This paper discusses the application of the supreme emergency doctrine from just-war theory to non-antagonistic threats. Two versions of the doctrine are considered: Michael Walzer’s communitarian version and Brian Orend’s prudential one. I investigate first whether the doctrines are applicable to non-antagonistic threats, and second whether they are defensible. I argue that a version of Walzer’s doctrine seems to be applicable to non-antagonistic threats, but that it is very doubtful whether the doctrine is defensible. I also argue that Orend’s version (...) of the doctrine is applicable to non-antagonistic threats, but that his account is not defensible, regardless of whether the threats are antagonistic or not. An important way to become self-deceived, omitted by Mele, is by intentionally ignoring and avoiding the contemplation of evidence one has for an upsetting conclusion, knowing full well that one is giving priority to one's present peace of mind over the search for truth. Such intentional self-deception may be especially hard to observe scientifically.

In this article two problems with the recently developed "practice or virtue approach" to business ethics are discussed. The first problem concerns an alleged harmony between common demands of morality (generally understood) and the internal goods of actual business practice. The claimed harmony is strong in essence since it holds that the role expectations a good manager has to live up to, do in fact coincide with what morality demands. The second problem is related to the first and concerns the (...) alleged relevance of a virtue perspective for business ethics. According to the virtue perspective discussed in this article, moral reasoning should take actual practice, and only actual practice, as a point of departure. In so doing ethics is claimed to become insulated from e.g. putting irrelevant demands on practitioners. Such demands are understood as based on abstract principles alien to the practice in question. The thesis of this article is that neither of the above mentioned two claims are plausible. This is so basically because one needs to turn elsewhere than to actual business practice in order to detect a morally laden notion of managerial goodness. (shrink)

Abolitionism is the view that if no one is responsible, we ought to abandon the reactive attitudes. This paper defends abolitionism against the claim, made by P.F. Strawson and others, that abandoning these attitudes precludes the formation and maintenance of valuable personal relationships. These anti-abolitionists claim that one who abandons the reactive attitudes is unable to take personally others’ attitudes and actions regarding her, and that taking personally is necessary for certain valuable relationships. I dispute both claims and argue that (...) this objection exaggerates the role of the reactive attitudes and underestimates the importance of non-reactive moral emotions. (shrink)

The idea of self-forgiveness poses a serious challenge to any philosopher interested in giving a general account of forgiveness. On the one hand, it is an uncontroversial part of our common psychological and moral discourse. On the other, any account of self-forgiveness is inconsistent with any general account of forgiveness which implies that only the victim of an offense can forgive. To avoid this conclusion, one must either challenge the particular claims that preclude self-forgiveness or offer an independently plausible account (...) of self-forgiveness. I deploy both strategies in this article, explaining what self-forgiveness is and how it is possible. (shrink)

