Recent debate over transubstantiation has concentrated either on transubstantiation as a kind of embarrassment in consequence of modern physics, or on the extent to which it is both a doctrine elaborated in the light of metaphysics and recoverable in consequence of metaphysics having been overcome. In this sense the tension between Aquinas' apparently metaphysical formulation of the doctrine and the less overtly metaphysical formula adopted by the Council of Trent has indicated a way of ‘rescuing’ or ‘recovering’ the doctrine.This article (...) argues that such a recovery is a false trail. Pope Paul VI was right to be wary of relativising the Eucharistic event to the believing community in any doctrine of transignification. Alternatively, attempts like Chauvet's and Macquarrie's to restate Eucharistic event in terms of Heidegger's Geviert presuppose Heidegger has succeeded in destroying the metaphysics of presence, so that they can use the fruits of his researches. What is actually at issue in thinking through transubstantiation is how the doctrine relates to conceptions of the physical: Aristotelian, what comes to be Newtonian, or postmodern conceptions which appear to eschew physics altogether.Heidegger's contribution to the debate would better point to how knowing anything means being included in and disclosed by what I know. A re‐investigation of transubstantiation might therefore take into account the extraordinary reappearance of the term ‘transubstantiation’ in current non‐theological investigations of performativity .Here transubstantiation would include not the maximal meaning of bread and wine as signs constituted in das Geviert, ‘after’ substance has been critiqued, but their minimality, in enacting a change in substance . This would confirm the divinising meaning of the Eucharistic event, which stresses how we are caught up into the divine. Thus, whereas in transignification the Eucharistic event occurs in consequence of the will of the community of believers, in transubstantiation it is the enactment of the community as community that is at issue, an enactment in consequence of no act of will of its own. In terms of the postmodern and non‐theological appropriation of the word transubstantiation, this means that I who participate in the Eucharistic am re‐ordered, or re‐materialised, or ‘trans‐substantiated’ in the Eucharistic event. Cultured meat, like any new technology, raises inevitable ethical issues. For example, on animal ethics grounds, it may be argued that reformed livestock farming in which animals’ lives are worth living constitutes a better alternative than cultured meat, which, along with veganism, implies the extinction of farm animals. Another ethical argument is that, just as we would undermine human dignity by producing and consuming meat that is grown from human cells, eating meat that is grown from nonhuman animal cells would (...) violate animal dignity because it is a way to create an us and them, which would make veganism the only ethical option. The present study challenges this argument. First, I examine the fundamental issue of whether cultured meat provides such an attack on animal dignity. The second issue is whether, assuming that it is true that cultured meat undermines animal dignity, it would be acceptable to reject cultured meat even though this implies sacrificing nonhuman animals. Quantum walks exhibit different properties compared with classical random walks, most notably by linear spreading and localization. In the meantime, random walks that replicate quantum walks, which we refer to as quantum-walk-replicating random walks, have been studied in the literature where the eventual properties of QWRW coincide with those of QWs. However, we consider that the unique attributes of QWRWs have not been fully utilized in the former studies to obtain deeper or new insights into QWs. In this paper, we (...) highlight the directivity of one-dimensional discrete quantum walks via QWRWs. By exploiting the fact that QWRW allows trajectories of individual walkers to be considered, we first discuss the determination of future directions of QWRWs, through which the effect of linear spreading and localization is manifested in another way. Furthermore, the transition probabilities of QWRWs can also be visualized and show a highly complex shape, representing QWs in a novel way. Moreover, we discuss the first return time to the origin between RWs and QWs, which is made possible via the notion of QWRWs. We observe that the first return time statistics of QWs are quite different from RWs, caused by both the linear spreading and localization properties of QWs. (shrink)

