With disagreement, doubts, or ambiguous grounds in end–of-life decisions, doctors are advised to involve a clinical ethics committee. However, little has been published on doctors’ experiences with discussing an end-of-life decision in a CEC. As part of the quality assurance of this work, we wanted to find out if clinicians have benefited from discussing end-of-life decisions in CECs and why. We will disseminate some Norwegian doctors’ experiences when discussing end-of-life decisions in CECs, based on semi-structured interviews with fifteen Norwegian physicians (...) who had brought an end-of-life decision case to a CEC. Almost half of the cases involved conflicts with the patients’ relatives. In a majority of the cases, there was uncertainty about what would be the ethically preferable solution. Reasons for referring the case to the CEC were to get broader illumination of the case, to get perspective from people outside the team, to get advice, or to get moral backing on a decision already made. A great majority of the clinicians reported an overall positive experience with the CECs’ discussions. In cases where there was conflict, the clinicians reported less satisfaction with the CECs’ discussions. The study shows that most doctors who have used a CEC in an end-of-life decision find it useful to have ethical and/or legal aspects illuminated, and to have the dilemma scrutinized from a new perspective. A systematic discussion seems to be significant to the clinicians. (shrink)

Even though most people nowadays endorse to the necessity and importance of interreligious dialogue, opinions differ concerning the precise interpretation of the dialogic event. The most fundamental issue remains the dialogical tension between identity and alterity. How can we combine the engagement of religious faith with the openness to the other? At first sight, the pluralistic theology offers the most acceptable answer to this question. Pluralists are convinced that the success of the interreligious dialogue depends on the readiness of the (...) religious traditions and their adherents to abandon all absolute truth claims. However, the pluralistic project is criticized heavily due to a lack of consideration for the particularity of the religious identity. Many believers do not recognize themselves in the pluralistic interpretation of their religion. In the following article I will first explain the basic principle of the pluralistic epistemology, next I will establish the pluralistic contribution to the interreligious dialogue. In third instance, I will formulate some specific Christian critics to the pluralistic project, which can be traced back to a lack of insight in the particularity of the religious identity. In fourth instance I will try to elucidate this assessment by clarifying some aspects of religious identity. I conclude with the position that, if interreligious dialogue wants to be an event between believers of different religious traditions and not in the first place between academics, it should abandon the pluralistic discourse and accept the truly irrevocable religious diversity. In the context of synthetic biology, scientists and bioengineers talk of living beings as being 'living machines'. This categorisation of the envisaged new life forms has given rise to the ethical concern that their moral status may be seen as different from that of natural or only partially artificial living beings. The paper discusses the notion of a living being and the notion of a machine in order to arrive at a conclusion to the question of whether this categorisation is (...) warranted or not. For this reason, it also looks back to the history of the comparison of living beings to machines and tries to show what motivated the analogy. In the end, though, it is argued that one should stop short of categorising living beings as machines, even if there are areas of analogy between living beings and machines. Finally, the idea that the envisaged artificial synthetic living beings could be regarded as some kind of machines is rejected. (shrink)

