ZusammenfassungDer Internistenkongress von 1949 war Anlass und Arena einer breit wahrgenommenen Kontroverse zu epistemologischen Fragen der Psychosomatischen Medizin. Der Beitrag verortet zunächst den Kongress in der Nachkriegsgeschichte und zeichnet die Verlaufslinien der Debatte nach. Dabei werden sowohl die Positionen der Sprecher der Psychosomatischen Medizin – Viktor von Weizsäcker und Alexander Mitscherlich – als auch diejenige von Paul Martini, der auf Basis seiner Methodologie klinischer Forschung grundsätzliche Kritik äußerte, rekonstruiert. In einem zweiten Schritt werden die jeweils unterschiedlichen Auffassungen von Kausalität, (...) Evidenz und Subjektivität herausgearbeitet und kontextualisiert. Das Hauptaugenmerk liegt hierbei auf dem konkreten und expliziten Gebrauch dieser Begriffe bei Martini. Schließlich zeige ich, dass diese Ereignisse im Jahr 1949 als Kulmination einer fortdauernden Kontroverse über wissenschaftliche Evidenz in der klinischen Medizin gelesen werden können, die sich mit ihren Beteiligten und Bezugsebenen über mehrere Jahrzehnte erstreckte. ZusammenfassungDie traditionsreiche Deutsche Gesellschaft für Innere Medizin war durch ihr Agieren in der NS-Zeit belastet. Vor ihrem ersten Nachkriegskongress 1948 in Karlsruhe fiel dem Bonner Klinikdirektor Paul Martini die Rolle eines Reorganisators zu. Martini, der während der NS-Zeit in Opposition zum Regime gestanden hatte, wählte einen Kurs umfassender Integration. Verfolgte des NS-Staats versuchte er ebenso in die DGIM einzubinden wie einstige gemäßigte Nationalsozialisten. Zugleich bemühte er sich um die Bewahrung des gesamtdeutschen Charakters der Kongresse sowie um einen zügigen Anschluss (...) an die internationale Forschung. Dennoch führte der eingeschlagene Weg die DGIM in nur scheinbar unpolitische Wissenschaftlichkeit und Jahrzehnte weitgehender Kritiklosigkeit gegenüber ihrer NS-Geschichte. (shrink)

Ramsey sees this advance in science and technology as a mixed blessing. He examines the ramifications of genetic control, not only the now common measures of birth control and artificial insemination, but also the effect on the genetic pool of the increasing numbers of genetically poor individuals. His concern for humanistic values informs each argument as he tackles such issues as asexual reproduction of men, frozen semen banks, and the breeding of human beings for special purposes. With this book Paul Virilio inaugurated the new science whose object of study is the "dromocratic" revolution. Speed and Politics is the matrix of Virilio's entire work. Building on the works of Morand, Marinetti, and McLuhan, Virilio presents a vision more radically political than that of any of his French contemporaries: speed as the engine of destruction. Speed and Politics presents a topological account of the entire history of humanity, honing in on the technological advances made possible through the (...) militarization of society. Paralleling Heidegger's account of technology, Virilio's vision sees speed—not class or wealth—as the primary force shaping civilization. In this "technical vitalism," multiple projectiles—inert fortresses and bunkers, the "metabolic bodies" of soldiers, transport vessels, and now information and computer technology—are launched in a permanent assault on the world and on human nature. 1 Adaptationism is a research strategy that seeks to identify adaptations and the specific selective forces that drove their evolution in past environments. Since the mid-1970s, paleontologist Stephen J. Gould and geneticist Richard Lewontin have been critical of adaptationism, especially as applied toward understanding human behavior and cognition. Perhaps the most prominent criticism they made was that adaptationist explanations were analogous to Rudyard Kipling's Just So Stories. Since storytelling is an inherent part of science, the criticism refers to the acceptance (...) of stories without sufficient empirical evidence. In particular, Gould, Lewontin, and their colleagues argue that adaptationists often use inappropriate evidentiary standards for identifying adaptations and their functions, and that they often fail to consider alternative hypotheses to adaptation. Playing prominently in both of these criticisms are the concepts of constraint, spandrel, and exaptation. In this article we discuss the standards of evidence that could be used to identify adaptations and when and how they may be appropriately used. Moreover, building an empirical case that certain features of a trait are best explained by exaptation, spandrel, or constraint requires demonstrating that the trait's features cannot be better accounted for by adaptationist hypotheses. Thus, we argue that the testing of alternatives requires the consideration, testing, and systematic rejection of adaptationist hypotheses. Where possible, we illustrate our points with examples taken from human behavior and cognition. For over twenty years, Paul Weithman has explored the thought of John Rawls to ask how liberalism