Upshot: Bringing second-order understandings to the doing of climate science is to be welcomed. In taking a second-order turn, it is imperative to reflect on reflection, or report authentically our doings and thus move beyond sterile debates about what ought to be or what second-order doings are or are not. The main focus of this paper ison ways in which Kantian philosophy can informproponents and opponents of constructivismalike. Kant was primarily concerned withreconciling natural and moral law. His approachto this general problematic was to limit andseparate what we can know about things(phenomena) from things as they are inthemselves (noumena), and to identify moralagency with the latter. Revisiting the Kantianproblematic helps to address and resolve longstanding epistemological concerns regardingconstructivism as an educational philosophy inrelation to issues of objectivity andsubjectivity, the limits (...) of theoretical andpractical reason, and the relation betweenhuman experience and the world. It also servesto address ethical concerns regardingliberation from limited self-interests andcontexts conditioned by localised beliefs andinclinations. In light of revisiting theKantian problematic, both Glasersfeld's radicalview of constructivism and Jardine's socialcritique of constructivism are found wanting.Beyond constructivism, Kant's distinctionbetween phenomena and noumena and the limits ofreason that follow from it are brieflyconsidered in terms of Merleau-Ponty's noveldouble-embodied notion of flesh as anontological primitive – as a matter of beingboth in, and of, the world – with an aim tomore intimate connections between epistemologyand ethics. This distinction has sometimes been read as purely epistemic, resting not on things, but on our knowledge of them: there is one world, not two, though it may be apprehended in two ways. But this view is patently at odds with the text. Knowledge and opinion are δυνάμεις, "faculties," to be distinguished and defined by their objects, no less than by the state of mind they produce, and Plato clearly states that the fallibility and unclearness of opinion is rooted in (...) the relative unreality of opinables. The chapter argues from an ethology-inspired internalist perspective that ‘colour’ is not a homogeneous and autonomous attribute, but rather plays different roles in different conceptual forms underlying perception. It discusses empirical and theoretical evidence that indicates that core assumptions underlying orthodox conceptions are grossly inadequate. The assumptions pertain to the idea that colour is a kind of autonomous and unitary attribute. It is regarded as unitary or homogeneous by assuming that its core properties do not depend on the type of (...) ‘perceptual object’ to which it pertains and that‘colour per se’ constitutes a natural attribute in the functional architecture of the perceptual system. It is regarded as autonomous by assuming that it can be studied in isolation of other perceptual attributes. More generally, the chapter argues on the bases of corresponding empirical and theoretical evidence that perception cannot be understood as the ‘recovery’ of physical world structure from sensory structure by input-based computational processes. Rather, the sensory input serves as a kind of sign for biologically relevant aspects of the external world that activates biologically given conceptual forms with their internal parameters. Although the sensory input is a causally necessary requirement for the activation of conceptual forms, the perceptual computations triggered are under the control of an internal programme based on a set of conceptual forms. In _Sentient Flesh _R. A. Judy takes up freedman Tom Windham’s 1937 remark “we should have our liberty 'cause... us is human flesh" as a point of departure for an extended meditation on questions of the human, epistemology, and the historical ways in which the black being is understood. Drawing on numerous fields, from literary theory and musicology, to political theory and phenomenology, as well as Greek and Arabic philosophy, Judy engages literary texts and performative practices such as music and (...) dance that express knowledge and conceptions of humanity appositional to those grounding modern racialized capitalism. Operating as critiques of Western humanism, these practices and modes of being-in-the-world—which he theorizes as “thinking in disorder,” or “poiēsis in black”—foreground the irreducible concomitance of flesh, thinking, and personhood. As Judy demonstrates, recognizing this concomitance is central to finding a way past the destructive force of ontology that still holds us in thrall. Erudite and capacious, _Sentient Flesh _offers a major intervention in the black study of life. (shrink)

A collection of critical essays by English and American scholars, including such controversial academic political theorists as Gutmann, Barry and Nussbaum, that raises questions about the current theoretical reassessment of political liberalism.

On the basis of a communicative theory of criminal punishment, I show how mercy has a significant but limited role to play in the criminal law—in particular (although not only) in criminal sentencing. Mercy involves an intrusion into the realm of criminal law of values and concerns that are not themselves part of the perspective of criminal law: a merciful sentencer acts beyond the limits of her legal role, on the basis of moral considerations that conflict with the demands of (...) penal justice. Sometimes, however (but in a decent system of law in a decent society, rarely), that is how citizens should act. Finally, I discuss, and criticise, two attempts to find a place for mercy within a communicative conception of punishment, and argue that repentance is not an appropriate ground for leniency or mercy in sentencing. The environmental movement continues to be a dynamic force for protection of the environment despite new organizations emerging from the “birthing” process of the formation of new groups via factions and schisms. I focus on two aspects of the evolution of the environmental movement: how do new organizations emerge from existing environmental groups via benevolent or divisive mechanisms; and, which organizations produce new organizations? I develop a family tree of the American environmental movement from 1955 – 2005 and identify the (...) mechanisms that result in the formation of new organizations from a sample of 48 environmental organizations. I use social network analysis to identify which environmental organizations were most likely to produce new groups and set the stage for future inquiries into how new environmental organizations reestablish and maintain connections with their progenitors.
