In this article, I examine the consequences of Mamou’s recent solution to the so-called problem of reindividuation. The problem is first proposed by John Broome as an argument against the Humean view of rationality and subjective decision theory. Essentially, Broome argues that the reindividuation of outcomes must be constrained in some way if the axioms of rationality are not to be vacuous, but the constraints on individuation cannot be consistent with the Humean view of rationality. Mamou offers an elegant Humean (...) solution to this problem. We do not need such rules for reindividuation since the subjective decision theory operates under the assumption of maximal relevance of description, and only under that assumption do the axioms tell anything. Thus the problem of reindividuation dissolves in a quite natural and simple way. However, I argue that if we connect this solution to the topic of justification for the requirements of rationality, problems arise. I examine the influence of the solution on the common argument for the axioms of decision theory, the so-called money-pump arguments. These arguments are a staple in the justification of the axioms of subjective decision theory. I argue that they are in collision with Mamou’s solution. This collision brings us to the dilemma: either accept Broome’s conclusions or lose the money-pump arguments as an effective tool for justification of the axioms. I conclude that neither of the options is really good for the defenders of the Humean view of rationality. (shrink)

Departing from what Levey and Sznaider (2002) in their seminal work ‘Memory Unbound’ refer to as ‘cosmopolitan memory’ that emerges as one of the fundamental forms ‘collective memories take in the age of globalization’, this article will consider the underlying ethical implications of global memory formation that have yet to be adequately theorized. Since global disseminations of local memory cultures and the implicit canonization of its traumas are intimately related to the concept of archive, I will first focus on what (...) Derrida (1996) in Archive Fever calls ‘archival violence’ and will show its inherent relation to the formation of cosmopolitan memory. Another related concept that I will use and that will problematize the transformation of living, embodied memory into archival, cultural memory upon which the formation of cosmopolitan memory depends is the witness. Using Agamben’s writing (2002) in this context that in Remnants of Auschwitz focuses on the foundational (im)possibilities of bearing witness, I will show that this transformation that determines the very possibility of cosmopolitan memory is far from unproblematic and readily accessible as Levy and Sznaider seem to assume. What will emerge as the most distinctive concern of global memory formation is the ethical material of difference as that which both makes its imperatives historically and politically exigent and that which signifies the difficulties of its unified articulation. Solidarity with the suffering of the other that mobilizes the very formation of cosmopolitan memory is also what should solicit vigilance against the universalistic ritualizations of its prerogatives. Previous studies have addressed many different kinds of confessions in police investigations – real, false, coerced, fabricated – and highlighted both psychological and social mechanisms that underlie them. Here, we focus on inadvertent confessions and admissions, which occur when a suspect appears to be confessing without being fully aware of doing so, or when police officers believe they have a confession or admission of guilt when in fact this is not the case. The goal of the study is to explain (...) when, how and why these confessions and admissions occur as well as how they are dealt with in two different jurisdictions, the United States and the United Kingdom. We use a discourse analysis approach because inadvertent confessions and admissions of guilt are the product of miscommunication – they happen because the speaker’s meaning and the hearer’s meaning are misaligned. The data consist of 50 interviews from the United Kingdom and 50 interrogations from the United States with both English-speaking and non-English speaking suspects. Our results demonstrate that inadvertent confessions can occur in both locales due to reliance on inference, which is inevitable since inference is the backbone of any human communication, as well as due to additional factors such as linguistic, cultural and procedural issues. We found that these phenomena are more frequent and less well controlled for in the United States context due to no systematic checking of understanding, adversarial questioning techniques and an absence of legal representation, and lack of professional, high-quality interpreting. We discuss the implications of our findings for current efforts to improve access to justice, custodial procedures and language services, and we make recommendations for the implementation of our research in professional practice. In this text we offer an overview of Festini’s works on history of Croatian philosophy. The article is divided in five parts in which we discuss Festini’s attitude towards Croatian Renaissance philosophers, eighteenth and nineteenth century Croatian philosophers, and two philosophers from the twentieth century (Vladimir Filipović and Marija Brida). Majority of Festini’s texts were published in the journal Prilozi za istraživanje hrvatske filozofske baštine.

