Background The ideal basis of age estimation is considered to be a combination of clinical, skeletal and dental examinations. It is not easy to determine how forensic physicians take account of evidence-based data obtained from medical journals in their medical decision-making. The question of what is an ethically acceptable probability that adolescents are incorrectly considered to be over 18 has not been answered. Methods In a retrospective study over 1 year (2007), 498 files (for 141 female subjects and 357 male (...) subjects) regarding age assessment requested by the public prosecutor's office for purposes of criminal or asylum proceedings were reviewed. Chronological age was estimated from a combination of physical examination, radiographic examination of the left hand and determination of dental status. Results Estimates of chronological age in 498 subjects claiming to be 9–14 years old were incompatible with the alleged age in 356 (71%) when made by the forensic physician but in only 17 (3%) when based on data from published studies on age estimation in adolescents. Conclusions The present study suggests that in most cases the forensic physician ignores the adolescent's word. Medical mission and ethics imply a need to listen to the claims of persons in custody, whatever the risk of false claims. This situation should prompt forensic physicians to keep up with published data on estimating the age of adolescents. (shrink)

In this paper, I seek to present the range of issues involved in the efforts of sixteenth‐century kabbalists to understand the nature of selfhood, and the paths prescribed for the formation of an ideal life. I reflect on the mystical writings of Moshe Cordovero, Eliyahu de Vidas, andayyim Vital—probing their conceptions of core identity, the polarity between body and soul, and the ethical guidance for a life well lived. In so doing, I consider the following additional themes, and their relation (...) to the matrix of self‐formation and religious identity: reincarnation and rebirth; the virtue of humility and self‐effacement; the cultivation of wisdom; ideals of piety and prophetic experience; asceticism; and the spiritual transcendence of desire. In presenting this wide range of constituent themes, I argue that sixteenth‐century kabbalists understood the soul to be the ultimate marker of personal identity (nuanced and complicated by the doctrine of reincarnation), and that they formulated a vision of an ideal ethics in which the human being functions as an earthly vessel for the divine presence. What is more, the preparation of that vessel required a degree of humility so extreme that the attainment of ideal personhood ultimately involved the effacement of that very identity. (shrink)

In A.D. 60 Nero instituted at Rome a quinquennale certamen which he called Neronia. It was in three sections—athletics, chariot-racing, and music —after a Greek model. This model would be that of the Pythian rather than of the Olympic Games, for at the latter there was no regular musical contest; though perhaps Nero got his immediate inspiration from the Augustalia at Naples, which was an athletic and musical festival of a religious nature.

