance on projective inferences does not provide historical scientists with any special (...) protection against the problem of unconceived alternatives. Ásta’s Categories We Live By is a superb addition to the literature on social metaphysics. In it she offers a powerful framework for understanding the creation and maintenance of social categories. In this commentary piece, I want to draw attention to Ásta’s reliance on explanatory individualism – the view that the social world is best explained by the actions and attitudes of individuals. I argue that this reliance makes it difficult for Ásta to explain how many social categories are maintained (...) and why certain categories are reliably available to us and so resistant to change. These explanatory deficiencies could be overcome, I argue, by eschewing explanatory individualism and positing social structures to figure in structural explanations of the maintenance and availability of social categories. In lieu of an abstract, here is a brief excerpt of the content:Hume Studies Volume XXVI, Number 1, April 2000, pp. 171-177 Hume's Revised Racism Revisited AARON GARRETT John Immerwahr's brief note "Hume's Revised Racism" is doubtless one of the most intriguing recent discussions of Hume and racism.1 Immerwahr presents a thesis as to why Hume revised a footnote originally added to his essay "Of National Characters" (hereafter "ONC") in 1753. In this note I will examine and dispute Immerwahr's (...) thesis, which I believe can be shown to be seriously flawed. It is important to do so, as Immerwahr's note has been quoted a number of times in books and articles on Hume, and his thesis has been taken as gospel without sufficient examination of the grounds for his claims.2 As a consequence, Immerwahr's thesis is in danger of becoming a stubborn belief, even if not properly supportable. The controversy about Hume's racism centers on one infamous footnote added to the essay "Of National Characters" in the 1753-1754 edition of Essays and Treatises on Several Subjects. Why should we care about one footnote? We should care because the footnote seems to go against the image of a philosopher we thought we knew, and whom we likely esteem. In addition, it is shockingly bigoted. It reads in its entirety: I am apt to suspect the negroes, and in general all the other species of men (for there are four or five different kinds) to be naturally inferior to the whites. There never was a civilized nation of any other complexion than white, nor even any individual eminent either in action or speculation. In the 1770 edition the footnote becomes an endnote, M,4 and there are again a few minor changes (from "betwixt these breeds of men" to "between these breeds of men"; from "of which never discovered" to "of whom never discovered"; for "'tis likely he is admired," read "it is likely he is admired") and one interesting substantive change (for "admired for very slender accomplishments," read "admired for slender accomplishments"). The most important change from the 1753 version of the note is in the 1777 posthumous edition, which Hume had corrected before he died. Hume rewrote the first two lines of 177OM, to read in 1777M: I am apt to suspect the negroes to be naturally inferior to the whites. There scarcely ever was a civilized nation of that complexion, nor even any individual eminent either in action or speculation.5 In "Hume's Revised Racism," Immerwahr argues that it is likely that Hume, after reading James Beattie's "Essay On Truth" and in light of his criticisms, revised the footnote in the 1777 edition of ONC. Immerwahr cites two pieces of evidence, a letter from Hume to Strahan to which he refers but does not quote, and Beattie's criticisms of Hume, which Hume may have read (although how much of it he read... Conventionalism about property is the view that all moral duties correlative to property rights depend essentially either on the existence of a convention that assigns conventional ownership of objects, or on the existence of a body of positive law that confers legal property rights. It has been objected that, if Conventionalism about property is true, then it is impossible for someone to have her property right violated by someone who is not a member of the community in which her conventional (...) property right is assigned. But it is possible. When Christopher Columbus sailed up to the island of Hispaniola in 1492, he and his sailors wronged the inhabitants by forcing them off their land. So, Conventionalism is false. This is the Outsider Challenge for Conventionalism. The Outsider Challenge (and its first premise, in particular) receives support from the Benefit Condition, according to which one can be morally obligated to comply with a conventional rule only if one benefits or has one’s interests protected by the convention of which it is a part. Despite its provenance and plausibility, however, I think that the Benefit Condition should be rejected. Doing so in a principled way allows us to square Conventionalism with our moral intuitions and, thus, address the Outsider Challenge. My main aim in this essay is to reject the Benefit Condition in one such principled way by providing a Contractualist answer to the question of when, and why, someone is morally required to respect another’s conventional property right. One is morally required to respect the conventional property rights of another when and because failing to do so would run afoul of the Principle of Established Practices (pep) – a principle for which I give a Contractualist justification. Roughly, the pep requires us to comply with sufficiently just social practices in the absence of special justification, and the fact that one’s interests are not protected by a property convention is not always a sufficiently strong reason for one to violate the duties assigned by that convention. Since the fact that one’s interests are not protected by a property convention is not necessarily a special justification for violating the pep, the pep gives us reason to reject the Benefit Condition and, thus, the Outsider Challenge, too. My aim is to discuss some ideas developed by Aspe Armella, pointing out, from the perspective of the history of Mexican philosophy, both the successes of her approach, as well as some aspects that deserve more debate.

