Gifts: A Study in Comparative Law is the first broad-based study of the law governing the giving and revocation of gifts ever attempted. First, gift-giving is everywhere governed by social and customary norms before it encounters the law. Second, the giving of gifts takes place largely outside of the marketplace. As a result of these two characteristics, the law of gifts provides an optimal lens through which to examine how different legal systems confront social practice. Richard Hyland's study provides an excellent view of the ways in which different civil and common law jurisdictions confront common issues. The legal systems discussed include principally, in the common law, those of Great Britain, the United States, and India, and, in the civil law, the private law systems of Belgium and France, Germany, Italy, and Spain. Hyland also serves a critique of the dominant method in the field, which is a form of functionalism based on what is called the praesumptio similitudinis, namely the axiom that, once legal doctrine is stripped away, developed legal systems tend to reach similar practical results. When we engage with a work of fiction we gain knowledge about what is fictionally true in that work. Our grasp of what is true in a fiction is central to our engagement with representational works of art, and to our assessments of their merits. Of course, it is sometimes difficult to determine what is fictional – it is a good question whether the main character of American Psycho is genuinely psychotic or merely delusional, for instance. (And even in this (...) case, our ignorance itself is crucial to how we engage with the story and assess its qualities.) But in the vast majority of cases, we have no difficulty distinguishing what is fictionally true from what is not. Every attentive reader of Bleak House knows that it is fictional that Esther is Lady Dedlock’s daughter, but not fictional that Ada is the daughter of John Jarndyce. Moreover, we do not think that our judgements about what is fictional are based on guesswork. We have a folk theory of fictional truth, in the sense that we have a relatively stable framework upon which we rely when we engage with fiction, and we face the challenge of characterizing that theory systematically. Anthony Everett () argues that those who embrace the reality of fictional entities run into trouble when it comes to specifying criteria of character identity. More specifically, he argues that realists must reject natural principles governing the identity and distinctness of fictional characters due to the existence of fictions which leave it indeterminate whether certain characters are identical and the existence of fictions which say inconsistent things about the identities of their characters. Everett's critique has deservedly drawn much attention and (...) a number of defensive moves have been made by, or on the behalf of, fictional realists. My goal in this paper is to move this debate on a further step. I have three goals: to clarify the importance of Everett's discussion of identity criteria within the context of fictional realism, to reassess Everett's objections to realism in light of the resultant literature, and to develop a novel strategy for responding to Everett's concerns. On the approach to be developed, the problems emerge due to an indeterminacy inherent in the concept of a fictional character itself. (shrink)

Richard Rorty's collected papers, written during the 1980s and now published in two volumes, take up some of the issues which divide Anglo-Saxon analytic philosophers and contemporary French and German philosophers and offer something of a compromise - agreeing with the latter in their criticisms of traditional notions of truth and objectivity, but disagreeing with them over the political implications they draw from dropping traditional philosophical doctrines. In this volume Rorty offers a Deweyan account of objectivity as intersubjectivity, one (...) that drops claims about universal validity and instead focuses on utility for the purposes of a community. The sense in which the natural sciences are exemplary for inquiry is explicated in terms of the moral virtues of scientific communities rather than in terms of a special scientific method. Parallels in anatomy between humans and domesticated mammals suggest that for the last 300,000 years, Homo sapiens has experienced more intense selection against the propensity for reactive aggression than any other species of Homo. Selection against reactive aggression, a process that can also be called self-domestication, would help explain various physiological, behavioral and cognitive features of humans, including the unique system of egalitarian male hierarchy in mobile hunter-gatherers. Here I review nine leading proposals that could potentially explain why self-domestication occurred (...) in H. sapiens, whether by selecting in favor of cooperation and tolerance or by selecting against aggressiveness. To account for the domestication syndrome, proposals must explain what led to a decline in fitness of highly aggressive males, and why the explanatory factor applies only to H. sapiens rather than to other species of Homo. The proposed explanations invoke genetic group selection; group-structured culture selection (also known as cultural group selection); social selection by female mate choice; social selection by male partner choice; increased self-control; cooperative breeding; high population density; use of lethal weapons; and language-based conspiracy. Most proposals face difficulties in accounting for the origins and/or maintenance of self-domestication. I conclude that the evolution of language-based conspiracy, which is a form of collective intentionality, was the key factor initiating and maintaining self-domestication in H. sapiens, because it is the most convincing mechanism for explaining the selective pressure against individually powerful fighters. Sophisticated language enabled males of low fighting prowess to coordinate in executing physically aggressive and domineering alpha males. This system is known today as a leveling mechanism in small-scale societies. Group-structured culture selection possibly accelerated the process. (shrink)

