This paper examines how the Barthesian difference between écrivains et écrivants can help analyse H.L.A. Hart’s Open Texture of the law. By comparing literary and judicial interpretation, one is able to better understand how lawyers, judges, and legislators can better interpret, use, and draft legislation and case law. In using concrete examples of legislation with regard to the phrase “cruel and usual”, this paper evaluates different interpretive techniques, uncovering key differences. In particular, it compares what implications the Death of the (...) Author would have on legislation that may be considered as vague, or open-ended. Could this mean the Death of the Legislator? What kind of impact may this have on a democracy’s authority? Ultimately, it is suggested that Barthe’s interpretive literary theories are undesirable when it comes to deciphering legislation. Indeed, more concrete and structured approaches are needed. (shrink)

Jewish Agrarian Movements (JAM hereafter) in North America express the many different shapes and iterations of Jewish farming on the continent, grounded in historical perspectives that influence current practices and activities. From within this diversity, common threads emerge with much to contribute to agrarian social movements and scholarship. Jewish values of returning (_t_’_shuvah_), releasing (_shmitah_), and repairing (_tikkun_), along with theories of _doikayt_ (an anti-zionist movement around “hereness”) and radical diasporism, animate JAM’s critical engagement with agri-food systems. As researchers who (...) have both studied and participated in Jewish agrarianism in a variety of U.S. and Canadian contexts, we solidify a series of themes and tensions that emerge from JAM: diaspora and indigeneity, modernity and tradition, Jewish agroecological knowledge production, and lived religion. We argue that, while JAM has not yet been examined thoroughly within critical food scholarship, it has the potential to contribute to broader debates and frameworks within sub-fields such as radical food geographies, critical agrarianism, and decoloniality. Without consideration of JAM as a part the study of food and agriculture, there are risks of marginalization of farmers, activists and researchers of Jewish identity. (shrink)

In their 2010 book, Biology’s First Law, D. McShea and R. Brandon present a principle that they call ‘‘ZFEL,’’ the zero force evolutionary law. ZFEL says (roughly) that when there are no evolutionary forces acting on a population, the population’s complexity (i.e., how diverse its member organisms are) will increase. Here we develop criticisms of ZFEL and describe a different law of evolution; it says that diversity and complexity do not change when there are no evolutionary causes.

Peer review is a widely accepted instrument for raising the quality of science. Peer review limits the enormous unstructured influx of information and the sheer amount of dubious data, which in its absence would plunge science into chaos. In particular, peer review offers the benefit of eliminating papers that suffer from poor craftsmanship or methodological shortcomings, especially in the experimental sciences. However, we believe that peer review is not always appropriate for the evaluation of controversial hypothetical science. We argue that (...) the process of peer review can be prone to bias towards ideas that affirm the prior convictions of reviewers and against innovation and radical new ideas. Innovative hypotheses are thus highly vulnerable to being “filtered out” or made to accord with conventional wisdom by the peer review process. Consequently, having introduced peer review, the Elsevier journal Medical Hypotheses may be unable to continue its tradition as a radical journal allowing discussion of improbable or unconventional ideas. Hence we conclude by asking the publisher to consider re-introducing the system of editorial review to Medical Hypotheses. (shrink)

Co-opting the PLO analyzes the Oslo Accords, the interim self-government agreements signed between the government of Israel and the Palestine Liberation Organization, using a theoretical framework based on the work of Gilles Deleuze and Michael Hardt. Guided by these theoretical insights, Weinberger puts forth an innovative and provocative argument about Israel's simultaneous empowerment and disempowerment of its Palestinian partners-in-peace.