In the Panathenaic Games, there was a torch race for teams of ephebes that started from the altars of Eros and Prometheus at Plato’s Academy and finished on the Acropolis at the altar of Athena, goddess of wisdom. It was competitive, yes, but it was also sacred, aimed at a noble goal. To win, you needed to cooperate with your teammates and keep the delicate flame alive as you ran up the hill. Likewise, Plato’s philosophy combines competition and cooperation in (...) pursuit of the goal of wisdom. On one level, agonism in Plato is explicit: he taught in a gymnasium and featured gymnastic training in his educational theory. On another level, it is mimetic: Socratic dialogue resembles intellectual wrestling. On a third level, it is metaphorical: the athlete’s struggle illustrates the struggle to be morally good. And at its highest level, it is divine: the human soul is a chariot that races toward heaven. This volume explores agonism in Plato on all of these levels, inviting the reader—as Plato does—to engage in the megas agōn of life. ' These are perhaps Kant's most well-known and oft-repeated words. They reflect not only the profound feeling (...) that underlies his technical and abstruse treatises, but also his characteristic preoccupation with law. The "starry heavens" are a synecdoche both for the wonder of nature as we perceive it in all its multiplicity, and for the marvel of science's ability to reduce, order, and subdue that infinite multiplicity into a few elegant laws. These two types of law, natural and moral, define the focus of Kant's critical philosophy, and metaphors drawn from jurisprudence pervade all three critiques. In the context of controversial statements on the role of metaphor in philosophical texts by Jacques Derrida, Paul Ricoeur, and Richard Rorty, I will analyze the legal metaphors in the prefaces and Transcendental Deductions of the Critique ofPure Reason. My goal in engaging Kant's texts in this controversy over metaphor is twofold: on the one hand to assess experimentally the value of these positions on metaphor in the history of philosophy, and, on the other hand, to examine the relations between critical conceptualization and insurgent metaphoricity in Kant's carefully elaborated and systematized text. In a textwhose key words are "universal and necessary for all possible experience," contingentand ambiguous metaphors might be expected to cause problematic unravelings. Richard Rorty has argued recently that "the history ofscience, culture and politics" should be viewed "as a history of metaphor rather than of discovery." 2 He compares the creations of new vocabularies to the 245 246Philosophy and Literature invention of "new tools" ("CL," p. 5), alluding to "Nietzsche's definition of truth as a mobile army of metaphors" (p. 6). From Plato's figures of the world as cave and the mind as charioteer with unruly horses, we shift to Locke's view of mind as tahda rasa and Descartes's description of the world as a machine. Rorty's paradigm of cultural history as a history of metaphor enters into an earlier, unresolved debate between Jacques Derrida and Paul Ricoeur over the relationship between metaphor and philosophical discourse. Like Derrida, Rorty follows Nietzsche's claims about metaphor in the history of philosophy, a view Ricoeur wants to disprove so that he can recover the privileged univocity of speculative discourse. However Rorty has nothing in common with die complexity and "invaginated" ambiguities, the dazzling multivocity of Derrida's writing on the economics of metaphor. Although Rorty appears at first to agree with Derrida that there is no truth or reality apart from the linguistic tropes which dominate different epochs and cultures, he retains a metaphysical distinction between literal reference and figurative play. Rorty adopts Donald Davidson's theory that metaphors do not have "meaning" precisely because diey have no place in the language game into which they are inserted. They produce an effect, but it is not meaning: "One can only savour it or spit it out"; it is not a " 'truth-value candidate' " ("CL," p. 6). However, through repeated use, the metaphor will find a role in the language game; dying as a metaphor, it will live as a literal statement. Therefore Rorty agrees with Ricoeur that a moribund metaphor is no longer a metaphor, but a literally functioning segment of discourse. Thus despite his initial move toward a Derridean, or atleast Nietzschean, position, Rorty ultimately takes a stand consonant with Ricoeur's desire to rescue speculative discourse from the unruliness of metaphor. Considering Rorty's celebration of Freud in an article on "The Contingency of Selfhood," 3 his failure to consider the role of unconscious associations and overdetermination in the writing and reading of texts is surprising. Dead or alive, a metaphor brings with it a host ofpersonal and public, conscious and unconscious, new and traditional associations that become juxtaposed against a similar number of associations connected with the signifying chain into which the metaphor has been inserted. In his dialogue the Phaedrus, Plato compared the rational part of the soul to a charioteer who must control his steeds, which correspond to the emotional parts of the soul (Plato 1961, p. 499). Touching on primary texts, personalities, theologies, (...) histories, and practices Subverting Hatred is a sampling of the rich religious resources for nonviolence. The eight primary chapters cover Jainism, Buddhism, Confucianism and Daoism, Hinduism, indigenous traditions, Islam, Judaism, and Christianity. There is a summary epilogue and each chapter has a bibliography. Subverting Hatred [End Page 292] ought to be read in religious study groups as well as in academic settings for the study of religion.Editor Daniel Smith-Christopher teaches theological studies and directs the Peace Studies program at Loyola Marymount University in Los Angeles; he is also the author