EU regulations explicitly preclude recirculation aquaculture systems (RAS) for aquaculture grow-out from organic certification because they are not close enough to nature (Regulation (EEC) No. 710/2009). Meanwhile, according to another EU regulation, one criterion for organic food production is its contribution to sustainable development (Regulation (EEC) No. 834/2007). Against this background, one might argue that in spite of their distance to nature RAS are innovative solutions to sustainability issues in food production. The paper will deal with the claim that RAS (...) for aquaculture could be one innovative solution to sustainability issues. In this respect, the picture is ambivalent. In the past, the organic movement (OM) has searched for innovative alternatives to industrial forms of agriculture and food production that are non-sustainable. Hence, the majority of the OM does not feel fit to support industrial RAS, even though one might argue that these systems comply with many of the European OM’s founding principles. While there are potential positive effects for a sustainable development, we might still regard these systems as techno-scientific solutions to social problems. This paper discusses innovation narratives related to RAS from the perspective of post-normal innovation critique. It first presents potential contribution to a more sustainable food sector. It then contrasts these arguments within critical assessments of innovation narratives for sustainable development. Finally, the paper concludes by discussing moral challenges of RAS for the OM’s self-conception. (shrink)

For thousands of years, political leaders have unified communities by aligning them against common enemies. However, today more than ever, the search for “common” enemies results in anything but unanimity. Scapegoats like Saddam Hussein, for example, led to a stark polarization in the United States. Renowned neuropsychiatrist and psychologist Jean-Michel Oughourlian proposes that the only authentic enemy is the one responsible for both everyday frustrations and global dangers, such as climate change—ourselves. Oocyte donation raises conflicts of interest and commitment for physicians but little attention has been paid to how to reduce these conflicts in practice. Yet the growing popularity of assisted reproduction has increased the stakes of maintaining an adequate oocyte supply and minimizing conflicts. A growing body of professional guidelines, legal challenges to professional self-regulation, and empirical research on the practice of oocyte donation all call for renewed attention to the issue. As empirical findings better inform existing conflicts and their (...) potential harms, we can better attempt to reduce these conflicts. To that end, the article first describes the nature of conflicts in oocyte donation and relevant regulations and professional guidelines. We then describe studies on conflicts at four phases of oocyte donation: recruitment, screening, stimulation, and post-stimulation monitoring. Next we consider three models for conflict reduction in medicine generally: improved professional self-regulation, outright restriction like Stark anti-referral laws, or the use of conflict mediators, like in living organ donation. We ultimately conclude that improved professional self-regulation is a reasonable starting place for oocyte donation. (shrink)

In order to show how Michel Serres’s work diverges from traditional Western philosophy, this article explores a multitude of texts and contexts against which Serres might be better understood. Most starkly, Serres’s work diverges from the eighteenth and nineteenth century Germanic tradition of Bildung, meaning cultivation through introspection, apolitical thought and character building through education. Serres’s moves away from ego-centric thought to eco-centric thought more akin to what Gregory Bateson called an ecology of mind. That is, Serres’s integrates—in a more (...) ecological fashion—poetry, science, the arts, ecology and politics to raise philosophical questions. Further, this author suggests that Serres’s reference to the nineteenth century poem Pierrot Lunaire ) serves as a trope for Serres’s over-arching philosophy. Pierrot is an artist, a sage, an outlier, a Hermes-like figure who breaks with tradition. Arnold Schoenberg’s atonal performance piece, spoken and sung, shattered the boundaries of classical music. Like Schoenberg’s work, Serres’s work, both in style and content, shatters the boundaries of traditional philosophy. Serres’s breaks open a new paradigm in philosophy. (shrink)

