First published in 1903, this volume revolutionized philosophy and forever altered the direction of ethical studies. A philosopher’s philosopher, G. E. Moore was the idol of the Bloomsbury group, and Lytton Strachey declared that Principia Ethica marked the rebirth of the Age of Reason. This chapter offers a conceptual analysis of territory, distinguishes it from property accounts, and discusses different versions of property accounts, all derived from Locke’s ‘Second Treatise of Government’. It offers a conceptual analysis of territory and the various rights associated with territory. According to Locke, territorial right is established through the subjection, by free consent, of persons and their land to state authority. This theory is found to rest on a number of flawed assumptions, among them claims to natural rights (...) of property and an obvious link between private property and territorial jurisdiction. Cara Nine draws on Lockean principles to claim that a state is a collective that, like individuals, owns property, namely the territory of the state. After examining the historical antecedents of such ideas, the chapter points away from them and towards accounts of territory based on individual and collective claims of rights. (shrink)

Abstract:This paper is a further development of two previous pieces of work (Moore 2002, 2005) in which modern virtue ethics, and in particular MacIntyre’s (1985) related notions of “practice” and “institution,” have been explored in the context of business. It first introduces and defines the concept of corporate character and seeks to establish why it is important. It then reviews MacIntyre’s virtues-practice-institution schema and the implications of this at the level of the institution in question—the corporation—and argues that the (...) concept of corporate character follows from, but is a novel development of, MacIntyre’s schema. The paper contrasts corporate character and virtues with the more familiar concepts of corporate culture and values. The constitutive and substantive elements of corporate character, including the essential corporate virtues, are then drawn out and illustrated with reference to the cases explored in Koehn (1998). The Breivik case in Norway has motivated a reassessment of Norwegian insanity law by the Norwegian government. Because Norway since 2002 has utilized a “medical model” for legal insanity—a model according to which the legal excuse of insanity is identified with some medical concept such as psychosis—the Norwegian reexamination of its law is not without interest throughout the world. In this paper, I utilize the Anglo-American experience with different medical models for insanity to assess the current Norwegian law on insanity. (...) I defend a strong version of the medical model against standard criticisms advanced against it in the Anglo-American literature, and venture some suggested improvements in how that model was applied in the Breivik case. ‘Why Not Common Morality?’ revisits an important and enduring question: is medical ethics distinct from ‘everyday’ ethics? In her paper, Rosamond Rhodes undertakes the ambitious project of answering this question, in addition to clarifying what constitutes a profession, how professions differ from ‘roles’ and how medical ethics relates to medical professionalism. Rhodes aims to challenge the status quo within medical ethics by departing from the views of certain giants within the field. The paper’s central contention is that the ethics of (...) everyday life and medical ethics are indeed distinct—the latter cannot be derived from the former and we consequently need a new theory of medical ethics. While I am sympathetic to the aims of the project and took no small delight in Rhodes’s gumption, the paper suffers from a number of issues. Putting aside the issue of whether Rhodes accurately represents the theories she critiques—and that is no small thing to set aside—first, many scholars have interrogated in great depth, and from many angles, the relationship between common morality and medical ethics.1–4 Scholarship from the philosophy of medicine, virtue ethics, role-differentiated ethics, narrative and care ethics has made a significant contribution to the projects of clarifying what is distinct about medical professionalism and understanding how we might subsequently treat ethical issues that arise in healthcare with due sensitivity to these myriad differences.5–10 Yet, Rhodes largely ignores this literature …. Moore] Criteria of ineffability are presented which, it is claimed, preclude the possibility of truths that are ineffable, but not the possibility of other things that are ineffable—not even the possibility of other things that are non-trivially ineffable. Specifically, they do not preclude the possibility of states of understanding that are ineffable. This, it is argued, allows for a reappraisal of the dispute between those who adopt a traditional reading of Wittgenstein’s Tractatus and those who adopt the (...) new reading recently championed by Cora Diamond, James Conant, and others. By maintaining that what the nonsense in the Tractatus is supposed to convey is ineffable understanding, rather than ineffable truth, we can do considerable justice to each of these readings. We can also do considerable justice to the Tractatus. /// [Peter Sullivan] Moore proposes to cut between 'traditional' and 'new' approaches to the Tractatus, suggesting that Wittgenstein's intention is to convey, through the knowing use of nonsense, ineffable understanding. I argue, first, that there is indeed room for a proposal of Moore's general kind. In 'A Puzzle about Belief' Saul Kripke appeals to a principle of disquotation that allows us to infer a person's beliefs from the sentences to which she assents (in certain conditions). Kripke relies on this principle in constructing some famous puzzle cases, which he uses to defend the Millian view that the sole semantic function of a proper name is to refer to its bearer. The examples are meant to undermine the anti-Millian objection, grounded in traditional Frege-cases, that truth-value is (...) not always maintained when co-referential names are intersubstituted in belief reports. I argue here that our disquotational practice is sensitive to certain shifts in conversational context, and it is only if we overlook these shifts - if we 'misdisquote' - that we can draw the conclusions Kripke wants to draw from his examples. In the wake of this conclusion, I provide a 'contextualist' treatment of Kripke's puzzle cases. I show how this treatment is motivated by certain norms of rationality, and I defend these norms against an intriguing 'anti-Cartesian' theory of mind. Throughout the paper, I develop the larger implications that my treatment of Kripke's argument has for the semantic theory of names and belief reports, and, more generally, for our picture of the relation between linguistic behaviour and our states of mind. Opposition to inducement payments for research subjects is an international orthodoxy amongst writers of ethics committee guidelines. We offer an argument in favour of these payments. We also critically evaluate the best arguments we can find or devise against such payments, and except in one very limited range of circumstances, we find these unconvincing.

