Kuala Lumpur is a diverse city representing many different religions and nationalities. Recent government policy has actively promoted unity and cohesion throughout the city; and the country of Malaysia, with the implementation of a programme called 1Malaysia. In this book, the authors investigate the aims of this programme – predominantly to unify the Malaysian society – and how these objectives resonate in the daily spatial practices of the city’s residents. -/- This book argues that elements of urban infrastructure could work (...) as an essential mediator ‘beyond community’, allowing inclusive social structures to be built, despite cultural and religious tensions existing within the city. It builds on the premise of an empirical study which explores the ways in which different communities use the same spaces, supported through the implementation of a theoretical framework which looks at both Western and Islamic conceptualisations of the notion of community. Through the analysis of Kuala Lumpur, this book contributes towards the creation of more inclusive places in multi-ethnic, multi-cultural and multi-religious communities across the world. (shrink)

In the last two decades, major cities in Malaysia have witnessed a spate of urban redevelopment including commercial and retail complexes, and residential estates. The current urban transformations taking place in Malaysian cities are mainly market-driven and characterized by fast-track development with a strong priority on the road infrastructure. This is a typical example of an intensive property-led development that is becoming a central driver of the national economy. This article provides a deeper understanding of the complexity of urban development (...) in Malaysia. Here, the major aim is to understand the Malaysian cities' transitions in the trajectory of their colonial past, national identity, multi-cultural community, culture, and religion. Focusing on South East Asian urbanism, this article determines how internal and external forces and global trends such as neoliberalism and property-led development affect the transformation of urban landscapes and expansions in Malaysia. The outcomes of this paper will indicate how much property-led development and globalisation have affected the traditional and tropical climate-responsive urban environment in Malaysia. It will also identify sustainable design and planning measures that should be implemented in the cities of Malaysia to combat the ill-effects of globalisation. (shrink)

Using E. Wolicka book "Consideration on Kant" as an anchoring point, the author investigates the conditions under which 'kingdom of ends' can successfully play a role of institution of culture, i.e. be translated into rules of action and empirical facts in the sphere of every day life and history.

Many countries employ systemic methods of protecting consumers from unfair business practices. One such practice is the use of abusive clauses in business-to-consumer (B2C) contracts, which unfairly impose additional obligations on the consumer or deprive them of their due rights. This article presents an information system that utilizes artificial intelligence methods to automate contract analysis and to detect abusive clauses. The goal of the system is to support the entire administrative process, from contract acquisition, through text extraction and the recommendation (...) of potentially abusive clauses, to the generation of official administrative documents that can be sent to court or to the owners of firms. This article focuses on the components that use machine learning methods. The first is an intelligent crawler that is responsible for automatically detecting contract templates on websites and retrieving them into the system. The second is a document analysis module that implements a clause recommendation algorithm. The algorithm employs transformer-based language models and information retrieval methods to identify abusive passages in text. Our solution achieved first place in a competition on the automatic analysis of B2C contracts organized by the Polish Office of Competition and Consumer Protection (UOKiK), and has since been implemented as an official tool to support the contract analysis process in Poland. Niedowolna kolejność poszczególnych ksiąg określa wtedy także porządek, w jaki układają się założone w nich wykładnie prawdy. Skorelowanie klasycznej i innych wykładni prawdy z odpowiednimi księgami "Logiki" pozwala więc wykorzystać porządek "Logiki” do odtworzenia struktury całości prawdy, tzn. także do objaśnienia miejsca, jakie klasyczna wykładnia zajmuje zarówno w obrębie całości prawdy, jak (...) i wśród wykładni pozostałych. This paper addresses the fairness of microcredit interest rates. Since microfinance institutions provide credit for the poor at relatively high prices, the fairness of their interest rates has been repeatedly debated. We first apply Rawls' principles of justice to the case of microcredit interest rates and suggest some limitations related to the hypothesis of rationality of the borrowers and the level of inequality. We then suggest another framework based on the analysis of the distribution of the benefits generated by the (...) transaction to assess the fairness of interest rates. We conceptualize this as the distribution of the bargaining range between the borrowers' and the institutions' reservation price and discuss what these reservation prices could be in the context of microfinance. Microfinance institutions are alternative financial providers offering financial services to people typically excluded from the standard banking sector. While most MFIs are active in developing countries, there is also a young and developing microfinance sector in Europe; however, very little literature exists on this MFI segment. In this paper, we analyze the environmental performance of 58 European MFIs. Our results suggest that the size of the MFI, investor concern for environmental performance and, to a lesser extent, donor interest, are closely (...) related to the institution’s environmental performance. Moreover, providing loans larger than microcredits is linked to better environmental performance. This could suggest that the additional revenues generated from these loans, also called cross-subsidies, could help MFIs to strengthen their environmental bottom line. Finally, no evidence suggests that profit status explains environmental performance. (shrink)