This paper takes its departure from Michel Henry’s criticism of a technological view that “extends its reign to the whole planet, sowing desolation and ruin everywhere” ( I am the Truth , 271). It argues that although Henry’s critique of technology is helpful and important, it does not go far enough, inasmuch as it excludes all non-human beings from the Truth of “Life” he advocates against the destructive truths of technology and therefore cannot fully articulate the way in which technology (...) does in fact cause “desolation and ruin” on the entire planet. At the same time I suggest that this strict division between human and non-human life is not essential to Henry’s project, which may well have resources for a more environmentally friendly proposal. The first part of the paper lays out Henry’s critique of technology in some detail, highlighting the ways in which it contains important insights for our contemporary situation. The second part of the paper explores the stark division Henry draws between human generation from the divine life and the creation of everything else, including his rejection of any identification of humans with “protozoa and honey bees,” which would seem to suggest a complete lack of concern for non-human life. The final part of the paper seeks to find a way beyond this dichotomy by showing how non-human life may be included in Henry’s proposal in a way that extends his critique of technology in environmentally conscious ways without losing his phenomenological insights about the human condition. This paper guides the Romanian reader through a variety of discussions surrounding the central themes of Michel Henry’s latest books (C’est moi la Vérité,1996; Incarnation, 2000). Basically, it aims to present the principles of the phenomenology of Life in Henry’s thought, focusing on the status of the apparition, and of truth, both of which are to be understood not as the ontic relation of adaequatio, but as the self-revelation of Life in the immanence of each non-intentional experience. My review-article draws (...) upon the problem of the ‘original impression’, a crucial stage in shifting the theme of the ‘transcendental body’ and of the ‘self-affection’. At this point, my interpretation suggests that Henry’s phenomenology of affection would require further stark distinctions like the one between the ‘corporeal pain’ and the ‘transcendental sufferance’, very significant from the Christian viewpoint, too. I also try to suggest the importance of Henry’s phenomenology of Life for a radical understanding of bioethics. In addition, I tackle Michel Henry’s strong critique of the autistic sexual love, which sounds strikingly similarly to those raised up, respectively, by S. Kierkegaard and J.-L. Marion. Eventually, my essential claim is that one should reconsider very seriously the importance of the Christian mystical theology (best represented by the Patristic tradition) in order to get an adequate understanding of Michel Henry’s radical phenomenology of Life. Michel Foucault's The Archaeology of Knowledge was published in March 1969; Discipline and Punish in February 1975. Although only six years apart, the difference in tone is stark: the former is a methodological treatise, the latter a call to arms. What accounts for the radical shift in Foucault's approach? Foucault's time in Tunisia had been a political awakening for him, and he returned to a France much changed by the turmoil of 1968. He taught at the experimental University of (...) Vincennes and then moved to a prestigious position at the Collège de France. He quickly became involved in activist work concerning prisons and health issues such as abortion rights, and in his seminars he built research teams to conduct collaborative work, often around issues related to his lectures and activism. Foucault: The Birth of Power makes use of a range of archival material, including newly available documents at the Bibliothèque nationale de France, to provide a detailed intellectual history of Foucault as writer, researcher, lecturer and activist. Through a careful reconstruction of Foucault's work and preoccupations, Elden shows that, while Discipline and Punish may be the major published output of this period, it rests on a much wider range of concerns and projects. Dabei bezieht sie auch die Philosophie von Judith Butler und Byung-Chul Han sowie den Neuen Realismus in ihre kritische Lektüre mit ein und macht die bislang in der Rezeption vernachlässigten philosophischen Bezüge zu Bloch und Kant stark. In 1783 John Michell published a note entitled ‘On the Means of Discovering the Distance, Magnitude etc. of the Fixed Stars, in Consequence of the Diminution of the Velocity of their Light’, but it was Christian Doppler who in 1842 for the first time formulated the principle : If a source of sound or light is in motion relative to an observer, or an observer in motion relative to a source, the period of the waves received by the observer will (...) be different from the period of the waves emitted by the source. The acoustical Doppler principle was verified in 1845 by Buys-Ballot's experiments and by Ernst Mach ). H. Fizeau proposed to verify the optical Doppler principle by measuring the shift of lines in the spectra of stars . This was carried out by William Huggins , and H. C. This paper supports the personal data platform cooperative as a means of bringing about John Rawls’s favoured institutional realisation of a just society, the property-owning democracy. It describes personal data platform cooperatives and applies Rawls’s political philosophy to analyse the institutional forms of a just society in relation to the economic power deriving from aggregating personal data. It argues that a society involving a significant number of personal data platform cooperatives will be more suitable to realising Rawls’s principle of fair (...) equality of opportunity. (shrink)