The aim of this paper is to offer a conceptual analysis of Weinberg's proof of the spin-statistics theorem by comparing it with Pauli's original proof and with the subsequent textbook tradition, which typically resorts to the dichotomy positive energy for half-integral spin particles/microcausality for integral-spin particles. In contrast to this tradition, Weinberg's proof does not directly invoke the positivity of the energy, but derives the theorem from the single relativistic requirement of microcausality. This seemingly innocuous difference marks an important change (...) in the conceptual basis of quantum physics. Its historical, theoretical, and conceptual roots are here reconstructed. The link between Weinberg's proof and Pauli's original is highlighted: Weinberg's proof turns out to do justice to Pauli's anti-Dirac lines of thought. The work of Furry and Oppenheimer is also surveyed as a “third way” between the textbook tradition established by Pauli and Weinberg's approach. (shrink)

Much forensic inference based upon DNA evidence is made assuming Hardy-Weinberg Equilibrium (HWE) for the genetic loci being used. Several statistical tests to detect and measure deviation from HWE have been devised, and their limitations become more obvious when testing for deviation within multiallelic DNA loci. The most popular methods-Chi-square and Likelihood-ratio tests-are based on asymptotic results and cannot guarantee a good performance in the presence of low frequency genotypes. Since the parameter space dimension increases at a quadratic rate on (...) the number of alleles, some authors suggest applying sequential methods, where the multiallelic case is reformulated as a sequence of “biallelic” tests. However, in this approach it is not obvious how to assess the general evidence of the original hypothesis; nor is it clear how to establish the significance level for its acceptance/rejection. In this work, we introduce a straightforward method for the multiallelic HWE test, which overcomes the aforementioned issues of sequential methods. The core theory for the proposed method is given by the Full Bayesian Significance Test (FBST), an intuitive Bayesian approach which does not assign positive probabilities to zero measure sets when testing sharp hypotheses. We compare FBST performance to Chi-square, Likelihood-ratio and Markov chain tests, in three numerical experiments. The results suggest that FBST is a robust and high performance method for the HWE test, even in the presence of several alleles and small sample sizes. (shrink)

