This essay offers a critical examination of Neil Ormerod’s treatment of the debate between Lonergan and Gilson on the question of being. Although this debate concerns a highly technical issue of metaphysics and epistemology, it remains germane and relevant, especially within the field of Christian thought. In Ormerod’s careful and for the most part generous examination of this debate, he argues that being for Gilson is perceived through the senses, whereas for Lonergan being is intended in the questions that (...) arise from the relevant sense data. Where Gilson’s philosophy gives priority to the metaphysics of being, Lonergan gives priority to epistemology and cognitional theory. In arguing for the superiority of Lonergan’s approach to the question of being, Ormerod relies on a fundamental misunderstanding of Gilson’s metaphysics. By appeal to the more recent work of Kenneth Schmitz, this essay proposes a proper understanding of Gilson’s metaphysics as a basis for a more conciliatory relationship between these two giants in modern Christian philosophy who too often are pitted against one another. This article is an attempt to understand ethical theory not just as a set of well-developed philosophical perspectives but as a range of moral capacities that human beings more or less grow into over the course of their lives. To this end, we explore the connection between formal ethical theories and stage developmental psychologies, showing how individuals mature morally, regarding their duties, responsibilities, ideals, goals, values, and interests. The primary method is to extract from the writings of Kohlberg and his (...) students the cues that help to flesh out a developmental picture of a wide range of ethical perspectives. Thus, developmental psychology benefits from gaining a broader understanding of “morality” and “ethics,” and ethical theory benefits from a richer understanding of how moral maturity arises from youthful beginnings in juvenile and adolescent thinking. Results of this study offer insight into the difficulty of teaching ethics and a refined ability to assess moral maturity in business activity. (shrink)

The thesis that propositions of law are intrinsically arguable is opposed by the antithesis that the Rule of Law is valued for the sake of legal certainty. The synthesis considers the insights of theories of rhetoric and proceduralist theories of practical reason, then locates the problem of indeterminacy of law in the context of the challengeable character of governmental action under free governments. This is not incompatible with, but required by the Rule of Law, which is misstated as securing legal (...) certainty. Defeasible certainty is the most that is desirable or achievable. (shrink)

Das Gendiagnostikgesetz verbietet seit 2010 die pränatale Diagnostik spätmanifestierender Erkrankungen GenDG). In seiner Begründung bezog sich der Gesetzgeber in Analogie zu internationalen Empfehlungen für den pädiatrischen Bereich vor allem auf das Recht des heranwachsenden Kindes bzw. des späteren Erwachsenen auf Nichtwissen. Mit diesem gesetzlichen Verbot hat Deutschland einen viel diskutierten Sonderweg in der Regulierung genetischer Pränataldiagnostik eingeschlagen. Seither jedoch hat sich nicht nur die Perspektive auf prädiktive Testungen im Kindesalter verändert. In zunehmendem Maße generieren auf das gesamte Genom abzielende Diagnostikangebote (...) auch andere vorgeburtlich genetische Informationen, die – in ähnlicher Weise wie diejenigen zu spätmanifestierenden Erkrankungen eine potenzielle Gefahr für das Recht auf Nichtwissen der späteren Person darstellen. Es soll daher im Rahmen dieses Beitrages überprüft werden, inwiefern das deutsche Diagnostikverbot und dessen Bezug auf das Recht auf Nichtwissen des späteren Kindes eine tragfähige Basis zur Regulierung gendiagnostischer Untersuchungen in der Pränatalmedizin insgesamt darstellt bzw. zukünftig darstellen kann.Untersucht wird der Argumentationsgang des Diagnostikverbotes im Hinblick auf spätmanifestierende Erkrankungen vor dem Hintergrund der Entwicklungen in der prädiktiven Diagnostik. Eine Analyse des normativen Begründungsrahmens zeigt, dass nach wie vor deutlicher Klärungsbedarf hinsichtlich der philosophisch-ethischen Fundierung wie auch hinsichtlich der Interpretation eines Rechts auf Nichtwissen eines Kindes im Kontext von genetischer Diagnostik besteht. Darüber hinaus müssen auch Interessen des Kindes an eventuell möglich werdender pränataler Behandlung oder Prävention von Erkrankungen in die Abwägung miteinbezogen werden.Um zukünftigen Herausforderungen genomischer Pränataldiagnostik und -therapie begegnen zu können, müsste dringend geklärt werden, inwiefern Rechte zukünftiger Personen tatsächlich in der speziellen Situation der Schwangerschaft relevant sein können und mit welchen Pflichten diese für den Gesetzgeber, aber insbesondere auch für zukünftige Eltern und Ärzte einhergehen. Der Menschenrechtsdiskurs könnte hierfür eine tragfähige Basis und hilfreiche Strategien liefern. (shrink)