In lieu of an abstract, here is a brief excerpt of the content:preface At a time when access to safe abortions is being curtailed in the United States under the pretext of a response to the COVID-19 pandemic, this Feminist Studies issue focuses on abortion and women’s embodiment. The essays by Melissa Oliver-Powell, Rachel Alpha Johnston Hurst, and Jennifer L. Holland each contribute new approaches to the stillvexed topic of abortion, positioning movements for abortion access in relation to historical and (...) ecological change. Two collaboratively written essays, by South American authors María Fernanda Olarte-Sierra and Tania Pérez-Bustos, and by North American and European authors Laura Bisaillon with six colleagues, both center the body within feminist labor, exploring how the embodied experience of work can also be a site of knowledge-making. Other authors push us to move beyond humanistic understandings of affect and the body in feminist work, as Nathan Snaza shows in a review essay of four recent books engaging “Biopolitics without Bodies.” Poems by Rosetta Marantz Cohen, Darlene Taylor, and Abby Minor also feature experiences of bodily violence and bodily pleasure, while Ellyn Weiss discusses the distinctive representations of bodies in the visual art of Swedish-American artist Anna U. Davis. To close the issue, two News and Views pieces by Pang Laikwan and Sealing Cheng on the recent protest movement in Hong Kong provide two complementary perspectives on living through tumultuous political times. Our next issue will include content directly focused on the COVID-19 pandemic. In the first essay, Melissa Oliver-Powell’s “Beyond the Spectacle of Suffering: Agnès Varda’s L’Une chante, l’autre pas and Rewriting the Subject of Abortion in France” addresses the complexities of anti-​ abortion 8 rhetoric in France. Placing Varda’s 1977 film in the historical context of French nationalistic anxiety about low birthrates in the twentieth century, Oliver-Powell argues that the film deconstructs polarized narratives about abortion. While dominant cultural representations of abortion typically depicted it as the result of female irresponsibility or traumatic victimization, Varda’s film rejects the binary concepts of villain and victim and questions the presumption that women always suffer when exercising their reproductive choice. Oliver-Powell situates Varda alongside the 343 eminent French female cultural leaders who composed a famous 1971 Manifesto publicly declaring themselves criminals for having had illegal abortions and presents simultaneous histories of French feminism and French cinema. Varda’s film constructs a feminist representation of abortion that avoids foregrounding women ’s suffering and instead emphasizes empowerment and solidarity. Its narrative features two women friends, both treated unjustly by France’s abortion laws, who participate in the movement for reform over a fourteen -year span. Varda represents the interplay of motherhood with women ’s lives as a continuum, not a disruptive episode, and she blends documentary -style devices with imaginative musical interludes: she shows actual women seeking abortions in Holland and includes songs about abortion, pregnancy, and motherhood. Oliver-Powell claims that Varda dramatizes unprecedented representations “of female friendship without pathology, of abortion without guilt, death or persecution, of motherhood without objectification....” A second essay, Rachel Hurst’s “Abortion as a Feminist Pedagogy of Grief in Marianne Apostolides’s Deep Salt Water,” proposes that the championing of women’s reproductive rights could better account for the context of difficult emotions and an imperfect world. Hurst uses reproductive justice approaches to critique simplistic rights-based arguments for abortion, premised on liberal concepts of choice and autonomy, which fail to understand the material conditions of poor women and especially women of color. Such analyses emphasize the necessity of rights discourses that include the right to bear and parent one’s own children free from violence and economic hardship, and they advocate the transformative possibilities of acknowledging rather than suppressing women’s ambivalence about their own abortions as well as others’ choices. Hurst describes a collaboration between two contemporary Canadian feminists, writer Marianne Apostolides and visual artist  9 Catherine Mellinger, in their mixed-media text, Deep Salt Water, which is organized according to the weeks of a pregnancy and the aftermath of its termination. (...) A stately public ode, the poem mourns not only the death of a publicly significant individual, but the collapse of a world. Hitler had overrun Austria, Czechoslovakia, Poland; assaults on Jews had intensified; England and France had just declared war on Germany. There would be, indeed, many who would have to be mourned:When there are so many we shall have to mourn, when grief has been made so public, and exposed to the critique of whole epoch the frailty of our conscience and anguish,of whom shall we speak?...Someone encountering this poem for the first time, on the page or in the ear, might be pardoned for puzzling over its form. It sounds prosy. It seems to have some recognizable English cadences, pentameters (“[inline-graphic 01]”), tetrameters (“ ”), and even trimeters (“ ”). In several papers (2013, 2014, 2015) Conor McHugh defends the influential view that doxastic responsibility, viz. our responsibility for our beliefs, is grounded in a specific form of reasons-responsiveness. The main purpose of this paper is to show that a subject’s belief can be responsive to reasons in this specific way without the subject being responsible for her belief. While this specific form of reasons-responsiveness might be necessary, it is not sufficient for doxastic responsibility.

