Review boards responsible for vetting the ethical conduct of research have been criticised for their costliness, unreliability and inappropriate standards when evaluating some non-medical research, but the basic value of mandatory ethical review has not been questioned. When the standards that review boards use to evaluate research proposals are applied to review board practices, it is clear that review boards do not respect researchers or each other, lack merit and integrity, are not just and are not beneficent. The few benefits (...) of mandatory ethical review come at a much greater, but mainly hidden, social cost. It is time that responsibility for the ethical conduct of research is clearly transferred to researchers, except possibly in that small proportion of cases where prospective research participants may be so intrinsically vulnerable that their well-being may need to be overseen. Kovacs argues that honorary authorship and regarding each co-author of multi-authored papers as if they were sole authors when the performance of researchers is being evaluated by their publications mean that we should require authors to identify what proportion of each publication should be attributed to each co-author. Even if such attributions could be made reliably, such a change should not be made. Contributions to authorship cannot be validly quantified, and the relative merits of different publications are also neither equal (...) nor validly quantifiable. Research administrators need to recognise that whatever criteria they adopt to evaluate the performance of researchers, researchers will find a way to game the system in order to maximise their personal benefit. Anderson and Dyck claim that the current trend of almost exclusively using citation-based evaluative metrics to assess the research output of scholars is unsound. I agree with them in this, but I feel that, for practical reasons, this system will not disappear in the near future, so we must concentrate on making it fairer. Both commentators doubt whether numerically expressing each contributor's relative contribution is feasible. I admit that an important precondition for this task is the possibility of an (...) informed, democratic debate among equals about the relative contribution of each contributor to the article. Mechanisms should be established to protect vulnerable researchers in the academic field in the same way as safeguards exist today to protect vulnerable research participants. Theoretically, however, I think that the fair allocation of authorship credit is possible, and much of this task is already being performed routinely when contributors determine the order of their names in the byline, being well aware of the widespread assumption that this order mostly mirrors the order of their relative contributions. All they would have to do as an additional task is to express this order in numbers. If they cannot reach a consensus, they could always choose not to express their relative contribution in numbers, in which case the presumption would be that they contributed equally. My proposal could, at best, make the system fairer and, at worst, not reduce the options that evaluators already have. (shrink)

There is considerable controversy about the mandatory ethics review of research. This paper engages with the arguments offered by Murray Dyck and Gary Allen against mandatory review, namely, that this regulation fails to reach the standards that research ethics committees apply to research since it is harmful to the ethics of researchers, has little positive evidence base, leads to significant harms (through delaying valuable research) and distorts the nature of research. As these are commonplace arguments offered by researchers (...) against regulation it is useful to assess their strength and the conclusion that they are taken to support, namely, that we ought to move back to a system of trust in researchers without compulsory regulation. Unfortunately, these arguments are at best weak and to some degree come into conflict in terms of supporting the desired conclusion. (shrink)

This paper discusses three potential varieties of update: updates to the common ground, structuring updates, and updates that introduce discourse referents. These different types of update are used to model different aspects of natural language phenomena. Not-at-issue information directly updates the common ground. The illocutionary mood of a sentence structures the context. Other updates introduce discourse referents of various types, including propositional discourse referents for at-issue information. Distinguishing these types of update allows a unified treatment of a broad range of (...) phenomena, including the grammatical evidentials found in Cheyenne (Algonquian) as well as English evidential parentheticals, appositives, and mood marking. The novel use of symbolism in early modern mathematics poses both philosophical and historical questions. How can we trace its development and transmission through manuscript sources? Is it intrinsically related to the emergence of symbolic algebra? How does symbolism relate to the use of diagrams? What are the consequences of symbolic reasoning on our understanding of nature? Can a symbolic language enable new forms of reasoning? Does a universal symbolic language exist which enable us to express all knowledge? This book (...) brings together a collection of papers that address all these and related questions which were initially posed at a conference held in Ghent (Belgium) in August 2009. Scholars working on philosophy of science, history of philosophy and history of mathematics provide an insight into the role and function of symbolic representations in the development of early modern mathematics. This article argues that traditional, regulative principles of research ethics offer insufficient guidance for research in the narrative study of lives. These principles presuppose an implicit epistemology that conceives of research participants as data sources, a conception that is argued not tenable for narrative research. The case is made by drawing on recent discussions of research ethics in the qualitative and narrative research literature. This article shows that narrative ethics is inextricably entwined with epistemological issues--namely, issues of narrative ownership and (...) the multiplicity of narrative meaning. Finally, practical recommendations are made for the ethical treatment of research participants in narrative research. The article concludes by situating our approach with respect to the broad range of contemporary perspectives on research ethics. (shrink)