When we judge something to be beautiful, do we identify an inherent feature of the object, or only our subjective response to it? This paper argues that, for Kant, pure aesthetic judgment occupies a middle ground. Such judgments are based upon affective responses to our own cognitive faculties. Thus, pure aesthetic judgment is subjective insofar as it concerns our feeling ourselves to be engaged in a certain task; it is objective insofar as the task we are engaged in is cognition (...) of an object, and the faculties that we are feeling to be at work are the cognitive faculties of the understanding and the imagination. This paper locates this interpretation in the text of the Critique of Aesthetic Judgment in the third Critique and uses it to make sense of many otherwise opaque features of Kant’s account of pure aesthetic judgment. The State You See uncovers a racial gap in the way the American government appears in people's lives. It makes it clear that public policy changes over the last fifty years have driven all Americans to distrust the government that they see in their lives, even though Americans of different races are not seeing the same kind of government. For white people, these policy changes have involved a rising number of generous benefits submerged within America's tax code, which taken together (...) cost the government more than Social Security and Medicare combined. Political attention focused on this has helped make welfare and taxes more visible representations of government for white Americans. As a result, white people are left with the misperception that government does nothing for them, apart from take their tax money to spend on welfare. Distrust of government is the result. For people of color, distrust is also rampant but for different reasons. Over the last fifty years, America has witnessed increasingly overbearing policing and swelling incarceration numbers. These changes have disproportionately impacted communities of color, helping to make the criminal legal system a unique visible manifestation of government in these communities. While distrust of government emerges in both cases, these different roots lead to different consequences. White people are mobilized into politics by their distrust, feeling that they must speak up in order to reclaim their misspent tax dollars. In contrast, people of color are pushed away from government due to a belief that engaging in American elections will yield the same kind of unresponsiveness and violence that comes from interactions with the police. The result is a perpetuation of the same kind of racial inequality that has always been present in American democracy. The State You See is essential reading for anyone interested in understanding how the American government engages in subtle forms of discrimination and how it continues to uphold racial inequality in the present day. This paper investigates the complexity hypothesis in microbial evolutionary genetics from a philosophical vantage. This hypothesis, in its current version, states that genes with high connectivity are likely to be resistant to being horizontally transferred. We defend four claims. There is an important distinction between two different ways in which a gene family can persist: vertically and horizontally. There is a trade-off between these two modes of persistence, such that a gene better at achieving one will be worse at achieving (...) the other. At least some genes are likely to experience selection favoring increased transferability. One consequence of this can be encapsulated as the “simplicity hypothesis”: horizontally persisting genes will experience selection favoring reduced connectivity. In order to make sense of the simplicity hypothesis, we need to consider evolutionary populations that transcend species boundaries. Vertical and horizontal persistence are therefore not two competing ways of succeeding at the same game, but involve playing two different games altogether. The complexity hypothesis can be understood in terms of two related notions: entrenchment and Cuvierian functionalism. This framing reveals previously unrecognized and philosophically interesting connections between reasoning about deep conservation and horizontal transfer. (shrink)