The Nuffield Council on Bioethics introduced an ‘intervention ladder’ to guide policymakers on public health interventions.1 The ladder’s vertical structure represents an ordering of interventions, from least to most intrusive. In his article, Paetkau acknowledges that this ladder is ‘a useful tool’ (p. 1) for evaluating public health interventions.2 However, he objects that its focus on individual behaviour is too narrow and obscures ‘interventions that operate on the level of systems rather than individuals’ (p. 2). To be sure, some of (...) the interventions on the original ladder do involve what might ordinarily be seen as ‘system’ or environmental changes. For instance, we might encourage active transport by building dedicated cycle lanes. However, these measures still have their intended effects through altering individual choices. What Paetkau means by a ‘systemic intervention’ is specifically one that improves public health without changing individual behaviour change (pp. 2–3). For example, reducing pollution or improving public health infrastructure. He suggests that, because the Nuffield ladder focuses on individual behaviour, it may lead policymakers to overlook these possibilities. COVID-19 vaccine refusal seems like a paradigm case of irrationality. Vaccines are supposed to be the best way to get us out of the COVID-19 pandemic. And yet many people believe that they should not be vaccinated even though they are dissatisfied with the current situation. In this paper, we analyze COVID-19 vaccine refusal with the tools of contemporary philosophical theories of responsibility and rationality. The main outcome of this analysis is that many vaccine-refusers are responsible for the belief that (...) they should not be vaccinated and epistemically rational in holding it. This is an important result because it provides insights into the legitimacy of certain public health policies. In particular, this result shows that a public health policy that would abandon the project of convincing certain vaccine-refusers with reasons – e.g., by simply making vaccination compulsory – is prima facie illegitimate. Many philosophers have defended the view that we are subject to the following evidential ought: “One ought to believe in accordance with one's evidence.” Although they agree on this, a more fundamental question keeps dividing them: from where does the evidential ought derive its normative force? The instrinsicalist answer to this question is sometimes described as the claim that "there is a brute epistemic value in believing in accordance with one's evidence" (Cowie, 2014, 4005). But what does this really mean? (...) Intrinsicalists' negative claim is that the normative source of the evidential ought has nothing to do with the fulfilment of our epistemic purposes. But what is their positive claim exactly? This paper aims at improving our understanding of intrinsicalism. Its conclusion is that there is only one possible way of being an intrinsicalist. The knowledge-first solution to the New Evil Demon Problem (NEDP) goes hand in hand with a particular conception of the normativity of justification, one according to which a justified belief is one that satisfies some sort of ought or should (Williamson forthcoming). This claim is incompatible with another, well accepted, view that regards the normativity of justification. According to this established view, a justified belief is rather something that is neither obligatory, nor forbidden (see e.g. Alston 1989, 1993, 2006; Ginet (...) 1975). The purpose of this contribution is to settle the debate between these two irreconcilable conceptions of the normativity of justification. The main upshot is that the knowledge-first conception of the normativity of justification, the one on which the knowledge-first solution to the NEDP relies, seems in fact superior. (shrink)

Homeotic genes are subject to transcriptional silencing, which prevents their expression in inappropriate body regions. Here, we shall focus on Drosophila, as little is known about this process in other organisms. Evidence is accumulating that silencing of Drosophila homeotic genes is conferred by two types of cis‐regulatory sequences: initiation (SIL‐I) and maintenance (SIL‐M) elements. The former contain target sites for transient repressors with a highly localised distribution in the early embryo and the latter for constitutive repressors that are likely to (...) be present in all cells. We discuss how SIL‐I elements may cooperate with SIL‐M elements to promote formation of a silencing complex. We propose that this complex consists of specific non‐histone proteins, the so‐called Polycomb group proteins, and that it is anchored at SIL‐M elements and at the promoter. (shrink)

