Belief and Truth: A Skeptic Reading of Plato explores a Socratic intuition about belief, doxa -- belief is "shameful." In aiming for knowledge, one must aim to get rid of beliefs. Vogt shows how deeply this proposal differs from contemporary views, but that it nevertheless speaks to intuitions we are likely to share with Plato, ancient skeptics, and Stoic epistemologists.

Neuronal aggregates involved in conscious awareness are not evenly distributed throughout the CNS but comprise key components referred to as the neural network correlates of consciousness (NNCC). A critical node in this network is the posterior cingulate, precuneal, and retrosplenial cortices. The cytological and neurochemical composition of this region is reviewed in relation to the Brodmann map. This region has the highest level of cortical glucose metabolism and cytochrome c oxidase activity. Monkey studies suggest that the anterior thalamic projection likely (...) drives retrosplenial and posterior cingulate cortex metabolism and that the midbrain projection to the anteroventral thalamic nucleus is a key coupling site between the brainstem system for arousal and cortical systems for cognitive processing and awareness. The pivotal role of the posterior cingulate, precuneal, and retrosplenial cortices in consciousness is demonstrated with posterior cingulate epilepsy cases, midcingulate lesions that de-afferent this region and are associated with unilateral sensory neglect, observations from stroke and vegetative state patients, alterations in blood flow during sleep, and the actions of general anesthetics. Since this region is critically involved in self reflection, it is not surprising that it is similarly a site for the NNCC. Interestingly, information processing during complex cognitive tasks and during aversive sensations such as pain induces efforts to terminate self reflection and result in decreased processing in posterior cingulate and precuneal cortices. The exploration of chemical periodicity over the past 250 years led to the development of the Periodic System of Elements and demonstrates the value of vague ideas that ignored early scientific anomalies and instead allowed for extended periods of normal science where new methodologies and concepts are developed. The basic chemical element provides this exploration with direction and explanation and has shown to be a central and historically adaptable concept for a theory of matter far from the reductionist frontier. This (...) is explored in the histories of Prout’s hypothesis, Döbereiner Triads, element inversions necessary when ordering chemical elements by atomic weights, and van den Broeck’s ad-hoc proposal to switch to nuclear charges instead. The development of more accurate methods to determine atomic weights, Rayleigh and Ramsey’s gas separation and analytical techniques, Moseley’s X-ray spectroscopy to identify chemical elements, and more recent accelerator-based cold fusion methods to create new elements at the end of the Periodic Table point to the importance of methodological development complementing conceptual advances. I propose to frame the crossover from physics to chemistry not as a loss of accuracy and precision but as an increased application of vague concepts such as similarity which permit classification. This approach provides epistemic flexibility to adapt to scientific anomalies and the continued growth of chemical compound space and rejects the Procrustean philosophy of reductionist physics. Furthermore, it establishes chemistry with its explanatory and operational autonomy epitomized by the periodic system of elements as a gateway to other experimental sciences. (shrink)

What is the explanatory role of ‘status-truths’ such as essence-truths, necessity-truths and law-truths? A plausible principle, suggested by various authors, is Ground by Status, according to which status truths ground their prejacents. For instance, if it is essential to a that p, then this grounds the fact that p. But Ground by Status faces a forceful objection: it is inconsistent with widely accepted principles regarding the logic of grounding (Glazier in Philos Stud 174(11):2871–2889, 2017a, Synthese 174(198):1409–1424, 2017b; Kappes in Synthese (...) 199(1–2):2575–2595, 2020, Philos Stud 178(4):1267–1284, 2021). The article discusses retributive justice and punitive restraint in response to the worst types of crime. I take the Breivik Case as a starting point. Anders Behring Breivik was sentenced to 21 years of preventive detention for killing 69 people, mainly youths, at Utøya and 8 people in Oslo on July 22nd, 2011. Retributivist theories as well as commonly held retributive intuitions suggest that much harsher punishment is required for such crimes. According to some retributivist theories, most notably on the (...) influential theories of Kant and Hegel, the death penalty is warranted for murderers like Breivik. This suggests that the rationale for punitive restraint in a case like the Breivik Case can only be found in forward- looking, consequentialist theories of punishment, or by adding to retributivist theories a side-constraint in the form of a principle of parsimony. However, I argue that if we look closer at the function of punishment in the retributivist theories of Kant and Hegel, they too imply a rationale for punitive restraint, even for such horrific crimes as here discussed. Against Kant and Hegel’s own views on the death penalty, I argue that their broader “freedom theories” of retributive justice do not imply the justice of the death penalty or life imprisonment. In the last part of the article, I explore differences in the concepts of freedom entailed by Kant and Hegel’s theories, and I relate these to some of the background factors relevant to the Breivik Case. The role of speed in innovations needs to be explored more thoroughly. I advocate here that for innovations which rely on scarce materials, research into more abundant substitutes needs to be accelerated while a regulatory-driven extension of the product life should slow down the number of incremental innovations and reduce our overall footprint on scarce resources. Chemical elements need to be established as global commons whose overuse can be regulated if required. Part of the efficiency gains of innovations could be (...) used for research to offset the ‘rebound effect’ and provide the public with a return on early infrastructure investments. (shrink)

After introducing the concept of compressed sensing as a complementary measurement mode to the classical Shannon-Nyquist approach, I discuss some of the drivers, potential challenges and obstacles to its implementation. I end with a speculative attempt to embed compressed sensing as an enabling methodology within the emergence of data-driven discovery. As a consequence I predict the growth of non-nomological sciences where heuristic correlations will find applications but often bypass conventional pure basic and use-inspired basic research stages due to the lack (...) of verifiable hypotheses. Av noen teoretikere har dette kravet til fortjent straff blitt forstått som et negativt krav, som setter en begrensning på oppnåelsen av straffens formål. Straffen må da være «ikke ufortjent». I denne artikkelen argumenterer jeg for at en slik forståelse av fortjenesteideen er utilstrekkelig. Straff som fortjent må ansees som et positivt, selvstendig formål for strafferetten. Philip Vogt reassesses specific aspects of Lockean rhetoric: the theory and use of analogy, the characteristic tropes, the topoi that connected Locke with his original and later audiences.