The paper outlines the historical development of question about ambiguous and mysterious human nature, in particular considering the reasons and conditions for the founding of modern philosophical anthropology. Subsequently, it brings an overview of the conceptual beginnings and directions of anthropological research in Croatia. The focus is on the following questions: When did the investigations begin in the field of philosophical anthropology, in what kind of thinking environments were they shaped and what scientific achievements were reached? The presentation brings to (...) light the cognition that philosophical anthropology in Croatia got its first contours and valuable contributions to the very beginning of the contemporary renewal of this discipline, shortly after its phenomenological and scientific revivals in the ventures of Scheler and Plessner. The development of this research branch is, according to Hans Lankʼs model, divided into four main conceptual orientations. The anthropology from above shows the creative contributions of Stjepan Zimmermann, Vilim Keilbach, Rajmund Kupareo, Miljenko Belić, Ante Kusić, Josip Ćurić, Hrvoje Lasić and Ivan Koprek. The anthropology from below is illustrated by the reference to the research by Vera Ehrlich-Stein, Rudi Supek, the Institute of Anthropology, Pavao Rudan and Darko Polšek. For the anthropology from culture, the philosophical achievements of Pavao Vuk-Pavlović, Vladimir Filipović, Vjekoslav Mikecin, Esad Ćimić, Nikola Skledar, Branka Brujić, Milan Galović and Mihaela Girardi-Karšulin were delineated. Under the anthropology from history, the works of Predrag Vranicki, Milan Kangrga, Vanja Sutlić, Gaja Petrović, Hotimir Burger, Mislava Kukoč and Raul Raunić are outlined. The conclusion summarises four insights. 1. Philosophical anthropology is an under-researched and not enough appreciated field, which represents one of the most fertile currents of thought in the 20th century. 2. Creative contributions are presented in all four major orientations. 3. In the context of anthropological research, lively dialogue and a fruitful meeting of different worldviews were realised. 4. The beginnings of the development of the discipline should be moved earlier in history than previously considered, from the 1950s and 1960s to the early 1930s. The last insight points to the need for further exploration of the perceived, and so far largely neglected, continuity of anthropological themes and related ideas in the history of recent philosophy in Croatia. This paper argues for a comprehensive conception of empathy as comprising epistemic, affective, and motivational elements and introduces the ancient Stoic theory of attachment (Greek,oikeiōsis) as a model for describing the embodied, emotional response to others that we take to be distinctive of empathy. Our argument entails that in order to provide a suitable conceptual framework for the interdisciplinary study of empathy one must extend the scope of recent “simulationalist” and “enactivist” accounts of empathy in two important respects. First, against (...) the enactivist assumption that human mindreading capacities primarily rely on an immediate, quasi-perceptual understanding of other’s intentional states, we draw on Alfred Schutz’ analysis of social understanding to argue that reflective types of understanding play a distinct, but equally fundamental role in empathic engagements. Second, we insist that empathy also involves an affective response toward the other and their situation (as the empathizer perceives this). We suggest analyzing this response in terms of the Stoic concepts of attachment, concern, and a fundamental type of prosocial motivation, that can best be described as an “extended partiality.” By way of conclusion, we integrate the above concepts into a comprehensive conceptual framework for the study of empathy and briefly relate them to current debates about empathic perception and prosocial motivation. The result, we argue, is an account that stays neutral with regard to the exact nature of the processes involved in producing empathy and can therefore accommodate discussion across theoretical divides—e.g., those between enactivist, simulationalist, and so-called theory-theorist approaches. The central problem at the heart of it was the development of a new standard of theoretical reflection and of the principle of rationality itself. Einstein, in his “Zur Elektrodynamik bewegter Körper”, gave a physical (operational) meaning to “time” of a remote event in describing “motion” by introducing the concept of “synchronous stationary clocks located at different places”. But with regard to “place” in describing motion, he assumed without analysis the concept of a system of co-ordinates.In the present paper, we propose a way of giving physical (operational) meaning to the concepts of “place” and “co-ordinate system”, and show how the observer can define both the (...) place and time of a remote event. Following Einstein, we consider another system “in uniform motion of translation relatively to the former”. Without assuming “the properties of homogeneity which we attribute to space and time”, we show that the definitions of space and time in the two systems are linearly related. We deduce some novel consequences of our approach regarding faster-than-light observers and particles, “one-way” and “two-way” velocities of light, symmetry, the “group property” of inertial reference frames, length contraction and time dilatation, and the “twin paradox”. Finally, we point out a flaw in Einstein’s argument in the “Electrodynamical Part” of his paper and show that the Lorentz force formula and Einstein’s formula for transformation of field quantities are mutually consistent. We show that for faster-than-light bodies, a simple modification of Planck’s formula for mass suffices. (Except for the reference to Planck’s formula, we restrict ourselves to Physics of 1905.). The paper argues that the moral philosophy of Thomas Hobbes is unified by a complex conception of reason that imposes consistency norms of both rationality and reasonableness. Hobbes’s conceptions of rightness as reciprocity, and moral goodness as sociability belong to an original and attractive moral theory that is neither teleological nor classically deontological, nor as interpreters have variously argued, subjectivist, contractarian, egoist, or dependent on divine command.

Health professionals do not always have the luxury of making “right” choices. This article introduces the “devil's choice” as a metaphor to describe medical choices that arise in circumstances where all the available options are both unwanted and perverse. Using the devil's choice, the paper criticizes the principle of double effect and provides a re-interpretation of the conventional legal and ethical account of symptom relief in palliative care.

In _Opposition to Philosophy in Safavid Iran_ Ata Anzali and S.M. Hadi Gerami offer a critical edition of what is arguably the most erudite and extensive critique of philosophy from the Safavid period. The editors’ extensive introduction offers an in-depth analysis that places the work within the broader framework of Safavid intellectual and social history.

