Immer öfter werden der Natur eigene Rechte zugesprochen. Rund um den Globus helfen sie gefährdeten Ökosystemen, sich gegen schädliche Wirtschaftsinteressen zu verteidigen. Seit ihrer Einführung in die ecuadorianische Verfassung im Jahre 2008 wurden Rechte der Natur unter anderem in Bolivien, Kanada, Kolumbien, Neuseeland und den USA eingeführt. Zuletzt in Spanien zum Schutz einer Salzwasserlagune. Dieses Buch zeigt, wie die Idee der Rechte der Natur entstand, wie sie immer mehr an Fahrt aufnahm und wie sie uns künftig helfen kann, die Natur (...) und gefährdete Ökosysteme zu schützen. Blumenbergs Philosophie ist eine Philosophie der Umwege und des Neuansetzens. Sie stellt einen Versuch dar, sich unter den Bedingungen der Moderne produktiv einzurichten, ohne ethische Ansprüche aus dem Blick zu verlieren. Das Provisorische kehrt bei Blumen-berg implizit wie explizit wieder. Als Beschreibungskategorie macht es die Welt erklärbar und stiftet eine Orientierungsleistung. In Kombination mit einer positiven Umdeutung des Umweges erlaubt es Distanzierung von einem unübersichtlichen Verstricktsein in Weltzusammenhänge sowie ein Handeln als ob wir wüssten, was wir tun. Ziel ist (...) ein Nachdenken, das der Vorläufigkeit moderner Wirklichkeiten gerecht wird. Many philosophers have claimed that relying on the testimony of others in normative questions is in some way problematic. In this paper, I consider whether we should be troubled by deference in democratic politics. I argue that deference is less problematic in impure cases of political deference, and most non-ideal cases of political deference are impure. To establish the second point, I rely on empirical research from political psychology. I also outline two principled reasons why we should expect political deference (...) to be untroubling: political problems are difficult and require a division of epistemic labour; furthermore, there is value in exercising epistemic solidarity with those one shares an identity or interests with. This paper argues that data-driven medicine gives rise to a particular normative challenge. Against the backdrop of a distinction between the good and the right, harnessing personal health data towards the development and refinement of data-driven medicine is to be welcomed from the perspective of the good. Enacting solidarity drives progress in research and clinical practice. At the same time, such acts of sharing could—especially considering current developments in big data and artificial intelligence—compromise the right by leading to injustices and (...) affecting concrete modes of individual self-determination. In order to address this potential tension, two key elements for ethical reflection on data-driven medicine are proposed: the controllability of information flows, including technical infrastructures that are conducive towards controllability, and a paradigm shift towards output-orientation in governance and policy. In this paper, I argue that the rejection of doxastic voluntarism is not as straightforward as its opponents take it to be. I begin with a critical examination of William Alston's defense of involuntarism and then focus on the question of whether belief is intentional.

Delayed-choice experiments in quantum mechanics are often taken to undermine a realistic interpretation of the quantum state. More specifically, Healey has recently argued that the phenomenon of delayed-choice entanglement swapping is incompatible with the view that entanglement is a physical relation between quantum systems. This paper argues against these claims. It first reviews two paradigmatic delayed-choice experiments and analyzes their metaphysical implications. It then applies the results of this analysis to the case of entanglement swapping, showing that such experiments pose (...) no threat to realism about entanglement. (shrink)