Value analysis establishes a way to practice functional analysis which enables to think all matter as sets of functions. The study of the correlations between the phases of activation of these functions leads to consider the aggregation of correlated activation functions as an attractor in a configuration space. This point of view allows figuring out general behaviors reducing the conceptual gap between microeconomics and macroeconomics. Then, based on a characterization of complex adaptive systems in terms of functional attractors, the theory (...) links together value and physical magnitudes, like work or energy and action. The evolution of these systems is studied from the viewpoints of learning or of voluntary and involuntary interactions with others described in the ultimate way by the strategies, or operators, of which they make use. Three kinds of uncertainties are emphasized among which the uncertainty between the structure and the business outlook of a system is recreated through an analogy between physics and economics. The rationality of the complex functional systems economics is based on value and on market or environment awareness. Equilibria establish potential of agents or players whose profiles are built through the equivalence between a time-dependent payoff at equilibrium and the regular value of the corresponding attractor. The law of supply and demand is naturally founded on unbiased profiles of agents and can be a means of uncertainty reduction and of growth. Freedoms are opportunities to grow, when they result in confidence, and to bear risks in decision-making through an innovative process. (shrink)

The use of artificial intelligence (AI) to aid legal decision making has become prominent. This paper investigates the use of AI in a critical issue in employment law, the determination of a worker’s status—employee vs. independent contractor—in two common law countries (the U.S. and Canada). This legal question has been a contentious labor issue insofar as independent contractors are not eligible for the same benefits as employees. It has become an important societal issue due to the ubiquity of the gig (...) economy and the recent disruptions in employment arrangements. To address this problem, we collected, annotated, and structured the data for all Canadian and Californian court cases related to this legal question between 2002 and 2021, resulting in 538 Canadian cases and 217 U.S. cases. In contrast to legal literature focusing on complex and correlated characteristics of the employment relationship, our statistical analyses of the data show very strong correlations between the worker’s status and a small subset of quantifiable characteristics of the employment relationship. In fact, despite the variety of situations in the case law, we show that simple, off-the-shelf AI models classify the cases with an out-of-sample accuracy of more than 90%. Interestingly, the analysis of misclassified cases reveals consistent misclassification patterns by most algorithms. Legal analyses of these cases led us to identify how equity is ensured by judges in ambiguous situations. Finally, our findings have practical implications for access to legal advice and justice. We deployed our AI model via the open-access platform, https://MyOpenCourt.org/, to help users answer employment legal questions. This platform has already assisted many Canadian users, and we hope it will help democratize access to legal advice to large crowds. (shrink)

Braitenberg et al.'s target article presents the best current integration of anatomical and physiological data, and provides a qualitative description of cerebellar function in terms of the dynamics of processes based on the geometry of the cerebellar cortex. We compare the proposed model to our own quantitative model based on the concept of Purkinjeunit.

The identification of regularities in time-dependent functional structures leads to turn patterns, observed according to a given time resolution, into functional attractors on which it is first possible to found any complex system. Rationality is introduced under the form of probabilities for functions to make up a given attractor beyond the first rough descriptive pattern. These physically characterized attractors are the medium enabling the definition of value as an extension of the Prospect Theory overall utility, considering that the actions produced (...) by their functions are outcomes which are modulated by PT psychological value functions and an operational value appears naturally as an optimization taking account of diminishing sensitivity to action efficiency. Nevertheless, this diminishing sensitivity, when applied to negative actions, introduces also a bias of negative externalities underestimation. An attractor-based complex system evolution in an industrial context is described according to Manufacturing Readiness Level and to the main milestones of an industrial project, corresponding to singular points of maturity expressed in terms of probability—or decision—weighting, up to the system release to the market. So, a maturity assessment heuristics is proposed both for the system development and for its marketing. The supply and demand law is established, highlighting that the ideal case of a purely mature economy can be a good approximation reducing the complexity of the exchanges analysis. Equilibria are discussed as depending on an initial point from which the usual Gaussian probability distribution and a speculative weight qualify equilibrium. (shrink)