In this paper we discuss an often-neglected topic in the literature on the ethics of voting. Our aim is to provide an account of what states are obligated to do, so that voters may fulfil their role as public decision-makers in an epistemically competent manner. We argue that the state ought to provide voters with what we call a substantive opportunity for competence. This entails that the state ought to actively foster the epistemic capabilities that are necessary to achieve competent (...) participation in political decision-making practices. (shrink)

In this study, we explore the role of Chief Executive Officers’ incentives, split between monetary and non-monetary, in relation to corporate social responsibility. We base our analysis on a sample of 597 US firms over the period 2005–2009. We find that both monetary and non-monetary incentives have an effect on CSR decisions. Specifically, monetary incentives designed to align the CEO’s and shareholders’ interests have a negative effect on CSR and non-monetary incentives have a positive effect on CSR. The study has (...) important implications for the design of executive remuneration plans, as we show that there are many levers that can affect the CEO’s decisions with regard to CSR. Our evidence also confirms the prominent role of the CEO in relation to CSR decisions, while also recognizing the complexity of factors affecting CSR. In 2003, the South Carolina Supreme Court upheld the conviction of Regina McKnight, an African American woman who was convicted at the age of twenty‐two for committing “homicide by child abuse.” She became the first woman in the United States to be arrested, prosecuted, and convicted for experiencing a stillbirth. Rather than an outlier case in the annals of American jurisprudence that stretched law beyond reason while restraining compassion and justice, McKnight's conviction inspired similar prosecutions of other poor black women (...) and then of other women. More than one‐third of states consider pregnant women's illicit drug use a form of child abuse, resulting in unprecedented forms of criminal and civil punishment. Laws previously understood to protect pregnant women from domestic violence during pregnancy, such as fetal protection laws, now serve as the vehicles for prosecuting pregnant women. What these prosecutions and laws expose are the multitudinous ways in which the criminalization of poor pregnant women—and normalization of that criminalization, such that even doctors and nurses are expected to participate in it—serve to humiliate women, interfere with their reproductive health, and ultimately rob women of reproductive autonomy. This article presents a fairness principle for evaluating decision-making based on predictions: a decision rule is unfair when the individuals directly impacted by the decisions who are equal with respect to the features that justify inequalities in outcomes do not have the same statistical prospects of being benefited or harmed by them, irrespective of their socially salient morally arbitrary traits. The principle can be used to evaluate prediction-based decision-making from the point of view of a wide range of antecedently specified (...) substantive views about justice in outcome distributions. This paper develops a notion of manipulative gaslighting, which is designed to capture something not captured by epistemic gaslighting, namely the intent to undermine women by denying their testimony about harms done to them by men. Manipulative gaslighting, I propose, consists in getting someone to doubt her testimony by challenging its credibility using two tactics: “sidestepping” and “displacing”. I explain how manipulative gaslighting is distinct from reasonable disagreement, with which it is sometimes confused. I also argue for three further claims: (...) that manipulative gaslighting is a method of enacting misogyny, that it is often a collective phenomenon, and, as collective, qualifies as a mode of psychological oppression. For nearly five years, bioethicists and neurologists debated whether Jahi McMath, an African American teenager, was alive or dead. While Jahi's condition provides a compelling study for analyzing brain death, circumscribing her life status to a question of brain death fails to acknowledge and respond to a chronic, if uncomfortable, bioethics problem in American health care—namely, racial bias and unequal treatment, both real and perceived. Bioethicists should examine the underlying, arguably broader social implications of what Jahi's medical treatment and experience (...) represented. On any given day, disparities in the quality of health care and health outcomes for people of color in comparison to whites are evidenced in American hospitals and clinics. These disparities are not entirely explained by differences in patient education, insurance status, employment, income, expressed preference for treatments, and severity of disease. Instead, research indicates that, even for African Americans able to gain access to health care services and navigate institutional nuances, disparities persist across a broad range of services, including diagnostic screening and general medical care, mental health diagnosis and treatment, pain management, HIV‐related care, and treatments for cancer, heart disease, diabetes, and kidney disease. The pluralist sheds the more traditional ideas of truth and ontology. This is dangerous, because it threatens instability of the theory. To lend stability to his philosophy, the pluralist trades truth and ontology for rigour and other ‘fixtures’. Fixtures are the steady goal posts. They are the parts of a theory that stay fixed across a pair of theories, and allow us to make translations and comparisons. They can ultimately be moved, but we tend to keep them fixed temporarily. Apart (...) from considering rigour of proof as a fixture, I discuss fixed models, invariant notions and fixed information about objects across theories. This paper focuses on two legal languages such as the legal English developed by the European Union institutions and the legal Chinese of Mainland China, to study whether the mental representations and the embodied simulation created by the conceptual metaphors for the same Western concept, right, differ in any significant ways. By analysing the data contained in two large corpora, this study has found that, despite the common origin of the concept right in the two legal languages, they conceptualise it (...) in a significantly different fashion. Finally, the findings of this study are read through the theoretical framework proposed for this special issue—hybridity and the Third Space. While it is somewhat straightforward to conceive of Euro English as a hybrid language, owing to the multilingual and supranational setting where it is used, this study has found that the Chinese legal language, too, is a hybrid language exhibiting linguistic features that intersect different belief systems. It is often claimed that democratic voters have epistemic responsibilities. However, it is not often specified why voters have such epistemic responsibilities. In this paper, I contend that voters have epistemic responsibilities because voting is best understood as an act that bears assertoric force. More precisely, voters perform what I call an act of political advocacy whereby, like an asserter who states or affirms that something is the case, they state or affirm that a certain course of political action is (...) the one that should be followed or enacted. Consequently, the performance of acts of political advocacy such as voting should be understood as bounded by epistemic norms mirroring those binding the act of assertion and yield epistemic responsibilities mirroring the ones required to satisfy these norms. Summary By introducing the concept of “invariants”, Koffka endowed perceptual psychology with a flexible theoretical tool, which is suitable for representing vision situations in which a definite part of the stimulus pattern is relevant but not sufficient to determine a corresponding part of the perceived scene. He characterised his “invariance principle” as a principle conclusively breaking free from the “old constancy hypothesis”, which rigidly surmised point-to-point relations between stimulus and perceptual properties. In this paper, we explain the basic terms and (...) assumptions implicit in Koffka’s concept, by representing them in a set-theoretic framework. Then, we highlight various aspects and implications of the concept in terms of answers to six separate questions: forms of invariants, heuristic paths to them, what is invariant in an invariant, roots of conditional indeterminacy, variability vs. indeterminacy, and overcoming of the indeterminacy. Lastly, we illustrate the lasting value and theoretical power of the concept, by showing that Koffka’s insights relating to it do occur in modern perceptual psychology and by highlighting its role in a model of perceptual transparency. In this paper we argue that transparency of machine learning algorithms, just as explanation, can be defined at different levels of abstraction. We criticize recent attempts to identify the explanation of black box algorithms with making their decisions (post-hoc) interpretable, focusing our discussion on counterfactual explanations. These approaches to explanation simplify the real nature of the black boxes and risk misleading the public about the normative features of a model. We propose a new form of algorithmic transparency, that consists in (...) explaining algorithms as an intentional product, that serves a particular goal, or multiple goals (Daniel Dennet’s design stance) in a given domain of applicability, and that provides a measure of the extent to which such a goal is achieved, and evidence about the way that measure has been reached. We call such idea of algorithmic transparency “design publicity.” We argue that design publicity can be more easily linked with the justification of the use and of the design of the algorithm, and of each individual decision following from it. In comparison to post-hoc explanations of individual algorithmic decisions, design publicity meets a different demand (the demand for impersonal justification) of the explainee. Finally, we argue that when models that pursue justifiable goals (which may include fairness as avoidance of bias towards specific groups) to a justifiable degree are used consistently, the resulting decisions are all justified even if some of them are (unavoidably) based on incorrect predictions. For this argument, we rely on John Rawls’s idea of procedural justice applied to algorithms conceived as institutions. (shrink)

