Recent judicial rulings and changes in federal and state legislation have given for-profit corporations a growing list of rights and constitutional protections, including the right to practice religion free from many types of federal or state restriction. In this paper, we highlight the implications of these developments using Rawls’ Theory of Justice to explore the consequences of for-profit corporate religious freedom for consumers and employees. We identify preliminary principles to spark a discussion as to how expanding religious freedom for businesses (...) and fair access to goods and services can coexist in the for-profit marketplace. Using automated systems to avoid the need for human discretion in government contexts – a scenario we call ‘rule by automation’ – can help us achieve the ideal of a free and equal society. Drawing on relational theories of freedom and equality, we explain how rule by automation is a more complete realization of the rule of law and why thinkers in these traditions have strong reasons to support it. Relational theories are based on the absence of human domination and (...) hierarchy, which automation helps us achieve. Nevertheless, there is another understanding of relational theories where what matters is the presence of valuable relationships with those in power. Many investigations of moral decision-making employ hypothetical scenarios in which each participant has to choose between two options. One option is usually deemed “utilitarian” and the other either “non-utilitarian” or “deontological”. Very little has been done to establish the validity of such measures. It is unclear what they measure, let alone how well they do so. In this exploratory study, participants were asked about the reasons for their decisions in six hypothetical scenarios. Various concerns contributed to each decision. Action decisions (...) occurred when utilitarian concerns dominated. Bystanding decisions resulted from different concerns or combinations of concerns dominating in different situations, with utilitarianism usually among participants’ concerns. None of the labels usually used for either decision therefore seems entirely appropriate. Five concerns were identified as necessary and sufficient to predict over 85% of participants’ decisions. This suggests great promise for future research, particularly in investigation of real-world moral decisions. (shrink)

La integración de la tecnología en el ámbito del derecho penal plantea desafíos significativos debido a la falta de regulación de la inteligencia artificial (IA), lo que podría comprometer los derechos fundamentales. Este estudio se centra en abordar estos desafíos y proponer soluciones mediante un análisis exhaustivo de la situación actual y las posibles implicaciones de la IA en el sistema jurídico penal. El objetivo principal de esta investigación es analizar los problemas, desafíos y oportunidades que surgen con la implementación (...) de la inteligencia artificial en el ámbito penal. Se busca identificar la necesidad de una regulación específica para la IA en el derecho penal, con el fin de proteger los derechos fundamentales de las personas y garantizar un sistema jurídico justo y equitativo. Para abordar esta problemática, se adoptó un enfoque metodológico cualitativo. Se llevó a cabo una revisión bibliográfica detallada para examinar los antecedentes, problemas y desafíos asociados con la IA en los sistemas jurídicos, especialmente en el ámbito penal. Además, se realizaron análisis de criterios y opiniones de expertos en derecho para obtener una comprensión más profunda de la situación y las posibles soluciones. Los resultados de este estudio revelan la necesidad urgente de establecer una normativa específica para regular la aplicación de la inteligencia artificial en el ámbito penal. Se destaca que la falta de regulación representa un riesgo significativo para los derechos fundamentales, especialmente en lo que respecta a la configuración de delitos con el apoyo de la IA. Además, se identifican diferentes dimensiones que deben abordarse en la regulación, incluyendo principios y reglas básicas del derecho, supervisión humana de los sistemas de IA y la promoción de la innovación responsable en este campo. Este artículo subraya la importancia de establecer una regulación efectiva para la inteligencia artificial en el ámbito penal. Esta regulación no solo protegerá los derechos fundamentales de las personas, sino que también promoverá un uso responsable y progresivo de la IA como una herramienta valiosa para los profesionales del derecho. Brennan and Jaworski (2018) accuse me of misunderstanding their thesis and failing to produce a counterexample to it. In this Response, I clarify my central argument in “Can’t Buy Me Love,” explain why I used prostitution as an example, and work to advance the debate.