The emphasis on general distributive principles in the climate justice literature has left significant gaps regarding the problem of weak climate governance. The main contribution of this chapter is to show how normative theory can contribute to addressing the apparent political incapacity to respond to the threat of climate disruption. The chapter argues that a set of six underlying obstacles to effective climate change politics can serve as a framework around which ‘non-ideal’ normative theorizing about climate politics can be organized. Genzten’s 1938 proof of the consistency of pure arithmetic was hailed as a success for finitism and constructivism, but his proof requires induction along ordinal notations in Cantor normal form up to the first epsilon number, ε0. This left the task of giving a finitisically acceptable proof of the well-ordering of those ordinal notations, without which Gentzen’s proof could hardly be seen as a success for finitism. In his seminal book Proof Theory G. Takeuti provides such a proof. After (...) a brief philosophical introduction, we provide a reconstruction of Takeuti’s proof including corrections, comments, re-organization and notational adjustments for the sake of clarity. The result is a much longer, but much more tractable proof of the well-ordering of ordinal notations in Cantor normal form less than ε0, that nevertheless follows Takeuti’s strategy closely. We end with some more general comments about that proof strategy and the notion of accessibility more generally. (shrink)

This chapter surveys the respective influences of Personalism and of analytic philosophy on twentieth-century thought about persons. It shows that personalism promoted a concept of personhood that is supportive of human dignity and conducive to positive moral and social engagement, as exemplified in Personalism’s best-known representative, Martin Luther King, Jr. By contrast, the analytic tradition has exhibited a persistent tendency to undermine personhood as King and the Personalists understood it, while failing to supply a metaphysically and morally adequate alternative. This (...) unfortunate legacy is worth reversing if possible. With this in mind, I suggest that contemporary analytic philosophy has something important to learn from personalism concerning what counts as an adequate metaphysical basis for human dignity and the moral life. Norbert M. Samuelson is Harold and Jean Grossman Chair of Jewish Studies at Arizona State University. Trained in analytic philosophy, he has contributed to the professionalization of Jewish philosophy in America and to the field of religion and science.

Recently, several states in the US have made it more difficult to receive nonmedical exemptions to school vaccine mandates in the hope of better orienting parents towards vaccination. However, little is known about how public-facing school staff implement and enforce mandate policies, including why or how often they steer parents towards nonmedical exemptions. This study focused on Michigan, which has recently added an additional burden for families seeking nonmedical exemptions. We used an anonymous online survey to assess Michigan public-school employees (...) (n = 157) about their knowledge, attitudes, and behaviors regarding Michigan's school enrollment vaccine mandate policy. Our main conclusions are that frontline school staff are generally knowledgeable about vaccines and immunization policy, but are at best ambivalent about their role in immunization governance, believing that other agents should be responsible for ensuring that children are vaccinated. Furthermore, some respondents indicated low vaccine confidence, which was associated with increased ambivalence about, or opposition to, their role in immunization governance. As more jurisdictions within and beyond the US consider introducing or tightening childhood vaccine mandates, it is increasingly important to understand how these policies can be improved by attending to the attitudes and roles of relevant frontline actors. This chapter presents Connecting Scotland as a case study, highlighting the correlation between current research into digital inequality to identify those most in need of support, and the practical application of work to address this at scale through third sector organisations working directly with those at greatest risk of digital exclusion. The chapter also considers the vital role of the ‘trusted intermediary’ acting as digital champion for device recipients, and, using the data gathered via sessions with hundreds of frontline staff, (...) explore immediate challenges and opportunities for engagement. It will also reflect on the application of research in the creation of training and resources to support the programme. Finally, the chapter will reflect on some of the many lessons learned, and consider implications for both policy-makers and fieldworkers seeking to address digital inequality at scale. The aim of this work is to demarcate, develop, and defend the commitments and consequences of metaethical minimalism. Very roughly, this is the