can secure the principled allegiance of those people whom Rawls called 'citizens of faith'. This volume brings together ten of his major essays, which reflect on the task and political character of political philosophy, the ways in which liberalism does and does not privatize religion, the role of liberal legitimacy in Rawls's theory, and the requirements of public reason. The essays reveal Rawls (...) as a thinker deeply engaged with political and existential questions that trouble citizens of faith, and explore how - in firm opposition to political realism - he tries to show that the possibility of liberal democracy and the natural goodness of humanity are objects of reasonable faith. A general conceptual framework for large-scale neocortical dynamics based on data from many laboratories is applied to a variety of experimental designs, spatial scales, and brain states. Partly distinct, but interacting local processes (e.g., neural networks) arise from functional segregation. Global processes arise from functional integration and can facilitate (top down) synchronous activity in remote cell groups that function simultaneously at several different spatial scales. Simultaneous local processes may help drive (bottom up) macroscopic global dynamics observed with electroencephalography (EEG) or (...) magnetoencephalography (MEG). A local/global dynamic theory that is consistent with EEG data and the proposed conceptual framework is outlined. This theory is neutral about properties of neural networks embedded in macroscopic fields, but its global component makes several qualitative and semiquantitative predictions about EEG measures of traveling and standing wave phenomena. A more general “metatheory” suggests what large-scale quantitative theories of neocortical dynamics may be like when more accurate treatment of local and nonlinear effects is achieved. The theory describes the dynamics of excitatory and inhibitory synaptic action fields. EEG and MEG provide large-scale estimates of modulation of these synaptic fields around background levels. Brain states are determined by neuromodulatory control parameters. Purely local states are dominated by local feedback gains and rise and decay times of postsynaptic potentials. Dominant local frequencies vary with brain region. Other states are purely global, with moderate to high coherence over large distances. Multiple global mode frequencies arise from a combination of delays in corticocortical axons and neocortical boundary conditions. Global frequencies are identical in all cortical regions, but most states involve dynamic interactions between local networks and the global system. EEG frequencies may involve a “matching” of local resonant frequencies with one or more of the many, closely spaced global frequencies. In this strikingly original work, Paul W. Kahn rethinks the meaning of political theology. In a text innovative in both form and substance, he describes an American political theology as a secular inquiry into ultimate meanings sustaining our faith in the popular sovereign. Kahn works out his view through an engagement with Carl Schmitt's 1922 classic, _Political Theology: Four Chapters on the Concept of Sovereignty_. He forces an engagement with Schmitt's four chapters, offering a new version of each that (...) is responsive to the American political imaginary. The result is a contemporary political theology. As in Schmitt's work, sovereignty remains central, yet Kahn shows how popular sovereignty creates an ethos of sacrifice in the modern state. Turning to law, Kahn demonstrates how the line between exception and judicial decision is not as sharp as Schmitt led us to believe. He reminds readers that American political life begins with the revolutionary willingness to sacrifice and that both sacrifice and law continue to ground the American political imagination. Kahn offers a political theology that has at its center the practice of freedom realized in political decisions, legal judgments, and finally in philosophical inquiry itself. (shrink)

Paul Ricoeur was one of the most important philosophers of the twentieth century. In this short and accessible book, he turns to a topic at the heart of much of his work: What is translation and why is it so important? Reminding us that The Bible, the Koran, the Torah and the works of the great philosophers are often only ever read in translation, Ricoeur reminds us that translation not only spreads knowledge but can change its very meaning. In (...) spite of these risk, he argues that in a climate of ethnic and religious conflict, the art and ethics of translation are invaluable. Drawing on interesting examples such as the translation of early Greek philosophy during the Renaissance, the poetry of Paul Celan and the work of Hannah Arendt, he reflects not only on the challenges of translating one language into another but how one community speaks to another. Throughout, Ricoeur shows how to move through life is to navigate a world that requires translation