In this article we criticize two recent articles that examine the relation between explanation and unification. Halonen and Hintikka (1999), on the one hand, claim that no unification is explanation. Schurz (1999), on the other hand, claims that all explanation is unification. We give counterexamples to both claims. We propose a pluralistic approach to the problem: explanation sometimes consists in unification, but in other cases different kinds of explanation (e.g., causal explanation) are required; and none of these kinds is more (...) fundamental. What are the ethical concerns among the growing populations of business people in Central & Eastern Europe, and how might they be dealt with practically in the course of business life? David Murray has been a management consultant since 1979 working primarily with the Hay Group in the area of strategic organisational change. Since founding Maine Consulting Services in 1991 he spends most of his time in the field of business and professional ethics, also holding a Visiting Fellowship at (...) the University of Central Lancashire. He is chairman of the Professional & Technical Board at the (British) Institute of Quality Assurance and a coordinating editor of the quarterly Organisations & People. Marek Kucia is a social researcher operating his own research agency (which organised the Polish part of this exercise) and an academic teaching sociology, and conducting and co‐ordinating Central European Studies at the Jagiellonian University, Krakow. He studied political science, sociology and philosophy at Krakow and studied for his PhD at Oxford. He has also worked for Gallup, London, in opinion and market research. This survey report is based on presentations made in April 1994 to the EBEN Research Centres Conference in Prague, and in June 1994 to the conference on “Ethics in Transition” organised in Gödöllö, Hungary, by the Democracy after Communism Foundation, Budapest. This book argues that Nietzsche bases his affirmative morality on the model of individual responsiveness to otherness which he takes from the mythology of Dionysus. The subject is not free to choose to avoid such responding to the demands of the other. Nietzsche finds that the basic mode of responding is pleasure. This feeling, as a basis for morality, underlies the morality which is true to the earth and the major concepts of "will to power", "eternal return", and "amor fati". (...) The priority of otherness makes all thought ethical and not only aesthetic. The basis of all meanings combines the fundamental impulse of responding outwards with an immediate complement in the individual interpretation-world. This is specifically ethical because the recognition of our own historical specificity arises as a result of the refusal of others to become mere differences within our notion of the Same, and through their demand that we "become who we are" in the recognition of their separate existence. This paper presents a computer model of cortical broadcast and competition based on spiking neurons and inspired by the hypothesis of a global neuronal workspace underlying conscious information processing in the human brain. In the model, the hypothesised workspace is realised by a collection of recurrently inter-connected regions capable of sustaining and disseminating a reverberating spatial pattern of activation. At the same time, the workspace remains susceptible to new patterns arriving from outlying cortical populations. The essential nature of legislative power is to make the laws; that of executive power is to execute those law. The difference between the two is both substantial and significant; it is the difference between the rule of arbitrary power and the rule of law. This paper will seek to trace the genesis of an independent judicial power, in both theory and practice, through an examination of sections of The Constitutions of Clarendon, The Assize of Clarendon, Hobbes’ Leviathan, Locke’s Second (...) Treatise, Montesquieu’s Spirit of the Laws, as well as The Federalist Papers. Moreover, it will seek to establish its executive nature and to explain why it is so often (at least presently) misunderstood to be akin to the legislative power. (shrink)

An alternative title for this discussion might have run: "Heidegger or The Concept of Mind." Its ambivalence provides a direction. Read in an inclusive or appositional way "or" has the sense of "Heidegger Revisited," while interpreted exclusively it confronts us with the necessity to choose between two incompatible versions. No one would seriously dispute that there are significant differences in technique, motive, and goal between Heidegger’s Sein und Zeit and Ryle’s Concept of Mind, and in their philosophizing generally. Ryle’s technique (...) is that of the linguistic portrayal or sentence-frame analysis; his goal is not a science or a clarification of the meaning of Being, but rather a "theory of mind" or philosophical psychology. His method lies within what may be termed a behaviorist perspective and, implicitly, adopts the verification principle of meaning. Unlike Skinnerian behaviorism, the source of the behavioral indicators of "mind" as well as its measure is provided for by ordinary, cultivated English. In Heidegger’s work the appeal to the evidence of ordinary language, the language of everyday being in the world, is frequent. He often cites linguistic usage for guidance in his analyses, as for example the passages on the hammer, on social inauthenticity, on temporal expressions, and on the grammar of listening and hearing. At this stage he is not as self-conscious of this method as is Ryle in a later period, although it is consonant with Heidegger’s emergent stress on the importance of language. For Heidegger of course these analyses of ordinary language are not ends in themselves, because this realm is meant to exhibit certain a priori structures of human existence, which he calls "existentials" in contradistinction to the "categories" applicable to things. Furthermore, his interest in these existential clarifications is governed by his contention that they afford a necessary basis for and prelude to ontology, for which reason he designates this endeavor "fundamental-ontology." The analysis of being human, consequently, can never, according to Heidegger, be autonomous and self-sufficient, because man’s constitution is meshed with that of others, things, and instruments, with works of art, thought, and politics, and above all with Being. His analysis also differs in an important way from Ryle’s in his view that our understanding of the world is ensnared in the conflicting claims of authentic and inauthentic possibilities for life. As a result, from the outset, ordinary language, a theme to which he later returns in his essays on Hölderlin, represents a threat as well as a rich fund of expression. Lastly, there is nothing in Ryle resembling Heidegger’s detailed examination of gossip, hearsay, and curiosity, boredom, fear, and dread, time, freedom, and death. (shrink)

DHHS's rule on the care of imperiled newborns has a symbolic significance for the groups that struggled for compromise, but it will have a minimal impact on medical and moral decision making.