of The Religion of the Landless. In the introduction, Smith-Christopher sets out the intent of this collection. First, in the face of clear evidence that religious traditions "can be manipulated and used to justify all kinds of violence," it is vital to argue that religions are not inevitably "divisive and destructive" (p. 9). Second, the book presents the positive claim that it is "precisely the call to nonviolence that embodies one of the noblest values and sacred obligations of religion" (p. 10). Here, nonviolence means active peacemaking rather than merely refusal to engage in violence.It was exciting to see a chapter devoted to Jainism, and have it be the first of the book. The author, Christopher Chapple, is professor of theological studies and director of Asian and Pacific Studies at Loyola Marymount University; among his publications is Nonviolence to Animals, Earth, and Self in Asian Traditions. Rooted in the deep strand of nonviolence it shares with Hinduism and Buddhism, Jainism powerfully advocates nonviolence. The earliest records of the religious impulse in the Indus Valley are also the earliest images most associated with nonviolence in these religious traditions. These cylinder seal impressions of figures seated in the yoga position surrounded by plants and animals can still evoke a sense of a calm and peace. Thus, in Indian traditions the connection of nonviolence to meditative practices is inseparable.Jainism has arguably made nonviolence a central teaching for all adherents to a greater extent than other traditions. The earliest text of the Jain tradition, the Acaranga Sutra (fourth or fifth century B.C.E.) makes this clear: "'All breathing, existing, living, sentient creatures should not be slain, nor treated with violence, nor abused, nor tormented, nor driven away. This is the pure, unchangeable, eternal law." As the Vedic tradition developed, it produced contrasts to the tradition of yogic nonviolence shared with Jainism. And I tremble as he approaches, just as an aged, yoke-carrying horse that has carried off victory unwillingly walks into contest with swift chariots. (Ibycus, frag. 287)1 The resurgence of love in his old age prompts a fearful reflection in the aged (...) Ibycus. Love sets a trap he must escape, but cannot for all its infinitude, just as an athlete’s prior victories never sate his love of competition. Ibycus discovers the paradox of his situation, that the satisfaction sought is immeasurably greater than what a finite victory could ever provide. The competition of rival lovers for the beautiful beloved appears to Ibycus to be an immediate contrivance for an ineluctably distant object. Ibycus thus learns that love is human finitude’s attempt to answer the question that it itself raises. And yet, despite his fear, Ibycus’ reflection seems more comic than tragic, for his bestial image of love’s effects subverts all pretense to participation in the divinity of Aphrodite. The thought that the ultimate object of love’s longing is spurious may engender fear, but fear, in giving us an acute sense of our mortal limits, has the potential to take us outside ourselves and so prepare us for laughter. For reasons this tattered remnant of Ibycus’ poem doesn’t give us, the apparent tragedy of love—of the simultaneous necessity of pursuing the beloved and impossibility of complete satisfaction—appears resolved by our very awareness of it.2 Thankfully, Ibycus’ vision of love as both tragic and comic has a striking corollary in the films of Buster Keaton, who arion 26.3 winter 2019 mirrors the tension between yoked racehorse and reflective poet in the determined striving of his protagonists and the reflective depth of his directing. As both actor and director, Keaton is both striving body and disembodied thought, both trapped in finitude and reflecting thereupon. Ibycus and Keaton may bear love’s yoke, but they know the yoke’s on them. Keaton’s films thus promise some glimpse into the possibility of a comic redemption to the tragedy of lover and beloved, so much so that it seems one can connect these tatters of papyrus using celluloid film. Can the finite, particular beloved ever satisfy the lover, who strives to escape the limits of finitude? Or must we resign ourselves to our own transience? Keaton explores these questions by crafting comedies around characters who so strive. These characters—strikingly similar in their circumstances and ambitions, yet with slight but essential differences in disposition—offer Keaton a way to look for who bears easiest the weight of love’s yoke. I’ve chosen four films—Cops, College, The Playhouse, and The General—that, when ordered thus, bring us gradually from unavoidable tragedy to the unwitting self-redemption that comes when we laugh at ourselves. Discussing each in turn, I hope to offer some glimpse into what Ibycus may have had in mind when he playfully cast man’s most distinctive and serious striving as a yoked horse. CO P S (1922) the burden of love’s yoke is nowhere clearer in Keaton’s films than in Cops, as the film’s ominous epigraph warns: “Love laughs at locksmiths.” Keaton the director elegantly and humorously frames Keaton’s character as among love’s prisoners. The first shot features him behind bars, gripping them from within what appears to be a jail cell, as he and his love interest carry on a discussion with forlorn looks on their faces. Because the camera is on her side of the bars, we are invited to imagine ourselves free from Keaton’s predicament. She bids him farewell, and as she walks away Keaton the 116 keaton’s yoke director cuts to the other side of the bars and at a greater distance from the action. Pp. xxi, 177· US$19.95; paper $9·95· B rian Hendley's book is more than a well-written account of three eminent philosophers who wrote about and participated in educational theory and (...) reform. The author has in fact selected Dewey, Russell and Whitehead as three stallions to draw a