The central thesis of Foucault's Critical Ethics is that Foucault's account of power does not foreclose the possibility of ethics; on the contrary, it provides a framework within which ethics becomes possible. Tracing the evolution of Foucault's analysis of power from his early articulations of disciplinary power to his theorizations of biopower and governmentality, Richard A. Lynch shows how Foucault's ethical project emerged through two interwoven trajectories: analysis of classical practices of the care of the self, and engaged practice (...) in and reflection upon the limits of sexuality and the development of friendship in gay communities. These strands of experience and inquiry allowed Foucault to develop contrasting yet interwoven aspects of his ethics; they also underscored how ethic practice emerges within and from contexts of power relations. The gay community's response to AIDS and its parallels with the feminist ethics of care serve to illustrate the resources of a Foucauldian ethics—a fundamentally critical attitude, with substantive (but revisable) values and norms grounded in a practice of freedom. His lectures—lucid, accessible, beautifully written, and delivered with a notable lack of jargon—distilled modern European history from the Enlightenment to the dawn of the twentieth century and conveyed the turbulence of a rapidly changing era in European history through its ideas and leading figures. Gifts: A Study in Comparative Law is the first broad-based study of the law governing the giving and revocation of gifts ever attempted. First, gift-giving is everywhere governed by social and customary norms before it encounters the law. Second, the giving of gifts takes place largely outside of the marketplace. As a result of these two characteristics, the law of gifts provides an optimal lens through which to examine how different legal systems confront social practice. The law of gifts is (...) well-developed both in the civil and the common laws. Richard Hyland's study provides an excellent view of the ways in which different civil and common law jurisdictions confront common issues. The legal systems discussed include principally, in the common law, those of Great Britain, the United States, and India, and, in the civil law, the private law systems of Belgium and France, Germany, Italy, and Spain. Hyland also serves a critique of the dominant method in the field, which is a form of functionalism based on what is called the praesumptio similitudinis, namely the axiom that, once legal doctrine is stripped away, developed legal systems tend to reach similar practical results. His study demonstrates, to the contrary, that legal systems actually differ, not only in their approach and conceptual structure, but just as much in the results. (shrink)

In his essay “Painting Memories” , Michael Fried identifies memory as the privileged thematic that structures Charles Baudelaire’s Salon of 1846. But he then limits his investigation of this topic by focusing on the representation of “past” art, to the exclusion of the recollection of “past” experience. Fried thus isolates the theme of memory from the dialectic of life and art that characterizes its performance for Baudelaire. Such selective analysis not only reverses Baudelaire’s priorities but deflects his pointed comments on (...) modernity and naiveté, which in turn inform the example of Edouard Manet, Fried’s exemplary modernist painter. One wonders whether too much of Baudelaire and Manet is lost to this view. Perhaps the predilections of contemporary criticism have sanctioned Fried’s approach. For today we hesitate to ground art in experience, preferring to conceive of representations as signs fully engendered by and engendering other signs. Baudelaire was of a different mind; he lived through the dawning of our own age, but also in the fading light of another. He was heir to a tradition that regarded the forms of art as powerfully motivated by the experience of internalized ideas and sensations; for him, a master artist’s “signs” would appear more symbolic than allegorical, more immediate than mediated or distanced. As we deny artistic signs motivation in extralinguistic “experience,” we aggravate that perennial problem of origins which Fried himself invokes. It might be reformulated in this manner: all painting depends on a lineage of antecedent painting; yet, to succeed, a new work must transcend its filial bondage, as it compounds the effect of the “original” in its own originality. Vexation follows from this issue of the artistic source. Since memories of past art make possible the very creation of art, the creative event cannot assume priority over memory. And the matter of primordial memory, like the matter of an absolutely original art, is aporia. Fried does not pursue this matter ; but the question necessarily implies that both representations and memories, in constituting the “past,” must always be distanced. Distanced not from the present, which they enter and likewise constitute, but from those “original” experiential moments they purport to present. Human actions, together with natural events in general, were intelligible as aiming at the realization