Rivka Weinberg advances an error theory of ultimate meaning with three parts: (1) a conceptual analysis, (2) the claim that the extension of the concept is empty, and (3) a proposed fitting response, namely being very, very sad. Weinberg’s conceptual analysis of ultimate meaning involves two features that jointly make it metaphysically impossible, namely (i) the separateness of activities and valued ends, and (ii) the bounded nature of human lives. Both are open to serious challenges. We offer an internalist alternative (...) to (i) and a relational alternative to (ii). Statistical tests that detect and measure deviation from the Hardy-Weinberg equilibrium (HWE) have been devised but are limited when testing for deviation at multiallelic DNA loci is attempted. Here we present the full Bayesian significance test (FBST) for the HWE. This test depends neither on asymptotic results nor on the number of possible alleles for the particular locus being evaluated. The FBST is based on the computation of an evidence index in favor of the HWE hypothesis. A great deal of (...) forensic inference based on DNA evidence assumes that the HWE is valid for the genetic loci being used. We applied the FBST to genotypes obtained at several multiallelic short tandem repeat loci during routine parentage testing; the locus Penta E exemplifies those clearly in HWE while others such as D10S1214 and D19S253 do not appear to show this. This chapter places some historically interesting actual positions among the possible positions on psychological reality, on linguistic competence. There is strong evidence that Chomsky is committed to the Representational Thesis, but that commitment is open to question. Although Fodor, Bever, and Garrett, Bresnan and Kaplan, and Berwick and Weinberg all seem to subscribe to RT, it is often unclear what role, if any, RT plays in their theories of language use. Matthews rejects RT. Philosophical conceptual analysis is an experimental method. Focusing on this helps to justify it from the skepticism of experimental philosophers who follow Weinberg, Nichols & Stich. To explore the experimental aspect of philosophical conceptual analysis, I consider a simpler instance of the same activity: everyday linguistic interpretation. I argue that this, too, is experimental in nature. And in both conceptual analysis and linguistic interpretation, the intuitions considered problematic by experimental philosophers are necessary but epistemically irrelevant. They are like variables introduced (...) into mathematical proofs which drop out before the solution. Or better, they are like the hypotheses that drive science, which do not themselves need to be true. In other words, it does not matter whether or not intuitions are accurate as descriptions of the natural kinds that undergird philosophical concepts; the aims of conceptual analysis can still be met. In this paper, I present a new framework supporting the claim that some elements in science play a constitutive function, with the aim of overcoming some limitations of Friedman's (2001) account. More precisely, I focus on what I consider to be the gradualism implicit in Friedman's interpretation of the constitutive a priori, that is, the fact that it seems to allow for degrees of 'constitutivity'. I tease out such gradualism by showing that the constitutive character Friedman aims to track can (...) be captured by three features - namely, quasi-axiomaticity (QA), generative potential (GP), and empirical shielding (ES) - which are exhibited to a maximal degree by the examples Friedman deploys, particularly in his analysis of Newtonian mechanics. I argue that not all varieties of 'constitutivity' can be captured by the kind of gradualism implicit in Friedman's view, although developing the gradualism itself might provide useful insights. To show this, I analyse the function of the Hardy-Weinberg principle (HWP) in population genetics in terms of its QA, GP, and ES. Whereas the HWP does not count as constitutive in classical philosophical interpretations (Sober 1984), nor does it within Friedman's framework, it does nonetheless perform a minimally constitutive function. By means of historical details and considerations on the prospects of replacing the HWP, I show that the HWP is minimally constitutive by being a counterfactual instantiation of a paradigmatically constitutive stability principle, where the latter might itself be regarded as an enabling condition for a variety of modelling practices across the sciences. Uncovering the historical roots of naturalistic, secular contemporary ethics, in this volume Michael Gill shows how the British moralists of the seventeenth and eighteenth centuries completed a Copernican revolution in moral philosophy. They effected a shift from thinking of morality as independent of human nature to thinking of it as part of human nature itself. He also shows how the British Moralists - sometimes inadvertently, sometimes by design - disengaged ethical thinking, first from distinctly Christian ideas and then from (...) theistic commitments altogether. Examining in detail the arguments of Whichcote, Cudworth, Shaftesbury, and Hutcheson against Calvinist conceptions of original sin and egoistic conceptions of human motivation, Gill also demonstrates how Hume combined the ideas of earlier British moralists with his own insights to produce an account of morality and human nature that undermined some of his predecessors' most deeply held philosophical goals. Because of the difficulty posed by the contrast between the search for truth and truth itself, Michael Polanyi believes that we must alter the foundation of epistemology to include as essential to the very nature of mind, the kind of groping that constitutes the recognition of a problem. This collection of essays, assembled by Marjorie Grene, exemplifies the development of Polanyi's theory of knowledge which was first presented in Science, Faith, and Society and later systematized in Personal Knowledge. Polanyi (...) believes that the dilemma of the modern mind arises from the peculiar relation between the positivist claim for total objectivity in scientific knowledge and the unprecedented moral dynamism characterizing the social and political aspirations of the last century. The first part of Knowing and Being deals with this theme. Part two develops Polanyi's idea that centralization is incompatible with the life of science as well as his views on the role of tradition and authority in science. The essays on tacit knowing in Part Three proceed directly from his preoccupation with the nature of scientific discovery and reveal a pervasive substructure of all intelligent behavior. Polanyi believes that all knowing involves movement from internal clues to external evidence. Therefore, to explain the process of knowing, we must develop a theory of the nature of living things in general, including an account of that aspect of living things we call "mind." This book challenges the dominant approach to problems of justice in global normative theory and offers a radical alternative designed to transform our thinking about what kind of problem injustice is and how political theorists might do better in understanding and addressing it. It argues that the dominant approach, ideal moral theory (IMT), takes a fundamentally wrong-headed approach to the problem of justice. IMT seeks to work out what an ideally just society would look like, and only then outlines our (...) moral obligations in realizing that ideal. In other words, it ignores the realities of everyday politics. As Michael Goodhart asserts, IMT postpones engagement with actually existing injustices and distorts our understanding of them, and it normalizes many problematic features of our world. On the other hand, the leading alternatives to IMT struggle to make sense of the role values play in politics. This book sees justice as an ideology and develops an innovative bifocal theoretical framework for making sense of it. This framework provides two complementary perspectives on justice: a theoretical perspective that situates competing ideological claims about justice in a broader political context and a partisan perspective that evaluates the structure and coherence of particular conceptions of justice. As opposed to IMT, it focuses on barriers to justice and advocates an activist political theory that takes sides in political struggles against injustice. Goodhart argues that theorists can help to generate the countervailing power necessary for social transformation through the work of articulation, translation, and mapping, work which contributes to a more comprehensive social science of injustice. Viral modernity is a concept based upon the nature of viruses, the ancient and critical role they play in evolution and culture, and the basic application to understanding the role of information and forms of bioinformation in the social world. The concept draws a close association between viral biology on the one hand, and information science on the other – it is an illustration and prime example of bioinformationalism that brings together two of the most powerful forces that now drive (...) cultural evolution. The concept of viral modernity applies to viral technologies, codes and ecosystems in information, publishing, education and emerging knowledge systems. This paper traces the relationship between epidemics, quarantine, and public health management and outlines elements of viral-digital philosophy based on the fusion of living and technological systems. We discuss Covid-19 as a ‘bioinformationalist’ response that represents historically unprecedented level of sharing information from the sequencing of the genome to testing for a vaccination. Finally, we look at the US response to Covid-19 through the lens of infodemics and post-truth. The paper is followed by three open reviews, which further refine its conclusions as they relate to philosophy and the notion of the virus as Pharmakon. (shrink)