itself. Paul Ricoeur died in 2005. He was one of the great contemporary French philosophers and a leading figure in hermeneutics, psychoanalytic thought, literary theory and religion. Our computational metaphysics group describes its use of automated reasoning tools to study Leibniz’s theory of concepts. We start with a reconstruction of Leibniz’s theory within the theory of abstract objects (henceforth ‘object theory’). Leibniz’s theory of concepts, under this reconstruction, has a non-modal algebra of concepts, a concept-containment theory of truth, and a modal metaphysics of complete individual concepts. We show how the object-theoretic reconstruction of these components of Leibniz’s theory can be represented for investigation by means of automated (...) theorem provers and finite model builders. The fundamental theorem of Leibniz’s theory is derived using these tools. (shrink)

This essay explores the mutual reinforcements between socioeconomic precarity and right-wing populism, and then envisions a politics that contests Trumpism through workers’ organizations that create alternatives to predominant patterns of subject formation through work. I first revisit my recent critique of precarity, which initiates a new method of critical theory informed by Paulo Freire’s political pedagogy of popular education. Reading migrant day laborers’ commentaries on their work experiences alongside critical accounts of today’s general work culture, this “critical-popular” procedure yields a (...) conception of precarity with two defining characteristics. First, precarity is socially bivalent: it singles out specific groups for especially harsh treatment even as it pervades society. Second, precarity constitutes subjects through contradictory experiences of time in everyday work-life, exacerbated by insoluble dilemmas of moral responsibility. Antonio Vásquez-Arroyo’s conception of “political literacy” and Bridget Anderson’s notion of “migrantizing the citizen,” in turn, help us understand how precaritization blocks workers from developing the critical dispositions toward time needed for democratic citizenship. This analysis then makes it possible to elucidate, in dialogue with Daniel Martinez-HoSang and Joseph Lowndes, how precaritized worker-citizenship facilitates the cross-class and multiracial appeal of Trumpism’s white supremacist discourse of national economic decline and resurgence, while normalizing the temporal affects of shock and violence characteristic of Trumpism, as theorized by Lia Haro and Romand Coles. Day laborers’ worker centers, I argue, refunction precaritized time, regenerate political literacy, and migrantize the citizen. A large-scale alternative to right-wing populism thus could emerge if the worker center network were expanded throughout the economy. (shrink)

Genomic research—including whole genome sequencing and whole exome sequencing—has a growing presence in contemporary biomedical investigation. The capacity of sequencing techniques to generate results that go beyond the primary aims of the research—historically referred to as “incidental findings”—has generated considerable discussion as to how this information should be handled—that is, whether incidental results should be returned, and if so, which ones.Federal regulations governing most human subjects research in the United States require the disclosure of “the procedures to be followed” in (...) the research as part of the informed consent process. It seems reasonable to assume—and indeed, many commentators have concluded—that genomic investigators will be expected to inform participants about, among other procedures, the prospect that incidental findings will become available and the mechanisms for dealing with them. Investigators, most of whom will not have dealt with these issues before, will face considerable challenges in framing meaningful disclosures for research participants.To help in this task, we undertook to identify the elements that should be included in the informed consent process related to incidental findings. We did this by surveying a large number of genomic researchers (n = 241) and by conducting in‐depth interviews with a smaller number of researchers (n = 28) and genomic research participants (n = 20). Based on these findings, it seems clear to us that routine approaches to informed consent are not likely to be effective in genomic research in which the prospect of incidental findings exists. Ensuring that participants’ decisions are informed and meaningful will require innovative approaches to dealing with the consent issue. We have identified four prototypical models of a consent process for return of incidental findings. (shrink)

