The role of research ethics committees, and research ethics issues more broadly are often not viewed in the context of the development of scientific methods and the academic community. This topic piece seeks to redress this gap. I begin with a brief outline of the changes we experience within the social sciences before exploring in more detail their impact on research ethics and the practices of research ethics committees. Twenty-first-century philosophy has been drawn into a false opposition between speculation and critique. Nathan Brown shows that the key to overcoming this antinomy is a re-engagement with the relation between rationalism and empiricism. Political corruption imposes substantial costs on shareholders in the U.S. Yet, we understand little about the basic factors that exacerbate or mitigate the value consequences of political corruption. Using federal corruption convictions data, we find that firm-level economic rents and monitoring mechanisms moderate the negative relation between corruption and firm value. The value consequences of political corruption are exacerbated for firms operating in low-rent product markets and mitigated for firms subject to external monitoring by state governments or monitoring induced by (...) disclosure transparency. Our results should inform managers and policymakers of the tradeoffs imposed on firms operating in politically corrupt districts. (shrink)

In this article, we report the results of a survey of North American adults (n= 1,215) conducted between March 24 and 30, 2020 at the onset of the COVID-19 pandemic. Respondents completed the COVID-TIS (Transitional Impact Scale-Pandemic version) and the 21-item Depression, Anxiety, and Stress Scale (DASS), indicated their level of COVID-infection concern for themselves and close others, and provided demographic information. The results indicated: (a) during its early stage, the pandemic produced only moderate levels of material and psychological change; (...) (b) the pandemic produced mild to moderate levels of psychological distress; (c) respondents who lost their jobs as a result of the pandemic experienced more change and more psychological distress than those who did not, and (d) younger respondents and less well-educated ones experienced more psychological distress than older respondents. Unexpectedly, (e) respondents indicated that they were more concerned that friends and family members would become infected with COVID-19 than that they would be. We conclude by speculating that these results are driven less by the immediate changes brought about by the pandemic and more by uncertainty concerning its long-term economic and social impact. The American Society for Bioethics and Humanities has developed a curriculum leading to a certificate in health care ethics consultation. A certification in ethics consultation initially seems to fit nicely into the biomedical model of clinical expertise espoused by modern biomedicine, but examining what exactly constitutes moral expertise, particularly for traditional Christians, reveals a significant problem: the certification relies on an implicit view of ethics as essentially procedural. It leaves virtually all serious moral content to be filled in, if at (...) all, after an ostensibly neutral scaffolding has been erected. Such an approach does not help answer deep moral questions about how one should live, and it is these questions that ought to be encouraged during some conflicts that result in requests for ethics consultations. This paper suggests that, in certain circumstances, and for a subset of patients, encouraging conversion can help remedy the deficiency of an overly mechanized approach. A system open to conversion would have more room for Traditional Christians, regardless of the outcome, as it would take morality as lived, communal experience more seriously and help others, if desired, to do so as well. The pervasive use of contracts in healthcare is a source of unease for many healthcare ethicists and patient advocates. This commentary examines the use of such contracts with individuals in rehabilitation settings who have complex medical and behavioural issues. The goals of this paper are to examine the many factors that can lead to contract use, to discuss some legal and ethical implications of contract use, and to assess contract use in light of concerns about health equity. Here is the final volume of Norman O. Brown's trilogy on civilization and its discontents, on humanity's long struggle to master its instincts and the perils that attend that denial of human nature. Following on his famous books _Life Against Death_ and _Love's Body_, this collection of eleven essays brings Brown's thinking up to 1990 and the fall of Communism in Eastern Europe. Brown writes that "the prophetic tradition is an attempt to give direction to the social structure precipitated by (...) the urban revolution; to resolve its inherent contradictions; to put an end to its injustice, inequality, anomie, the state of war... that has been its history from start to finish." Affiliating himself with prophets from Muhammad to Blake and Emerson, Brown offers further meditations on what's wrong with Western civilization and what we might do about it. Thus the duality in his title: crisis and the hope for change. In pieces both poetic and philosophical, Brown's attention ranges over Greek mythology, Islam, Spinoza, and _Finnegan's Wake_. The collection includes an autobiographical essay musing on Brown's own intellectual development. The final piece, "Dionysus in 1990," draws on Freud and the work of Georges Bataille to link the recent changes in the world's economies with mankind's primordial drive to accumulation, waste, and death. What if we looked at the notion of the end of literature as a truism, only lacking in plurality and logical rigor? Nicholas Brown explains that one of these “ends” can be regarded as internal to the functioning of literature itself, and as such, the point of departure for a more complete formulation of a Marxist literary criticism. For Brown, this formulation reveals that both literary criticism and Marxism are to be regarded as what he calls “formal materialisms,” a mode (...) of analysis that must be completed and revised every time in light of an object it cannot posit beforehand. What this means for a Marxist literary-critical project subsequently becomes all the more apparent in Brown’s reading of another end of literature – postmodernism. (shrink)