Rational choice models are characterized by the image of the self-interested Homo economicus. The role of moral concerns, which may involve a concern for others' welfare in people's judgments and choices, questions the descriptive validity of such models. Increasing evidence of a role for perceived moral obligation within the expectancy-value-based theory of reasoned action and the theory of planned behavior indicates the importance of moral-normative influences in social behavior. In 2 studies, the influence of moral judgments on attitudes toward food (...) produced with the use of genetic engineering techniques and toward meat consumption is addressed. The reasons participants provide for their moral judgments indicate some foci of their moral concerns. The results of both studies corroborate earlier findings that perceived moral obligation has independent effects on behavioral intentions; they also provide evidence that such judgments may affect attitudes themselves. The results are discussed in relation to the need for attitude-behavior models to reflect the role of moral evaluations in judgment and choice. (shrink)

Mindfulness can benefit athletes’ mindset and performance. These benefits may be enhanced by sport-specific mindfulness interventions. Accordingly, our objectives were 2-fold: first, to develop a rowing-specific mindfulness intervention, and second, to investigate its effects on mindfulness, flow, reinvestment, and rowing performance. Rowers were randomly assigned to either a 6-week rowing-specific mindfulness intervention, which included generic and rowing-specific practices, or a control group. Rowers completed pre-test and post-test measures of performance, mindfulness, flow, and rowing-specific reinvestment. Lastly, rowers completed an evaluation form (...) following the intervention. The results demonstrated that the intervention group increased flow, mindfulness, and improved performance, additionally conscious motor processing decreased from pre-test to post-test. However, the intervention did not preferentially change mindfulness or reinvestment compared to control. Participants provided favorable feedback and evaluated the intervention positively. Our 6-week rowing-specific mindfulness intervention promoted flow, encouraged mindfulness, and aided performance. Thus, we provide preliminary explorative evidence that a sport-specific mindfulness intervention can benefit athletes. We recommend that future research, with large sample sizes and improved home practice, should examine mediators and moderators of the mindfulness-performance relationship. (shrink)

An animal confronts numerous challenges when constructing an optimal navigational route. Spatial representations used for path optimization are likely constrained by critical environmental factors that dictate which neural systems control navigation. Multiple coding schemes depend upon their ecological relevance for a particular species, particularly when dealing with the third, or vertical, dimension of space.

In lieu of an abstract, here is a brief excerpt of the content:Homeric Echoes in RhesusRobin Sparks BondWhen we think of Rhesus—if we do at all—we think of a play so structurally awkward, so dramatically unsatisfying, so inferior that it could not possibly be from the hand of Euripides.1 Our knowledge of the story's source—a selfcontained Iliadic episode (attractive for dramatic adaptation)—causes us to question the author's reasons for introducing new elements, such as Hector's contentious exchanges with the characters (...) around him and his apparent weakness as a leader. Our greatest difficulties with the play probably result from its episodic nature: first Dolon, then Rhesus, then Odysseus and Diomedes claim their time on the stage. So many seemingly discrete encounters detract from, or may even draw attention to the lack of, any sustained dramatic tension and most likely account for a second problematic feature—the absence of a clearly central hero. While Hector comes closest to filling this role, he fails to meet our expectations for a tragic hero of Athenian drama. His unchanging view of the circumstances around him and complete ignorance of what has happened, even at the end, leave us simply puzzled as to the author's interest or intent in putting these events on the stage.Albin Lesky has remarked on the play's "lifeless" quality: "no problems loom concerning the meaning of [the characters'] fate, nor are they convincing as human beings," 201. Other plays vaguely similar in structure or subject matter illuminate specific problems. Ajax, another drama in which a hero's death is the climax of the action, requires its characters to explore their predicament, to look forward to and then to confront the ramifications of a single deed. Oedipus Tyrannus, which [End Page 255] hardly falls short of Rhesus in the number of characters who take part in the unraveling process, is a highly effective example of a play in which the introduction of each character results in some type of forward movement in a progressive series of motivating questions (Who killed King Laius? Who was the robber? Who is Oedipus?). The process here is even more successful because of the surprising nature of the reversals which the various characters introduce. For instance, as Aristotle points out, "the man who comes to bring delight to Oedipus, and to rid him of his terror about his mother, does the opposite by revealing who Oedipus is."2 In effect, the