The thesis discusses the justice of state punishment in response to criminal wrongs. The introductory chapter explores the logic of the concept of justice itself, proposing that we understand justice as the function of remedying injustice. This negative approach – studying justice through injustice – allows us to critically evaluate theories of retributive justice via the conceptions of the wrong in crime that they entail, and for which punishment is perceived as a remedy. Examples of the conceptions of the wrong (...) in crime considered in the first part of the thesis are: ‘infringement of mutual freedom’, ‘freeloading’, ‘undermining the mutual benefits of law’, ‘undeserved profit’, ‘harm to the victim’ and ‘material imbalance’. Punishment, upon each of these conceptions, is just to the extent that it remedies the particular wrong of the crime, for instance by cancelling its undeserved profits or by alleviating the harm of the victim. The first part of the thesis culminates in a prolonged discussion of what is deemed the most suitable theory of punishment in a modern democratic state, the ‘Freedom Perspective’ based on a Kantian-Hegelian framework, whereupon crime is wrong because it infringes upon mutual freedom. The second part discusses the possible injustice of punishing severely socially deprived offenders. Specifically, it considers four reasons for the justice of lowering or abstaining from punishment of this group of offenders. These reasons relate to the material, cultural and psychological factors which increase this group’s likelihood of committing crimes and of being punished. These factors are to some extent the result of unjust social structures in society. Hence, this part discusses the links between social justice and criminal justice. Finally, the thesis examines the justice of an alternative way of remedying the wrong in crime: restorative justice processes between victim, offender and other parties to the crime. The concluding remarks are devoted to the meta-issue of how to conceive of justice when facing competing, yet plausible claims of justice. (shrink)

Proponents of the emerging field of P4 medicine argue that computational integration and analysis of patient-specific “big data” will revolutionize our health care systems, in particular primary care-based disease prevention. While many ambitions remain visionary, steps to personalize medicine are already taken via personalized genomics, mobile health technologies and pilot projects. An important aim of P4 medicine is to enable disease prevention among healthy persons through detection of risk factors. In this paper, we examine the current status of P4 medicine (...) in light of historical and current challenges to predictive and preventive medicine, including overdiagnosis and overtreatment. Moreover, we ask whether it is likely that in silico integration of patient-specific data will be able to better deal such challenges and to turn risk predictions into disease-preventive actions in a wider social context. Given the lack of evidence that P4 medicine can tip the balance between benefits and harms in preventive medicine, we raise concerns about the current promotion of P4 medicine as a solution to the current challenges in public health. The practice and development of modern medicine requires large amounts of data, particularly in the domain of cancer. The future of personalized medicine lies neither with “genomic medicine” nor with “precision medicine”, but with “data medicine”. The establishment of this DM has required far-reaching changes, to establish four essential elements connecting patients and doctors: biobanks, databases, bioinformatic platforms and genomic platforms. The “transformation” of scientific research areas, such as genetics, bioinformatics and biostatistics, into clinical specialties has generated a new vision (...) of care. Molecular tumor boards are one response to these changes and are now providing better access to next-generation sequencing and new cancer treatments to patients with inoperable or metastatic cancers, and those for whom the usual treatment has failed. However, MTB face a crucial ethical challenge: maintaining and improving the trust of patients, clinicians, researchers and industry in academic medical centers supported by private or public funding rather than providing genetic data directly to private companies. We believe that, in this era of DM, appropriate modern digital communication networks will be required to maintain this trust and to improve the organization and effectiveness of the system. There is, therefore, a need to reconsider the form and content of informed consent documents at all academic medical centers and to introduce dynamic and electronic informed consent. (shrink)

Artikkelen drøfter hvordan vi bør forstå kravet om likhet for loven i Grl. § 98. Vi spør hvorvidt en appell til likhet for loven har selvstendig normativ funksjon, og eventuelt hvorfor og hva som kreves for at likhetskravets skal realiseres. Artikkelen tar utgangspunkt i et behov for avklaring av disse spørsmålene, da verken forarbeidene til grunnlovsrevisjonen i 2014 eller etterfølgende rettsvitenskapelig litteratur, i særlig grad avklarer hva likhet for loven betyr. Vi utvikler en teori om at likhetsprinsippet i § 98 (...) er et grunnprinsipp for retten som fastlegger begrunnelsesbyrden ved utformingen av lov og annen regulering, og ved rettsanvendelsen. Likhetsprinsippet innebærer at likebehandling krever i seg selv ingen begrunnelse, mens ulikebehandling må kunne begrunnes i henhold til kravene i andre ledd. De to leddene i paragrafen er derfor etter vårt syn uatskillelige: Første ledd stadfester hva som er utgangspunktet, mens andre ledd presiserer hva som ikke regnes som relevante begrunnelser for ulikhet. Likhetskravet er dermed ikke et krav om likt utfall, men et krav om likeverdighet, som vi hevder er en konstitutiv verdi for verdien av politisk rettferdighet.