In our contemporary world, the rights of nature have become an important legal device for environmental protection. Some of the most influential rights of nature frameworks can be found in non-Western contexts and have been strongly influenced by ecocentric accounts of nature. This article addresses the question of whether rights of nature can be implemented in Western contexts as well, focusing in particular on Europe. It first examines ecocentric justifications of the rights of nature and discusses two possible non-ecocentric alternatives. (...) Second, two models for implementing rights of nature—the nature’s rights model and the legal personhood model—are compared to demonstrate how different combinations of elements from both models can fit different socio-cultural contexts, including Western ones. Is there a difference between human beings and those based on artificial intelligence that would affect their ability to be subjects of dignity? This paper first examines the philosophical notion of dignity as Immanuel Kant derives it from the moral autonomy of the individual. It then asks whether animals and AI systems can claim Kantian dignity or whether there is a sharp divide between human beings, animals and AI systems regarding their ability to be subjects of dignity. How this question (...) is answered depends crucially on one’s understanding of what constitutes human dignity and autonomy, and what requirements one places upon systems in order for them to be seen as morally autonomous. Any intermediate propositional logic can be extended to a calculus with epsilon- and tau-operators and critical formulas. For classical logic, this results in Hilbert’s $\varepsilon $ -calculus. The first and second $\varepsilon $ -theorems for classical logic establish conservativity of the $\varepsilon $ -calculus over its classical base logic. It is well known that the second $\varepsilon $ -theorem fails for the intuitionistic $\varepsilon $ -calculus, as prenexation is impossible. The paper investigates the effect of adding critical $\varepsilon $ - (...) and $\tau $ -formulas and using the translation of quantifiers into $\varepsilon $ - and $\tau $ -terms to intermediate logics. It is shown that conservativity over the propositional base logic also holds for such intermediate ${\varepsilon \tau }$ -calculi. The “extended” first $\varepsilon $ -theorem holds if the base logic is finite-valued Gödel–Dummett logic, and fails otherwise, but holds for certain provable formulas in infinite-valued Gödel logic. The second $\varepsilon $ -theorem also holds for finite-valued first-order Gödel logics. The methods used to prove the extended first $\varepsilon $ -theorem for infinite-valued Gödel logic suggest applications to theories of arithmetic. (shrink)

The aim of this paper is to show that the French philosopher and historian of science Abel Rey played a more influential role in the formative phase of the Vienna Circle than hitherto supposed. On the whole, it will be argued that Rey's contribution had political impact. His interpretation of "modern physics" in 1907 in the face of the alleged "bankruptcy of science" should be appreciated as a masterpiece of applied enlightenment thought. As such, it was especially paradigmatic for Philipp (...) Frank's "positivist" defense of the theory of relativity and quantum mechanics against the irrationalist tendencies of the 1920s and 1930s. Narrativists about well-being claim that our lives go better for us if they make good stories—if they exhibit cohesion, thematic consistency, and narrative arc. Yet narrativism leads to mistaken assessments of well-being: prioritizing narrative makes it harder to balance and change pursuits, pushes us toward one-dimensionality, and can’t make sense of the diversity of good lives. Some ways of softening key narrativist claims mean that the view can’t tell us very much about how to live a good life that we (...) can’t find in other theories of well-being; while there are smaller-scale ways we can incorporate narrativist insights into our views of well-being, narrativism should not be a universal organizing principle for our lives. Anosognosia for visual deficits—cases where significant visual deficits go unnoticed—challenges the view that our own conscious experiences are what we know best. We review these widespread and striking failures of awareness. Anosognosia can occur with total blindness, visual abnormalities induced by brain lesions, and eye diseases. We show that anosognosia for visual deficits is surprisingly widespread. Building on previous accounts, we introduce a framework showing how apparently disparate forms of anosognosia fit together. The central idea is that, to notice a (...) deficit, individuals need to form expectations about normal vision, compare expectations and visual input, and judge any mismatch at the metacognitive level. A failure in any of these three steps may lead to unawareness of visual deficits. (shrink)