Le sacramentalisme qu’on s’accorde, depuis longtemps déjà, à reconnaître comme excessif à la fin du Moyen Âge devait conduire Luther puis les autres Réformateurs à dénoncer la « captivité babylonienne » de l’Eglise, notamment sous l’espèce d’une sorte d’emprisonnement de la « Parole de Dieu » dans l’institution sacramentelle, emprisonnement qui fut analogiquement dénoncé, à l’époque moderne, dans l’institution magistérielle de l’Eglise. Cette opposition entre Parole et Sacrement a en outre connu au XXe siècle une sorte de redoublement avec la (...) dichotomie entre la « foi » et la « religion », dichotomie qui a d’ailleurs traversé aussi bien le camp « catholique » que le camp « protestant », la foi étant mise du côté de la Parole, censée être nécessairement plus « pure » que les sacrements, lesquels relèveraient plutôt de la « religion » avec toutes les ambiguïtés que prend alors le terme devenu proche de la « magie ». This opposition between Word and Sacrament has moreover resurfaced in the 20th century, as a dichotomy between “faith” and “religion.” This dichotomy passed through both the “Catholic” and the “Protestant” camps. Faith was allied with the Word, because it was deemed to be necessarily “purer” than the sacraments, which were more a product of “religion” with all its ambiguities, which then takes on a connotation close to “magic.” Perspectives have considerably changed today, so it seems clear that it is possible to remain faithful to the dogmas of the Catholic faith and theologically view the sacraments as flowing directly from the Word. The laser chaos decision maker has been demonstrated to enable ultra-high-speed solutions of multiarmed bandit problems or decision-making in the GHz order. However, the underlying mechanisms are not well understood. In this paper, we analyze the chaotic dynamics inherent in experimentally observed laser chaos time series via surrogate data and further accelerate the decision-making performance via parameter optimization. We first evaluate the negative autocorrelation in a chaotic time series and its impact on decision-making detail. Then, we analyze the decision-making ability (...) using three different surrogate chaos time series to examine the underlying mechanism. We clarify that the negative autocorrelation of laser chaos improves decision-making and that the amplitude distribution of the original laser chaos time series is not optimal. Hence, we introduce a new parameter for adjusting the amplitude distribution of the laser chaos to enhance the decision-making performance. This study provides a new insight into exploiting the supremacy of chaotic dynamics in artificially constructed intelligent systems. (shrink)

