A typical discussion around health reform in the U.S. focuses on how the nation can most effectively and efficiently extend insurance coverage to the rising number of people who have none. Furthermore, discussions about health care reform typically are centered on times of normalcy, when the health care system is not overly taxed and there is the luxury of time to think about everyday matters of health and health care, including health care services needed to prevent illness, treat conditions, and (...) address individual emergencies. But in light of the lessons learned over the past decade, it is also essential to consider how any reformed health care system will react to and mitigate the consequences of a public health emergency. When We Collide is a landmark reassessment of the significance of sex in contemporary Jewish ethics. Rebecca Epstein-Levi offers a fresh and vital exploration of sexual ethics and virtue ethics in conversation with rabbinic texts and feminist and queer theory. Epstein-Levi explores how sex is not a special or particular form of social interaction but one that is entangled with all other forms of social interaction. Regnant public accounts of Jewish sexual ethics—both external and internal—fall short of what they could accomplish. Using a Twitter thread on sexual ethics which falls into some key errors as a case study, I argue that Jewish ethicists are poised to address the thread's errors by offering sources for alternative moral frameworks. I examine how thinking with this Twitter thread can help us clarify what we mean by public scholarship more generally, what is wrong with some common public deployments of (...) specifically Jewish sources, and some implications of this for both Jewish and non‐Jewish publics. I conclude with some reflections about the role of traditional academic venues, such as the Journal of Religious Ethics, within this. (shrink)

What can the Jewish tradition contribute to the current public debate about vaccination? Much of the rhetoric surrounding vaccine refusal appeals to concepts of individual autonomy and fears of political and intellectual authority, claiming that the individual is the best expert on his or her own health and on whether to actively deny accepted medical consensus. Unlike many other health decisions, vaccine refusal has direct and measurable consequences for one's community. The Jewish tradition's emphasis on community and the well-being of (...) the collective, as well as its tradition of respect for intellectual authority, can be a critical support to the medical community in encouraging wide-spread vaccination. Mr. Galanas, an eighty‐six‐year‐old man, intentionally shot himself in the chest and abdomen. Surprisingly, the bullet damaged only his distal pancreas and part of his colon, requiring a diverting colostomy to prevent leakage of bowel fluids into his abdomen. After being admitted, he lies intubated in the intensive care unit awaiting surgery to repair his colon. He is responsive but does not demonstrate clear decision‐making capacity. He grudgingly accepts pain medications but refuses antibiotics and antidepressants. He has a living will (...) that gives his wife durable power of attorney and also explicitly states a desire to refuse all medical interventions if he is permanently unconscious or in an end‐stage condition. Mrs. Galanas reports frequent conversations in which her husband said he would not want to be sustained on life support. She also says that he often mentioned he would not want an ostomy bag—a likely, albeit temporary, outcome of the proposed surgery. His physicians are nervous about withholding medical interventions when Mr. Galanas's injury is the result of a suicide attempt and his prognosis is good. Should the care team surgically repair his injured colon, regardless of the patient's capacity, his advance directive, and his wife's statement that he would not want surgery or other life‐sustaining treatment? This essay aims to elucidate how multiple voices and traditions should interact with one another in the practice of ethics. First, it explores some of the major ways in which questions of bodily autonomy function in secular feminist and Jewish bioethical discourses. It then uses case studies to illuminate ways each discourse's concepts of bodily autonomy can be deeply problematic, and argues that the strengths in each discourse can serve as important correctives for the weaknesses in the other. It suggests (...) that some formal features of rabbinic texts can serve as a model for a discourse of constant and animated mutual correction. The adage “an ounce of prevention is worth a pound of cure” is widely used in healthcare