Some Medieval Readings of Aristotle’s Argument for the Collective Superiority of “the Many”.Martin Ossikovski - 2012 - Studia Neoaristotelica 9 (2):135-153.
An essential challenge of Aristotle’s Politics arises from the juxtaposition of contrasting and competing arguments in favour of virtuous monarchy, on the one hand, and the collective superiority of “the many”, on the other. This paper examines the purely theoretical reception of this contrast in the writings of some late medieval Aristotelians by focusing on a key section in Politics Γ (1280a8–1284b34). After reviewing Aristotle’s problematic position, the paper discusses its interpretation in the commentaries of Albert the Great, Thomas Aquinas/Peter (...)

Stellungnahme zur Etablierung der sekundären Forschungsnutzung von Behandlungsdaten in Deutschland. Ergebnisse des Verbundprojekts LinCDat: "Learning from Clinical Data. Ethical, Social and Legal Aspects".Martin Jungkunz, Anja Köngeter, Markus Spitz, Katja Mehlis, Kai Cornelius, Christoph Schickhardt & Eva C. Winkler - 2022 - Forum Marsilius Kolleg.

Many scholars of Medieval Political Philosophy have suggested that Marisilius of Padua’s Defensor Pacis defends a «positivist» approach to law. In this article we try to show that such claim is wrong. We begin by sketching a brief summary of Marilius’ legal doctrine and then we turn to many scholarly pieces that have found it either in favor of or against «juridical positivism» in the Defensor Pacis. By reviewing the most recent theories on «juridical positivism» we argue that there are (...)

  5. Poverty, Exploitation, Mere Things and Mere Means.Martin Sticker - 2021 - Ethical Theory and Moral Practice 26 (2):1-17.
I argue that, alongside the already well-established prohibition against treating persons as mere means, Kant’s Formula of Humanity requires a prohibition against treating persons as mere things. The former captures ethical violations due to someone’s (perceived) instrumental value, e.g. exploitation, the latter captures cases in which I mistreat others because they have no instrumental value to me. These are cases in which I am indifferent and complacent towards persons in need; forms of mistreatment frequently suffered by the world’s poorest. I (...)

    Postphenomenological Method and Technological Things Themselves.Martin Ritter - 2021 - Human Studies 44 (4):581-593.
We live in a world where it is impossible to exist without, and beyond, technologies. Despite this omnipresence, we tend to overlook their influence on us. The vigorously developing approach of postphenomenology, combining insights from phenomenology and pragmatism, focuses on the so-called technological mediation, i.e., on how technologies as mediators of human-world relations influence the appearing of both the world and the human beings in it. My analysis aims at demonstrating both the methodological weaknesses and open possibilities of postphenomenology. After (...)

    Evaluating Reasoning in Natural Arguments: A Procedural Approach.Martin Hinton & Jean H. M. Wagemans - 2021 - Argumentation 36 (1):61-84.
In this paper, we formulate a procedure for assessing reasoning as it is expressed in natural arguments. The procedure is a specification of one of the three aspects of argumentation assessment distinguished in the Comprehensive Assessment Procedure for Natural Argumentation that makes use of the argument categorisation framework of the Periodic Table of Arguments. The theoretical framework and practical application of both the CAPNA and the PTA are described, as well as the evaluation procedure that combines the two. The procedure (...)

    Collective Affordances.Martin Weichold & Gerhard Thonhauser - 2020 - Ecological Psychology 32 (1).
This article develops an ecological framework for understanding collective action. This is contrasted with approaches familiar from the collective intentionality debate, which treat individuals (with collective intentions) as fundamental units of collective action. Instead, we turn to social ecological psychology and dynamical systems theory and argue that they provide a promising framework for understanding collectives as the central unit in collective action. However, we submit that these approaches do not yet appreciate enough the relevance of social identities for collective action. (...)

I develop a puzzle, the resolution of which, I argue, requires an unfamiliar distinction between two forms or senses of metaphysical modality, each bearing a different relationship to time. In one sense of ‘metaphysically possible’, it is metaphysically possible for it to be a time other than the time it is now; in another sense, this is not metaphysically possible.

Defending the Epistemic Condition on Moral Responsibility.Martin Montminy - 2021 - Journal of Ethics and Social Philosophy 20 (2).
I consider three challenges to the traditional view according to which moral responsibility involves an epistemic condition in addition to a freedom condition. The first challenge holds that if a person performs an action A freely, then she thereby knows that she is doing A. The epistemic condition is thus built into the freedom condition. The second challenge contends that no epistemic condition is required for moral responsibility, since a person may be blameworthy for an action that she did not (...)

Sonic Environments as Systems of Places: A Critical Reading of Husserl’s Thing and Space.Martin Nitsche - 2021 - Open Philosophy 4 (1):136-148.
This article offers a thorough and critical reading of Husserl’s Thing and Space. This reading is principally motivated by the effort to methodologically design a phenomenological–topological approach to the research of lived sonic environments. In this book, Husserl lays foundations of phenomenological topology by understanding perceptions as places and defining, consequently, the space as a system of places. The critical reading starts with pointing out the ambiguity of location in Thing and Space, which consists mainly in the insufficient implementation of (...)

Moral luck occurs when factors beyond an agent’s control affect her blameworthiness. Several scholars deny the existence of moral luck by distinguishing judging blameworthy from blame-related practices. Luck does not affect an agent’s blameworthiness because morality is conceptually fair, but it can affect the appropriate degree of blame for that agent. While separatism resolves the paradox of moral luck, we aim to show it that it needs amendment, because it is unfair to treat two equally blameworthy people unequally. We argue (...)