Ethical reflection on Artificial Intelligence (AI) has become a priority. In this article, we propose a methodological model for a comprehensive ethical analysis of some uses of AI, notably as a replacement of human actors in specific activities. We emphasize the need for conceptual clarification of relevant key terms (e.g., intelligence) in order to undertake such reflection. Against that background, we distinguish two levels of ethical analysis, one practical and one theoretical. Focusing on the state of AI at present, we (...) suggest that regardless of the presence of intelligence, the lack of morally relevant features calls for caution when considering the role of AI in some specific human activities. In recent years, scepticism about democracy’s ability to deliver good political decisions has resurfaced. In response, some political philosophers have argued that we should replace democracy with epistocracy. In this political system, the exercise of political decision-making powers – including the exercise of the right to vote – is made formally conditional on a sufficient degree of political competence. The purpose of this thesis is to evaluate the normative justifiability of epistocracy. Whereas most political philosophers firmly reject epistocracy and support (...) democracy, I will instead defend an uncommon middle-ground view. More precisely, I will defend what I call the civic argument for epistemic constraints on voting. According to this argument, voters have a civic duty (an obligation grounded in the normativity of joint agency) to uphold the demands associated with their role in political decision making practices and owe each other compliance with this duty. Given the distinctively epistemic dimension that characterizes their role, the civic duty of voters is to act in an epistemically responsible way by exercising a cluster of epistemic capacities. I then contend that some limited constraints on participation in voting can be normatively justified as a way to ensure, as much as possible, that voters act in an epistemically responsible way. This view provides a novel contribution to the debate, one that can resist some standard egalitarian objections to epistocracy and yet avoid some of the most radical conclusions of standard accounts of epistocracy. Recent epidemiological reports of associations between socioeconomic status and epigenetic markers that predict vulnerability to diseases are bringing to light substantial biological effects of social inequalities. Here, we start the discussion of the moral consequences of these findings. We firstly highlight their explanatory importance in the context of the research program on the Developmental Origins of Health and Disease (DOHaD) and the social determinants of health. In the second section, we review some theories of the moral status of health inequalities. (...) Rather than a complete outline of the debate, we single out those theories that rest on the principle of equality of opportunity and analyze the consequences of DOHaD and epigenetics for these particular conceptions of justice. We argue that DOHaD and epigenetics reshape the conceptual distinction between natural and acquired traits on which these theories rely and might provide important policy tools to tackle unjust distributions of health. Here, we provide an ethical analysis of discrimination in private insurance to guide the application of non-discriminatory algorithms for risk prediction in the insurance context. This addresses the need for ethical guidance of data-science experts, business managers, and regulators, proposing a framework of moral reasoning behind the choice of fairness goals for prediction-based decisions in the insurance domain. The reference to private insurance as a business practice is essential in our approach, because the consequences of discrimination and predictive inaccuracy in (...) underwriting are different from those of using predictive algorithms in other sectors. Here we focus on the trade-off in the extent to which one can pursue indirect non-discrimination versus predictive accuracy. The moral assessment of this trade-off is related to the context of application—to the consequences of inaccurate risk predictions in the insurance domain. (shrink)