settings and can be applied to the work of institutional clinical ethics committees. The model of clinical ethics consultation, however, is inherently reactive: a crisis or question emerges, and ethics experts are called to help. In an effort to employ a proactive component to the model of clinical ethics consultation (as well as to standardize our educational interventions), we developed ethics pocket cards. The (...) purpose of this article is to: (1) describe the rationale for using ethics pocket cards, (2) provide examples of our cards, and (3) begin a dialogue about the potential uses of ethics pocket cards. This image of choreographed perfection is reproduced in popular culture. … But the actual practice of sex, by ordinary people, is not so lofty, so beautifully synchronous. Real sex, even "good" sex, is carnivalesque, even grotesque. Part of the reason that Epstein-Levi takes this approach is to distinguish Jewish ethics' discussion of sex, which regards sex, and therefore sexual ethics, "as an empirical, lived, and granular phenomenon" (3).Discussions in Jewish sexual ethics should treat sex as a lived social experience and be responsive to the messiness of that experience. Paris is firing all its ammunition into the August night. Against a vast backdrop of water and stone, on both sides of a river awash with history, freedom's barricades are once again being erected. Once again justice must be redeemed with men's blood.Albert Camus wrote these words in August 1944, as Paris was being liberated from German occupation. Although best known for his novels including The Stranger and The Plague, it was his vivid descriptions of the horrors of the occupation (...) and his passionate defense of freedom that in fact launched his public fame. Now, for the first time in English, Camus at 'Combat' presents all of Camus' World War II resistance and early postwar writings published in Combat, the resistance newspaper where he served as editor-in-chief and editorial writer between 1944 and 1947. These 165 articles and editorials show how Camus' thinking evolved from support of a revolutionary transformation of postwar society to a wariness of the radical left alongside his longstanding strident opposition to the reactionary right. These are poignant depictions of issues ranging from the liberation, deportation, justice for collaborators, the return of POWs, and food and housing shortages, to the postwar role of international institutions, colonial injustices, and the situation of a free press in democracies. The ideas that shaped the vision of this Nobel-prize winning novelist and essayist are on abundant display. Realist ideology critique (RIC) is a strand of political realism recently developed in response to concerns that realism is biased toward the status quo. RIC aims to debunk an individual's belief that a social institution is legitimate by revealing that the belief is caused by that very same institution. Despite its growing prominence, RIC has received little critical attention. In this article, I buck this trend. First, I improve on contemporary accounts of RIC by clarifying its status and the role (...) of motivated reasoning. Second, I show that realist ideology critics face a dilemma: either their account makes deeply implausible epistemological assumptions, or they temper its epistemology at the expense of rendering it toothless. I argue for each horn in turn before revealing the dilemma to be a false one by making a novel distinction between varying strengths of RIC based on their underlying epistemological assumptions. I propose Moderate RIC as a solution: upon discovering that one reason for your belief that a social institution is legitimate is likely malignantly epistemically circular, the belief should undergo further epistemic testing. I respond to three potential objections and suggest that Moderate RIC would make a fruitful addition to political theorists' methodological toolkit. (shrink)

There is disagreement among physicians and medical ethicists on the precise goals of Hospice and Palliative Medicine (HPM). Some think that HPM’s goals should differ from those of other branches of medicine and aim primarily at lessening pain, discomfort, and confusion, while others think that HPM’s practices should aim, like all other branches of medicine, at promoting health. I take the latter position: using the ars moriendi to set a standard for what it means to die well, I argue that (...) if HPM’s practices were to aim at mitigating suffering with little regard to promoting health, some patients would die worse deaths than if HPM’s practices were to aim at health. According to the ars moriendi, flourishing at the end of one’s life requires that persons exercise their agency and pursue the goods most important to them. On this view, HPM’s practices should promote patients’ health to enable them to pursue these goods. (shrink)

