This article explores the underestimated teaching of the 'five tears' as mystical expression in the text Il dialogo by the Dominican nun and philosopher-theologian, Catherine of Siena. The objective of the article is to indicate the significance of the teaching of the 'five tears', against the backdrop of the wider symbolic function of tears and 'holy grief' in Late Medieval mysticism. After presenting a biographical introduction, the contemplative, communicative and secretive import of the meaning of tears in the Middle Ages (...) are reappraised and applied to The dialogues. By synthesising the scarce references in the relevant secondary literature, the teaching of the five tears are henceforth discussed: the tears of damnation, which are the tears of 'evil and sinful people'; the tears of fear, which are the tears of fallen humankind in the presence of God's judgement; the tears of gratitude, cried by a 'saved humanity' who now 'see and taste God's goodness' ; the perfect tears, cried by people in their selfless disposition toward and love for the human Other; and the sweet tears of tenderness, cried by those who love God and humankind, in a radicalisation of Jesus of Nazareth's summary of the Law, 'more than thyself'. Catherine's teaching of the 'five tears' certainly presents unique features and its own considerations, but should, nevertheless, be interpreted as an extension of the contemplative and secretive functions of 'holy grief' as already presented in Scripture and reconsidered by the Eastern and Western church fathers in the second to the fifth centuries. Catherine's contribution to Medieval mysticism is established therein that she expanded those initial contents by presenting the teaching of the five tears as a ritualised prerequisite for development in the Medieval pilgrim's spiritual itinerary to God.CONTRIBUTION: This article contributes to scholarship in Medieval philosophy by contextualising Catherine of Siena's teaching of the 'five tears' within the wider symbolic realm of tears and 'holy grief' in late Medieval mysticism, stressing the contemplative, communicative and secretive import of tears throughout the Middle Ages. This paper sketches a theory of the reason‐giving force of well‐being that allows us to reconcile our intuitions about two of the most recalcitrant problem cases in population ethics: Jan Narveson's Procreation Asymmetry and Derek Parfit's Non‐Identity Problem. I show that what has prevented philosophers from developing a theory that gives a satisfactory account of both these problems is their tacit commitment to a teleological conception of well‐being, as something to be ‘promoted’. Replacing this picture with one according to which (...) our reasons to confer well‐being on people are conditional on their existence allows me to do better. It also enables us to understand some of the deep structural parallels between seemingly disparate normative phenomena such as procreating and promising. The resulting theory charts a middle way between the familiar dichotomy of narrow person‐affecting theories and totalist or wide‐person affecting theories in population ethics. (shrink)

What moral reasons, if any, do we have to ensure the long-term survival of humanity? This article contrastively explores two answers to this question: according to the first, we should ensure the survival of humanity because we have reason to maximize the number of happy lives that are ever lived, all else equal. According to the second, seeking to sustain humanity into the future is the appropriate response to the final value of humanity itself. Aus ethischer, rechtlicher und sozialwissenschaftlicher Perspektive wirft die Verwendung von humanen embryonalen Stammzellen und induzierten pluripotenten Stammzellen in der Grundlagenforschung, der sich abzeichnenden klinischen Anwendung oder auch der ebenfalls näher rückenden Nutzung von Stammzellen als Testsystemen eine Reihe von Fragen auf, die, neben eher allgemeinen Fragen der Ethik der Stammzellforschung, den Fokus der Beiträge des vorliegenden Sammelbandes bilden.

Transgender people have among the highest rates of suicide attempts of any group in society, driven strongly by the perception that they do not belong in the sex of their physical body. Gender reassignment surgery is a procedure that can change the transgender person’s physical body to accord with their gender identity. The procedure raises important ethical and distributive justice concerns, given the controversy of whether it is a cosmetic or medical procedure and the economic costs associated with performing the (...) procedure. This paper argues that there is a strong case for funding GRS as a matter of clinical necessity and justice. This paper will be divided in four key sections: First, the state of transgender health will be outlined, including the role of GRS and common objections to it. Second, a number of common objections to GRS will be analysed at the outset and shown to be unconvincing. Third, a constructive argument will be advanced, arguing that publicly funded GRS is clinically necessary, cost-effective, and demanded by principles of justice. Fourth, the paper will briefly discuss moralistic biases and why we demand a higher burden of justification for funding GRS compared with other analogous procedures. (shrink)