This paper raises a problem for the pair of views that universals are immanent in their instantiations and that these instantiations, or states of affairs, are somehow constructed from the instantiated universals. It is argued that the pair is inconsistent. The first view implies that universals are prior to states of affairs, whereas the second view implies that states of affairs are prior to universals. This paper does not attempt to solve this problem, but rather to formulate it precisely. The literature on Kierkegaard is often content to paraphrase. By contrast, Michael Theunissen articulates one of Kierkegaard's central ideas, his theory of despair, in a detailed and comprehensible manner and confronts it with alternatives. Understanding what Kierkegaard wrote on despair is vital not only because it illuminates his thought as a whole, but because his account of despair in The Sickness unto Death is the cornerstone of existentialism. Theunissen's book, published in German in 1993, is widely regarded as the (...) best treatment of the subject in any language. Kierkegaard's Concept of Despair is also one of the few works on Kierkegaard that bridge the gap between the Continental and analytic traditions in philosophy. Theunissen argues that for Kierkegaard, the fundamental characteristic of despair is the desire of the self "not to be what it is." He sorts through the apparently chaotic text of The Sickness unto Death to explain what Kierkegaard meant by the "self," how and why individuals want to flee their selves, and how he believed they could reconnect with their selves. According to Theunissen, Kierkegaard thought that individuals in despair seek to deny their authentic selves to flee particular aspects of their character, their past, or the world, or in order to deny their "mission." In addition to articulating and evaluating Kierkegaard's concept of despair, Theunissen relates Kierkegaard's ideas to those of Heidegger, Sartre, and other twentieth-century philosophers. (shrink)

Most anyone interested in such topics as creation mythology, Jungian theory, or the idea of "secret teachings" in ancient Judaism and Christianity has found "gnosticism" compelling. Yet the term "gnosticism," which often connotes a single rebellious movement against the prevailing religions of late antiquity, gives the false impression of a monolithic religious phenomenon. Here Michael Williams challenges the validity of the widely invoked category of ancient "gnosticism" and the ways it has been described. Presenting such famous writings and movements (...) as the Apocryphon of John and Valentinian Christianity, Williams uncovers the similarities and differences among some major traditions widely categorized as gnostic. He provides an eloquent, systematic argument for a more accurate way to discuss these interpretive approaches.The modern construct "gnosticism" is not justified by any ancient self-definition, and many of the most commonly cited religious features that supposedly define gnosticism phenomenologically turn out to be questionable. Exploring the sample sets of "gnostic" teachings, Williams refutes generalizations concerning asceticism and libertinism, attitudes toward the body and the created world, and alleged features of protest, parasitism, and elitism. He sketches a fresh model for understanding ancient innovations on more "mainstream" Judaism and Christianity, a model that is informed by modern research on dynamics in new religious movements and is freed from the false stereotypes from which the category "gnosticism" has been constructed.