In this paper, I propose to resolve the controversy over the derivation of the categories of quantity by spelling out three claims: (1) the three quantitative functions/forms of judgment (universal-particular-singular), qua synthetic categories of quantity (unity-plurality-totality), lawfully direct the determination of sensible manifolds as singular totalities, which (2) brings to light a specifically categorial type of judgmental activity, distinguishable from but presupposed by empirical judgments. This calls for (3) pairing the category of totality with the singular judgment and the category (...) of unity with the universal judgment (‘Order B’), rather than pairing the singular judgment with unity and the universal judgment with totality (‘Order A’). At stake in this controversy is our understanding of the categories’ normativity, their scope, and the division of labor between intuitions and categories in individuating objects. (shrink)

This article provides an assessment of Jeremy Waldron's arguments (in God, Locke and Equality and his subsequent 'Response to Critics') that Locke provides us with a compelling version of liberal equality. A close examination of the case of the criminally convicted in The Second Treatise shows how Locke's commitment to the principle of equality is compromised. This is revealed in part through recourse to contextualist considerations. This leads to the suggestion that Waldron's principled rejection of contextualist approaches to the history (...) of political ideas can lead to a distorted understanding. It also suggests a need for a more thorough consideration of how a substantive principle of moral equality should apply in the field of criminal justice and in liberal democracy more generally. Peirce and John Dewey. Inquiry according to Peirce is a struggle to replace doubt by true belief. Dewey insisted that the transformation was from an indeterminate situation to a determinate or non-problematic one. In this paper, I argue that Hume’s account of moral judgment is best understood if it is read in light of Hume’s explanatory project. I first lay out the textual support to show that Hume’s account of justice in the Treatise includes both approval of a motive that gives rise to the virtue of justice, and approval of a system of conduct, irrespective of a motive. I then argue that we can allow for such plurality in Hume’s theory of moral (...) judgment if we view it in light of his explanatory project: finding unifying causes for disparate phenomena. Hume offers a unified theory of moral judgment because he can show that the different approvals are explained by the same causes. Finally, I argue that viewing Hume’s account of moral judgment in light of his explanatory project allows us to appreciate a further distinction between the moral judgment of the natural and the artificial virtues: while judgments of the former are fully explained by the causes of a certain motive, the latter are only fully explained by the causes of the motive in the context of a convention, which in turn is partially constituted by non-approved motives. Many have the intuition that human persons are both extremely and equally valuable. This seeming extremity and equality of vale is puzzling: if overall value is the sum of one’s final value and instrumental value, how could it be that persons share the same extreme value? One way that we can solve the Value Puzzle is by following Andrew Bailey and Josh Rasmussen. Philosophy and Phenomenological Research, 103, 264–277 (2020) and accepting that persons have infinite final value. But there are (...) some significant downsides to their way of thinking about values, which relies on the extended real numbers. We offer a different approach: if we model values using the hyperreal numbers, we can capture many of our intuitions about the extremity and relative equality of human value without incurring the substantial theoretical costs of using the extended real numbers. We also examine other ways of modeling the infinite value of persons and evaluate the strengths and weaknesses of these other accounts compared to ours. (shrink)

The article responds to some of the points raised by B. van Fraassen concerning probability kinematics and direct inference within the framework of the approach to the revision of probability judgment proposed by Levi in The Enterprise of Knowledge. In particular, the critical importance of the question of direct inference is emphasized and explained.