Recent developments in virtual reality technology raise a question about the experience of presence and immersion in virtual environments. What is immersion and what are the conditions for inducing the experience of virtual presence? In this paper, we argue that crucial determinants of presence are perception of affordances and sense of embodiment. In the first section of this paper, we define key concepts and introduce important distinctions such as immersion and presence. In the second and third sections, we respectively discuss (...) presence, immersion and their determinants in detail. In the fourth and fifth sections, we argue for the importance of perception of affordances and sense of embodiment in increasing the degree of presence. Finally, we show the consequences of our view and discuss possible future implications. (shrink)

In recent years, development practice has seen that microfinance institutions are starting to consider their environmental bottom line in addition to their financial and social objectives. Yet, little is known about the characteristics of institutions involved in environmental management. This paper empirically identifies the characteristics of these MFIs for the first time using a sample of 160 microfinance institutions worldwide. Basing our analysis on various econometric tests, we find that larger MFIs and MFIs registered as banks tend to perform better (...) in environmental policy and environmental risk assessment. Furthermore, more mature MFIs tend to have better environmental performances, in particular in providing green microcredit and environmental non-financial services. On the other hand, financial performance is not significantly related to environmental performance, suggesting that ‘green’ MFIs are not more or less profitable than other microfinance institutions. The issue of whistleblower protection has been gaining more attention in recent years, especially after the passing of Directive (EU) 2019/1937 of the European Parliament and of the Council of October 23, 2019 on the protection of persons who report breaches of Union law. However, there is a fundamental question as to whether the regulations are sufficient to provide real protection for whistleblowers in organizations. In this regard, it seems crucial that the various actors (legislators, managers, employees) work together to (...) create an appropriate social environment. In this context, it is worth considering the use of knowledge of human decision-making processes, with particular emphasis on the possibility of modifying choice architecture and influencing decisions without imposing specific solutions. Nudging can be used in the “foreground” of legal regulation, by adjusting the social environment in such a way that legal regulation can work effectively. The paper provides an introduction to the application of nudge theory in the context of legal protection of whistleblowers. (shrink)

This paper suggests that Nash equilibrium can be interpreted as a conceptual tool for addressing comparative-statics issues on an aggregate level. Together with additional assumptions, Nash equilibrium helps generate testable predictions about changes or differences of behavior induced by changes or differences of exogenous variables. However, Nash-equilibrium behavior, as such, is not subject to empirical testing. Instead, widespread and persistent behavior is modeled as a Nash equilibrium by assumption. The paper argues that this interpretation is in line with the traditional (...) use of an equilibrium concept in price theory. The suggested interpretation is illustrated with the model of public-goods provision. The paper compares this interpretation of Nash equilibrium with other interpretations and discusses its limits. Introduction: A Theory of Democracy and Justice.

The Law of Peoples and Global Justice: Beyond the Liberal Nationalism of John Rawls The paper deals with the relation of a theory of international justice, specifically John Rawls's philosophy of the law of peoples, and a theory of global justice. In the first part, the paper outlines Rawls's main theses on the international conception of the law of peoples. The second part concerns a problem found in segments of Rawls's theory, specifically his concept of a social contract—contractualism. This problem (...) inadequately approaches the relationship between the individual and the community. The third part deals with the inconsistent points in Rawls's theory contained in part two, i.e. his principles of justice selected with the aid of social contract. In the fourth part, the paper concentrates on the consequences of these limitations for a socially distributive dimension of justice or as an approach for dealing with disproportionate global inequalities. The last part formulates the causes of the limitations of Rawls's theory of international justice and points out the need for a global justice which is socially and inter-culturally considerate. The character of norms is a relevant issue in the contemporary legal philosophy and in the metaethics. The analysis of Lewis’ sugguestions concerning the fictional statements (sentences “describing” the fiction) prima facie may seem to be useless from the perspective of law. However, the situation is different, due to the fact that it is possible to treat the legal text as the description of possible world. The issue is analyzed in the paper.