of given purposes or ends. To be a human person was to have a particular sort ofend: intellectual contemplation, according to (...) Aristotle, or oneness with God, according to Augustine. Self-knowledge becomes problematic, however, once events in nature are conceived in terms of the new physics to be only materially caused, not purposive. Given that human actions are events in nature, physical explanations then seem to be both necessary and sufficient for understanding them. It then becomes no longer possible to understand and explain one's actions as grounded in a partial grasp of an intelligible order of things. The self, it seems, is not real; bits of matter are, and their motions are mechanical, not plotted in a divinely ordered book ofnature. Thus the self or the person as a locus ofautonomous agency and understanding tends to come to be regarded as a fiction, not a physical something and not effective in the occurrence of events, so not a something at all. Human actions tend no longer to be seen as stemming from persons who can alter and are responsible for diem, but instead as complex events falling under physical laws. Yet despite the revolutionary revisions in the explanation of human action and die account of personhood seemingly forced by the new physics, self-knowledge is not something easily abandoned in favor ofknowledge of matter. It is not easy to conceive of one's actions as nonpurposive and of oneself as an unreal playdiing of fortune. Determinism seems incompatible with individual responsibility and hence with morality. Even within modern scientific understanding, autonomous creativity and human understanding are generally allotted roles in experimentation as well as in the rest of life. Yet this acknowledgment of human autonomy is seemingly in fundamental conflict with the commitment to the explanation of all events under physical laws that is characteristic of the modern scientific attitude.1 In the absence, however, of a well worked out description of how we can autonomously generate partial understandings of our proper ends as persons, understandings to which we then give expression in action, these objections will seem hollow, and the sense diat it must be possible to explain our actions fully under physical laws will press upon us. Ifwe cannot say how we can understand ourselves and our end in ways that inform our actions, then it will seem wise to abandon trying to understand agentive persons and to try instead to formulate the physical explanations of the motions of our bodies that are seemingly in order. Here Wordsworth's poetry can be of special value, for one of Wordsworth 's chief poetic concerns was to diagnose and locate skepticism about the possibility of self-understanding as a natural but temporary stage in the lives of persons who can grasp their proper end. Skepticism about action-guiding self-understanding, on his showing, is a plight of mind to which self-conscious end-directed beings succumb just as they most fully assert their particularity and separateness from others. Recovery from this plight occurs naturally when they come both to see that genuine autonomy requires community with others in a particular sort of expressive activity and to find themselves already so engaged. Further self-conscious and effective engagement in this expressive activity then emerges as the proper end of persons and as an end that is to be achieved communally. Discussion in the paper focuses on instituting a requirement that juries in criminal cases make public the reasons for their verdicts. The nature of such a requirement is elaborated, as is the way in which defects in the reasons provided might serve as a basis for appealing convictions. Various arguments for adopting such a requirement are considered, as are objections to doing so. In support of the requirement, I contend that it would enable defendants in criminal cases to ensure that (...) their procedural rights have been respected. Such a requirement can also be construed as a condition of the legitimacy of exercises of political power and as an implication of the right of each person to be treated with equal concern and respect. The main objections to such a requirement concern its possible interference with jury independence and the complications and inefficiencies appeals of reasoned verdicts would produce. (shrink)

In offering this as a work of philosophy rather than of cultural anthropology or Native spirituality, authors Rabb and McPherson take as their point of departure anthropologist A. I. Hallowell's claim that a cultural worldview is a “cognitive orientation” from which a set of metaphysical claims might be deduced—even if it is not consciously recognized as such by those who live within it. Mealey's sociopathy model is an exemplar of popular diathesis-stress models. Although such models, when presented in descriptive language, offer the illusion of integrative explanation, their actual scientific value is very limited because they fail to make specific, quantitative, falsifiable predictions. Conceptual and quantitative weaknesses of such diathesis-stress models are discussed and the requirements for useful models are outlined.

