We examined participants' reading and recall of informed consent documents presented via paper or computer. Within each presentation medium, we presented the document as a continuous or paginated document to simulate common computer and paper presentation formats. Participants took slightly longer to read paginated and computer informed consent documents and recalled slightly more information from the paginated documents. We concluded that obtaining informed consent online is not substantially different than obtaining it via paper presentation. This article argues for taking into account an emendation brought forward by the early 19 th century British scholar Peter Paul Dobree. (...) Andrew von Hirsch and Andrew Ashworth recently argued that there is generally a reason to punish a socially deprived offender less than his non-deprived counterpart (ie someone who is not socially deprived but is otherwise similar to the deprived offender in that he committed the same crime, caused the same harm, with the same degree of foresight, etc), because deprived offenders generally face stronger temptations to offend than their non-deprived counterparts. In reply, I will argue that we should draw (...) a distinction between (i) facing stronger temptations to offend when one offended and (ii) acting on stronger temptations in offending. The distinction is analogous to Antony Duff’s distinction between having a reason for an action and acting on/for that reason. After drawing the distinction, I will argue that while acting on stronger temptations in offending should be a mitigating factor, facing stronger temptations to offend per se should not be a mitigating factor. Moreover, I will argue that since it is not true that deprived offenders generally act on stronger temptations in offending, social deprivation cannot be defended as a general mitigating plea on the basis that deprived offenders generally act on stronger temptations in offending. Marianne Hirsch’s influential concept of postmemory articulates the ethical significance of representing trauma in art and literature. Postmemory, for Hirsch, “describes the relationship of children of survivors of cultural or collective trauma to the experiences of their parents, experiences that they ‘remember’ only as the narratives and images with which they grew up, but that are so powerful, so monumental, as to constitute memories in their own right”. Through appeal to recent philosophical work on memory, the ethics of (...) remembering, and Peter Goldie’s discussion of empathy, I explore the virtues and limitations of Hirsch’s concept of postmemory. I take particular issue with her recent attempt to place author W.G. Sebald in league with the postmemory generation. (shrink)

There is currently debate between deflationists and anti-deflationists about the ontology of persisting objects. Some deflationists think that disputes between, for example, four-dimensionalists (e.g. Ted Sider and David Lewis) and quasi-nihilists (e.g. Peter Van Inwagen and Trenton Merricks) are merely verbal disputes. Anti-deflationists deny this. Eli Hirsch is a deflationist who maintains that many ontological disputes are merely verbal. Theodore Sider maintains that the disputes are not merely verbal. Hirsch and Sider are thus engaged in a metaontological (...) dispute. In this paper, I argue that Hirsch's metaontological dispute with Sider is, by Hirsch's own lights, itself merely verbal. I conclude that the mere verbalness of his metaontological dispute with Sider suggests that Hirsch's account of what makes a dispute merely verbal may be problematic. (shrink)

[End Page 117]Ultimate endsMany consider Herman Daly to be a heterodox and even heretic economist. He associates himself with ecological economics, the field he co-founded. But while some of his ideas seem radical, many of his core proposals do not deviate substantially from mainstream economics. For instance, his “ultimate ends” concept is perfectly consistent with the broad notion of “welfare” in standard economics. In line with this, many welfare economists—such as Samuelson (1961), Mishan (1967), Hirsch (1976), Sen (1976), Scitovsky (1976) and Frank (1985)—have expressed themselves as critical of GDP (gross domestic product) dominance and growthmania (van den Bergh 2009). In fact, neoclassical economics is not married to economic growth—this is more the empirical side of macroeconomics. While Daly recognizes these subtleties, some of his followers do not.Daly sees his Protestant religion as delivering the ultimate ends, but Victor notes that this has not led to concrete suggestions. Revisionary ontologists are making a comeback. Quasi-nihilists, like Peter van Inwagen and Trenton Merricks, insist that the only composite objects that exist are living things. Unrestriced universalists, like W.V.O. Quine, David Lewis, Mark Heller, and Hud Hudson, insist that any collection of objects composes something, no matter how scattered over time and space they may be. And there are more besides. The result, says Eli Hirsch, is that many commonsense judgments about the existence or identity of highly visible (...) physical objects are a priori necessarily false. In a “last ditch effort” to bring revisionary ontologists back to their senses, Hirsch marshalls what he calls the Argument from Charity. We can be sure that there are tables and chairs and that there are no fusions of Plato’s nose and the Eiffel Tower, says Hirsch, because these commonsense platitudes are a logical consequence of the well-known principle of interpretive charity applied to natural languages, like English. In what follows, I assess the Argument from Charity. My conclusion is that if this is the best we can do to save revisionary ontologists, they are surely lost forever. (shrink)