The paper distinguishes between two different senses of ‘genius’ found in Kant's Critique of Judgement, and criticizes an argument commonly attributed to Kant. The argument is in support of the conclusion that an agent must possess and employ genius in the ‘productive faculty’ sense in order to produce an artwork. It is shown that Kant did not in fact make this argument. He defended a different claim concerning the need to employ the concept of a productive faculty of genius in (...) order to make pure judgements of taste concerning artworks. I conclude with the suggestion that there are indications in Kant's theory of a significant departure from a tradition of thought according to which there is something essentially mysterious about the possibility of the production of fine art. IN ONE of the last seminars of his life, Heidegger remarks that just as Hegel was trying to lay the definitive foundation of the modern age, so was his friend Hölderlin trying to break through the ground of the age in order to inaugurate a step beyond modernity. For this reason, Heidegger clearly regards the poet as more radical than the philosopher. Without trying myself to assess the validity of this contrast, I shall take it as a clue and argue (...) that each was attempting to discover, and to build a time-design that could do justice to his epoch and respond to the experience of its historical destiny. The question that concerns this essay is just how Hegel construed and constructed such a philosophical designing of the time, and while important texts for this topic are thematized in his earlier writings and in his subsequent lectures, the central text must be the Phenomenology of Spirit. The aim of this discussion therefore is to determine the time-sense of the Phenomenology of Spirit and its phenomenology of Time, and to draw in other texts insofar as they illumine its matrix. Leibniz presents not only his reflections on predestination and election but also a more detailed account of the problem of evil than is found in any of his other works apart from the _Theodicy_. Surprisingly, his _Dissertation on Predestination and Grace_ has never before been published in any form. Michael J. Murray's project of translating, editing, and providing commentary for the volume will therefore attract great interest among scholars and students of Leibniz's philosophy and (...) theology. Leibniz addresses such topics as free will, moral responsibility, divine causation, justice, punishment, divine foreknowledge, and human freedom, revealing crucial aspects of the genesis of his mature metaphysics and the theological motivations behind it. From Leibniz's time until the mid-1970s, the word ‘theodicy’ was used to describe attempts to explain God's permission of evil. Since the mid-1970s, however, it has taken on a more refined sense among philosophers of religion – a change that can be attributed to Alvin Plantinga's book God, Freedom and Evil. In this work, Plantinga distinguishes between two types of explanations of evil that theists might construct. The first type is offered in response to arguments that the coexistence of God (...) and evil is impossible. Explanations of this sort, which Plantinga calls ‘defences’, need only show the logical compatibility of God and evil. The second type aims to provide plausible and perhaps even likely-to-be-true explanations of evil, explanations which show that the existence of evil is not unlikely given the existence of God. Plantinga labelled explanations of this latter sort ‘theodicies’. His distinction has left a lasting mark on the field, and in the contemporary literature philosophers of religion use the term ‘theodicy’ in this narrower sense, and it is in this sense that it will be addressed in this article. The article discusses the punishment theodicy, the natural consequence theodicy, the free-will theodicy, the natural-law theodicy, soul-making theodicies, and theodicies of animal suffering. Critical management education typically assumes that management courses that emphasize critical reflection—that is, courses that critique problematic systems and structures, and ask students to dialogue about and actively reflect upon these critiques—will foster student transformation. In contrast, critical theory typically suggests that transformation requires praxis, that is, critical reflection plus practical action where students enact their new knowledge in their everyday lives. We empirically test these assumptions by measuring student transformation in management classes that emphasize critical reflection and in other (...) classes that emphasize praxis. We find no significant differences in three measures of student transformation in classes where only critical reflection is emphasized, but significant differences in all three measures when praxis is emphasized. In a content analysis of student praxis assignments, we find further evidence of the link between praxis and student transformation. Specifically, the majority of students value praxis, describe changes in their self-understanding/consciousness thanks to assignments that emphasize praxis, and plan to continue new behaviors that address concerns raised by critiques of problematic systems and structures. Finally, we find that the greater a student’s self-described effect of praxis, the greater that student’s transformation. Taken together, the results suggest that the practical application dimension of praxis is a key “missing ingredient” in the teaching of business ethics as students move from critically reflecting on ethical issues, to actually becoming transformed by their knowledge.
