Whistle blowing programs have been central to numerous government, legislative, and regulatory reform efforts in recent years. To protect investors, corporate boards have instituted numerous measures to promote whistle blowing. Despite significant whistle blowing incentives, few individuals blow the whistle when presented with the opportunity. Instead, individuals often remain fallaciously silent and, in essence, become passive fraudsters themselves. Using the fraud triangle and models of moral behavior, we model and analyze fallacious silence and identify factors that may motivate an individual (...) to rationalize fallacious silence. We use a survey of graduate accounting students to test hypothesized factors that contribute to fallacious silence rationalizations in an academic setting. We find evidence that the ability to rationalize fallacious silence is related to community influences and personal traits such as awareness and moral competence. (shrink)

Recent discussions among lawyers, philosophers, policy researchers and athletes have focused on the potential threat to privacy posed by the World Anti-Doping Agency’s (WADA) whereabouts requirements. These requirements demand, among other things, that all elite athletes file their whereabouts information for the subsequent quarter on a quarterly basis and comprise data for one hour of each day when the athlete will be available and accessible for no advance notice testing at a specified location of their choosing. Failure to file one’s (...) whereabouts, or the non-availability for testing at said location on three occasions within any 18-month period constitutes an anti-doping rule violation that is equivalent to testing positive to a banned substance, and may lead to a suspension of the athlete for a time period of between one and two years. We critically explore the extent to which WADA’s whereabouts requirements are in tension with existing legislation on privacy, with respect to UK athletes, who are simultaneously protected by UK domestic and EU law. Both UK domestic and EU law are subject to the European Convention on Human Rights (ECHR) Article 8, which establishes a right to “respect for private and family life, home and correspondence”. We critically discuss the centrality of the whereabouts requirements in relation to WADA’s aims, and the adoption and implementation of its whereabouts rules. We conclude that as WADA’s whereabouts requirements appear to be in breach of an elite athlete’s rights under European workers’ rights, health & safety and data protection law they are also, therefore, in conflict with Article 8 of the ECHR and the UK Human Rights Act 1998. We call for specific amendments that cater for the exceptional case of elite sports labour if the WADA requirements are to be considered legitimate. (shrink)

The idea of perfection -- On "god" and "good" -- The sovereignty of good over other concepts.

By operations on models we show how to relate completeness with respect to permissivenominal models to completeness with respect to nominal models with finite support. Models with finite support are a special case of permissive-nominal models, so the construction hinges on generating from an instance of the latter, some instance of the former in which sufficiently many inequalities are preserved between elements. We do this using an infinite generalisation of nominal atoms-abstraction. The results are of interest in their own right, (...) but also, we factor the mathematics so as to maximise the chances that it could be used off-the-shelf for other nominal reasoning systems too. Models with infinite support can be easier to work with, so it is useful to have a semi-automatic theorem to transfer results from classes of infinitely-supported nominal models to the more restricted class of models with finite support. In conclusion, we consider different permissive-nominal syntaxes and nominal models and discuss how they relate to the results proved here. (shrink)

This paper offers two possible readings of the Earth Charter that are informed by current scholarship in the field of environmental politics. The first reading finds much in the document to suggest congruence with emerging discourses of cosmopolitanism and global environmental citizenship. The second reading, a more sceptical one, identifies aspects of the Earth Charter that seem more resonant with depoliticizing United Nations-style light green globalism than with an inclusive ethical vision of environmentalism. After setting out these two readings, I (...) argue that, although potentially undermining of its endorsability, thinking critically about problematic aspects of the Earth Charter is an exercise that may point in the direction of a cosmopolitan environmentalism that is less banal and instrumental and more dialogically open, reflexive, and democratic. Although there are important aspects of ecofeminist valuations of women's caring, a greater degree of skepticism than is now found in ecofeminist scholarship is in order. In this article I argue that there are political risks in celebrating women's association with caring, as both an ethic and a practice, and in reducing women's ethico-political life to care. I support this position by drawing on the work of feminist theorists who argue that the positive identification of women with caring ought to (...) be treated cautiously for it obscures some of the negative implications of feminized care and narrows our understanding of women as political actors. I explain why I think ecofeminists would be better served by using feminist theories of citizenship to understand and interpret women's engagement in politics. (shrink)