When we forgive, we do so for reasons. One challenge for forgiveness theorists is to explain which reasons are reasons to forgive and which are not. This paper argues that we forgive in response to a perceived change of heart on the part of the offender. The argument proceeds in four steps. First, I show that we forgive for reasons. Second, I argue that forgiveness requires the right kind of reason. Third, I show that these two points explain a common (...) distinction between forgiving and letting go and, in doing so, solve a problem facing many accounts of forgiveness. Finally, I consider candidate reasons to forgive and argue that all of them are either the wrong kind of reason or are instances of a more general reason of the right kind, namely, a perceived change of heart. It is often claimed both that forgiveness is elective and that forgiveness is something that we do for reasons. However, there is a tension between these two central claims about the nature of forgiveness. If forgiving is something one does for reasons, then, at least sometimes, those reasons may generate a requirement to forgive or withhold forgiveness. While not strictly inconsistent with electivity, the idea of required forgiveness strikes some as antithetical to the spirit of the concept. They argue that (...) forgiveness is essentially elective. In this paper, I dispute these arguments. I argue that the intuitive plausibility of the position diminishes upon reflection and that the best arguments fail to explain why reasons to forgive, unlike most other reasons for action, cannot generate requirements. This paper examines the psychology of existential guilt with Martin Heidegger and Rollo May’s conceptualizations as the point of departure. The concept of existential guilt describes preconditions for responsibility and accountability in life choices and the relationship to the potential given in the life of a human. It might also be used as a starting point to examine an individual’s relationship to the potential offered in their life and life context and, in this way, the hitherto unlived life of an (...) individual. The following questions are discussed in contexts of identity development, perfectionism, and current cultural shifts in conceptualizations of selfhood: How can humans relate to the fact that only limited parts of who they might be can ever be actualized? Moreover, how can they relate to the fundamental ambiguity and “groundlessness” in the contexts of life where choices are made? There are striking parallels between the role of exploration in the Eriksonian approaches to healthy identity development and the ontological groundlessness that stands out as a premise for existential guilt. There are also parallels between identity fore-closure and normative identity styles and “falling” into das Man in the existential framework. Perfectionistic ideals easily become an objectivization – and closure – of possible alternatives and choices. In contemporary theories of constructions of selfhood, the dangers of alienation from the community on the one hand and escape into what might become totalitarian collectivism on the other is pointed out. The contextualization of personal responsibility offered through the concept of existential guilt might address both dangers. It provides a perspective on how personal responsibility is embedded in contexts of human relationships, relationships to nature, and the finitude, freedom, uncertainties, and suffering that is given through human existence. Existential guilt can wake sorrow and regret over opportunities overlooked and lost. However, most of all, it can be seen as a drive toward repair in the relationship toward both oneself and the other. It takes the form of receptivity, an openness to a life not yet lived, and creative use of imagination. (shrink)

This paper investigates the possibility of understanding the rudimentary elements of clinical sensitivity by investigating the works of Edmund Husserl and Emmanuel Levinas on sensibility. Husserl's theory of intentionality offers significant reflections on the role of pre-reflective and affective intuition as a condition for intentionality and reflective consciousness. These early works of Husserl, in particular his works on the constitution of phenomenological time and subjective time-consciousness, prove to be an important basis for Levinas’ works on an ethics of alterity and (...) infinite responsibility for the other person. In fact, it is difficult to understand the core of Levinasian ethics, of vulnerability as proximity, of ethical sensitivity as passivity and a suffering for the suffering of another, without understanding the influence from Husserl's work. Crucially, the paper will, on the basis of Levinasian ethics, establish an understanding of sensibility as vulnerability and receptivity that is fundamental also for understanding significant intuitions in clinical nursing. Clinical sensitivity and carefulness in nursing are shaped by the concrete and also bodily expressions of vulnerabilities in a receptivity that is pre-reflective and pre-ontological. (shrink)