This research compares the importance of moral values for corporations' managements, as reported by 97 knowledgeable employees in eight corporations. Does an employee consensus emerge within corporations and does it differ between corporations? To answer this question, an analysis of covariance technique was used to compare the importance of moral values between corporations versus within corporations. Results corroborate the hypothesis that closely matched corporations do differ significantly from one another in the importance of prevailing moral values. Evidence also suggests that (...) the importance of prevailing moral values may be inversely related with company size. Because liberalism is blind to sacrifice, it is unable to explain how the modern state has brought us to both the rule of law and the edge of nuclear annihilation. Arguing from these insights, Kahn offers a new reading of the liberalism/communitarian debate, a genealogy of American liberalism, an exploration of the romantic and the pornographic, a new theory of the will, and a refoundation of political theory on the possibility of sacrifice.Approaching politics from the perspective of sacrifice allows us to understand the character of twentieth-century politics, which combined progress in the rule of law with massive slaughter for the state. Equally important, this work speaks to the most important political conflicts in the world today. It explains why American response to September 11 has taken the form of war, and why, for the most part, Europeans have been reluctant to follow the Americans in their pursuit of a violent, sacrificial politics. Kahn shows us that the United States has maintained a vibrant politics of modernity, while Europe is moving into a postmodern form of the political that has turned away from the idea of sacrifice. : Responding to the paper by Miller and Joffe, we review the development of the concept of therapeutic misconception (TM). Our concerns about TM's impact on informed consent do not derive from the belief that research subjects have poorer outcomes than persons receiving ordinary clinical care. Rather, we believe that subjects with TM cannot give an adequate informed consent to research participation, which harms their dignitary interests and their abilities to make meaningful decisions. Ironically, Miller and Joffe's approach ends up (...) largely embracing the very position that they inaccurately attribute to us: the belief that, with some exceptions, it is only the prospect of poorer outcomes that should motivate efforts to dispel TM. In the absence of empirical studies on the steps required to dispel TM and the impact of such procedures on subject recruitment, it is premature to surrender to the belief that TM must be widely tolerated in clinical research. The object of this paper is to throw light on the reciprocal exchanges between legal philosophy and the theory of speech acts (as developed by Austin and Searle). The first part concerns the contributions to legal philosophy made by the theory of speech acts with a view to developing new perspectives. The second part deals with the contributions of legal philosophy to speech act theory.

The Theaetetus is one of the most widely studied of any of the Platonic dialogues because its dominant theme concerns the significant philosophical question, what is knowledge? In this book Paul Stern provides a full-length treatment of its political character in relationship to this dominant theme. He argues that this approach sheds significant light on the distinctiveness of the Socratic way of life, with respect to both its initial justification and its ultimate character. More specifically, he argues that Socrates' (...) revolutionary decision to subject political life to philosophic reflection, the decision that leads directly to his trial and execution, is based on his awareness of the elusiveness of comprehensive knowledge and the implications of that elusiveness for the validity of philosophic inquiry. Many religiously minded materialist philosophers have attempted to understand the doctrine of the survival of death from within a physicalist approach. Their goal is not to show the doctrine false, but to explain how it can be true. One such approach has been developed by Peter van Inwagen. After explaining what I call the duplication objection, I present van Inwagen’s proposal and show how a proponent might attempt to solve the problem of duplication. I argue that the very features of (...) the view that aid the proponent in responding to the duplication objection entails the possibility of an impossible state of affairs—that two distinct persons can at the same time be identical with the same bundle of material simples. The religiously minded materialist is caught between the horns of a dilemma. One’s view regarding human persons must be robust enough to account for personal identity over time, and so not fall to the duplication objection. At the same time, the view must not entail the possibility of two persons temporarily having complete coincident existence. (shrink)