Brent Kious has recently attacked several arguments generally adduced to support anti-doping in sports, which are widely supported by the sports medicine fraternity, international sports federations, and international governments. We show that his attack does not succeed for a variety of reasons. First, it uses an overly inclusive definition of doping at odds with the WADA definition, which has global, if somewhat contentious, currency. Second, it seriously misconstrues the position it attacks, rendering the attack without force against a more balanced (...) construal of an anti-doping position. Third, it makes unwarranted appeals to matters Kious considers morally ‘clear’, while simultaneously attacking a position many others take to be equally morally ‘clear’, namely that of anti-doping. Such an inconsistency, attacking and appealing to the moral status quo as befits one’s argument, is not acceptable without further qualification. Fourth, his position suffers from a general methodological flaw of over-reliance upon argumentation by analogy. Moreover, it is argued that the analogies, being poorly selected and developed, fail to justify his conclusion that the anti-doping lobby lacks philosophical and moral authority for its stance. These issues are symptomatic of a more fundamental problem: any attempt at providing a blanket solution to the question of whether doping is morally acceptable or not is bound to run up against problems when applied to highly specific contexts. Thus, rather than reaching any particular conclusion for or against doping products or processes in this article, we conclude that an increased context-sensitivity will result in a more evenhanded appraisal of arguments on the matter. European political theorists have argued that contemporary imaginaries of climate change are symptomatic of a post-political condition. My aim in this essay is to consider what this analysis might mean for a feminist green politics and how those who believe in such a project might respond. Whereas much of the gender-focused scholarship on climate change is concerned with questions of differentiated vulnerabilities and gendered divisions of responsibility and risk, I want to interrogate the strategic, epistemological, and normative implications for ecological (...) feminism of a dominant, neoliberal climate change narrative that arguably has no political subject, casts Nature as a threat to be endured, and that replaces democratic public debate with expert administration and individual behavior change. What hope is there for counter-hegemonic political theories and social movements in times like these? I suggest that rather than give in and get on the crowded climate change bandwagon, an alternative response is to pursue a project of feminist ecological citizenship that blends resistance to hegemonic neoliberal discourses with a specifically feminist commitment to reclaiming democratic debate about social-environmental futures. BackgroundAdvances in healthcare artificial intelligence (AI) are occurring rapidly and there is a growing discussion about managing its development. Many AI technologies end up owned and controlled by private entities. The nature of the implementation of AI could mean such corporations, clinics and public bodies will have a greater than typical role in obtaining, utilizing and protecting patient health information. This raises privacy issues relating to implementation and data security. Main bodyThe first set of concerns includes access, use and control (...) of patient data in private hands. Some recent public–private partnerships for implementing AI have resulted in poor protection of privacy. As such, there have been calls for greater systemic oversight of big data health research. Appropriate safeguards must be in place to maintain privacy and patient agency. Private custodians of data can be impacted by competing goals and should be structurally encouraged to ensure data protection and to deter alternative use thereof. Another set of concerns relates to the external risk of privacy breaches through AI-driven methods. The ability to deidentify or anonymize patient health data may be compromised or even nullified in light of new algorithms that have successfully reidentified such data. This could increase the risk to patient data under private custodianship.ConclusionsWe are currently in a familiar situation in which regulation and oversight risk falling behind the technologies they govern. Regulation should emphasize patient agency and consent, and should encourage increasingly sophisticated methods of data anonymization and protection. (shrink)

The title of this article, “The State at Dusk,” was adopted from the famous image of Minerva’s Owl in the Preface to Hegel’s Philosophy of Right. I chose it to capture the current mood of despair and foreboding about the state, both in its growing failure to protect individuals from the ravages of capital and in its malevolent capacity to destroy all life on earth. The threat of nuclear holocaust and the question of whether the welfare state has a future (...) are now urgent topics of political debate. Notwithstanding a few significant victories, however, the so-called New Right has achieved nothing like total success in its war against public-financed health care, education, and civil liberties, to name only a few of its targets. Moreover, despite the obvious madness of the nuclear arms race and two terms under the most reactionary of all modern U. S. presidents, the planet survives. As darkness gathers around the late twentieth century state, its outline appears much the same as it was at the outset of the conservative attack a decade ago. (shrink)