It is a pleasure to respond to Paul Guyer’s rich, imaginative, and sound paper on perfectionist themes in Kant and Cavell in relation to moral and aesthetic education, just as it was instructive and pleasurable to read it. Overall, it is one of the best and most useful things I have read on Cavell, especially in deepening and enriching the insights of both Kant and Cavell by juxtaposing them against each other, rather than simply repeating the terminology of either alone. We study the existence of efficient approximation methods to verify quantitative specifications of probabilistic systems. Models of such systems are labelled discrete time Markov chains and checking specifications consists of computing satisfaction probabilities of linear temporal logic formulas. We prove that, in general, there is no polynomial time randomized approximation scheme with relative error for probabilistic verification. However, in many applications, specifications can be expressed by monotone formulas or negation of monotone formulas and randomized approximation schemes with absolute error are (...) sufficient. We show how some simple randomized approximation algorithms can improve the efficiency of verification of such probabilistic specifications and can be implemented in a probabilistic model checker. In lieu of an abstract, here is a brief excerpt of the content:Holly Flora’s published dissertation is a critical contribution to scholarship of the origins of the Meditationes Vitae Christi, a text strongly associated with the preaching and prayer habits of the early Franciscan order and perhaps the most representative example of the late-Medieval devotional and pictorial phenomenon often summarized as the “Vita Christi tradition.” For almost a century, art historians have invoked the MVC to explain iconographic innovations in late-Medieval (...) and Renaissance art, in particular the emergence of apocryphal images of the early life of Christ. In contrast to these earlier art-historical uses of this text, Flora advocates for a re-contextualization of the MVC. She joins scholars, in particular Isa Ragusa, who suggest that the didactic content and devotional strategies of the MVC reflect a particularly Franciscan strain of the Vita Christi, one aligned with the cura monialium , and argues that it was probably composed by a Franciscan friar for the spiritual benefit of a Poor Clare. The MVC’s distinctive emphasis on themes of virginity, silence, and enclosure support this interpretation, as do a series of interjected prompts or imperatives for the reader to visualize herself participating in poignant events that underscore the humanity of Christ and promote affective devotion. Flora sees the MVC as an attempt by a friar to reconcile the competing Franciscan notions of the vita activa and vita contemplativa in the interests of a cloistered nun under his care; the performative devotional strategies offered by the MVC would have afforded her the means to engage actively—even if only virtually—in a life of extreme poverty or to engage in charitable public giving as exemplified by the lives of Christ and the Virgin, opportunities Flora suggests were not readily available to a cloistered nun.Association of the MVC with the Poor Clares is bolstered by the manuscript that probably contains the closest witness to the original version of this text . The author’s compelling consideration of the textual, material, and pictorial content of Ms. ital. 115 supports the claim that it was made in Pisa around 1340–50 for the community of Poor Clares at the convent of San Martino. Although written on paper rather than parchment and painted in a humble watercolor technique, Ms. ital. 115 contains the lengthiest extant pictorial cycle of any version of the MVC, a characteristic that agrees with the image-centric devotional practices of medieval nuns. Flora’s comparison of those few MVC manuscripts that contain pictorial cycles of comparable length casts into relief those discrete iconographic characteristics of the Ms. ital. 115 cycle. Most telling are ubiquitous images of women that resemble Poor Clares, regular sewing companions of the Virgin, whose presence indicates the illuminators’ attentions to the interests and identities of their audience.Having established Ms. ital. 115’s Clarissan context, the remainder of the Devout Belief of the Imagination is a consideration of a Poor Clare’s interaction with the manuscript. Flora describes this experience as an intensely emotional didactic process that begins with instruction and culminates in imaginative devotional performances where Mary constitutes the main paradigm for female monastic conduct. The extensive account of the Virgin’s childhood in the Temple, for example, supplies a progressive lesson for a young nun on the virtues of discipline and devotion. The culmination of this spiritual maturation process is the extraordinary text-image structure of the Circumcision of the Christ child by his Mother. Not only does this event resonate with Franciscan typology, but as Flora demonstrates, Mary’s privileged position in sharing the suffering of Christ offers a powerful introduction to the affective devotional strategy that structures the viewer’s experience of the remainder of the manuscript. Students often study logic on the assumption that it provides a normative guide to reasoning in English. In particular, they are taught to associate connectives like “and” with counterparts in Sentential Logic. English conditionals go over to formulas with → as principal connective. The well-known difficulties that arise from such translation are not emphasized. The result is the conviction that ordinary reasoning is faulty when discordant with the usual representation in standard logic. Psychologists are particularly susceptible to this attitude.

What do the living owe those who come after them? It is a question nonsensical to some and unanswerable to others, yet tantalizing in its persistence especially among environmentalists. This article makes a new start on the topic of intergenerational justice by bringing together human rights and environmental justice arguments in a novel way that lays the groundwork for a theory of intergenerational environmental justice based in the human rights to clean air, water, and soil. Three issues foundational to such (...) a theory are explored here. First is the broad question of whether justice is applicable to future (or past) generations in any real sense, or do such issues fall under the rubric of superogation. Second, can environmental goods properly be contained in a theory of distributive justice at all, since, superficially at least, they seem different in kind than the usual objects of justice? I will discuss them as “emergent” goods in fact central to contemporary justice distributions. Third, what is the relationship of justice to rights, and how can environmental human rights be included in justice distributions? (shrink)