This paper provides an overview of the account of fictionality — i.e. the phenomenon of things being true “in” or “according to” fictions — that lies at the heart of Kendall Walton's account of representational art. Walton's central idea is that what it is for a proposition to be fictional is for there to be a prescription to imagine that proposition. As we shall see, however, properly understanding this proposal requires an antecedent grasp of Walton's picture of games of make-believe (...) and the relations that artworks bear to appreciators. Having explicated these connections, we will then examine the extensional accuracy of Walton's account of fictionality and its connections to the wider debate about the interpretation of artworks. Richard Bett presents a ground-breaking study of Pyrrho of Elis, who lived in the late fourth and early third centuries BC and is the supposed originator of Greek scepticism. In the absence of surviving works by Pyrrho, scholars have tended to treat his thought as essentially the same as the long subsequent sceptical tradition which styled itself 'Pyrrhonism'. Bett argues, on the contrary, that Pyrrho's philosophy was significantly different from this later tradition, and offers the first detailed account of (...) that philosophy in this light. Bett considers why Pyrrho was adopted as the figurehead for that tradition: his answer suggests that we should distinguish two phases within Pyrrhonism, of which the initial phase is much closer to Pyrrho's own thought than is the better-known later phase. Bett also investigates the origins and antecedents of Pyrrho's ideas; in particular, Plato is singled out as an important inspiration. The result is the first comprehensive picture of this key figure in the development of philosophy. The new claims that Bett puts forward have major implications for the history and interpretation of ancient Greek thought. (shrink)

Adaptive Planning is an approach to planning in the commonsense domain. An adaptive planner takes advantage of the habitual nature of many of the planning situations for which it plans by bosing its activities on a memory of pre‐stored plans. A critical issue, and the subject of this paper, is the question of flexibility: How does an adaptive planner refit an old plan in order to meet the demands of some new planning situation? An adaptive planner refits prestored plans by (...) constructing an interpretation of the situation in which it is engaged. Key elements in the theory of adaptive planning are its treatment of specific plans and a notion of situation matching. In Mimesis as Make-Believe, Kendall Walton gave a pioneering account of the nature of fictionality, which holds that what it is for p to be fictional is for there to exist a prescription to imagine that p. But Walton has recently distanced himself from his original analysis and now holds that prescriptions to imagine are merely necessary conditions on fictionality. Many of the alleged counterexamples that have prompted Walton's retreat are drawn from the field of photography, and it is upon (...) these cases that I focus. I argue that once Walton's analysis is properly articulated, we can accommodate the apparent counterexamples by paying careful attention both to the general features of the photographic medium and the specific features of the photographs in question. This paper begins with a discussion of two features of the everyday task environment. First, the everyday task environment is designed, and an important part of the design is the provision of explicit information to guide the individual in the adaptation of his activity. Second, some task environments are semi‐permanent. These two features of the task environment reveal some important characteristics in the psychology of the individual. When novelty occurs, expansion in the range of behavior of the individual is guided (...) by a process of internalization of information provided in the task environment by another. Because of the semi‐permanence of home task environments, there is pay‐off in organizing behavior in terms of the particulars of those environments. The body of this paper examines these ideas from the perspective of FLOABN. FLOABN is a computational cognitive model of an individual acquiring skill at using household and office devices. (shrink)