L’Association nationale des réseaux de personnel handicapé (NADSN) est un super-réseau qui relie et représente les réseaux de personnel handicapé dans les organisations à travers le Royaume-Uni. Le NADSN a été très préoccupé par le développement de la politique nationale jusqu’à ce jour et par le fait de sortir de la phase de verrouillage COVID-19, car la politique nationale est restée silencieuse en ce qui concerne le personnel handicapé, si ce n'est en présentant un point de vue étroit et médicalisé. Nous avons structuré ce document dans le cadre d’un modèle social du handicap et des sentiments exprimés dans la Convention des Nations unies relative aux droits des personnes handicapées (CDPH) en examinant les problèmes actuels et en formulant nos douze recommandations. Ce document présente les observations du NADSN sur les expériences vécues par les personnes handicapées au cours de la conférence COVID-19. Il décrit ensuite la COVID-19 et l’évolution du lieu de travail. This article discusses xenotransplantation and examines the way its scientific promoters have defended their technology against potentially damaging public representations. The authors explore the criteria used to legitimate the selection of the pig as the best species from which to “harvest” transplant tissues in the future. The authors’ analysis shows that scientists and medical practitioners routinely switch between scientific and cultural repertoires. These repertoires enable such actors to exchange expert identities in scientific discourse for public identities in cultural discourse. These (...) discourses map onto similarities and differences between animal donors and human hosts. Capitalism is back. Three decades ago, when all alternatives to liberal democracy and free markets appeared discredited, talk of capitalism seemed passé. Now, after a decade of political and economic turmoil, capitalism and its temporal critique of progress and decline again seems an indispensable category to understanding a world in flux. Among the social sciences, historians have led both the embrace and critique of this ‘re-emergent’ concept. This roundtable discussion between leading and emerging Australian scholars working across histories of economy, (...) work, policy, geography and political economy, extends this agenda. Representing the outcome of a workshop convened at La Trobe University in November 2018 and responding to questions posed by conveners Huf and Rees, five participants debate the nature, utility and future of the new constellation of ‘economic’ historical scholarship. Many assumptions are made about public willingness to participate in epidemiological research, yet few empirical studies have been conducted to ascertain whether such assumptions are correct. Our qualitative study of the public and of expert stakeholders leads us to suggest that people are generally prepared to participate in epidemiological research, particularly if it is conducted by a trusted public institution such as a government health department, charity, or university. However, there is widespread community distrust of research conducted or sponsored by (...) pharmaceutical companies. Individuals are prompted to take part if the study concerns an illness they or a family member or friend have personally experienced or if they believe the research will confer a widespread public benefit. Preferences vary about the mode of contact for the research to be conducted. Willingness to participate in telephone surveys has decreased in recent years, and this may be a consequence of an increase in calls to homes by telemarketers and market researchers. Participants also stressed the importance of knowing where their names and contact details were sourced and suggested that this information be available to prospective study participants as a matter of course in the first approach or letter. We provide valuable information to epidemiologists in designing studies. (shrink)

Umbilical cord blood has become the focus of intense efforts to collect, screen and bank haematopoietic stem cells in hundreds of repositories around the world. UCB banking has developed through a broad spectrum of overlapping banking practices, sectors and institutional forms. Superficially at least, these sectors have been widely distinguished in bioethical and policy literature between notions of the ‘public’ and the ‘private’, the commons and the market respectively. Our purpose in this paper is to reflect more critically on these (...) distinctions and to articulate the complex practical and hybrid nature of cord blood as a ‘bio-object’ that straddles binary conceptions of the blood economies. The paper draws upon Roberto Esposito’s reflections on biopolitics and his attempt to transcend the dualistic polarisations of immunity and community, or the private and the public. We suggest that his thoughts on immunitary hospitality resonate with many of the actual features and realpolitik of a necessarily internationalised and globally distributed UCB ‘immunitary regime’. The Drosophila position‐specific (PS) integrins are members of the integrin family of cell surface receptors and are thought to be receptors for extracellular matrix components. Each PS integrin consists of an α subunit, αPS1 or αPS2, and a βPS subunit. Mutations in the βPS subunit and the αPS2 subunit have been characterised and reveal that the PS integrins have an essential role in the adhesion of different cell layers to each other. The PS integrins are especially required for the function (...) of the cell‐matrix‐cell junctions, where the muscles attach to the epidermis and where one surface of the developing wing adheres to the other. These junctions are similar to vertebrate focal adhesions and hemidesmosomes, which also contain integrins. Integrin‐mediated cell to cell adhesion via the extracellular matrix provides a way for tissues to adhere to each other without intermingling of their cells. (shrink)

This essay offers an examination of Agamben's statement that there is an important ambiguity in Aristotle's Metaphysics Theta as to whether actuality or potentiality is primary. I argue that this ambiguity is significant because it exposes the ontological dimension of Agamben's paradox of sovereignty.