Many of the contemporary global challenges we face involve economics, and theologians serving the contemporary church cannot escape an engagement with economics. This paper explores the place of future hope in economics through an examination of Adam Smith’s treatment of the topic. It begins by outlining the eighteenth-century theological background of Smith’s work, including Stoicism, the Newtonian tradition of natural theology, and the Calvinism of the Scottish Enlightenment moderates. It argues that the future hope plays an important (and neglected) role (...) in Smith’s system. Future rewards and punishments are never invoked in a utilitarian manner; instead judgment and future life operate as a court of appeal where wrongs on this world are righted. The justice of this divine court of appeal is continuous with and reinforces the natural sense of justice we have in this present life. There can be no conflict between the two because, as Smith affirms, the same ‘great Director of nature’ is at work in both. For Smith the future state also operates as imaginative space where morality can be considered and renegotiated. Moving from the eighteenth to the twenty-first century, some comments are offered on hope and contemporary economics, particularly how they might be brought together again to more fruitfully engage with the global challenges we face. Appelbaum (bio)The work of the Advisory Committee on Human Radiation Experiments confirms once again the value of combining empirical and normative approaches to problems in clinical and research ethics. The Committee, like its predecessor, the President’s Commission for the Study of Ethical Problems in Medicine and Biomedical and Behavioral Research, spent relatively modest sums of money gathering targeted data to inform (...) its deliberations. The results of the Committee’s research, which are discussed by Nancy Kass and Jeremy Sugarman in this issue of the Kennedy Institute of Ethics Journal, enhance our understanding of the current ethical status of human subjects research, helping to focus attention on areas of particular concern, and lay the basis for future research and policy development.My comments here focus on the two major empirical studies conducted by the Committee—the Research Proposal Review Project and the Subject Interview Study. I will underscore just a few of the primary findings from these studies, consider their limitations, and explore their implications. Readers interested in the details of the studies should consult the Committee’s Final Report (ACHRE 1995), on which I rely in part and which provides additional information on the methodology and findings of the studies.Research Proposal Review ProjectWhat can be learned from the Committee’s review of 125 federally-funded human research studies? In answering that question, one cannot ignore the irony inherent in the Committee’s decision to review documents related to institutional review board (IRB) consideration of the selected protocols. The single most frequent complaint about the current system for protecting human subjects is that IRBs focus almost exclusively on review of consent forms and other research documents, as if they bore some close relationship to what actually transpires between investigators and potential research subjects. Only a small number of studies examine the research consent process. Nevertheless, existing data strongly [End Page 283] suggest that subject recruitment often involves an extended process of courtship, during which the information contained in consent forms is only a small part of the information passed between investigators and subjects (Benson, Roth, and Winslade 1985; Lidz et al. 1984).Indeed, the second of the Committee’s studies—the Subject Interview Study, which is discussed below—appears to confirm these findings. In-depth interviews with 99 individuals who reported that they were former or current research subjects suggest that “[f]or many, the decision to participate seemed to have been made before the consent form was given to them, and they signed it almost as a formality” (ACHRE 1995 [GPO, p. 742; Oxford, p. 471]). 1 Why, then, did the Committee focus its attention on documents that in many cases seem to play only a tangential role in the consent process? As is the case with IRBs around the country, the answer appears to be that consent forms and related documents are the only easily available window on consent transactions. In addition, under the current system, consent forms constitute the part of the process that IRBs can influence most easily. Consequently, it suits almost everyone’s needs—except perhaps those of the research subjects—to pretend that they reflect what actually transpires in the recruitment process. To the Committee’s credit, it was well aware of this dilemma. Nonetheless, it struggled to wring valid lessons from these limited data in its Final Report.Perhaps the most interesting finding from the Research Proposal Review Project is just how poor so many consent forms are. Given the disproportionate emphasis that many IRBs place on the content of the forms, one would expect that investigators by now would have learned to design documents that meet objective standards of adequacy, such as those applied by the Committee.