chariot. The precise nature of this "chariot" is indicated in the chapter entitled "The Philosopher as Educator Today" appearing at the end of the book: My intention throughout has been to suggest a way out of the current impasse in the philosophy ofeducation by reopening a conversation regarding a more productive role for philosophers to play, rather than merely analyzing concepts and policing arguments. My claim has been that philosophers of education can learn from their past, that we can see in Dewey, Russell and Whitehead instances of a productive approach to educational problems through thought and action. (P. 105) Having said this, the structure and contents of Hendley's book fall squarely into place. Chapter One, entitled "The Reconstruction of the Philosophy of Education", argues that there is a crisis in the current state of educational philosophy. The ensuing three chapters are devoted individually to Dewey, Russell and Whitehead. The concluding chapter, resting upon the strength of the examples given of three constructive contributors to the field, suggests new directions for the philosophy of education. It is clear that Hendley's book is more than an interesting account of the practical and theoretical educational activities of three of the most influential philosophers of the twentieth century. Dewey, Russell and Whitehead are not gathered together between the. same covers in order to explore or present a detailed analysis of their theoretical similarities or who may have influenced Reviews 219 whom. Instead, one gathers that the author has selected them on the basis of his own admiration and preference rather than for any shared theories which connect them. The point is made, however, that the strongest common element, and the most significant one, is that each man had ideas about education, each was a philosopher, and each attempted to exert some practical influence upon the educational institutions and practices of the day. In short, Dewey, Russell and Whitehead were theorists who were prepared to get their hands dirty. Hendley argues that after the death of John Dewey in 1952 educational philosophy was neglected and· philosophers tended to pay less attention to education. The author goes on to suggest some renewed interest in the field on the grounds of contributions made to the fifty-fourth Yearbook of the National Society for the Study of Education in 1955 under the theme "Modern Philosophies and Education", a special issue of the Harvard Education Review published in 1956; the publication of Israel Scheffler's edited collection of readings entitled Philosophy and Education in 1958; and R. S. Peters' Inaugural Address given at London in 1963, and his publication of Ethics and Education in 1966. According to this argument, we witness a general lapse after the death of Dewey, a rekindling in the mid-1950S and a broader resurgence in the 1960s. On the basis of the author's own account, I think that it is very difficult to argue that Dewey's death initiated any period of calm or disinterestedness. Furthermore, it is very problematic to point to various yearbooks or publications as indicators. The point is that with the death of Dewey there were numerous contenders to fill his position as the pre-eminent American philosopher of education. The extent to which anyone has been able to do so is a different matter. What I believe Hendley is really trying to say here is implicit in his argument, namely, that after the death of Dewey, no philosopher of equal stature took his place. We analyse the extent of possible computations following Hogarth ([2004]) conducted in Malament–Hogarth (MH) spacetimes, and Etesi and Németi ([2002]) in the special subclass containing rotating Kerr black holes. Hogarth ([1994]) had shown that any arithmetic statement could be resolved in a suitable MH spacetime. Etesi and Németi ([2002]) had shown that some relations on natural numbers that are neither universal nor co-universal, can be decided in Kerr spacetimes, and had asked specifically as to the extent of computational limits there. The purpose of this note is to address this question, and further show that MH spacetimes can compute far beyond the arithmetic: effectively Borel statements (so hyperarithmetic in second-order number theory, or the structure of analysis) can likewise be resolved: Theorem A. OBJECTIVE: To examine the long-term effects of an innovative curriculum on medical house officers' (HOs') knowledge, confidence, and attitudes regarding medical ethics. DESIGN: Long term cohort study. The two-year curriculum, implemented by a single physician ethicist with assistance from other faculty, was fully integrated into the programme. It consisted of monthly sessions: ethics morning report alternating with didactic conferences. The content included topics such as ethics vocabulary and principles, withdrawing life support, informed consent, and justice. Identical content was offered simultaneously (...) at the largest affiliated community hospital. SETTING: A multi-hospital university training programme from July, 1992 to June, 1994. PARTICIPANTS: Thirty-nine HOs responded in 92. Thirty HOs from the same cohort responded in 94 (response rates = 83% v 71%; P = 0.19). RESULTS: The curriculum was well received, with 96% of HOs finding the sessions stimulating. Previously validated scales of knowledge and confidence were administered at baseline and at follow-up. The average knowledge score improved 14% (P < 0.001). Confidence also improved, rising from 3.3 to 3.8 on a 5-point Likert scale (P < 0.001). These findings were independent of age, gender, religion, and prior education. The only attitudinal change was an increase in the proportion of residents who thought that ethics should be a required part of residency training (57% v 80%, P = 0.05). CONCLUSION: This curriculum appears practical, popular, and effective. It should be readily transferable to other institutions. (shrink)