Leeds (1990) levels an objection against the criterion of rational choice I have proposed (Levi 1997, Ch. 6; 1980; 1986), pointing out that the criterion is sensitive to the way possible consequences are partitioned. Seidenfeld, Kadane and Schervish (1989) call into question the defense of the cross product rule by appeal to Pareto Unanimity Principles that I had invoked in my 1986. I offer clarifications of my proposals showing that the difference between my views and those of my critics (...) concerns the extent to which full belief, probabilistic belief, and value judgment are separable. Does God know what people will freely do? An obvious source to consult is the Bible—which is what the philosophers who debate about open theism do. They agree that God is omniscient. However, open theists insist that God does not know what we will freely do, and the other side disagrees. The problem is that both sides seem to misread the Bible in order to make it philosophically relevant, which is not surprising because the philosophy they read into it is (...) problematic. This result raises questions I try to answer: How are their readings questionable because they are used for philosophical purposes? How should the relevant texts be read? (shrink)

What are the roles of semantic and pragmatic processes in the interpretation of sentences in context? And how do we attain such interpretations when sentences are deemed indeterminate? Consider a sentence such as “Lisa began the book” which does not overtly express the activity that Lisa began doing with the book. Although it is believed that individuals compute a specified event to enrich the sentential representation – yielding, e.g., “began [reading] the book” – there is no evidence that a default (...) event meaning is attained. Moreover, if indeterminate sentences are enriched, it is not clear where the information required to generate enriched interpretations come from. Experiment 1 showed that, in isolation, there is no default interpretation for indeterminate sentences. The experiment also showed that biasing contexts constrain event interpretations and improve plausibility judgments, suggesting that event representations for indeterminate sentences are generated by context. In Experiment 2, participants heard biasing discourse contexts and later falsely recognized foil sentences containing the biased events (“Lisa began reading the book”) at the same proportion and with the same confidence as the original indeterminate sentence (“Lisa began the book”). We suggest that indeterminate sentences trigger event-enriching inferences but only in sufficiently constraining contexts. We also suggest that indeterminate sentences create two memory traces, one for the proposition consistent with the denotational, compositional meaning, and another for the proposition that is enriched pragmatically over time. It is necessary to realize first of all that the concept of culture is founded upon two closely related dichotomies: that between the natural and artificial and that between the chaotic and the orderly. In its most primitive signification, culture means simply the imposition of an exquisite order upon the raw givenness of experience. In this sense, nature represents the immediacy of need, culture its formalization. Man may be "a rational animal," as Aristotle said, but in possessing the rational potential (...) which he intermittently actualizes, he never ceases to remain an animal grounded immediately in hunger, lust, and the multiple instances of natural desire. Plato waged a never-ending struggle against the lawless outbreak of the natural appetites, and his efforts to curb, discipline, and form them is a primitive paradigm of the activity of culture. Man's capacity for thought and reason, for sociality and humane consideration has made him a sculpture-building animal and has made it possible for him, as Cassirer said, to live in a symbolic universe which he has himself created. But while his basic reality is not physical but cultural and spiritual, his anchorage forever remains that of nature and of animal need. One can sympathize with [Leo] Strauss' ultimate aim—to protect the validity of moral judgment against that form of relativism which would assess the value of great philosophic works simply in terms of how they satisfied the needs of the times for which they were written. But in believing that "historicism " meant "relativism," and that all attention to the temporal relevance of great doctrines in the history of ideas was somehow perverse, Strauss was profoundly mistaken. Hermeneutics is not axiology. Questions (...) of truth and validity are fundamental, but they are dependent upon a prior solution of the problem of meaning. And for the establishment of meaning, contextual analysis is crucial. For it is not as if ideas were the ghostly inhabitants of another world, logically cut off from human purposes and intentions. All three things exist: ideas, agents, and social contexts, and the best history of ideas is, I believe, constituted by the careful consideration of the multiple interrelationships between them. It is false to believe that texts exhaust their own meaning. For there is always an historical grounding and a web of person and social events that give them wider and deeper significance. And this is precisely why we must ask such questions as: What sort of society was the author writing for and trying to persuade? What were the conventions of communication and the literary forms of discourse current at the time? What was the author's class affiliation, his place in the social hierarchy of his age? And perhaps above all: What were his moral commitments, the structure of his ideals? Carlo