After three proceedings in which neuroscience was a relevant factor for the final verdict in Italian courts, for the first time a recent case puts in question the legal relevance of neuroscientific evidence. This decision deserves international attention in its underlining that the uncertainty still affecting neuroscientific knowledge can have a significant impact on the law. It urges the consideration of such uncertainty and the development of a shared management of it.

This paper investigates the compatibility between the theoretical framework of the global neuronal workspace theory (GNWT) of conscious processing and the perturbational complexity index (PCI). Even if it has been introduced within the framework of a concurrent theory (i.e. Integrated Information Theory), PCI appears, in principle, compatible with the main tenet of GNWT, which is a conscious process that depends on a long-range connection between different cortical regions, more specifically on the amplification, global propagation, and integration of brain signals. Notwithstanding (...) this basic compatibility, a number of limited compatibilities and apparent differences emerge. This paper starts from the description of brain complexity, a notion that is crucial for PCI, to then summary of the main features of PCI and the main tenets of GNWT. Against this background, the text explores the compatibility between PCI and GNWT. It concludes that GNWT and PCI are fundamentally compatible, even though there are some partial disagreements and some points to further examine. (shrink)

Alongside significant gains in our understanding of the human mind, research in Cognitive Science has produced substantial evidence that the details of cognitive processes vary across cultures, contexts, and individuals. In order to arrive at a more nuanced account of the workings of the human mind, in this letter we argue that one challenge for the future of Cognitive Science is the integration of this evidence of variation with findings which can be generalized.