We show how in the hierarchies${F_\alpha }$of Fieldian truth sets, and Herzberger’s${H_\alpha }$revision sequence starting from any hypothesis for${F_0}$ that essentially each${H_\alpha }$ carries within it a history of the whole prior revision process.As applications we provide a precise representation for, and a calculation of the length of, possiblepath independent determinateness hierarchiesof Field’s construction with a binary conditional operator. We demonstrate the existence of generalized liar sentences, that can be considered as diagonalizing past the determinateness hierarchies definable in Field’s recent (...) models. The ‘defectiveness’ of such diagonal sentences necessarily cannot be classified by any of the determinateness predicates of the model. They are ‘ineffable liars’. We may consider them a response to the claim of Field that ‘the conditional can be used to show that the theory is not subject to “revenge problems”.’. (shrink)

Reflection Principles are commonly thought to produce only strong axioms of infinity consistent with V = L. It would be desirable to have some notion of strong reflection to remedy this, and we have proposed Global Reflection Principles based on a somewhat Cantorian view of the universe. Such principles justify the kind of cardinals needed for, inter alia , Woodin’s Ω-Logic.

We represent truth sets for a variety of the well known semantic theories of truth as those sets consisting of all sentences for which a player has a winning strategy in an infinite two person game. The classifications of the games considered here are simple, those over the natural model of arithmetic being all within the arithmetical class of $\Sum_{3}^{0}$.

We consider various concepts associated with the revision theory of truth of Gupta and Belnap. We categorize the notions definable using their theory of circular definitions as those notions universally definable over the next stable set. We give a simplified account of varied revision sequences-as a generalised algorithmic theory of truth. This enables something of a unification with the Kripkean theory of truth using supervaluation schemes.

We look at various notions of a class of definability operations that generalise inductive operations, and are characterised as “revision operations”. More particularly we: (i) characterise the revision theoretically definable subsets of a countable acceptable structure; (ii) show that the categorical truth set of Belnap and Gupta’s theory of truth over arithmetic using \emph{fully varied revision} sequences yields a complete \Pi13 set of integers; (iii) the set of \emph{stably categorical} sentences using their revision operator ψ is similarly \Pi13 and which (...) is complete in Gödel’s universe of constructible sets L; (iv) give an alternative account of a theory of truth—realistic variance that simplifies full variance, whilst at the same time arriving at Kripkean fixed points. The figure of Peter the Tomb, various aspects of his life and activity, as well as the era called by his name, have long been the subject of study by numerous scholars, comprehensive and meticulous research. It is enough to mention the works of M.Grushevsky, A.Zhukovsky, V.Klimov, A.Kolodny, V.Nichik, O.Sarapin, L.Filipovich and V.Shevchenko, in which the phenomenon of the metropolitan, his spiritual and religious dominant, is thoroughly and thoroughly explained, the influence of P. Mogila's heritage on the past and present. (...) And yet it is impossible to talk about the exhaustiveness of this topic, because such inexhaustibility is dictated by the very universe of its multidimensional activity. This is what determines the relevance of the proposed article. And this, in turn, gives rise to reflections on the need for scientific innovative understanding of religious philosophy as a constant basis of thinking of Petro Mohyla, which, in particular, was reflected in his "Notebook", which is still a little-studied phenomenon of Ukrainian spiritual culture, for the first time it saw the world only in 1995, more than 60 years after its invention by M. Grushevsky. This work, like all narratives on the spiritual and religious themes that make up it, is an integral part of the metropolitan's religious and philosophical heritage. (shrink)