During the Zimbabwean crisis, millions crossed through the apartheid-era border fence, searching for ways to make ends meet. Maxim Bolt explores the lives of Zimbabwean migrant labourers, of settled black farm workers and their dependants, and of white farmers and managers, as they intersect on the border between Zimbabwe and South Africa. Focusing on one farm, this book investigates the role of a hub of wage labour in a place of crisis. A close ethnographic study, it addresses the complex, shifting (...) labour and life conditions in northern South Africa's agricultural borderlands. Underlying these challenges are the Zimbabwean political and economic crisis of the 2000s and the intensified pressures on commercial agriculture in South Africa following market liberalization and post-apartheid land reform. But, amidst uncertainty, farmers and farm workers strive for stability. The farms on South Africa's margins are centers of gravity, islands of residential labour in a sea of informal arrangements. Ignorant speech, which spreads falsehoods about people and policies, is pervasive in public discourse. A popular response to this problem recommends countering ignorant speech with more speech, rather than legal regulations. However, Mary Kate McGowan has influentially argued that this ‘counterspeech’ response is flawed, as it overlooks the asymmetric pliability of conversational norms: the phenomenon whereby some conversational norms are easier to enact than subsequently to reverse. After demonstrating that this conversational ‘stickiness’ is an even broader concern for counterspeech than (...) McGowan suggests—it applies not just to oppressive or hateful speech, but also to ordinary policy-related misinformation—I argue that a more sophisticated account of counterspeech can nevertheless overcome it. First, the stickiness objection overlooks the distinction between ‘negative’ and ‘positive’ counterspeech. Instead of directly negating a distorted proposition, positive counterspeech affirms a correct proposition that is inconsistent with the falsehoods at hand. This, I contend, allows it to counter ignorant speech without triggering the properties that render it sticky. Second, the stickiness objection presupposes an unrefined conception of counterspeech’s temporality. Counterspeech should be understood as a diachronic process, which not only follows, but also pre-empts, ignorant utterances. Drawing on speech-act theories of silencing, I argue that pre-emptive counterspeech can condition the conversational context so as to prevent subsequent ignorant utterances from enacting sticky conversational norms. Thus, this theoretically-refined conception of counterspeech helps appreciate how verbal responses might overcome the stickiness of conversational norms; and, in doing so, it reveals that this stickiness need not provide reasons to prefer legal remedies to counterspeech. The notions of perceptual normativity and optimality have generated much discussion in the last decade or so in the literature on Merleau-Ponty. Husserl’s position on the topic has been far less extensively investigated. Surprisingly, however, Husserl wrote a great deal about the question of perceptual optimality. Not only are there a considerable number of important passages scattered throughout the manuscripts, the archive also contains a few important full texts on precisely this issue. Given the role of fulfillment for Husserl’s concept (...) of intentionality, this should not really come as a surprise, since the teleological nature of the fulfillment structure terminates in an experience of the optimum. Hence, however marginal this topic might seem at first glance, reflecting on it rapidly leads us to the heart of Husserl’s project and sheds further light on his conception of intentional experience. Faced with hate speech, oppressed groups can use their own speech to respond to their verbal oppressors. This “counterspeech,” however, sometimes itself takes on a hateful form. This paper explores the moral standing of such “hateful counterspeech.” Is there a fundamental moral asymmetry between hateful counterspeech, and the hateful utterances of dominant or oppressive groups? Or are claims that such an asymmetry exists indefensible? I argue for an intermediate position. There _is_ a key moral asymmetry between these two forms of (...) speech. But, this asymmetry notwithstanding, hateful counterspeech is capable of enacting serious harms—and so, contrary to what many legal theorists have argued, it is in principle an appropriate object of legal regulation. I begin by considering the central argument for thinking that hateful counterspeech is not seriously troubling. This argument holds that oppressed groups lack authority—and, by extension, “speaker power.” Yet this argument, I suggest, sits in tension with the fact that low-status members of dominant groups can, through their utterances, seriously harm members of oppressed groups. Philosophers of language have developed sophisticated arguments to explain this last phenomenon: they have argued that speaker power is relativised to particular jurisdictions; that it can be acquired dynamically in local settings; and that it is socially dispersed. I argue that, in light of these arguments, it appears that hateful counterspeech, too, can generate serious harms. Nevertheless, I show that this conclusion is compatible with recognising a crucial moral asymmetry between hateful counterspeech and the hate speech of oppressors. (shrink)

This present book explores recent advances in modeling discourse processes, in particular, new approaches aimed at understanding pathological language behavior specific to schizophrenia. The contributors examine the modeling paradigm of formal semantics, which falls within the scope of both linguistics and logic while providing overlapping links with other fields such as philosophy of language and cognitive psychology. This book is based on results presented during the series of workshops on Coherence and Discourse organized by SLAM, a project developed to systemize (...) the study of pathological language processing by taking an overarching interdisciplinary approach combining psychology, linguistics, computer science and philosophy. The principle focus is on conversations produced by people with psychiatric disorders such as schizophrenia and autism. Most twentieth‐century European philosophers have attempted to think anew the Kantian question about the necessary conditions of experience. A rapid survey of last century's European philosophy would easily show that in spite of the various criticisms formulated against the very project of transcendental foundationalism, the vast majority of the philosophers in the so‐called Continental tradition have not abandoned the project of formulating transcendental arguments altogether. These transcendental inquiries into the conditions of possibility of all these phenomena are certainly more immediately (...) visible in the early works, especially those on Husserl, but a patient reading would show that they are still very much present in the later writings as well. The overcoming of classical transcendentalism at work in deconstruction is indeed the outcome of an ultra‐transcendental strategy. In Of Grammatology, Derrida exposes this ultra‐transcendental logic for the first time when he famously claims that a “pathway” through the transcendental is necessary. (shrink)

When is choice affected by subliminal messages? This question has fascinated scientists and lay people alike, but it is only recently that reliable empirical data began to emerge. In the current paper we bridge the literature on implicit motivation and that on subliminal persuasion. We suggest that motivation in general, and implicit motivation more specifically, plays an important role in subliminal persuasion: It sensitizes us to subliminal cues. To examine this hypothesis we developed a new paradigm that allows powerful tests (...) of subliminal influences as well as stringent assessments of subliminality. The results of two experiments suggest that implicit motivation can enhance the effects of subliminal priming on choice. (shrink)