Dans le cadre de notre thèse, nous avons confronté les Lais de Marie de France datant du xiie siècle qui présentent la particularité alors inédite d’avoir pour auteur une femme et le Genji Monogatari de Murasaki Shikibu (une femme également), écrit au xie siècle au Japon, qui fait aussi figure d’exception dans un paysage scriptural majoritairement masculin, a fortiori pour une œuvre d’une telle ampleur. Le rapprochement entre les deux œuvres était avant tout motivé par une thématique de fond, l’imaginaire (...) féminin, déployé dans deux cultures géographiquement et sociologiquement éloignées, cependant immergées dans un milieu élitiste, celui de la Cour. Ce choix s’inscrivait surtout dans la perspective d’une approche mythocritique plutôt que strictement littéraire, dont l’intérêt se situait en deçà du cadre du texte, puisqu’il puisait dans la mythologie fondatrice des deux cultures, source de l’émergence d’un imaginaire féminin à des époques chiches de féminité. Or, cette analyse, que nous avons qualifiée de contrastive, a permis l’ouverture de la réflexion sur d’autres perspectives que seul autorisait un tel rapprochement ; elle a également cherché à distinguer, parmi les motifs communs aux deux textes, ceux qui relevaient d’une universalité (contextuelle) de ceux qui relevaient d’une commune origine eurasiatique. La réflexion était axée sur la notion d’altérité selon une acception très large mais concentrée sur la représentation par l’imaginaire féminin de l’Autre sexe et d’un Ailleurs avant tout textuel et narratif. Abstract This article raises a worry concerning Ernest Sosa's way of solving the problem of epistemic circularity. Sosa's solution to the problem of epistemic circularity relies on the following claim of sufficiency: for S to deserve to be credited for his true belief, it is sufficient that his belief is, in a sense to be made clear, ?apt?. I argue that this solution undersells the notion of credit. I present three kinds of cases in which the attribution of credit to (...) a believer requires more than the possession of apt beliefs and I defend these cases against possible misinterpretations. This contribution presents an adult education workshop implemented in the field of early childhood education. One of the specificities of education and care practices lies in the competences of the professionals to give a central role to the detailed observation of situations, in order to adjust their modalities of action. How can such observational work be developed and transformed? A participatory research-training approach aims to support the co-construction of an analytical view on observable phenomena in the course of interactions. Situations where it is not obvious which of two incompatible actions we ought to perform are commonplace. As has frequently been noted in the contemporary literature, a similar issue seems to arise in the field of beliefs. Cases of doxastic divergence are cases in which the subject seems subject to two divergent oughts to believe: an epistemic and a practical ought to believe. This article supports the moderate pragmatist view according to which subjects ought, all things considered, to hold the (...) practically right belief in, at least, some cases of doxastic divergence. Unlike many defences of pragmatism, this paper does not aim to overcome exclusivism (briefly, the view that only epistemic, but not practical, considerations have an influence on what a subject ought to believe). Another major challenge that pragmatism faces is to show that the epistemic and the practical ought to believe are comparable. This article makes a case for their comparability. (shrink)

It is commonly accepted – not only in the philosophical literature but also in daily life – that ignorance is a failure of some sort. As a result, a desideratum of any ontological account of ignorance is that it must be able to explain why there is something wrong with being ignorant of a true proposition. This article shows two things. First, two influential accounts of ignorance – the Knowledge Account and the True Belief Account – do not satisfy this (...) requirement. They fail to provide a satisfying normative account of the badness of ignorance. Second, this article suggests an alternative explanation of what makes ignorance a bad cognitive state. In a nutshell, ignorance is bad because it is the manifestation of a vice, namely, of what Cassam calls “epistemic insouciance”. (shrink)

In this paper, we are interested in the effects of institutional context on public attitudes towards climate policies, where institutions are defined as the conventions, norms and formally sanctioned rules of any given society. Building on a 2014 survey experiment, we conducted thirty qualitative interviews with car-owners in Oslo, Norway, to investigate the ways in which institutional context and political-value orientation affect public attitudes towards emissions policies. One context (presented as a text treatment) highlighted individual rationality, emphasising the ways in (...) which local pollution impacts the individual citizen; the other highlighted social rationality, emphasising the wider significance of carbon emissions and global responsibility for climate change. We analysed the effects of these contexts on attitudes, finding that institutional context influenced individuals’ perspectives as well as their attitudes towards climate policies. Groups with different value orientations differed in terms of their evaluations but not their interpretations of these contexts. (shrink)