Was macht das Besondere der menschlichen Lebensform aus? Wie können wir es verstehen, dass unsere Art wie alle anderen natürlich evolviert ist und dennoch als einzige Art die Fähigkeit entwickelt hat, unter dem Anspruch der Freiheit und in reflexiver Distanz zu handeln, damit aber die Umwelt auf eine Welt hin zu transzendieren? Jung argumentiert, dass sich diese Fragen nur beantworten lassen, wenn man philosophische, evolutionstheoretische und kognitionswissenschaftliche Ansätze aufeinander bezieht. Der Schlüssel hierfür ist der Begriff der Bedeutung. Alle Lebewesen erfassen (...) ihre Umwelt im praktischen Umgang mit ihr als bedeutsam. Auch der Geist des Menschen ist essentiell verkörpert und basiert auf erlebten Bedeutsamkeiten. Die Fähigkeit zur symbolischen Artikulation und kulturellen Weiterentwicklung solcher Lebensbedeutungen erlaubt es ihm aber auch, die lokale Umwelt zu transzendieren und dabei Werte, Normen und objektive Geltungsansprüche zu entwickeln. Eine zeitgemäße Anthropologie muss in der Lage sein, diese qualitativen Besonderheiten des menschlichen Geistes als Resultate von Naturprozessen verständlich zu machen. Sie verbindet methodischen Naturalismus mit Offenheit für die Transzendenz des Geistes über die Umwelt. Damit leistet der Autor einen wichtigen Beitrag zu einem nichtreduktionistischen Verständnis des Menschen, das Leib und Geist nicht dualistisch trennt, sondern ihre spannungsvolle Einheit sichtbar macht. The Gratitude Questionnaire-Six Item Form (GQ-6; McCullough et al., 2002) is a well-established instrument for measuring gratitude. Recently, the Multi-Component Gratitude Measure (MCGM) was developed as a more holistic approach (Morgan et al., 2017). While the GQ-6 mainly focuses on the emotional component of gratitude, the MCGM encompasses conceptual, attitudinal and behavioral aspects. As of today, there is no validated German measure for gratitude. In order to close that research gap, the present study focused on validating the German versions of (...) the GQ-6 (GQ-6-G) and of the MCGM (MCGM-G). In addition, multi-group comparisons were conducted to test for cultural measurement invariance. Construct validity was tested similar to original validation studies of the two scales focusing on affect, well-being, empathy, anxiety and depression. The online survey was completed in random order by 508 participants. The one-factor model of the GQ-6-G and the hierarchical structure of the MCGM-G could be replicated. However, model fit of the Gratitude Questionnaire was significantly better after eliminating one item (GQ-5-G). Multi-group comparisons revealed cultural measurement invariance was established for the GQ-5-G and partial measurement invariance for five of six factors of the MCGM-G, respectively. Reliability analyses revealed good internal consistency for both instruments and measures for criterion-related and discriminant validity have shown hypothesized relationships. Thus, the GQ-5-G and the MCGM-G are two instruments with good reliability and validity for measuring gratitude in Germany. (shrink)

When discussing the philosophical question of the relation between mind and nature, dualistic approaches are often contrasted with scientistic approaches. However, mind can be situated in nature in a non-scientistic manner and outside of nature in a non-dualistic manner. John McDowell represents the first approach, as he connects mind to our second nature. In his attempt to specify the categorial relation between first and second nature, McDowell finds himself in a dilemma which cannot be solved within his framework. The second (...) approach is represented by Nicolai Hartmann, for whom mind does not belong to nature, but to the real world. Hartmann’s ontology of layers is able to avoid McDowell’s dilemma and the unity of the real world is made intelligible. (shrink)

In this book review, I summarize the main argument of Tilo Wesche's book "Die Rechte der Natur: Vom nachhaltigen Eigentum" (The rights of Nature: On sustainable ownership) and conclude with a critical appraisal.

I raise several problems for Phenomenal Explanationism, which McCain and Moretti intend to be a fusion of Evidentialism and Phenomenal Conservatism. I argue that the view is actually a non-conservative, credentialist view. Unlike conservatism, it does not allow for immediate justification. I also argue that the view has trouble accounting for justification coming from background knowledge. Finally, I argue that the view runs into the problem of equally good explanations.