initial (and all subsequent) reasons for the action and the development from one scene to the next are integrally linked. All this is, of course, well known. What we have not been so quick to perceive is its opposite, how Rhesus creates movement without necessity, and activity without realized implications, while its characters appear simply to act out a piece of epic oblivious to the real consequences of the events unfolding around them.If then Rhesus does not invite its audience to sympathize with the conscious suffering of its principal characters, we ought at least to feel compassion for the future hardship to which the play's ending points. It is not clear whether the audience is expected to know of the oracle about Rhesus, that if he should drink the water of the Scamander river he will become invincible.3 However, the outcome of the Trojan War is obvious, and Hector's enthusiasm for victory, which is constant throughout the play, seems to increase our awareness of his own inevitable doom. In fact, the play only concerns itself with enhancing the audience's anticipation of what they already know is going to happen, a quality which must result from the drama's adaptation of a Homeric source and which perhaps signals the author's interest in more than simply taking his plot from epic. Analysis of the nature of this anticipation and of Rhesus' reliance upon other Iliadic features reveals a guiding rationale behind much of its apparent quirkiness.The relationship between Rhesus and Iliad 10 has been explored by Bernard Fenik, who was primarily interested in explaining problems and [End Page 256] ambiguities in the Doloneia.4 He suggested that the play is based on a non-Iliadic version of the Rhesus story and... This essay proposes an approach to understanding changes in political responses to crime in England and Wales over the last third of the twentieth century and developments in criminological knowledge over the same period. To explore the association between these in some empirical detail, we argue, would provide a historical?sociological understanding that is currently lacking, notwithstanding Garland's significant intervention in The Culture of Control. We take issue with some aspects of Garland's account, on both methodological and substantive grounds, and delineate (...) certain distinctions between his ?history of the present? and the historically situated hermeneutics that we favour. The latter, we suggest, can be more attentive to particular political and intellectual struggles that have had a formative bearing on the current field and, as such, offer new perspectives on the position of crime and punishment in contemporary political culture. The expression 'the criminal question' does not at present have much currency in English-language criminology. The term was carried across from Italian debates about the orientation of criminology, and in particular debates about what came to be called critical criminology. One definition offered early in the debate described it as 'an area constituted by actions, institutions, policies and discourses whose boundaries shift'. According to this writer, crime, and the cultural and symbolic significance carried by law and criminal justice, is an (...) integral aspect of the criminal question. 'The criminal question' draws attention to the specific location and constitution of a given field of forces, and the themes, issues, dilemmas and debates that compose it. At the same time it enables connections to be made between these embedded realities and the wider, conceivably global, contours of influence and flows of power with which it connects. This in turn raises many questions. How far do the responses to crime and punishment internationally flow from and owe their contemporary shape to the cultural and economic transformations now widely known as 'globalisation'? How can something that is in significant ways embedded, situated, and locally produced also travel? What is not in doubt is that it does travel - and travel with serious consequences. The international circulation of discourses and practices has become a pressing issue for scholars who try to understand their operation in their own particular cultural contexts. This collection of essays seeks a constructive comparative view of these tendencies to convergence and divergence. (shrink)

Tentaremos analisar o riso burlesco, erótico e satírico da obra de Petrônio, característico da sátira menipéia e do conto milesiano, como nos atesta Enylton Sá Rego na obra O calundu e a panacéia:Machado de Assis, a sátira Menipéia e a tradição luciânica ( 1989) e, também, Ettore Paratore no livro História da literatura latina (1987). A incursão do riso no Satiricon segue um caminho erótico e libertino e, para embasar teoricamente essa questão, buscamos o estudo do filósofo francês Michel Foucalt (...) com sua História da Sexualidade3: o cuidado de si ( 1988) e de do historiador Paul Veyne em seu artigo o Império Romano Nosso objetivo é confrontar passagens significativas de Brás Cubas com passagens semelhantes do Satiricon, sob a perspectiva, ou seja, através da visão do narrador-personagem. Por meio do sério-cômico e do distanciamento do estilo sátira menipéia, mostraremos que mesmo destituídas de intenções moralizantes de forma direta, ambas as obras fazem uma crítica ao comportamento da sociedade. Por fim, ao tratar o riso de Petrônio e Machado como uma forma de crítica social velada, tentarei mostrar que a obra