Although social scientists have identified diverse behavioral patterns among children from dissimilarly structured families, marketing scholars have progressed little in relating family structure to consumption-related decisions. In particular, the roles played by members of single-mother families—which may include live-in grandparents, mother’s unmarried partner, and step-father with or without step-sibling(s)—may affect children’s influence on consumption-related decisions. For example, to offset a parental authority dynamic introduced by a new stepfather, the work-related constraints imposed on a breadwinning mother, or the imposition of adult-level (...) household responsibilities on children, single-mother families may attend more to their children’s product preferences. -/- Without a profile that includes socio-economic, behavioral, and psychological aspects, efficient and socially responsible marketing to single-mother households is compromised. Relative to dual-parent families, single-mother families tend to have fewer resources and less buying power, children who consume more materialistic and compulsively, and children who more strongly influence decision making for both own-use and family-use products. Timely research would ensure that these and other tendencies now differentiate single-mother from dual-parent families in ways that marketers should address. Hence, our threefold goal is (1) to consolidate and highlight gaps in existing theory applied to studying children’s influence on consumption-related decision making in single-mother families, and (2) to propose a hybrid framework that merges two theories conducive to such research, and (3) to identify promising research propositions for future research. Yaffe's handling of two general questions is assessed in this review. The first question is why mere attempts (as opposed to successful wrongdoing) should be made punishable in a well-conceived criminal code. The second question is how attempt liability should be conceived in such a code. As to the first question, Yaffe's nonsubstantive mode of answering it (in terms of his ) is contrasted to answers based on some more substantive desert-bases; Yaffe's own more substantive kind of answer (in terms (...) of a desert-base of ) is examined in light of the implication that the traditional requirements of trying and intending are mere proxies for faulty reason recognition and response as the basis for blaming and punishing attempts. As to the second question, Yaffe's analysis of trying in terms of a is examined in some detail. Canvassed here are the subquestions of: (1) whether appropriate assessibility by certain norms of rationality can give the nature of intending and thus of trying; (2) whether the externally de dicto intent requirements of criminal law statutes can easily be interpreted and applied by standard, extensional methods; (3) whether the distinctions between various kinds of elements within the content of intentions, can be justified ontologically or only practically; (4) whether actors necessarily intend results of their actions that are to other results that clearly are intended, and if not, whether such actors are nonetheless just as blameworthy for those results as if they did intend them; and (5) whether intention with respect to circumstance-elements differ (in either their psychology or in their moral effect) from beliefs with respect to such circumstance-elements. While God could have made our universe better, that would in fact have turned our universe into another universe, which God has also created. Our universe remains as it is to actualize its specific goals. The second part uses this basis to defend why God's revelation is so vague. It could have been clearer, (...) which again would have turned our universe into another universe, which also exists. Since our kind of independent universe with vague revelation actualizes unique goods, God has created our universe where the vague revelation serves specific purposes. (shrink)

This paper argues for a new perspective on Locke's account of toleration by looking at a set of important but neglected arguments for toleration. Standard accounts which view Lockean toleration as justified solely on considerations of conscience fail to explain Locke's preferred form of toleration, the process by which he overcame his earlier objections to toleration, and the importance of considerations regarding the practicability of religious toleration. The paper argues that attention to Locke's political arguments provides a more complete account (...) of his toleration, which integrates his views on toleration with his wider political theory. These political arguments arise from, and are intimately related to this theory of consent and his epistemological views. The political arguments allow Locke to formulate a response to the then prevailing problematique of toleration exemplified by Samuel Parker's objections. These arguments not only establish toleration as a natural right, but also a necessary condition for maintaining legitimate political society. They also explain his intolerance of atheists and Catholics on grounds other than prejudice. (shrink)

Study of Aprokṣānubhūti of Śaṅkarācārya, work on Advaita philosophy and self realization.

Background: Little is known about U.S. healthcare provider views and practices regarding evidence, counseling, and shared decision-making about in-hospital versus out-of-hospital birth settings. Methods: We conducted 19 in-depth, semistructured, qualitative interviews of eight obstetricians, eight midwives, and three pediatricians from across the United States. Interviews explored healthcare providers’ interpretation of the current evidence and their personal and professional experiences with childbirth within the existing medical, ethical, and legal context in the United States. Results: Themes emerged concerning risks and benefits, decision-making, (...) and patient-provider power dynamics. Collectively, the narratives illuminated fundamental ideological tensions between in- and out-of-hospital providers arising from divergent assignment of value to described risks and benefits. The majority of physicians focused on U.S.-specific data demonstrating increased neonatal morbidity and mortality associated with delayed access to hospital-based interventions, thereby justifying hospital birth as the standard of care. By contrast, midwives emphasized data demonstrating fewer interventions and superior maternal and neonatal outcomes in high-income European countries, where out-of-hospital birth is more common for low-risk birthing people. A key gap in counseling was revealed, as no interviewees offered anticipatory counseling regarding birth setting options. Providers directly and indirectly illustrated the propensity for asymmetric power relations between birth providers and pregnant people, especially in hospital settings. Conclusions: The narratives highlight the common goal of optimizing maternal and neonatal outcomes despite tensions arising from divergent prioritization of specific maternal and neonatal risks. Our findings suggest opportunities to foster collaboration and optimize outcomes via mutual respect and improved integration of care. (shrink)