Much of the most interesting work in philosophy today is metaphysical in character: this new series is a much-needed focus for it. OSM offers a broad view of the subject, featuring not only the traditionally central topics such as existence, identity, modality, time, and causation, but also the rich clusters of metaphysical questions in neighbouring fields, such as philosophy of mind and philosophy of science. (...) Besides independent essays, volumes will often contain a critical essay on a recent book, or a symposium that allows participants to respond to one another's criticisms and questions. Anyone who wants to know what's happening in metaphysics can start here. Volume Two begins with a major paper on consciousness by Ned Block. Block examines 'Max Black's Objection to Mind-Body Identity', an argument for a dualism of physical and phenomenal properties, closely related to Jackson's 'knowledge argument'. His extensive exploration of this family of arguments for property dualism includes considerable discussion of John Perry and Stephen White; their responses to Block's paper complete the section on the metaphysics of consciousness.Three papers consider the thesis that the future is, in some sense, 'open'. Eli Hirsch elaborates a view according to which contingent statements about the future can be indeterminate in truth-value, while preserving 'straight logic', including a principle of bivalence. Peter Forrest defends a sort of 'growing block' theory of the passage of time, emphasizing the way such a metaphysics, combined with a truth-maker principle, can provide an analysis of natural necessity. Trenton Merricks presents a trenchant and original criticism of the 'growing block' theory of time.The volume continues with a group of papers on problems of ontology. Thomas Hofweber's paper, defending nominalism from the objection that there are 'inexpressible' properties and propositions, won the first annual Oxford Studies in Metaphysics Younger Scholar Prize. John Hawthorne's paper raises some extremely puzzling questions about the nature of persons, given the ontology needed for Timothy Williamson's theory of vagueness. Michael Bergmann and Jeffrey Brower raise objections to combining a Platonic conception of universals with the doctrine of divine aseity; while Brian Leftow defends a non-Platonic theory of universals - a kind of divine-concept nominalism. McGuire argue that the philosopher's views, particularly in natural philosophy, actually change radically between his early and later works--and that any interpretation of Descartes must take account of these changes. The first comprehensive study of the most significant of these shifts, this book also provides a new picture of the development of Cartesian science, epistemology, and metaphysics. No changes in (...) Descartes's thought are more significant than those that occur between the major works The World and Principles of Philosophy. Often seen as two versions of the same natural philosophy, these works are in fact profoundly different, containing distinct conceptions of causality and epistemology. Machamer and McGuire trace the implications of these changes and others that follow from them, including Descartes's rejection of the method of abstraction as a means of acquiring knowledge, his insistence on the infinitude of God's power, and his claim that human knowledge is limited to that which enables us to grasp the workings of the world and develop scientific theories. Two recent discussions concerning punishment of the socially deprived reach conflicting conclusions. Andrew von Hirsch and Andrew Ashworth argue that we should sympathize with the predicament of the poor and therefore mitigate their sentences. Peter Chau disputes von Hirsch and Ashworth’s conclusion, contending that having to face strong temptations is not an appropriate ground for reducing anyone’s punishment for their crimes. I argue that neither von Hirsch and Ashworth’s account nor Chau’s critique of it is persuasive. (...) I then take up the challenge of showing why social deprivation renders punishment problematic. I contend that it establishes a perverse incentive structure that is persistent and powerful, requiring the disadvantaged to exercise self-control on an ongoing basis. Repeated acts of self-control are difficult, especially for youths whose skills at it are not yet fully developed. Also, in a variety of more and less subtle ways, social deprivation reduces the incentives for self-control and may work to stunt its development. In closing, I briefly consider the options for responding to the crimes of the chronically disadvantaged. (shrink)

What are the causes of the evolution of complex cognition? Discussions of the evolution of cognition sometimes seem to assume that more complex cognition is a fundamental advance over less complex cognition, as evidenced by a broad trend toward larger brains in evolutionary history. Evolutionary biologists are suspicious of such explanations since they picture natural selection as a process leading to adaptation to local environments, not to progressive trends. Cognitive adaptations will have costs, and more complex cognition will evolve only (...) when its local utility outweighs them. (shrink)