inserida na categoria de sátira menipeia não precisa satisfazer necessariamente um caráter prosimétrico, ou seja, ser uma mistura de prosa e verso - já que, dessa forma, Memórias Póstumas estaria totalmente fora do estilo - mas, sim, estar dentro de um viés cômico-crítico em relação a sociedade de sua época. En la primera sección, mencionaré los principales aportes que, en mi perspectiva, el dialeteísmo ha hecho a la lógica filosófica. En la segunda sección, analizaré el principal problema del dialeteísmo. En la tercera sección, mostraré que los argumentos a favor del dialeteísmo no llegan a establecer la verdad de esta posición. Finalmente, explicaré cuál es el tipo de paraconsistencia que considero adecuada y la (...) compararé con la posición dialeteísta. Dialetheism is the position which claims that there are true contradictions. This paper deals with this position. In the first section, I will mention the main contributions that, in my perspective, dialetheism has made to philosophical logic. In the second section, I will analyze the main problem of dialetheism. In the third section, I will show that the arguments in favor of dialetheism are not conclusive. Este artículo tiene un doble objetivo: describir y analizar los aprendizajes de las cuestiones socialmente vivas con medios digitales y recursos multimediales; y caracterizar las potencialidades de estos medios en las clases de Ciencias Sociales a partir de la educación remota de emergencia. Estas transformaciones trajeron mutaciones en el oficio de ser estudiante. Desde la perspectiva instrumental identificamos aprendizajes vinculados con: la administración del tiempo personal, la organización de los recursos multimediales y las nuevas demandas de aprendizaje. Por su parte, (...) desde la perspectiva social los/as estudiantes de formación docente reconocen aprendizajes referidos a estas nuevas formas de participación en los medios digitales, vinculadas con: el uso de las redes sociales para las tareas de aprendizaje, la búsqueda, selección y lectura colaborativa de fuentes y documentos y el cuidado en internet. Y desde la perspectiva psíquica, se identifica un malestar asociado a la incertidumbre vinculada con los nuevos regímenes de cursada y acreditación. Across languages, we find epistemic indefinites, i.e. existential determiners that can convey information about the speaker’s epistemic state.1 One such indefinite is Spanish alg´un, which marks ignorance on the part of the speaker. By using alg´un in (1a) the speaker signals that he is unable (or unwilling) to identify the doctor that Mar´ıa married. Hence, it would be odd for him to add a namely continuation that explicitly identifies the doctor in question, as in (1b). In this paper, dimensions of the debate surrounding the application of gene technology to food production are discussed and a study assessing perceptions of the technology among a sample of the UK public (n = 1499) is reported. The general picture that emerges from the study is one of people expressing low familiarity with the technology, with more people associating it with high risks than with low risks, and more people expecting it to provide low benefits than high benefits. Attitudes (...) towards different applications vary significantly, as does trust in different potential sources of information about the technology. It is also shown that attitudes can be predicted not only by estimates of risks and benefits but also by perceptions of the involvement of ethical issues, by the perceived need for the technology, and by the perceived likelihood of improvements it is likely to bring to the quality of life in the UK. The results are discussed in the context of the need for greater public information about the technology and the realization that communication of risks takes place within a complex network of societal relationships. It is a common assumption that medical institutions may permissibly use the force of law to seek remuneration for costs incurred in medical intervention done without patient consent. In this paper, we challenge that assumption. Specifically, we claim that: Generally, when patients who lack capacity are given medical treatment without their consent, those practitioners who treated them are wrong to use legal mechanisms to secure remuneration for that treatment.

A graduate student–led initiative organized by Paula Barba Guerrero (University of Salamanca), the seminar comprised six sessions that took place in spring 2023. The series opened with a keynote by Miriam Borham Puyal (University of Salamanca), followed by five more panels throughout the semester. Open to the public and organized in a hybrid format, the event positioned itself as a welcoming, non-commodified space for the exchange of ideas. To that end, the shared philosophy of the speakers was usually to deliver accessible talks, written not exclusively for established researchers and early career researchers (ECRs), but also catering to graduate and undergraduate populations. Questions ranged, therefore, from the most specialized to the most general—though questions such as "What is SF?" or "What is Utopia?" that might sound "basic" are not taken as such, and these led to the most intensive conversations among the diverse audience. [End Page 299]In the keynote lecture, titled "From Shelley to Braidotti: Posthuman Maternity in Netflix's I Am Mother," Borham Puyal traced a feminist genealogy of the streaming platform's latest speculative thriller