Content disjunctivism is the view that veridical experience involves contents and objects that differ from those of corresponding hallucinations. On one formulation of this view, we are aware of ordinary material things in our surroundings when we experience veridically, and we are aware of mere appearances when we hallucinate. This paper proposes a way of developing this view and offers some considerations in support. Central to the proposed regimentation will be a distinction between different notions of appearance. We distinguish between (...)

A semiotic phenomenology of the scission point boundary condi-tion between Karl Jaspers’s concepts of existence and Existenz reveal them as fundamental distinctions that can manifest in healthy or pathological forms of communication, including the “inner action” of the competing “voices” “heard” by the patient undergoing treatment. My analysis illustrates that the mind, for Jaspers, represents how communicability as truth involves us in a natural rhetorical (tropic) relationship with a society. In this analysis, I frame the problematic boundary between existence and (...)

Over 60% of all epidemics have a zoonotic origin, that is, they result from the transmission of infectious diseases from animals to humans. The spill-over of diseases often happens because humans exploit and use animals. According to Fernández, we self-attribute beliefs on the basis of their grounds, “bypassing” the beliefs to be attributed. My paper argues that this procedure runs into normative and metaphysical problems if certain changes in the subject’s ways of forming beliefs occur. If the change is accidental, the problem is normative: self-attributing the resulting belief by way of Bypass cannot be justified. The metaphysical problem is that it is unclear how the procedure can reflect any change in belief-formation at all, given (...)

In this short contribution I argue that the history of philosophy has much to gain from an engagement with the questions and conceptual tools of contemporary philosophy. In particular I argue against the view that the historian of philosophy’s engagement with contemporary philosophy necessarily leads to anachronism. Whatever the risks of failure, they seem to be outweighed by the potential for insight. Advocates of a “purely” historical approach to the history of philosophy defend their approach by pointing to the idea (...)

    Recovering religion's prophetic voice for business ethics.Martin S. J. Calkins - 2000 - Journal of Business Ethics 23 (4):339 - 352.
This article surveys western business ethics' recent history to show how this ethic has neglected recently its religious traditions and become construed more narrowly as an applied philosophy and social science. It argues that this narrowness has confused business ethics' role in business education and helped to weaken the distinctiveness of certain institutions of higher education. It then suggests ways that western business ethics might become more integrated, interesting, and autonomous as an academic discipline by incorporating its key religious traditions.

Although Political Theology examined mainly the political dimension of the relationship between God-Father and God-Son, it is paramount to consider the political performance of the Holy Spirit in the Economy of Redemption. The Holy Spirit has been characterized as the binding cause and the principle of relationality both referring to God’s inner life and to God’s relationship with His creatures. As the personalization of relationality, the Holy Spirit performs a unique task: to bring together what is apart by means of (...)

We propose an original response to Derk Pereboom’s four-case manipulation argument. This response combines a hard-line and a soft-line. Like hard-liners, we insist that the manipulated agent is blameworthy for his wrongdoing. However, like soft-liners, we maintain that there is a difference in blameworthiness between the manipulated agent and the non-manipulated one. The former is less blameworthy than the latter. This difference is due to the fact that it is more difficult for the manipulated agent to do the right thing. (...)

This analysis, I show, has several virtues. (...)

    A Nursing Ethic: the moral voice of experienced nurses.Martin Woods - 1999 - Nursing Ethics 6 (5):423-433.
Nursing acts occur in thousands of instances daily, being a major component of professional health care delivery in institutions, communities and homes. It follows that the ethical practice of most nurses is put to the test on an everyday rather than an occasional basis. Hence, within nursing practice there must be a rich and deep seam of reflective interpretation and practical wisdom that is 'embedded' within the experiences of every experienced nurse. This article presents discussion on some of the main (...)

Personal Responsibility and Lifestyle Diseases.Martin Marchman Andersen & Morten Ebbe Juul Nielsen - 2016 - Journal of Medicine and Philosophy 41 (5):480-499.
What does it take for an individual to be personally responsible for behaviors that lead to increased risk of disease? We examine three approaches to responsibility that cover the most important aspects of the discussion of responsibility and spell out what it takes, according to each of them, to be responsible for behaviors leading to increased risk of disease. We show that only what we call the causal approach can adequately accommodate widely shared intuitions to the effect that certain causal (...)

  48. The dissociative and polemical political: Chantal Mouffe and the intellectual heritage of Carl Schmitt.Martin Https://Orcidorg Beckstein - 2011 - .
In her more recent work, Chantal Mouffe enters into what she calls a 'dialogue' with Carl Schmitt on the political. So far, interpretations of this dialogue suggest that Mouffe attempts to revise Schmitt's friend/enemy-distinction and carve out a theory of agonistic pluralism. An interpretation on these grounds, this article argues, reduces the dialogue to its analytical dimension and cannot comfortably be upheld. Mouffe indeed appropriates Schmitt's friend/enemy-distinction, but she also gets inspired by the metatheoretical facet of his intellectual heritage with (...)

    Cultural safety and the socioethical nurse.Martin Woods - 2010 - Nursing Ethics 17 (6):715-725.
This article explores the social and ethical elements of cultural safety and combines them in a model of culturally safe practice that should be of interest and relevance for nurses, nurse educators and nurse ethicists in other cultures. To achieve this, the article briefly reviews and critiques the main underpinnings of the concept from its origins and development in New Zealand, describes its sociocultural and sociopolitical elements, and provides an in-depth exploration of the key socioethical elements. Finally, a model is (...)