This article investigates the palimpsest reception of Pseudo-Dionysius (ca. 500) in the metaphysics of Nicholas of Cusa (1401–1464). The article covers Cusa’s political theory and metaphysics, which are intertwined. Reading Cusa against the backdrop of an analysis of Pseudo-Dionysius’ metaphysics in a preceding article, the author, in a synthetic conclusion, isolates seven Dionysic ‘trails’ (S1 to S7) in Cusa’s metaphysics: the interpretation of transcendence as bound to immanence; the affirmation of God’s transcendence in the world (or a metaphysics of ‘creation (...) as teophany’); the radical transcendence and simultaneous radical immanence of God (that is, God as ‘Beingness’); fundamental restrictions of language and the analogical ‘Naming’ of God; creation as a system of dialectical symbols about God; the analogical participation of the subject in creation; and unification (reditus, the ‘flowing of things back to God’). The Dionysic trails in Cusa’s metaphysics are described as a noteworthy, if not important, palimpsest in the corpus of late Medieval philosophy and is indicative of what the author puts forward as ‘discursive memory’, which is presented as a modern-critical concept. Human oversight has become a key mechanism for the governance of artificial intelligence (“AI”). Human overseers are supposed to increase the accuracy and safety of AI systems, uphold human values, and build trust in the technology. Empirical research suggests, however, that humans are not reliable in fulfilling their oversight tasks. They may be lacking in competence or be harmfully incentivised. This creates a challenge for human oversight to be effective. In addressing this challenge, this article aims to make three contributions. (...) First, it surveys the emerging laws of oversight, most importantly the European Union’s Artificial Intelligence Act (“AIA”). It will be shown that while the AIA is concerned with the competence of human overseers, it does not provide much guidance on how to achieve effective oversight and leaves oversight obligations for AI developers underdefined. Second, this article presents a novel taxonomy of human oversight roles, differentiated along whether human intervention is constitutive to, or corrective of a decision made or supported by an AI. The taxonomy allows to propose suggestions for improving effectiveness tailored to the type of oversight in question. Third, drawing on scholarship within democratic theory, this article formulates six normative principles which institutionalise distrust in human oversight of AI. The institutionalisation of distrust has historically been practised in democratic governance. Applied for the first time to AI governance, the principles anticipate the fallibility of human overseers and seek to mitigate them at the level of institutional design. They aim to directly increase the trustworthiness of human oversight and to indirectly inspire well-placed trust in AI governance. (shrink)

Le texte se signale d'une part par sa beaute architectonique et d'autre part par ses difficultes remarquables. Aussi bien un commentaire analytique a-t-il ete presente pour eclairer les vingt syntheses transcendantales de l'expose de 1801. De la sorte l'ensemble ici presente repond au travail (...) effectue il y a vingt ans pour la Doctrine de la science 1794-1795 (oeuvres choisies de philosophie premiere et La liberte humaine dans la philosophie de Fichte). Touraine's critique of the sociological tradition has gradually come to focus on the very notion of society and the basic assumptions associated with it: the interpretation of social life as organized around central principles that are embodied in institutions and internalized by individuals, the tendency to subsume social structure and social change under the same determinants, and the rejection or minimization of the distinction between state and society. In the light of this critique, his earlier attempts to construct a systematic (...) theory seem premature. In particular, the key notion of historicity was overshadowed by the more restrictive concept of the “self-production of society” and the model of a “historical system of action”. But on the other hand, the open questions and unresolved problems of the earlier work underline the need for a further radicalization of the critique of the dominant image of society. This would lead to a conceptualization of social life in terms of interrelations and tensions between structures of culture and structures of power, both of which transcend the social field. A more Weberian perspective would thus replace the residual Durkheimianism of Touraine's earlier writings. (shrink)

Im Zentrum seines Werkes steht Fichtes WL, die er siebenmal bearbeitete. Die zweite Darstellung, die Grundlage der gesamten Wissenschaftslehre , in der er das Wissen von Tatsachen von den Prinzipien der Gegenstandserfahrung aus erörtert, ist die einflußreichste geblieben. Fichte hat in der Gegenstandserfahrung nicht nur die praktischen, sondern auch die theoretischen Prinzipien aufgezeigt und damit die Verbindung von theoretischer und praktischer Vernunft nachgewiesen. Sein Werk wurde durch diese Leistung Ausgangspunkt des deutschen Idealismus.

Die erst im Juli 1980 gefundene, bis dahin gänzlich unbekannte Kolleghandschrift von Krause aus dem Wintersemester 1798/99 erweitert den Wissensstand um die Entwicklung der Philosophie Fichtes zwischen den Jahren 1795 und 1800 in einem erheblichen Maße und markiert eine Zäsur: Fichte scheidet die Philosophie nicht mehr in Theorie und Praxis, sondern faßt sie als eine, als Philosophie überhaupt.