In the recent epistemological literature much has been written about the nature of suspending judgement or agnosticism. There has also been a surge of recent interest in the nature of ignorance. But what is the relationship between these two epistemically significant states? Prima facie, both suspension and ignorance seem to involve the lack of a correct answer to a question. And, again prima facie, there may be some intuitive attraction to the idea that when one is ignorant whether p, one (...) ought to suspend judgement whether p. In this paper we will explore a range of different possible normative connections between ignorance and suspension of judgement. We will also discuss how both ignorance and suspension are related to having inconclusive evidence. As we will see, the issues can become quite complex due to the fact that there are different, competing views about the nature of ignorance and also about the nature of suspension. Moreover, there are importantly different kinds of epistemic norms. Our overall aim then will be to systematically chart how these different choices will impact the possible normative connections between ignorance and suspension. (shrink)

The standard view of ignorance is that it consists in the mere lack of knowledge or true belief. Duncan Pritchard has recently argued, against the standard view, that ignorance is the lack of knowledge/true belief that is due to an improper inquiry. I shall call, Pritchard’s alternative account the Normative Account. The purpose of this article is to strengthen the Normative Account by providing an independent vargument supporting it.

We frequently praise or blame people for what they believe or fail to believe as a result of their having investigated some matter thoroughly, or, in the case of blame, for having failed to investigate it, or for carelessly or insufficiently investigating. for instance, physicists who, after years of toil, uncover some unknown fact about our universe are praised for what they come to know. sometimes, in contrast, we blame and may even despise our friends for being ignorant of certain (...) ecological facts as a result of their refusing to countenance the evidence. the purpose of this paper is to explore what underlies the legitimacy of this practice—the praise or blame of people for what they know or fail to know as a result of investigation or otherwise—namely, the ability to exercise control over one’s doxastic states, and, in particular, as i will argue, one’s ability to exercise indirect generic control over one’s doxastic states. Language research has come to rely heavily on large‐scale, web‐based datasets. These datasets can present significant methodological challenges, requiring researchers to make a number of decisions about how they are collected, represented, and analyzed. These decisions often concern long‐standing challenges in corpus‐based language research, including determining what counts as a word, deciding which words should be analyzed, and matching sets of words across languages. We illustrate these challenges by revisiting “Word lengths are optimized for efficient communication” (Piantadosi, Tily, & Gibson, (...) 2011), which found that word lengths in 11 languages are more strongly correlated with their average predictability (or average information content) than their frequency. Using what we argue to be best practices for large‐scale corpus analyses, we find significantly attenuated support for this result and demonstrate that a stronger relationship obtains between word frequency and length for a majority of the languages in the sample. We consider the implications of the results for language research more broadly and provide several recommendations to researchers regarding best practices. (shrink)

The general aim of this article is to consider whether various affective phenomena – feelings like the feeling of knowing, of familiarity, of certainty, etc., but also phenomena like curiosity, interest, surprise and trust – which have been labelled “epistemic emotions” in fact constitute a unified kind, i.e., the kind of the so-called “epistemic emotions”. Obviously, for an affective phenomenon to belong to the kind of the epistemic emotions, it has to meet two conditions: it has to qualify, first, as (...) an emotion, and, second, as an epistemic one. The paper is structured accordingly. The first part is devoted to the question whether the aforementioned affective phenomena really are emotions, while the second part bears on their hypothetical common epistemicity. (shrink)