BackgroundThe theory and practice of ethics consultations (ECs) in health care are still characterized by many controversies, including, for example, the practice of giving recommendations. These controversies are complicated by an astonishing lack of evidence in the whole field. It is not clear how often a recommendation is issued in ethics consultations and when and why this step is taken. Especially in a facilitation model in which giving recommendations is optional, more data would be helpful to evaluate daily practice, ensure (...) that this practice is in line with the overarching goals of this approach and support the development of standards.MethodsWe analyzed all consultations requested from an EC service working under a facilitation approach at a maximum-care university hospital in Germany over a period of more than 10 years. Our aim was to better understand why—and under what circumstances—some consultation requests result in a recommendation, whereas others can be sufficiently addressed solely by facilitated meetings. We especially wanted to know when and why clients felt the need for clear advice from the EC service while in other cases they did not. We compared ethics consultations in terms of the differences between cases with and without recommendations issued by the ethics consultants using χ2 difference tests and Welch’s t-test.ResultsA total of 243 ECs were carried out between September 2008 and December 2019. In approximately half of the cases, a recommendation was given. All recommendations were issued upon the request of clients. When physicians asked for an EC, the consultation was significantly more likely to result in a recommendation than when the EC was requested by any other party. ECs in cases on wards with ethics rounds resulted in comparably fewer recommendations than those in wards without ethics rounds. When interpersonal conflicts were part of the problem or relatives were present in the meeting, clients less frequently asked for a recommendation.ConclusionFrom the client’s point of view, there does not seem to be only one “right” way to provide ethics consultations, but rather several. While facilitated meetings are obviously appreciated by clients, there also seem to be situations in which a recommendation is desired (especially by physicians). Further empirical and theoretical research is needed to validate our single-center results and re-evaluate the role of recommendations in ethics consultations. (shrink)

Eco-labels emphasize information disclosure as a tool to induce environmentally friendly behaviors by both firms and consumers. The goal of eco-labels is to reduce information asymmetry between producers and consumers over the environmental attributes of a product or service. However, by focusing on this information asymmetry, rather than on how the label meets consumer needs, eco-labels may send irrelevant, confusing, or even detrimental messages to consumers. In this article, the authors investigate how the environmental signal of eco-labels interacts with product (...) characteristics such as brand, quality, and price. In a discrete choice experiment, the authors examine consumer response to two similar eco-labels for wine, one associated with a quality reduction and the other not. The results show that respondents preferred both eco-labeled wines over otherwise identical conventional counterparts when the price was lower and the wine was from a lower quality region. However, they preferred conventional, more expensive wine from a high-quality region. This preference indicates that respondents not only obtain some warm glow value from eco-labeled wine but also possibly interpret eco-labeling as a signal of lower quality. This relationship held across both types of eco-labels, meaning that consumers did not understand the difference between them. This research contributes to the literature on information disclosure policies by highlighting important elements for effective eco-labels. These elements include consumer awareness and understanding of the eco-label, and consumer willingness to pay for an eco-labeled product. The results emphasize the need to create eco-labels that communicate clearly both the environmental attributes and the private benefits associated with them. (shrink)

Do pharmaceutical companies have a moral obligation to expand access to investigational drugs to patients outside the clinical trial? One reason for thinking they do not is that expanded access programs might negatively affect the clinical trial process. This potential impact creates dilemmas for practitioners who nevertheless acknowledge some moral reason for expanding access. Bioethicists have explained these reasons in terms of beneficence, compassion, or a principle of rescue, but their arguments have been limited to questions of moral permissibility, leaving (...) for future research the question of whether expanded access is morally obligatory. We take up this further question and argue that pharmaceutical companies have a moral obligation to expand access. Our defense is not based on beneficence, compassion, or rescue, but instead on a reciprocal moral expectation resulting from existing social commitments that help ensure a robust pharmaceutical practice within the broader healthcare system. Our aim is to give this obligation, along with several others, a coherent and plausible structure within the wider clinical trial process so that one might better explain the sources of the dilemmas and their possible resolutions. Evolution has become the standard way of understanding the world process. Theology has to express traditional faith in the context of the contemporary world. Since the common world view has profoundly changed, from a static world of being into a dynamic world of becoming, theology needs to change its language and its understanding of the universe as God's creation. This understanding of an evolving world is to be used as a theological source. Such a change of perspective necessitates a fundamental (...) reconstructing of theology; for theology, such reconstructing means a renewed understanding of the Creator and of the Incarnation. The paper tries to contribute to the discussion of the following problem: Nearly every government acts as if it has a natural right to collect taxes – if necessary by force. How legitimate is such an act of expropriation? To find an acceptable solution, three different theories of property are discussed – eventually favouring the Kantian approach. Subsequently, possible vindications of taxation are presented: (1) control of conduct, (2) financing public institutions, (3) reduction of social differences. All three justifications turn (...) out to be de ficient. What remains is John St. Mill's almost forgotten theory; he sees taxes as a sacrifice and, on this account, pleads for a proportional taxation. (shrink)