In The Selfish Gene, Richard Dawkins crystallized the gene's eye view of evolution developed by W.D. Hamilton and others. The book provoked widespread and heated debate. Written in part as a response, The Extended Phenotype gave a deeper clarification of the central concept of the gene as the unit of selection; but it did much more besides. In it, Dawkins extended the gene's eye view to argue that the genes that sit within an organism have an influence that reaches (...) out beyond the visible traits in that body - the phenotype - to the wider environment, which can include other individuals. So, for instance, the genes of the beaver drive it to gather twigs to produce the substantial physical structure of a dam; and the genes of the cuckoo chick produce effects that manipulate the behaviour of the host bird, making it nurture the intruder as one of its own. This notion of the extended phenotype has proved to be highly influential in the way we understand evolution and the natural world. It represents a key scientific contribution to evolutionary biology, and it continues to play an important role in research in the life sciences. The Extended Phenotype is a conceptually deep book that forms important reading for biologists and students. But Dawkins' clear exposition is accessible to all who are prepared to put in a little effort. Richard Rorty is famous, maybe even infamous, for his philosophical nonchalance. His groundbreaking work not only rejects all theories of truth but also dismisses modern epistemology and its preoccupation with knowledge and representation. At the same time, the celebrated pragmatist believed there could be no universally valid answers to moral questions, which led him to a complex view of religion rarely expressed in his writings. In this posthumous publication, Rorty, a strict secularist, finds in the pragmatic thought of John (...) Dewey, John Stuart Mill, William James, and George Santayana, among others, a political imagination shared by religious traditions. His intent is not to promote belief over nonbelief or to blur the distinction between religious and public domains. Rorty seeks only to locate patterns of similarity and difference so an ethics of decency and a politics of solidarity can rise. He particularly responds to Pope Benedict XVI and his campaign against the relativist vision. Counterpart theory has many benefits, but few are happy to accept the metaphysical setting in which this account of de re modality was developed by its architect, David Lewis. I argue here that counterpart theory can be made acceptable by the lights of those who repudiate the existence of merely possible objects. To the "ersatz" counterpart theorist I offer two stories: one about the relate of the counterpart relation and one about the relation itself. The evolution of nonconceptive sexuality in bonobos and chimpanzees is discussed from a functional perspective. Bonobos and chimpanzees have three functions of sexual activity in common (paternity confusion, practice sex, and exchange for favors), but only bonobos use sex purely for communication about social relationships. Bonobo hypersexuality appears closely linked to the evolution of female-female alliances. I suggest that these alliances were made possible by relaxed feeding competition, that they were favored through their effect on reducing sexual coercion, and that (...) they are ultimately responsible for the relaxed social conditions that allowed the evolution of “communication sex.”. The standard Kripkean semantic theories for quantified modal logic allow the individuals that exist at other worlds to vary from those that exist at the actual world. This causes a problem for those who deny the existence of non-actual individuals. I focus on two prominent strategies for solving this problem, due respectively to Bernard Linsky and Edward Zalta (who identify the possible individuals with the actual individuals) and Alvin Plantinga (who identifies the possible individuals with the individual essences). This article explores the ways in which Janelle Monáe’s audiovisual performances leverage black female flesh to trouble historically constituted imaginings of ‘the human’. Tracking Monáe’s audiovisual aesthetics across ‘Many moons’ and Dirty Computer, I interrogate acoustic and imagistic resonances that recall the repeating horrors of bondage, and which also constitute performative ‘fabulations’ whereby freedoms that are engendered specifically by and within black female flesh might be imagined. Monáe ‘enfleshes’ the cyborg to critique cyberfeminist and posthumanist theories that advocate for material (...) dissolution as a framework for liberation, as well as to trouble black women’s historical relationships to the category ‘human’. Rather than understand Dirty Computer as a (re)turn to the human Monáe, I contend that the project extends the artist’s longstanding critical engagement with the black female cyborg and black sonic cyberfeminist liberatory potentialities. Some theorists who accept the existence of global justice duties to alleviate the condition of distant needy strangers hold that these duties are significantly constrained by special ties to fellow countrymen. The patriotic priority thesis holds that morality requires the members of each nation-state to give priority to helping needy fellow compatriots over more needy distant strangers. Three arguments for constraint and patriotic priority are examined in this essay: an argument from fair play, one from coercion, another from coercion and (...) autonomy. Under scrutiny, none of these arguments qualifies as successful. (shrink)

A-LOGIC is a full-length book (600+ pg). It functions as a system of logic designed to: 1) solve the standard paradoxes and major problems of standard mathematical logic; 2) minimize that logic's anomalies with respect to ordinary language, yet; 3) prove that all theorems in mathematical logic are tautologies. It covers lst order logic the logic of the words "and", "or", "not", "all" and "some". But it also has a non truth functional "if...then" and differs in its definition of validity, (...) its semantics and its theorems. In the book A-logic is contrasted step by step with standard mathematical logic as presented and defended by Quine. All of standard logic's theorems are proven tautologies in A-logic. But some argument-forms called "valid" in standard logic are not valid in A-logic -- notably non-sequiturs like "(P and not-P), therefore Q". In addition A-logic has many tautologies with its non-truthfunctional "if ... then" that standard logic can not derive -- e.g., "Not-(if P&Q then not-P)." A-logic's semantics is based on syntactically defined concepts of logical synonymy and containment of meanings rather than on truth-values and truth-functions. Its "if...then" sentences (called "C-conditionals") are valid if and only if (i) the meaning of the consequent is logically contained in that of the antecedent, and (ii) the antecedent and consequent are jointly consistent. The predicate "valid" holds only of C-conditionals and arguments. No valid C-conditionals are translatable into standard logic though all of them imply tautologies of standard logic. (shrink)

RICHARD RORTY has written one of the most important and challenging books to be published by an American philosopher in the past few decades. Some will find it a deeply disturbing book while others will find it liberating and exhilarating—both, as we shall see, may be right and wrong. Not since James and Dewey have we had such a devastating critique of professional philosophy. But unlike James and Dewey, who thought that once the sterility and artificiality of professional—and indeed (...) much of modern philosophy since Descartes—had been exposed, there was an important job for philosophers to do; Rorty leaves us in a much more ambiguous and unsettled state. I will examine Rorty’s book from a variety of perspectives, beginning with a general overview and then moving to more finely meshed descriptions. My aim is not only to illuminate the power and subtlety of Rorty’s analysis and to show its inner unity, but to locate basic issues that are left unresolved. (shrink)

A number of studies in the apparent motion literature were examined using the cognitive penetrability criterion to determine the extent to which beliefs affect the perception of apparent motion. It was found that the interaction between the perceptual processes mediating apparent motion and higher order processes appears to be limited. In addition, perceptual and inferential beliefs appear to have different effects on perceived motion optimality and direction. Our findings suggest that the system underlying apparent motion perception has more than one (...) stage and is informationally encapsulated from cognitive factors. (shrink)