In his early essay "On the Writer's Philosophy of Life," and in his early letters to (...) Cloudsley Johns, his intellectually "slovenly" friend (who also happened to share his literary ambitions and interests), London insists, again and again, on the proper philosophical foundation of the successful writer. This is how poor Cloudsley, who had previously been told to "get in and systematically ground [himself] in history, economics, biology and the kindred branches" 1 gets browbeaten by his self-appointed mentor and master, a veritable Jack of all trades, in a letter dated March 15, 1900: "To be well fitted for the tragedy of existence (intellectual existence), one must have a working philosophy, a synthesis of things. Have you a synthesis of things? Do you write, and talk, and build upon a foundation which you know is securely laid? Or do you not rather build with a hazy idea of 'to hell with the foundation.'" London then proceeds to catechize his friend on scientific principles such as the indestructibility of Matter, the persistence of Force, and the overall "dynamic principle, true of the metamorphosis of the universe"—principles that Cloudsley is urged to study "carefully and painstakingly" before he can ever claim to have "a firm foundation for [his] philosophy of life" (Letters, pp. 170-71).In London's admittedly heavy-handed ad hominem argument, one recognizes the philosophical sledgehammer of Ernest Everhard, the revolutionary hero of The Iron Heel and one of the fictional exponents of "that cold forbidding philosophy, materialistic monism," 2 which also [End Page 43] served as the scientific foundation of London's own philosophy of life. There are, however, not one, but two components to London's philosophy, which, as I shall argue in this essay, together constitute an essentially dialectical construction, a dynamic juxtaposition of and negotiation with, on the one hand, the "cold forbidding" Medusa of Truth and, on the other hand, the life-enhancing Aphrodite of Romance, the second of which is one of several versions of the vital Maia-Lie (Maia being the Buddhist term for the power that creates or re-creates the world as cosmic illusion).Two points need to be stressed from the outset. First, London's work is implicitly aligned with literary naturalism—the "Zolaistic Movement" of modern American fiction that the genteel writer and editor Thomas Bailey Aldrich famously condemned for its "miasmatic breath" 3 —even though London himself would always qualify his own naturalism by insisting that, artistically, he was "an emotional materialist" (Letters, p. 329), and that his realism was, in the words of Martin Eden, one of his fictional alter egos, "an impassioned realism, shot through with human aspiration and faith." 4 Second, London's work is explicitly aligned with philosophical naturalism (as distinct from supernaturalism)—that is, naturalism as the philosophical or epistemological view that, to quote The Oxford Companion to Philosophy (1995), "everything is natural, i.e. that everything there is belongs to the world of nature, and so can be studied by the methods appropriate for studying that world." In philosophical practice, naturalism and materialism have tended to coalesce, materialism being basically understood as the view that everything is made of matter, which can be studied by the methods of natural science. Like London's philosophical alter ego Ernest Everhard (and also like fictional protagonists such as Wolf Larsen and Martin Eden), London declared himself "a materialistic monist," although, as he admitted to Cloudsley Johns, "there is dam little satisfaction in it." This paper examines the existential context of physical and mental health. Hans Georg Gadamer and The World Health Organization’s conceptualizations are discussed, and current medicalized and idealized views on health are critically examined. The existential dimension of health is explored in the light of theories of selfhood consisting of different parts, Irvin Yalom’s approach to “ultimate concerns” and Martin Heidegger’s conceptualization of “existentials.” We often become aware of health as an existential concern during times of illness, and health and illness (...) can co-exist. The paper discusses how existential suffering in Western culture is described, to an increasing degree, as disorders or psychological deficits, and perfectionistic health goals easily can become a problem. We seek to avoid suffering rather than relate to it, with all the tension that may create. The paper argues that suffering is an unavoidable aspect of people’s experience of their lives, and actively relating to suffering must be regarded as a fundamental aspect of health. The need and usefulness of a concept of “existential health” is discussed. (shrink)

In this article, we defend two claims about the precautionary principle. The first is that there is no ‘core’ precautionary principle that unifies all its different versions. It is more plausible to think of the different versions as being related to each other by way of family resemblances. So although precautionary principle x may have much in common with precautionary principle y, and y with z, there is no set of necessary and sufficient conditions that unify all versions of the (...) principle. Our second claim is that it is sometimes appropriate to think of the precautionary principle as a midlevel principle in the sense proposed by Beauchamp and Childress in their Principles of Biomedical Ethics, i.e. as a non-rigid moral principle. We argue that if the precautionary principle is conceived as a non-rigid principle that needs to be balanced against other principles before a moral verdict can be reached, then this enables us to address some standard objections to the principle. Abolitionism is the view that if no one is responsible, then we ought to abandon the reactive attitudes. Proponents suggest that reactive attitudes can be replaced in our emotional repertoire by non-reactive analogues. In this paper, I dispute and reject a common challenge to abolitionism according to which the reactive attitudes are necessary for protesting unfairness and maintaining social harmony. While other abolitionists dispute the empirical basis of this objection, I focus on its implications. I argue that even if non-reactive (...) analogues cannot perform the interpersonal and social functions of reactive attitudes, it does not follow that the losses of abandoning them outweigh the gains of retaining them. The force of the challenge rests on a mistake, identified by John Stuart Mill among others, that is common when evaluating entrenched social practices. (shrink)

Bauhn insists that courage is necessary for reinforcing people's understanding of themselves as autonomous agents, which is in turn necessary for countering widespread feelings of alienation and depression. The precautionary principle is frequently referred to in various momentous decisions affecting human health and the environment. It has been invoked in contexts as diverse as chemicals regulation, regulation of genetically modified organisms, and research into life-extending therapies. Precaution is not an unknown concept in medical contexts. One author even cites the Hippocratic Oath as a parallel to the precautionary principle.