Levi was a painter, writer, and antifascist Italian from a Jewish family, and his political activism forced him into exile for most of the Second World War. While in exile, he wrote _Christ Stopped at Eboli_, a memoir, and _Fear of Freedom_, a philosophical meditation on humanity's flight from moral and spiritual autonomy and our resulting loss of self and creativity. Brooding on what surely appeared to be the decline, if not the fall of Europe, Levi locates (...) the human abdication of responsibility in organized religion and its ability to turn the sacred into the sacrificial. In doing so, he references the entire intellectual and cultural estate of Western civilization, from the Bible and Greek mythology to Sigmund Freud and Carl Jung. This edition features newly published pieces of Levi's artwork and the first English translation of his essay "Fear of Painting," which was appended to a later publication of the work. It also includes an introduction that discusses Levi's life and enduring legacy. This poster presents results from applying agent-based modeling to an exploration of risk attitudes and rational decision making in the context of group interaction. We are also interested in the place of agent-based modeling and computational philosophy within the computational humanities. Computational philosophy has not typically been included in Digital Humanities; computational work has been done using philosophy texts as a source for analysis (Kinney 2022; Malaterre et al. 2021; Fletcher et al. 2021; Zahorec et al. 2022), but there are (...) few examples of philosophical arguments being made based on computation (Zahorec et al. 2022). Modeling is largely accepted as a computational humanist method (McCarty 2004; So 2022), but typically models are based on data rather than designed simulations as a method analogous to a thought experiment (Mayo-Wilson / Zollman 2021). Agent-based modeling is not as common in computational humanities, but we are interested in its potential; for instance, see work modeling correspondence networks to better understand lost information and biases in correspondence data sets (Buarque / Vogl 2023), or work simulating past human societies (Romanowska et al. 2021). Our project explores Lara Buchak’s theory of risk-weighted rational decision making by extending it to the context of group populations and interactions. Buchak has proposed risk-weighted expected utility maximization, which incorporates individual risk attitudes into the standard expected utility (EU) calculation based on utility and probability of outcomes (Buchak 2017). This theory provides an explanation for differences of behavior seen in human populations, while still allowing those different choices to be rational. Buchak’s theory has previously only been applied to individual decision making; our work uses agent-based modeling to develop and analyze simulations which incorporate a variety of risk attitudes (risk avoidance and risk seeking) into game theoretic interactions. This project is a collaboration between a philosopher and a research software engineer; we have worked together to develop simulations that implement agents with risk attitudes making risky choices. This presentation focuses on results from an implementation of a hawk/dove game with multiple risk attitudes and risk attitude adjustment. In the hawk/dove game cooperation, or playing dove, is better for the population, but acting aggressively, or playing hawk, is better for an individual if they are in a neighborhood of doves. To set up the game, we place agents on a grid and have them play against each of their neighbors, and accumulate payoffs based on the success of their plays. We define risk attitudes 0 through 9, where that number corresponds to the minimum number of neighbors playing dove for an agent to play hawk. An agent with risk attitude 0 is most risk seeking and always plays hawk; an agent with risk attitude 1 will play hawk if at least one neighbor plays dove; an agent with risk attitude 9 always takes the safe choice and plays dove; an agent with risk attitude 4 or 5 is risk neutral (breaking ties in different ways), which corresponds to expected utility. In this simulation we randomly set agent initial risk attitudes, and then every ten rounds agents compare their payoffs with their neighbors and adopt the most successful risk attitude in their neighborhood. The simulation is coded to stop once risk attitude adjustments stabilize. We define 13 different population states based on primary and second majority of risk averse, risk inclined, or risk moderate, and analysis of over 1 million runs indicate that while it’s more likely to stabilize with the population having become majority risk inclined, that is not the only outcome; we also see cases where the population stabilizes as risk neutral, risk avoidant, and many cases with no clear majority. This diversity of stable populations provides support for the argument that no one risk attitude is uniquely rational, but rather that risk attitudes are conventional. This matches what we observe in the real world: that different populations have different risk attitudes. Our simulations include numerous parameters to vary grid size; adjustment frequency, strategy, and wealth comparison; neighborhood sizes for observing previous choice, playing against, and comparing payoffs for adjusting risk attitudes; and different distributions for initializing risk attitudes. Analysis of parameters and adjusted risk attitudes shows that the strongest correlations are the initial distribution of risk attitudes, which tend to be preserved. * * * This poster was accepted and presented at the DH2024 conference in Washington, D.C.