Background Since the enactment of the euthanasia law in the Netherlands, there has been a lively public debate on assisted dying that may influence the way patients talk about euthanasia and physician-assisted suicide with their physicians and the way physicians experience the practice of EAS. Aim To show what developments physicians see in practice and how they perceive the influence of the public debate on the practice of EAS. Methods We conducted a secondary analysis of in-depth interviews with 28 Dutch (...) physicians who had experience with a complex case of EAS. Respondents were recruited both by the network of physicians working for SCEN as well as via a national questionnaire, wherein participating physicians could indicate their willingness to be interviewed. Results Three themes came up in analysing the interviews. First, the interviewed physicians experienced a change in what patients would expect from them: from a role as an involved caregiver to being the mere performer of EAS. Second, interviewees said that requests for EAS based on non-medical reasons came up more frequently and wondered if EAS was the right solution for these requests. Last, respondents had the impression that the standards of EAS are shifting and that the boundaries of the EAS regulation were stretched. Conclusions The perceived developments could make physicians less willing to consider a request for EAS. Our results also raise questions about the role of physicians and of EAS in society. (shrink)

Cet article (...) est consacré à deux problèmes auxquels est confronté le partisan de la théorie perceptuelle des émotions, c’est-à-dire, de la théorie selon laquelle les émotions constituent un type spécifique d’expériences perceptuelles. Ce sont les problèmes de la justification et de la rationalité des émotions. Loin d’ignorer ces difficultés, Tappolet y consacre une partie de son premier chapitre (pages 31-45). Cette contribution a plus précisément deux objectifs. Le premier est de montrer pourquoi la justification ne pose pas un problème aussi sérieux que la rationalité à la théorie perceptuelle des émotions. During the last decades several tools have been developed to anticipate the future impact of new and emerging technologies. Many of these focus on ‘hard,’ quantifiable impacts, investigating how novel technologies may affect health, environment and safety. Much less attention is paid to what might be called ‘soft’ impacts: the way technology influences, for example, the distribution of social roles and responsibilities, moral norms and values, or identities. Several types of technology assessment and of scenario studies can be used to (...) anticipate such soft impacts. We argue, however, that these methods do not recognize the dynamic character of morality and its interaction with technology. As a result, they miss an important opportunity to broaden the scope of social and political deliberation on new and emerging technologies.In this paper we outline a framework for building scenarios that enhance the techno-moral imagination by anticipating how technology, morality and their interaction might evolve. To show what kind of product might result from this framework, a scenario is presented as an exemplar. This scenario focuses on developments in biomedical nanotechnology and the moral regime of experimenting with human beings. Finally, the merits and limitations of our framework and the resulting type of scenarios are discussed. (shrink)

Comment cette doctrine a-t-elle séduit un public de plus en plus large? Que nous raconte cet engouement quant à nos valeurs, aux croyances de notre société? Phenomenology has been adapted for use in qualitative health research, where it’s often used as a method for conducting interviews and analyzing interview data. But how can phenomenologists study subjects who cannot accurately reflect upon or report their own experiences, for instance, because of a psychiatric or neurological disorder? For conditions like these, qualitative researchers may gain more insight by conducting observational studies in lieu of, or in conjunction with, interviews. In this article, we introduce a phenomenological approach to conducting (...) this kind of observational research. The approach relies on conceptual grounding to focus a study on specific aspects of the participants’ experiences. Moreover, the approach maintains the openness to novel discoveries that qualitative research requires while also providing a structured framework for data collection and analysis. To illustrate its practical application, we use examples of hemispatial neglect—a neurologic disorder in which patients characteristically lack awareness of their own illness and bodily capacities. However, the approach that we describe can be applied more broadly to the study of complex illness experiences and other experiential alterations. (shrink)

The Nuffield Council on Bioethics introduced an ‘intervention ladder’ to guide policymakers on public health interventions. 1 The ladder’s vertical structure represents an ordering of interventions, from least to most intrusive. In his article, Paetkau acknowledges that this ladder is ‘a useful tool’ (p. 1) for evaluating public health interventions. 2 However, he objects that its focus on individual behaviour is too narrow and obscures ‘interventions that operate on the level of systems rather than individuals’ (p. 2). To be sure, (...) some of the interventions on the original ladder do involve what might ordinarily be seen as ‘system’ or environmental changes. For instance, we might encourage active transport by building dedicated cycle lanes. However, these measures still have their intended effects through altering individual choices. What Paetkau means by a ‘systemic intervention’ is specifically one that improves public health _without_ changing individual behaviour change (pp. 2–3). For... (shrink)