The precautionary principle is frequently invoked in environmental law and policy, and the debate around the principle indicates that there is little agreement on what 'taking precautions' means. The purpose of the present paper is to provide an improved conceptual foundation for this debate in the form of an explication of the concept of precaution. Distinctions between precaution and two related concepts, prevention and pessimism, are briefly discussed. The concept of precaution is analysed in terms of precautionary actions. It is (...) argued that precautionary actions are implicitly assumed to be precautionary with respect to something, and that this assumption should be made explicit. A definition of a precautionary action involving three necessary and jointly sufficient conditions (intentionality, uncertainty and reasonableness) is proposed, and the implications of this analysis for the debate on the precautionary principle are discussed. The concept of the mahant- ātman-, or “vast self”, found in some of the Early and Middle Upaniṣads, has, at least since the days of Hermann Oldenberg, been explored by a number of scholars, most notably by van Buitenen :103–114, 1964). These studies have usually emphasized the cosmic implications of this concept; the vast ātman- being the non-individualized spirit that brings forth and pervades the universe, then enters the bodies of all created beings as their animating principle. As such it (...) precedes the mahān, or mahat, of the Sāṃkhya philosophy. The present paper argues that the concept of a mahant- puruṣa- or “vast person”, appearing parallel to the vast ātman in these texts, is in fact older, being traceable to Middle Vedic texts; the emergence of the Upaniṣadic ātman doctrine has eventually led to its replacement by the mahān ātmā. Originally, it is argued, the adjective mahant- stressed the difference between this “vast” puruṣa, who is said to dwell in the sun, and the minute puruṣa within man, who is seen as the tiny “person” in one’s pupil, or resides in the heart, having the size of a thumb. In contradistinction to the ātman, the puruṣa is a thoroughly anthropomorphic soul-concept, a “person” within the person. The ultimate identity between this tiny soul-person and the puruṣa in the sun is a recurring, but little studied, motif in the micro-macrocosmic speculations of the Brāhmaṇa texts. This “vast”, solar puruṣa is sometimes identified with the Puruṣa or primeval man of Ṛgveda 10.90, from whose body the universe was formed, and much of the imagery surrounding the vast puruṣa of Middle and Late Vedic literature seems to derive from this hymn. Some artworks are aesthetically better than others. But can bad artworks have certain merits in virtue of being bad? Can something be so bad that it is good? In this paper I distinguish several interpretations of the question and consider whether contemporary theories of aesthetic value can render such a claim true. I also present a handful of desirable features which a plausible theory of the value of bad art should satisfy.

There are great health disparities in the world today, both between countries and within them. This problem might be seen as related to the access to various kinds of capabilities. It is not fully clear, however, what the exact relation is between health and capabilities. Neither Amartya Sen nor Martha Nussbaum has explicitly formulated a theory of health to go with their theories of capabilities. This paper attempts to present a clarification of the conceptual relation between health and capabilities. Health, (...) it is argued, should be seen as a holistic multi-dimensional phenomenon, made up of basic abilities and subjective well-being, and of fundamental states and processes. Using this theory, the paper shows how health is related to Nussbaum’s ten capabilities. It is argued that health, in the senses described, is a necessary part of all ten capabilities. Moreover, some of the capabilities on Nussbaum’s list, such as thinking and imagining, and practical reasoning, refer to health. Finally, it is shown that even though health is part of all capabilities, health cannot itself primarily be seen as a capability. An acceptable degree of health is required as a functioning for any theory of human flourishing to be reasonable. (shrink)