The computer revolution has had an enormous effect on all aspects of the practice of medicine, yet little thought has been given to the role of social media in identifying treatment choices for incompetent patients. We are currently living in the ?Internet age? and many people have integrated social media into all aspects of their lives. As use becomes more prevalent, and as users age, social media are more likely to be viewed as a source of information regarding medical care (...) preferences. This article explores the ethical and legal issues raised by the use of social media in surrogate decision making. (shrink)

Responding to Derrida's Death Penalty Seminar of 1999–2000 and its interpretation by Michael Naas, in this paper I argue that Derrida's deconstruction of the theologico-political concept of the sovereign right over life and death in view of abolishing capital punishment should be understood in terms of the unconditional renunciation of sovereignty that dominates Derrida's later political writings, Rogues (2005) in particular. My reading takes seriously what I call the functional need for a “theological” moment in sovereignty beyond a merely historicist (...) or genealogical interpretation of the European monotheistic heritage. Further, I ask how Derrida can follow through on his goal of developing the allegedly first principled philosophical stance against capital punishment. To this end, I assemble some ingredients of this complex but “unconditional” abolitionism, one that doubts our comprehension of and active relation to death to the point of questioning the commonsense distinctions among murder, suicide, and legal putting to death. I conclude that, for Derrida, letting another die of hunger or AIDS may be understood as a form of a death sentence, so that a deconstructive abolitionism leaves no room for the development of a good conscience. Studies of the history of 20th century philosophy usually suggest a sharp antagonism between Martin Heidegger on the one hand and Philosophical Anthropology, as founded by Max Scheler and Helmuth Plessner, on the other. In contrast I will argue that one of Heidegger′s texts, namely his lecture The Fundamental Concepts of Metaphysics. World – Finitude – Solitude, held in the 1929/30 winter semester is in fact very close to the theoretical approach of Philosophical Anthropology. The measure for determining this proximity (...) is taken from Joachim Fischer′s study Philosophische Anthropologie. Eine Denkrichtung des 20. Jahrhunderts . Its main systematic thesis posits that the theoretical approach of Philosophical Anthropology is constituted by a core identity, which can be accurately defined by a set of features. In my paper I use these features heuristically to examine the question whether Heidegger, who prima facie is not an adherent of the theoretical approach, in his lecture The Fundamental Concepts of Metaphysics actually does argue like an exponent of Philosophical Anthropology. The force of inertia. A Sartrean perspective on resistance Although Sartre’s philosophy of freedom is often considered as a philosophy of resistance, rooted in the experience of the Second World War, Sartre did not formulate a full-blown theory of resistance. However, his Critique of Dialectical Reason contains a wealth of material that allows a rethinking of the notion of resistance. In much of the literature, this notion is inflated so as to include action, opposition, struggle, exodus and a range of (...) other phenomena. In order to acquire a sharper sense of the specific meaning of resistance, this paper argues, this notion has to be reconnected with its origins in mechanical physics. Sartre’s key concept of inertia provides a starting point for such a theoretical strategy. Although human beings are fundamentally free, they can live their relation to others and to themselves as if they were inert things. From a Sartrean perspective, resistance means making oneself inert in order to be able to persevere and to hold the line in the face of a threat. Resistance occurs at both sides of a struggle, and can take different, asymmetrical forms. The two fundamental modes of sociality Sartre distinguishes, namely the group and the series, offer different types of resistance to opponents. (shrink)

It is increasingly common in the philosophical literature to claim that political legitimacy, normatively understood, comes in degrees. However, most authors fail to specify what talk of degrees means, and the notion remains opaque. Using the Hohfeld schema as a guide, I survey possible accounts, distinguishing them into “width”, “depth”, and “weight” proposals. I argue that each fails to provide a convincing account of scalar legitimacy. Thus, talk of degrees of legitimacy, as currently used, is in serious need of explanation.