The intriguing issue of pain and suffering in patients with disorders of consciousness (DOCs), particularly in Unresponsive Wakefulness Syndrome/Vegetative State (UWS/VS) and Minimally Conscious State (MCS), is assessed from a theoretical point of view, through an overview of recent neuroscientific literature, in order to sketch an ethical analysis. In conclusion, from a legal and ethical point of view, formal guidelines and a situationist ethics are proposed in order to best manage the critical scientific uncertainty about pain and suffering in DOCs (...) and ensure the best possible care for the patient. We are told that there are standards of rigour in proof, and we are told that the standards have increased over the centuries. This is fairly clear. But rigour has also changed its nature. In this paper we as-sess where these changes leave us today.1 To motivate making the new assessment, we give two illustra-tions of changes in our conception of rigour. One, concerns the shift from geometry to arithmetic as setting the standard for rig-our. The other, concerns the notion (...) of effective proof or compu-tations. To make the assessment, we look at one motivation for increasing the rigour of a mathematical argument: explicitness and honesty. We then present a standard of rigour by means of a characterisation developed with reference to what we call ‘an account-proof’. We evaluate the standard with reference to the motivation. With the analysis we discover that, regardless of the motivations for rigour, the standard is almost never met, and that the motivations are not all satisfied. It follows that, in some sense, the motivations have misfired. The misfiring suggests to us that we re-assess our notion of rigour. We think of rigour as a relative term. Moreover, the standard for rigour depends on philosophical underpinnings. The strength of the argument of this paper rests on the plausibility of our selection of motivations and on the plausibility of our standard. (shrink)

I present a formal language that imposes a structure on processes in macro-chemistry. Each symbol in the language invites a type of analysis that is carried out either by looking into the semantics if the language or by looking at the context. Every formal language has assumptions underlying it. The assumptions made in developing the formal language are meant to help with conceptual analysis by inviting certain types of question.

In English, deictic verbs of motion, such ascomecan encode the perspective of the speaker, or another individual, such as the addressee or a narrative protagonist, at a salient reference time and location, in the form of an indexical presupposition. By contrast, Spanish has been claimed to have stricter requirements on licensing conditions forvenir(“to come”), only allowing speaker perspective. An open question is how a bilingual learner acquiring both English and Spanish reconciles these diverging language-specific restrictions. We face this question head (...) on by investigating narrative productions of young Spanish-English bilingual heritage speakers of Spanish, in comparison to English monolingual and Spanish dominant adults and children. We find that the young heritage speakers producevenirin linguistic contexts where most Spanish adult speakersdo not, but where English monolingual speakersdo, and also resemble those of young monolingual Spanish speakers of at least one other Spanish dialect, leading us to generate two mutually-exclusive hypotheses: (a) the encoding of speaker perspective in the young heritage children is cross-linguistically influenced by the more flexible and dominant language (English), resulting in a wider range of productions by these malleable young speakers than the Spanish grammar actually allows, or (b) the young Spanish speakers are exhibiting productions that are in fact licensed in the grammar, but which are pruned away in the adult productions, being supplanted by other forms as the lexicon is enriched. Given independent evidence of the heritage speakers' robust Spanish linguistic competence, we turn to systematically-collected acceptability judgments of three dialectal varieties of monolingual adult Spanish speakers of the distribution of perspective-taking verbs, to assess their competence and adjudicate between (a) and (b). We find that adultsaccept venirin contexts in which they do notproduceit, leading us to argue that (a)venirisnotobligatorily speaker-oriented in Spanish, as has been claimed, (b) adults may not producevenirin these contexts because they instead select more specific motion verbs, and (c) for heritage bilingual children, the more dominant language (English) may support the grammatically licensed but lexically-constrained productions in Spanish. The domains of religious doctrine and practice provide ground for double bind analysis, particularly as applied to race, religion, and bioethics. In these spheres, reconciling church doctrine with social or medical practice is often challenging; the demands from each sphere are unique and sometimes irreconcilable. This chapter uses double bind theory as a framework to engage in a dialogue concerning race, religion, and bioethics. It offers a dialogue that scrutinizes conservative religious thought in what is colloquially known as the “black (...) church” regarding the challenges of medical ethics and race. (shrink)