According to an influential objection, which Martha Nussbaum has powerfully restated, expressing anger in democratic public discourse is counterproductive from the standpoint of justice. To resist this challenge, this article articulates a crucial yet underappreciated sense in which angry discourse is epistemically productive. Drawing on recent developments in the philosophy of emotion, which emphasize the distinctive phenomenology of emotion, I argue that conveying anger to one’s listeners is epistemically valuable in two respects: first, it can direct listeners’ attention to elusive (...) morally relevant features of the situation; second, it enables them to register injustices that their existing evaluative categories are not yet suited to capturing. Thus, when employed skillfully, angry speech promotes a greater understanding of existing injustices. The idea that our perceptual openness to the world is normative can mean different things. In the Kantian tradition of Peter Strawson, Wilfrid Sellars and John McDowell, this openness is essentially tied to epistemic justification, that is to say, to our readiness to provide reasons for our actions and our beliefs about how things are. In the phenomenological tradition inaugurated by Edmund Husserl, the notion of norm-responsiveness that is relevant to perceptual experience has less to do with epistemic justification than (...) with perception’s capacity to guide action or elicit certain behaviors. In the lectures on Active and Passive Synthesis, Husserl explains how perception involves a pull towards gaining a more optimal view of the object by moving around it or scrutinizing it in various ways. On his part, Maurice Merleau-Ponty invokes the notion of norm in reference to our capacity to skillfully move our bodies and alter our points of view according to the particular demands of our perceptual situation. Intensity profiles of emotional experience over time have been found to differ primarily in explosiveness and accumulation. However, the determinants of these temporal features remain poorly understood. In two studies, we examined whether emotion regulation strategies are predictive of the degree of explosiveness and accumulation of negative emotional episodes. Participants were asked to draw profiles reflecting changes in the intensity of emotions elicited either by negative social feedback in the lab or by negative events in daily life. In addition, trait, (...) and state usage of a set of emotion regulation strategies was assessed. Multilevel analyses revealed that trait rumination was positively associated with emotion accumulation. State rumination was also positively associated with emotion accumulation and, to a lesser extent, with emotion explosiveness. These results provide support for emotion regulation theories, which hypothesise that rumination is a central mechanism underlying the maintenance of negative emotions. (shrink)

The purpose of the study is to test the pedagogical potential of design and research activities in the context of the formation of research independence of cadets of a military higher educational institution through experimental work. The article reveals the technological aspect of the implementation of design and research activities by cadets of a military university. Scientific novelty lies in the identification and verification of the effectiveness of the pedagogical conditions that contribute to the formation of research independence of cadets (...) of a military higher educational institution. The article presents the author's edition of the thematic focus and content of the design and research assignments. As a result of the study, the empirical method proved the effectiveness of the revealed pedagogical conditions on the process of forming the research independence of cadets of a military higher educational institution. Cognitive test batteries are widely used in diverse research fields, such as cognitive training, cognitive disorder assessment, or brain mechanism understanding. Although they need flexibility according to their usage objectives, most test batteries are not available as open-source software and are not be tuned by researchers in detail. The present study introduces an open-source cognitive test battery to assess attention and memory, using a javascript library, p5.js. Because of the ubiquitous nature of dynamic attention in our daily lives, it is (...) crucial to have tools for its assessment or training. For that purpose, our test battery includes seven cognitive tasks, common in cognitive science literature. By using the test battery, we conducted an online experiment to collect the benchmark data. Results conducted on 2 separate days showed the high cross-day reliability. Specifically, the task performance did not largely change with the different days. Besides, our test battery captures diverse individual differences and can evaluate them based on the cognitive factors extracted from latent factor analysis. Since we share our source code as open-source software, users can expand and manipulate experimental conditions flexibly. Our test battery is also flexible in terms of the experimental environment, i.e., it is possible to experiment either online or in a laboratory environment. (shrink)