This study examines the notion of antinomy, or unavoidable contradiction, in the work of Pavel Florensky. Many Russian philosophers of the Silver Age shared a common conviction which is yet to receive sufficient attention in critical literature, either in Russia or abroad. This is namely a philosophical and theological dependence on unavoidable contradiction, paradox, or antinomy. The history of antinomy and its Russian reception is introduced here before a new framework for understanding Russian antinomism is defended. This is namely the (...) anticipation of ‘vertical’ antinomies in ‘horizontal’ antinomies. Here, by ‘horizontal’ we suppose an unavoidable contradiction of reason or philosophical reflection, and by ‘vertical’ an unavoidable contradiction of revelation, faith, or a self-contradictory dogma. While there are reasons to believe that both component forces and a resultant force operate on a body in combined circumstances, the threat of overdetermination largely prevents adoption of this view. Accordingly, a lively debate has arisen over which force actually exists and which force is eliminated in combined circumstances, the components or the resultant. In this article I present a non-reductive model of resultant force which ensures the existence of both the resultant force and the component forces without overdetermination. (...) According to the non-reductive model, the resultant force is the summation of component forces, where summation is interpreted as meaning that the component forces, when temporally and spatially overlapping, form a superposed mixture which is the resultant force, but which is not identical to the conjunction of component forces taken with temporal and spatial independence. This essay is concerned with six linguistic moves that we commonly make, each of which is considered in turn. These are: stating rules of representation; representing things categorically; mentioning expressions; saying truly or falsely how things are; saying vaguely how things are; and stating rules of rules of representation. A common-sense view is defended of what is involved in our doing each of these six things against a much more sceptical view emanating from the idea that linguistic behavior is fundamentally (...) messy. Both the fifth move and the sixth move involve vague concepts, and much of the essay is concerned with developing an approach to various problems and puzzles that attach to such concepts, most notably the sorites paradoxes. We take welfarism in moral theory to be the claim that the well-being of individuals matters and is the only consideration that fundamentally matters, from a moral point of view. We argue that criticisms of welfarism due to G.E. Moore, Donald Regan, Charles Taylor and Amartya Sen all fail. The final section of our paper is a critical survey of the problems which remain for welfarists in moral theory.

Previous research has shown that the activation of a goal leads to more implicit positivity toward goal-relevant stimuli. We examined how the actual pursuit of a goal influences subsequent implicit positivity toward such stimuli. Participants were consciously or non-consciously primed with a goal, or not, and then completed a goal-relevant task on which they succeeded or failed. We then measured their goal-relevant implicit attitudes. Those who were primed with the goal (consciously or non-consciously) and experienced success exhibited more implicit positivity (...) toward the goal, compared with the no-goal condition. Experiencing failure in the goal priming conditions reduced implicit positivity toward the goal, indicating disengagement from the goal. We discuss the theoretical implications for understanding the role of implicit attitudes in self-regulation. (shrink)

Using the theft of Indigenous land and territory and the destruction of Indigenous political authorities as an example, this paper examines two theories of territorial rights in relation to their treatment of historical territorial injustices. We apply Simmons’s historical theory of rights over territory, and the occupancy/self-determination theory of territorial rights associated with Moore and Stilz, to three problems: the Continuity Problem, the Particularity Problem, and the Distributive Justice Problem. We argue that the occupancy/self-determination theory is more promising for (...) resolving all three, but that the historical title theory can also be modified to accommodate this insight. (shrink)

All higher education institutions in Finland are committed to following the guidelines of good scientific practice and procedures to handle allegations of misconduct compiled by the Finnish Advisory Board on Research Integrity. However, there is no research available in what way institutions follow these guidelines. This article analyses the current practices of defining and dealing with plagiarism in published Master’s theses. The data consist of 29 written notifications of suspected plagiarism in Master’s theses that were sent to the rectors of (...) universities and decisions on these 29 cases. Inductive content analysis was used to classify the decisions according to definitions of plagiarism, processes to deal with suspicions and sanctions for plagiarism. Due to inconsistency and perplexity in some of the decisions, classifications are overlapping. The main actor in the process is the rector of the higher education institution who bases the decision on the views of preliminary enquirer. Preliminary inquiry has replaced investigation proper and this allows the procedures to remain internal and local. There is no consensus of the definition of plagiarism, and the sanctions for plagiarism vary from nothing to an attempt to revoke a Master’s degree. The adherence of the higher education institutions to the national ethical guidelines is not optimal and leads to inconsistent responses to notifications of suspected plagiarism. (shrink)

Aside from making a few weak, and hopefully widely shared claims about the value of privacy, transparency, and accountability, we will offer an argument for the protection of privacy based on individual self-interest and prudence. In large part, this argument will parallel considerations that arise in a prisoner’s dilemma game. After briefly sketching an account of the value of privacy, transparency, and accountability, along with the salient features of a prisoner’s dilemma games, a game-theory analysis will be offered. In a (...) game where both players want privacy and to avoid transparency and the associated accountability, the dominant action will be to foist accountability and transparency on the other player while attempting to retain one’s own privacy. Simply put, if both players have the ability or power to make the other more accountable and transparent, they will do so for the same reasons that player’s defect in a prisoner’s dilemma game. Ultimately this will lead to a sub-optimal outcome of too much accountability and transparency. While there are several plausible solutions to prisoner dilemma games, we will offer both technical, as well as, law and policy solutions. We need to change the payoffs of the game so that is it in everyone’s interest to balance privacy and accountability rather than foisting transparency on others. (shrink)