In recent months, pharmaceutical manufacturers have brought legal challenges to a provision of the 2022 Inflation Reduction Act (IRA) empowering the federal government to negotiate the prices Medicare pays for certain prescription medications. One key argument made in these filings is that price negotiation is a “taking” of property and violates the Takings Clause of the US Constitution. Through original case law and health policy analysis, we show that government price negotiation and even price regulation of goods and services, including (...) patented goods, are constitutional under the Takings Clause. Finding that the IRA violates the Takings Clause would radically upend settled constitutional law and jeopardize the US’s most important state and federal health care programs. (shrink)

Aristotle claims in book 9 of the Metaphysics that potentiality is distinct from actuality yet also that potentiality exists only for the sake of actuality. This essay presents the relationship between potentiality’s existence and actuality’s priority as an aporia, where potentiality remains distinct from and exists in excess of actuality, even though it exists only as actuality. I claim that this aporia helps the early Heidegger of Being and Time to conclude, contrary to Aristotle, that potentiality stands higher than actuality.

In Hegel's Ontology of Power: The Structure of Social Domination in Capitalism, Arash Abazari offers a highly original account of Hegel's Science of Logic as a book of political theory. Hegel's Logic is traditionally understood to be a systematic dialectical study of fundamental ontology; revising this tradition, Abazari says that Hegel's Logic ‘expresses the spirit of capitalism’ (p. 8). He claims that Hegel's Logic is an ontological treatise, which, at the same time, exposes the power structures and asymmetrical relations of (...) domination and acts as a precursor for Marx's and Adorno's subsequent critiques of capitalism. Although some readers might find this way of reading the Logic to require interpretation that goes beyond what is evident in the text, Abazari's book is nevertheless filled with persuasive arguments designed to help his reader unlock the political dimensions of the Logic. I will outline the trajectory of the book's chapters, underscore some of the book's insights, anticipate its readership, and also consider a criticism. (shrink)

The aim of this article is to contrast Hegelian insights about the secret with Derrida’s literary account of the secret in the story of Abraham. Derrida outlines two kinds of secret in “Literature in Secret,” one revealable and the other apophatic. I propose that the first kind of secret is Hegelian in nature because a productive concept of contradiction underlies it. On the other hand, the second kind of secret is Derridean because it withdraws from all revelation. Through an analysis (...) of the role of contradiction in Hegel’s Logic and Derrida’s distinction between revealable and unrevealable secrets, I aim to explore the logical and structural components of the concept of the secret. One of the challenges of modern healthcare ethics practice is the navigation of boundaries. Practicing healthcare ethicists in the performance of their role must navigate meanings, choices, decisions and actions embedded in complex cultural and social relationships amongst diverse individuals. In light of the evolving state of modern healthcare ethics practice and the recent move toward professionalization via certification, understanding boundary navigation in healthcare ethics practice is critical. Because healthcare ethics is endowed with many boundaries which often delineate concerns about (...) professional expertise and authority, epistemological reflection on the relationship between theory and practice points toward the social context as relevant to the conceptualization of boundaries. The skills of social scientists may prove helpful to provide data and insights into the conceptualization and navigation of clinical ethics qua profession. Empirical ethics research, which combines empirical description (usually social scientific) with normative-ethical analysis and reflection, is a way forward as we engage and reflect upon issues which have implications for practice standards and professionalization of the role. This requires cooperative engagement of the descriptive and normative disciplines to explore our understandings of boundaries in healthcare ethics practice. This will contribute to the ongoing reflection not only as we envision the professional role but to ensure that it is enacted in practice. (shrink)

Aristotle's famous claim that human beings are animals with rationality has a subtle and complicated articulation in his doctrine of the mean. This paper offers textual analysis of Aristotle's discussion of the mean as a resource for coming to terms with the thesis that humans naturally deliberate over the essence of their nature. Unlike other animals who tend to act without deliberation and without mediation, human beings are the animals who are capable of giving an account of themselves. However, this (...) also means that human beings are the animals whose nature it is to give an account. This paper proposes that Aristotle's doctrine of the mean, as it is found in the Nicomachean Ethics, helps to explain this circular, and in some ways puzzling, tension between having a nature and giving an account of one's nature.