This article lays the ground for a sensuous appreciation of both the human body and the physical world. Drawing on the biographical account of the climber's embodied reflection of rock-climbing, the `climbing body' highlights our overwhelming tactile and kinaesthetic engagement with the phenomenal world. I Begin by emphasizing the need to consider the organic nature of human being, that we should understand how the awareness of death and our consequent sense of mutability provide a significant moment to remember the body. (...) I highlight how this might be achieved through the practice of adventure climbing. The increasing denial of the body's organicity, its mutability - perhaps a key impulse of modernity - is thereby usurped. This is followed by a structure of thought, based around the work of Georg Simmel, conveying the radical materiality of the phenomenal world. In doing so, I highlight the propensity of the environment to inscribe itself upon the human body. This idea is brought alive during the second half of the article, which focuses upon the climbing body and, in particular, the hands of the climber. As they navigate vertical ground climbers are guided by the sense of touch in order to `make sense' of the world. The climbing body orientates itself through tactile navigation: by feeling or grasp-ing its way through the world. To engage with the world tactually is to situate oneself consciously in that world and to have a potentially unmediated relationship with it. In doing so, the climber opens up the possibility for a corporeal reconceptualization of modernity. (shrink)

An open question regarding how people develop their models of the world is how new candidates are generated for consideration out of infinitely many possibilities. We discuss the role that evolutionary mechanisms play in this process. Specifically, we argue that when it comes to developing a global world model, innovation is necessarily incremental, involving the generation and selection among random local mutations and recombinations of (parts of) one's current model. We argue that, by narrowing and guiding exploration, this feature of (...) cognitive search is what allows human learners to discover better theories, without ever grappling directly with the problem of finding a “global optimum,” or best possible world model. We suggest this aspect of cognitive processing works analogously to how blind variation and selection mechanisms drive biological evolution. We propose algorithms developed for program synthesis provide candidate mechanisms for how human minds might achieve this. We discuss objections and implications of this perspective, finally suggesting that a better process-level understanding of how humans incrementally explore compositional theory spaces can shed light on how we think, and provide explanatory traction on fundamental cognitive biases, including anchoring, probability matching, and confirmation bias. Is there a ‘constitutional moment’in contemporary Europe? What if anything is the constitution of the European Union; what kind of polity is the Union? The suggestion offered is that there is a legally constituted order, and that a suitable term to apply to it is a ‘commonwealth’, comprising a commonwealth of ‘post-sovereign’ states. Is it a democratic commonwealth, and can it be? Is there sufficiently a demos or ‘people’ for democracy to be possible? If not democratic, what is it? Monarchy, (...) oligarchy, or democracy, or a ‘mixed constitution’? Argued: there is a mixed constitution containing a reasonable element of democratic rule. The value of democracy is then explored in terms of individualistic versus holistic evaluation and instrumental versus intrinsic value. Subsidiarity can be considered in a similar light, suggestively in terms of forms of democracy appropriate to different levels of self-government. The conclusion is that there is no absolute democratic deficit in the European commonwealth. (shrink)

Ranging from Plato to Marx, one can only find a few philosophers who have talked about money without detesting it. Naturally, economists are avoiding such an attitude. But they deliver only functional definitions, nothing which could give a hint at the essence of money. The essay tries to clarify it by delineating a currency as an ‘ens ficitivum’ – created by our semiotic activities, which have been analysed by Charles Sanders Peirce. So, the thesis is: Money is basically a sign (...) indicating at a present time one’s ability to handle future events. (shrink)