Relacje władzy i przywództwa są tworzone i reprodukowane w mikrośrodowisku, jaką tworzy trzech głównych bohaterów zrzeszonych w specyficzny rodzaj koleżeńskiej grupy: tworzą oni zastęp harcerski funkcjonujący przy szkole podstawowej. Stabilność tej grupy podtrzymywana jest przez ramy instytucjonalne, w których funkcjonują bohaterowie. W kategoriach analitycznych władza jest tu rozumiana na sposób neoweberowski (podejście transformacyjne) oraz poststrukturalistyczny (władza dyscyplinarna). Szczególną rolę pełni tu postać (...) zastępowego A’Tomka: jest on liderem środowiskowym, autorytetem i przedstawicielem elit. (shrink)

Earlier research by the author brought about findings suggesting that people in a special way process words related to demands of a problem they previously solved, even when they do not consciously notice this relationship. The findings concerned interference in the task in which the words appeared, a shift in affective responses to them that depended on sex of the participants, and impaired memory of the words. The aim of this study was to replicate these effects and to find out (...) whether they are related to working memory span of the participants, taken as a measure of the individual’s ability to control attention. Participants in the experimental group solved a divergent problem, then performed an ostensibly unrelated speeded affective classification task concerning each of a series of nouns, and then performed an unexpected cued recall task for the nouns. Afterwards, a task measuring WM span was administered. In the control group there was no problem-solving phase. Response latencies for words immediately following problem-related words in the classification task were longer in the experimental than in the control group, but there was no relationship between this effect and WM span. Solving the problem, in interaction with sex of the participants and, independently, with their WM span, influenced affective responses to problem-related words. Recall of these words, however, was not impaired in the experimental group. (shrink)

Leibniz’s _principium identitatis indiscernibilium _excludes the existence of two different objects possessing all properties identical. Although perfectly acceptable for macroscopic systems, it becomes questionable in quantum mechanics, where the concept of identical particles is quite natural and has measurable consequences. On the other hand, Leibniz’s principle seems to be indispensable when we want to individuate an item and ascribe to it particular property (e.g. value of the projection of spin on a chosen axis). We may thus abandon the principle on (...) the quantum level, claiming it falsity here, or (better) try to find other ways of individuation of objects, possibly by adopting appropriately the very concept of it. All these problems, and many other connected with identity and indiscernibility of quantum objects, are thoroughly discussed in the book of Tomasz Bigaj, unique in the world literature due to its comprehensiveness. Multi-agent systems where the agents are developed by parties with competing interests, and where there is no access to an agent’s internal state, are often classified as ‘open’. The members of such systems may inadvertently fail to, or even deliberately choose not to, conform to the system specification. Consequently, it is necessary to specify the normative relations that may exist between the members, such as permission, obligation, and institutional power. We present a framework being developed for executable specification of open (...) multi-agent systems. We adopt a bird’s eye view of these systems, as opposed to an agent’s perspective whereby it reasons about how it should act. This paper is devoted to the presentation of various examples from the NetBill protocol formalised in terms of institutional power, permission and obligation. We express the system specification in the Event Calculus and execute the specification by means of a logic programming implementation. We also give several example formalisations of sanctions for dealing with violations of permissions and obligations. We distinguish between an open multi-agent system and the procedure by which an agent enters and leaves the system. We present examples from the specification of a role-management protocol for NetBill, and demonstrate the interplay between such a protocol and the corresponding multi-agent system. (shrink)

Artykuł podejmuje polemikę z obiegowym rozumieniem tolerancji. Autor podkreśla znaczenie podziału na tolerancję jako postawę i na dyskursy o tolerancji. Następnie, w nawiązaniu i częściowo w dyskusji z koncepcją tolerancji zaproponowaną przez Iję Lazari Pawłowską, przedstawione jest rozróżnienie trzech odmian tolerancji, a także rozróżnienie odpowiednich trzech odmian nietolerancji. Rozważane są również niektóre paradoksy związane z tolerancją oraz ze zwalczaniem nietolerancji.