by connecting it to Mary Shelley's Frankenstein (1818). Puyal's talk occurred on International Women's Day and, in keeping with the overall seminar subtitle, "Gendered Geographies across Time," the speaker explored such topics as gendered corporealities, vulnerable bodies, and reproductive justice in a technological world. Through the lens of Rosi Braidotti's notion of posthumanism, Puyal investigated I Am Mother's (2019) alternative modes of maternity, belonging, and relationality; the speaker also reflected on the potential of speculative fiction and media to question and to imagine alternatives futures in response to our less-than-perfect present. Puyal's talk sparked a vibrant debate regarding precarity, surrogacy, and the fight for legal control over women and trans* people's bodies. Established professors, ECRs and undergraduate students alike debated the meanings of feminist speculation and posthumanism, particularly the nature of posthuman bodies. The audience responded enthusiastically to the nonhierarchical format of the discussion, which established the seminar—with five events yet to come—as a venue welcoming to everyone, regardless of their academic status or their familiarity with science and speculative fiction.The themes of posthuman perspectives and corporealities reappeared in "Beyond the Human: Posthuman and Ecocritical Perspectives," a panel taking place the following week. Lidia María Cuadrado Payeras (University of Salamanca), and Ana Tejero Marín (University of Salamanca) discussed a set of North American speculative novels that bring together the environmental humanities and posthumanist philosophy, transitioning from the topics of the opening keynote into those of the first thematic cluster. Cuadrado Payeras opened with a methodological discussion on genre and form, drawing from the works of both Braidotti and Margaret Atwood to argue for a queer approach to science fiction, fantasy, and speculative fiction, positioning these categories as porous rather than rigid and separate. Then, Cuadrado Payeras turned to contemporary Canadian authors to explore the nature/technology dyad and its relation to posthumanism. Moving the conversation toward the environmental humanities and the role of capitalism in the current climate crisis, Tejero Marín's talk addressed themes of worldbuilding, ecofeminism, and the Anthropocene in US-American science fiction. Afterward, she analyzed gendered conceptions of the earth and the nonhuman in N. K. Jemisin's Broken Earth trilogy (2015–17), focusing on how the vengeful [End Page 300] Father Earth of Jemisin's work subverts traditional associations between femininity and nature. The first panel ended with a lively discussion, during which both speakers had the opportunity to discuss the necessity of understanding the environmental humanities and posthumanism in dialogue with one another, and the necessity of emphasizing the potential of contemporary stories to help us rethink our relationship... A hipótese do artigo é que o dilema da constituição da representação política, que não tem por função refletir, mas interferir e operar uma unidade de “vontade política” a um povo ou uma nação, foi enfrentado pelos primeiros pensadores da representação moderna em diferentes contextos de grande transformação política e social: na Inglaterra absolutista no século XVII, por Thomas Hobbes, e na França pós-revolucionaria no século XVIII, pelo Abade Sieyès. O artigo procura identificar nos argumentos dos respectivos filósofos os primeiros (...) esforços teóricos sobre a representação moderna, através de uma comparação que evidencia dilemas e constrangimentos semelhantes em diferentes contextos teóricos. Um dos principais desafios da representação política, nos dois autores, permanece sendo a busca dos mecanismos capazes de transformar vontades dispersas e múltiplas de indivíduos numa só vontade unificada do corpo social. Embora os argumentos de legitimidade possam variar, para ambos os autores, a “vontade” do representante político é produto de uma elaboração conceitual e de uma produção racional que se dá com a constituição de um corpo, que no caso de Hobbes se dá com a criação do Estado, e em Sieyès com a representação nacional. En este artículo se presenta un abordaje general de la teoría de la justicia social de John Rawls. Revisamos algunas críticas desde diversos frentes teóricos. Consideramos que la justicia social permite enjuiciar las consecuencias regresivas para la humanidad del capitalismo en su fase neoliberal y comenzar a imaginar otros mundos posibles.

Weak determiners have both a presuppositional and a non presuppositional reading. Two ways of accounting for this fact have been proposed. The Ambiguity Approach (Partee 1989, Diesing 1992, de Hoop 1992) posits that weak determiners are ambiguous. The Pragmatic Approach (Büring 1996) claims that we do not need to postulate an ambiguity in the semantics: the presuppositional reading arises as a result of presuppositions triggered by topic/focus marking. In this paper we explore the possibility that both theories are needed. We (...) present as evidence the behavior of two Spanish weak determiners, unos and algunos. Algunos can get a presuppositional reading independently of topic/focus marking, as predicted by the Ambiguity Approach. Unos, on the other hand, exhibits the behavior predicted by the Pragmatic Approach: it is presuppositional only when marked either as contrastive topic or as focus. (shrink)