That we have practical reasons to believe certain propositions even if sceptical arguments are cogent is nothing new. As Hume puts it, if sceptical principles were steadily accepted, “men would remain in a total lethargy until their miserable lives came to an end through lack of food, drink and shelter.” (Enquiry, 12, 2). This heart-breaking projection fails to move contemporary epistemologists who, for the most part, brush off pragmatist stances on scepticism. According to Sosa’s virtue epistemological account, an instance of (animal) knowledge is a belief that instantiates the property of being apt. The purpose of this contribution is, first, to show why this claim is, without further clarification, problematic. Briefly, an instance of knowledge cannot be identified to an apt belief because beliefs are states and aptness is a property that only actions —and no states— can exemplify. Second, I present the metaphysical amendment that the tenants of virtue epistemology can adopt (...) in order to avoid this objection. This conducts me to suggest a new, metaphysically sounder version of the virtue epistemological account of knowledge in which knowledge is extrinsically apt belief. (shrink)

Is the Miranda warning, which lets an accused know of the right to remain silent, more about procedural fairness or about the conventions of speech acts and silences? Do U.S. laws about Native Americans violate the preferred or traditional "silence" of the peoples whose religions and languages they aim to "protect" and "preserve"? In Just Silences, Marianne Constable draws on such examples to explore what is at stake in modern law: a potentially new silence as to justice.Grounding her claims (...) about modern law in rhetorical analyses of U.S. law and legal texts and locating those claims within the tradition of Nietzsche, Heidegger, and Foucault, Constable asks what we are to make of silences in modern law and justice. She shows how what she calls "sociolegal positivism" is more important than the natural law/positive law distinction for understanding modern law. Modern law is a social and sociological phenomenon, whose instrumental, power-oriented, sometimes violent nature raises serious doubts about the continued possibility of justice. She shows how particular views of language and speech are implicated in such law.But law--like language--has not always been positivist, empirical, or sociological, nor need it be. Constable examines possibilities of silence and proposes an alternative understanding of law--one that emerges in the calling, however silently, of words to justice. French cultural theorist and urbanist Paul Virilio is best known for his writings on media, technology, and architecture. Gathered here in _A Winter’s Journey _are four remarkable conversations in which Virilio and architectural writer Marianne Brausch look at a twentieth century characterized by enormous technological acceleration and by technocultural accidents of barbarism and horror. The dialogues in _A Winter_’_s Journey—_structured loosely around the dates 1940, 1950, 1960, and 1980—chart Virilio’s intimate intellectual biography, from his childhood lived against the unstable (...) backdrop of a heavily bombed, wartime Nantes to maturity in a crisis space that is neither entirely militarized nor yet fully civilian, but somewhere between the two. In the course of these conversations, Virilio and Brausch ultimately find hope that in understanding the events of the last century and the cultural responses spawned by them, we can create a more humane era that is more adept at handling the transformations of its technology and culture. _A Winter’s Journey _is a revealing and engaging look into the intellectual life and ideas of one of the most influential theorists of contemporary civilization. Anthropologists have tended to treat dreams as private fantasies arising from restless libidos struggling with reality. In this view, the dreamer is a victim of what she or he does not want, the intentions of the dreamer, and dreamed of, are often confused or illusory, and what happens in the dream is subj ect to a more primary, more objective, waking reality.The Barok people of New Ireland, Papua New Guinea, define dreams as both sleeping and waking experiences. Their dreams are (...) expressions of spiritually powerful persons who deal with a spiritual reality.In waking and real, but substantially dreamlike experiences such as one I describe in this paper, the desires and intents of all involved were perceived as wild possibilities. In the three sleeping dreams that I describe, the desires and intents of the dreamers were true, clearly expressed, and effective in creating or foretelling reality.Describing such subjective and willful experiences entails personal and professional risk. But toward understanding what happened, I undertake this in personally revealing terms, and I recommend Barok and other Native perspectives for the light they shed on dreams and reality.Social science has, for the most part, left dream analysis to the psychologists, and dreaming