We only need to think for a moment about surfaces and other interfaces to realise their enormous importance in everydaylife. There are numerous branches of physics, chemistry, biology, and materials science concerned wholly or largely with surfaces, and one sometimes comes across the expression ‘surface science’ Among the natural phenomena connected with surfaces which have aroused scientific interest are surface tension, surface waves, photoelectric emission, reflection, refraction, evaporation, adsorption, adhesion, thin films, detergents, catalysts, cell membranes, skin. All of these phenomena (...) are complex, interesting, and some of them are still far from completely understood. Are surfaces important for philosophy? An epistemologist might well answer affirmatively, thinking of Quine’s "surface irritations" as the basis of our knowledge of the physical world, or Berkeley’s theory of vision, or the view that we perceive a material object in virtue of suitable causal interaction with its surfaces. But at first sight it seems that there is not much of interest for an ontologist. In his work on surfaces, especially in the book of that name, Avrum Stroll has shown to the contrary that there is much ontological interest in surfaces} Every ontologist delights in a newly discovered or hitherto neglected member of the ontological zoo: surfaces are not exactly new, but they have been neglected, and we can be grateful to Stroll for bringing them to greater prominence. This volume is a collection of some of the most important philosophical papers by Peter Gärdenfors. Spanning a period of more than 20 years of his research, they cover a wide ground of topics, from early works on decision theory, belief revision and nonmonotonic logic to more recent work on conceptual spaces, inductive reasoning, semantics and the evolutions of thinking. Many of the papers have only been published in places that are difficult to access. The common theme of all (...) the papers is the dynamics of thought. Several of the papers have become minor classics and the volume bears witness of the wide scope of Gärdenfors’ research and of his crisp and often witty style of writing. Newton deplored speculation in science, Einstein reveled in it. What exactly are scientific speculations? Are they ever legitimate? Are they subject to constraints? This book defends a pragmatic approach to these issues and applies it to speculations within science and to speculations about science.

ABSTRACT Tensism is the view that tense is not merely a property of language and the mind, but of the world itself. Perspectivalism extends this idea to all perspectival properties be they person or locational. One challenge that perspectivalism faces is the problem of expressing the contents of the beliefs and utterances of persons that are in other perspectival positions. One proposed solution to this problem is to allow for semantic theories that "realign" the expression of contents so that the (...) contents expressed by persons in other perspectival positions can be re-expressed from one's own perspectival position. In this paper I argue that a similar semantic realignment strategy could be deployed in helping perspectivalists generally come to grips with a puzzle raised by the Special Theory of Relativity. In short, the strategy is to realign the expression of contents in another inertial frame so that they are expressed from within your inertial frame. As we will see, the strategy is not puzzle free. This chapter examines the extent to which there are continuities between the cognitive processes and epistemic practices engaged in by human hunter-gatherers, on the one hand, and those which are distinctive of science, on the other. It deploys anthropological evidence against any form of 'no-continuity' view, drawing especially on the cognitive skills involved in the art of tracking. It also argues against the 'child-as-scientist' accounts put forward by some developmental psychologists, which imply that scientific thinking is present in early infancy (...) and universal amongst humans who have sufficient time and resources to devote to it. In contrast, a modularist kind of 'continuity' account is proposed, according to which the innately channelled architecture of human cognition provides all the materials necessary for basic forms of scientific reasoning in older children and adults, needing only the appropriate sorts of external support, social context, and background beliefs and skills in order for science to begin its advance. ABSTRACT In Germany, applied ethics is under attack from a diverse coalition of left‐wing organisations, disability groups, and some conservative defenders of a strict doctrine of the sanctity of human life. The attack has been pressed to the point of forcing the cancellation of conferences and disrupting lectures or classes so that they cannot take place. This essay describes the extent and nature of the attack, and makes a preliminary assessment of its significance.

The authors here promote the reintroduction of temporality into the description and analysis of spoken interaction. They argue that spoken words are, in fact, temporal objects and that unless linguists consider how they are delivered within the context of time, they will not capture the full meaning of situated language use. Their approach is rigorously empirical, with analyses of English, German, and Italian rhythm, all grounded in sequences of actual talk-in-interaction.