The problems of diversity and pluralism have always been serious challenges to the stability of European societies. In the course of its history Europe elaborated various important ways of accommodation of differences, including toleration, respect and recognition. This article is devoted to discussion of the relations among them both in analytical and historical perspectives. I argue that toleration has always been based on a certain kind of respect and distinguish three main paradigms of the relations among these concepts. Then I (...) proceed to a discussion of the particular forms these paradigms took in European intellectual history and to an analysis of their applicability to the most important problems of contemporary society. I argue that pluralism and the complexity of contemporary society require pluralism in the modes of justifying toleration. (shrink)

Human activity is permeated by norms of all sorts: moral norms provide the 'code' for what we ought to do, norms of logic regulate how we ought to reason, scientific norms set the standards for what counts as knowledge, legal norms determine what is lawfully permitted and what isn't, aesthetic norms establish canons of beauty and shape artistic trends and practices, and socio-cultural norms provide criteria for what counts as tolerable, just, praiseworthy, or unacceptable in a community or milieu. Given (...) the diversity of norm-governed phenomena prevailing in our everyday experience, it is not surprising that the question of normativity has recently generated important debates in philosophy. However, the more specific question concerning the nature and function of 'norms in perceptual experience' has received comparatively little attention. This volume brings together scholars from philosophy of mind, philosophy of perception, and phenomenology to explore this question. (shrink)

This article defends the democratic ideal of inclusive public discourse, as articulated in Democratic Speech in Divided Times, against the critiques offered by Billingham, Fraser, and Hannon. Specifically, it considers and responds to three core challenges. The first challenge argues, notably, that the “shared reasons” constraint should either apply everywhere or not at all, and that, if this constraint is to apply in divided circumstances, its justificatory constituency must be idealized. The second challenge contends that the resistance of hate speech (...) and misinformation to counterspeech cannot adequately be explained by considerations of salience, and therefore cannot adequately by countered (as I suggest) by “positive” forms of counterspeech. While much research has focused on the effects of ethical and unethical leadership, little is known about how followers come to perceive their leaders as ethical or unethical. In this article, we investigate the co-creation of ethical and unethical leadership perceptions. Specifically, we draw from emerging research on moral congruence in organizational behaviour and empirically investigate the role of congruence in leaders’ and followers’ moral foundations in followers’ perceptions of ethical and unethical leadership. By analysing objective congruence scores from 67 (...) leader–follower dyads by means of polynomial regression with surface response analysis, we find partial support for our theoretically derived predictions. Significant effects were revealed for the fairness, loyalty, and authority moral foundations but not for the care and sanctity moral foundations. The seed system is a major component of traditional management of crop genetic diversity in developing countries. Seed flows are an important part of this system. They have been poorly studied for minor Andean crops, especially those that are propagated vegetatively. We examine the seed exchanges of Oxalis tuberosa Mol., a vegetatively propagated crop capable of sexual reproduction. We studied the seed exchanges of four rural communities in Candelaria district at the international and local levels, emphasizing the spread of new (...) sexually-produced genotypes through these exchanges. Interviews with 44 farmers generated socioeconomic, agronomic, crop diversity and seed exchange information, and data on the potential incorporation of new sexually-produced genotypes in the crop germplasm. We interviewed merchants to evaluate the input and output of genetic diversity in the communities studied. Results showed a positive effect of the farmers’ wealth on the diversity cultivated and on seed exchanges. Most seed exchanges occurred at market, creating a distinction between cash and self-consumption landraces. Cash landraces were intensively exchanged; self-consumption landraces were isolated at the farmer level and prone to genetic drift and complete loss. Merchants exported seeds of cash landraces across Bolivia and into Peru and Argentina. New sexually produced genotypes are less incorporated into cash landraces than in self-consumed landraces. However, new genotypes incorporated into cash landraces are diffused faster and better, being more intensively exchanged. We propose conservation strategies that can be applied to other vegetatively propagated and minor Andean crops. (shrink)

Although we see much utility in Osiurak and Reynaud's in-depth discussion on the role of what they term technical reasoning in cumulative culture, we argue that they neglect the time and energy costs that individuals would have to face to acquire skills in the absence of specific socio-cognitive abilities.