experiences to "the natives.” People educated in modern European traditions, and especially in academe, learn to not talk plainly or too much about their more subjective experiences or awarenesses, e.g, sex, emotions, and dreams. This applies not only to our lives as fieldworkers, but to our private lives in Western culture.Even recent publications1 still define dreams as a softer and more subjective, or even false, too private, in contrast to the harder and more objective, true reality of waking life (see Tedlock 1987). From this perspective, the accepted truth of there being an objective, socially defined, wakeful reality is not seriously called into question.Fieldwork experiences have shown me different distinctions between dreaming and not‐dreaming realities. I have learned to both expect and get more from dreams. I did not seek nor intentionally precipitate these experiences. They were a congruent part of my learning during four different periods of fieldwork.These experiences suggest a link between the ambiguity of intent in western style, non‐Native2 dreamers, and a lack of creative power. This contrasts with the clarity in the intent of Native style dreamers, and a real creative power.This link short‐circuits conventional academic distinctions between dreaming and waking experiences. For this reason, people like myself have not paid attention to these kinds of field experiences, much less written them up. We fear being disbelieved and discredited. Treating dreams on a comparable footing with objective reality is tantamount to "going native.”3 As Katherine Ewing has stated it, the problem is how to believe the Native meaning of dreams in defiance of the taboo against anthropologists' accepting the "temptation to believe" that "the subjects of one's research actually know something about the human condition and an encompassing 'reality'"(Ewing 1994:572).The field experiences I describe here have made me a believer of both the Native version of what happened, and the truth of there being an encompassing (Native) reality.4 They also convinced me of the necessity of trying to deal openly with what I know of the internal, private, libidinous, and willful stuff that is a part of these dreaming experiences. I reveal my own intent, desires, and needs, in both personal and professional terms, in order to lay some of the cards on the table, in order to look at them from both Native and non‐Native perspectives on what happened.I have learned that the difference between dreams and reality is not what it has been made out to be. On the one hand, the conventional definition of reality too strongly limits my ability to talk about my subjective experiences of it. On the other hand, the conventional definition of dreams does not make enough sense of my real experiences.By describing the real, non‐dreaming experience in which my subjective feelings are centered, the problematic issues of my own wakeful intent as a person and as an anthropologist are centered. This allows comparison of what is supposedly the nature of waking reality with what I experienced in the three sleeping dreams (hereafter "sleepdreams") which follow.The first three sleepdreams were experienced when I was living among Barok people at New Ireland, PNG, between 1979 and 1985. In this book, Marianne Moyaert develops a new interreligious appropriation of Paul Ricoeur’s hermeneutical philosophy. Viewed in context of his philosophical, anthropological, and ethical work, Ricoeur’s fragmentary reflections on the encounters between religions provide insights on global cooperation practices and religious identity concerns.

This paper discusses the definition of argumentation as a means for persuading an audience on the acceptability of a thesis. It is argued that persuasion is a goal that relates more to the communicative situation, the type of interaction or the type of discourse, rather than to the argumentative nature of it. Departing from the analysis of a short conversational sequence between people who agree on an issue and nevertheless argue, I suggest that a definition of argumentation in terms of (...) persuasion fails to account for what people are actually doing in these situations. I propose instead that several functions may be assigned to argumentation when considering the context in which it is produced: a cognitive function (which helps participants to elaborate a position on the discussed issue), and an identifying function (which enables them to portray themselves through the expression and the justification of their opinion). In the case analyzed here, a third function to which the argumentative activity contributes can also be identified, namely the enhancing of the emotional tonality of the relationship between the participants. While it becomes clear from the discussion of this argumentative sequence that the participants do not seek to persuade each other or some third party, it is not suggested that argumentation never aims at persuading an audience, but rather that persuasion cannot be considered as a defining feature of argumentation.