The purpose of the article is to argue for the significance of a clarified goal of health care for the setting of priorities. Three arguments are explored. First, assessment of needs becomes necessary in so far as the principle of need should guide the priority-setting. The concept of health care need includes a goal component. This component should for rational reasons be identical with the goal of health care. Second, in order to use resources efficiently it is necessary to assess (...) the effects of health care. It is not, however, a question of assessing whether there is an effect but a question of assessing whether there is the right effect. And what constitutes the right effect can only be determined in relation to the goal of the enterprise. Third, the health sector involves several groups of actors such as politicians, administrators, doctors, nurses, physiotherapists, occupational therapists, educationists and patients. It is common knowledge that successful teamwork requires an understanding of a common goal. The article ends with an example of a goal chosen from ethics. (shrink)

Introduction: The concept of ” work ability” is central for many sciences, especially for those related to working life and to rehabilitation. It is one of the important concepts in legislation regulating sickness insurance. How the concept is defined therefore has important normative implications. The concept is, however, often not sufficiently well defined. Aim and Method: The objective of this paper is to clarify, through conceptual analysis, what the concept can and should mean, and to propose a useful definition for (...) scientific and practical work. Results: Several of the defining characteristics found in the literature are critically scrutinized and discussed, namely health, basic standard competence, occupational competence, occupational virtues, and motivation. These characteristics are related to the work tasks and the work environment. One conclusion is that we need two definitions of work ability, one for specific jobs that require special training or education, and one for jobs that most people can manage given a short period of practice. Having work ability, in the first sense, means having the occupational competence, the health required for the competence, and the occupational virtues that are required for managing the work tasks, assuming that the tasks are reasonable and that the work environment is acceptable. In the second sense, having work ability is having the health, the basic standard competence and the relevant occupational virtues required for managing some kind of job, assuming that the work tasks are reasonable and that the work environment is acceptable. Conclusion: These definitions give us tools for understanding and discussing the complex, holistic and dynamic aspects of work ability, and they can lay the foundations for the creation of instruments for evaluating work ability, as well as help formulate strategies for rehabilitation. During the last decade, the populist radical nationalist party, the Sweden Democrats, has gone from being a minor party to become Sweden’s third largest party in parliament. In this article, the author shows how the category of Christianity has come to play a pivotal role in the party’s political identification. Drawing on Ernesto Laclau’s analysis of populism, the author argues that Christianity should be understood as a projection surface for fantasies of an ethnically and culturally superior homogenous nation vis-à-vis constructed (...) national others. In a populist logic, Christianity has thus become a way to distinguish the SD from its articulated external and internal political foes. By appropriating Christianity, the SD articulates itself as the guardian of true Christianity, the future savior of a Church allegedly hijacked by external and internal foes, and in the long run, the Swedish nation. Gold & Stoljar's target article is important because it shows the limitations of neurobiological theories of the mind more powerfully than previous philosophical criticisms, especially those that focus on the subjective nature of experience and those that use considerations from philosophy of language to argue for the holism of the mental. They use less controversial assumptions and clearer arguments, the conclusions of which are applicable to the whole of neuroscience. Their conclusions can be applied to psychiatry to argue that, contrary (...) to many researchers' assumptions, the approaches to both understanding and treating mental disorders must be interdisciplinary. It is an imperative within health care, medicine, and public health to restore, preserve, and enhance health. Therefore, it is important to determine what kinds of enhancement are increases in health and what kinds are not. Taking as its point of departure two conceptions of health, namely, “manifest health” and “fundamental health,” the paper discusses various means used to enhance ability and well-being, and if those means, such as wheelchairs, implants, medicines, stimulants, or narcotics, enhance health. The fact that some (...) means that enhance ability or well-being are not usually considered health enhancing, for example, narcotics, constitutes a problem. The paper ends with a discussion of some suggestions about how to distinguish between those enhancements that are health related and those that are not. One plausible idea holds that an enhancement is health related when the substance, or aid, increases ability or well-being, is integrated into the body, and does not harm the individual’s fundamental health.