position that a commitment to objective moral truths does not require any accompanying ontological commitments. While there are few, if any, who call themselves “metaethical minimalists”, I endeavor to uncover existing articulations of metaethical minimalism which have been presented under different names, attempting to identify the common ground between them. As I interpret the position, all metaethical minimalists (...) are committed to the same positive pair of claims (what I call the Objectivity Thesis): “a) Moral truths are strongly mind-independent; b) there are moral truths.” Taken by itself, however, this pair of claims is not sufficient for differentiating their view from the moral realist’s. Consequently, the minimalist must also articulate that which they are denying about the non-minimalist approach, or what I call the “negative ontological thesis”. I offer my own version of this negative thesis and argue for its dialectical advantages. -/- In Chapters 3 and 4, I focus my attention on attacks on the viability of metaethical minimalism in the form of two “challenges” that aim to problematize a commitment to objective moral truths absent any accompanying ontological commitment. The big-picture takeaway from these chapters is that minimalism can defend itself by playing to the dialectical advantage I find for it in Chapter 2 as well as by being creative about minimalist constructions/reworkings of plausible principles/lines of reasoning that seem to contradict it. -/- The temptation to embrace quietism is strong among minimalists, but in Chapters 5, 6, and 7 I aim to show that there is a positive alternative available for the minimalist interested in developing a full picture of their position. Chapter 5 is aimed at providing an adequate understanding of the distinction between the objects of purely normative thoughts and objects of thoughts about reality. Building on this are Chapters 6 and 7, which argue in favor of an account of the relationship between emotion and evaluative knowledge that is consistent with metaethical minimalism. (shrink)

However, it is not always clear which critics and criticisms should count as “external” to the analytic tradition, nor is it clear how to gauge the significance of such criticisms. Consequently, the survey is prefaced by a discussion of these methodological challenges which, I show, are deeply connected to features of the analytic tradition that have regularly been (...) subjected to criticism from the outside. The aim of this volume is to consider connections among issues in metaphilosophy, historiographical method, and the formation of philosophical canons. Here I consider an ancient metaphilosophical position very different from anything accepted in mainstream academic philosophy today, but which, I believe, merits revival in a form appropriate to our era. I call this position “metaphilosophical eudaimonism” because it takes human flourishing to be the ultimate goal of philosophy. I first explain the position before considering its implications for philosophy’s relationship (...) to its history, for the historiography of philosophy, and for the role of canons in philosophy. For most of the 20th century, analytic epistemology has been narrowly focused on the concept of knowledge and on closely-related issues like justification. But decades of work on Gettier problems, lottery paradoxes, and the like, have given mainstream analytic epistemology the appearance of a degenerating research program. In response, some analytic epistemologists have begun to investigate other cognitive states, like wisdom and understanding, that many pre-analytic philosophers valued as much or more than knowledge. In fact, Linda Zagzebski has argued that (...) Western philosophy exhibits the following historical pattern: in eras given to skeptical worries, philosophers have focused on certainty and justification; in eras less exercised by skepticism, philosophers have focused on understanding and the related issue of explanation. My aims are two-fold. First, I add to Zagzebski’s picture by showing that metaphysical and metaphilosophical issues have also contributed to this historical pattern. Second, I use the expanded picture to explain (i) the 19th century advent of verstehen as a term of art, (ii) the analytic tradition’s lack of interest in understanding, and (iii) the revival of interest in understanding in recent analytic epistemology. I conclude that the pro-verstehen movement of the 19th century and the pro-understanding movement of the 21st were motivated by similar concerns pertaining to the epistemic strictures of scientism, strictures which bear a complex relationship to skepticism.