Evolutionary fitness threats and rewards are associated with subjectively unpleasant and pleasant sensations, respectively. Initially, these correlations appear explainable via adaptation by natural selection. But here I analyse the major metaphysical perspectives on consciousness – physicalism, dualism, and panpsychism – and conclude that none help to understand the adaptive-seeming correlations via adaptation. I also argue that a recently proposed explanation, the phenomenal powers view, has major problems that mean it cannot explain the adaptive-seeming correlations via adaptation either. So the mystery (...) – call it the evolutionary paradox of consciousness – remains. Some have used this mystery to argue for non-naturalistic (e.g. theistic) explanations. But I propose a naturalistic, non-adaptive explanation of the adaptive-seeming correlations: namely, ‘sensational associative learning’ during development. In this perspective, pairing of particular sensations with unconditioned stimuli – fitness rewards or threats – cause the sensations themselves to come to be interpreted as good or bad, respectively. Sensations, like colours, that are not reliably paired with either fitness rewards or threats remain largely unvalenced. Sensational associative learning also provides explanations for adaptive-seeming structural aspects of sensations, such as the observation that sounds of different pitch are experienced as ordinal in correspondence to their wavelengths while the same is not true of colours of different hue. The sensational associative learning perspective appears compatible with physicalism, panpsychism, and dualism (though not epiphenomenalism). (shrink)

Do the ethical features of an artwork bear on its aesthetic value? This movie endorses misogyny, that song is a civil rights anthem, the clay constituting this statue was extracted with underpaid labor—are facts like these the proper bases for aesthetic evaluation? I argue that this debate has suffered from a false presupposition: that if the answer is “yes” (for at least some such ethical features), such considerations feature as pro tanto contributions to an artwork’s overall aesthetic value, i.e., as (...) merits or flaws which make something have more or less overall aesthetic value. As the case of ethically laden aesthetic evaluation makes clear, however, good aesthetic judgement is irreducibly multi-dimensional, e.g., “the movie has an engaging soundtrack, tasteful camera work, and takes a misogynistically purient perspective on its female lead.” Such a “non-summative” judgement refuses to reduce those various dimensions of aesthetic value to a single aggregate aesthetic evaluation, like “it’s a 6/10” or “it’s a pretty good movie!” I defend both the modest claim that such non-summative evaluations are not mistaken and the extremist claim that summative (i.e., unidimensional) aesthetic evaluation is defective by considering other domains of normative assessment in which summing seems inappropriate, notably including evaluations of people’s character. This article explores three ways in which a cognitively entrenched mindreading (or 'theory of mind') system may bias our thinking as cognitive scientists. One issues in a form of tacit dualism, impacting scientific debates about phenomenal consciousness. Another leads us to think that our own minds are easier to know than they really are, influencing debates about self-knowledge, and about mindreading itself. And the third results in a bias in favour of empiricist over nativist accounts of cognitive development. The discussion (...) throughout is tentative and speculative, and can be regarded as an appeal for caution, as well as a call for further research. (shrink)

Open peer commentary on the article “Perception-Action Mutuality Obviates Mental Construction” by Martin Flament Fultot, Lin Nie & Claudia Carello. Upshot: In my view, the clash between ecological psychology, enactivism, and constructivism in general has more to do with irreconcilable metaphysical and theoretical incommensurabilities than disagreements about specific mechanisms or processes of perception. Even with mutual enabling of action and perception, some internal process of self-modification is still needed if novel behavior is to be adequately explained.