Tradition is a complex phenomenon of which we can find a multiplicity of conceptualizations in the philosophical, sociological, anthropological, and economic literature. In this paper, I offer both a critical and a constructive contribution to answering the question of how tradition should be conceptualized. In the critical part, I argue against attempts to construct a unified conception of tradition. In the constructive part, I discuss three taxonomies proposed in the literature and then develop an analytical grid for conceptions of tradition (...) as an alternative. This analytical grid is based on a sample of 28 accounts of tradition sourced from the contemporary scholarly literature, and makes use of seven dimensions to distinguish among these conceptions. This volume is dedicated to the life and work of Ernest Nagel counted among the influential twentieth-century philosophers of science. Forgotten by the history of philosophy of science community in recent years, this volume introduces Nagel’s philosophy to a new generation of readers and highlights the merits and originality of his works. Best known in the history of philosophy as a major American representative of logical empiricism with some pragmatist and naturalist leanings, Nagel’s interests and activities went beyond these limits. (...) His career was marked with a strong and determined intention of harmonizing the European scientific worldview of logical empiricism and American naturalism/pragmatism. His most famous and systematic treatise on, The Structure of Science, appeared just one year before Thomas Kuhn’s even more renowned, The Structure of Scientific Revolutions. As a reflection of Nagel’s interdisciplinary work, the contributing authors’ articles are connected both historically and systematically. The volume will appeal to students mainly at the graduate level and academic scholars. Since the volume treats historical, philosophical, physical, social and general scientific questions, it will be of interest to historians and philosophers of science, epistemologists, social scientists, and anyone interested in the history of analytic philosophy and twentieth-century intellectual history. Scholars have struggled with identifying the exact reasoning that leads to the list of human rights in Rawls's Law of Peoples. This essay argues that the list can best be explained by a reasoning based on the value of self-determination of peoples. At the same time, it argues that this reasoning still has serious difficulties. In particular, it is necessary to clarify whether human rights may always be enforced by coercive means against states that violate them. However, once this has (...) been clarified, the balance of reasons on which Rawls’s argument rests no longer indisputably supports his conclusion. (shrink)

Time has often been understood as either linear or cyclical, sometimes in Eurocentric ways that enclose Indigenous peoples in natural cycles with little or no historical development. This article explores an alternative to the line and the circle. In the context of environmental destruction, Indigenous scholars have suggested that traditional Indigenous accounts of spiraling time, from the Anishinaabe and Māori to the Aztecs and Muskoke, better connect nature with human history as well as more appropriately link human generations, including ancestors (...) and descendants. Exploring its connection with the hermeneutic circle and other notions, I will propose the spiral as indeed a promising way to grasp these important connections. In conclusion, I will discuss the question of whether Indigenous spiral ontologies can be proposed for all of humanity beyond knowledge extractivism. (shrink)

The focus on animal welfare in society has increased during the last 50 years. Animal welfare legislation and private standards have developed, and today many farmers within animal production have both governmental legislation and private standards to comply with. In this paper intentions and values are described that were expressed in 14 animal welfare legislation and standards in four European countries; Sweden, United Kingdom, Germany and Spain. It is also discussed if the legislation and standards actually accomplish what they, in (...) their overall description and ethics, claimed to do, i.e. if this is followed up by relevant paragraphs in the actual body of the text in the legislation and standards respectively. The method used was an on-line questionnaire from the EconWelfare research project and text analyses. This study shows that the ethical values within a set of legislation or private standards are not always consistently implemented, and it is not always possible to follow a thread between the intentions mentioned initially and the actual details of the legislation or standard. Since values will differ so will also the animal welfare levels and the implications of similar concepts in the regulations. In general, the regulations described were not based on animal welfare considerations only, but also other aspects, such as food safety, meat quality, environmental aspects and socio-economic aspects were taken into account. This is understandable, but creates a gap between explicit and implicit values, which we argue, can be overcome if such considerations are made more transparent to the citizens/consumers. (shrink)

Lässt sich das Unsagbare eigentlich bezeugen? Matthias Käser plädiert mithilfe interdisziplinärer Zeug*innenschaftsdiskurse gegen das Unbeschreibliche und für das Ethos des Erzählens.
